Shai Stern is an associate professor of law at the Bar Ilan University Law School. Shai’s primary research and teaching interests include the philosophical foundations of private law, especially property, and the effects of regulatory and other legal mechanisms on the socio-spatial distribution of social and economic burdens in society. His other areas of interests are communities and their role within law (in particular, religious, cultural and geographic communities). Shai serves as Bar Ilan Law School's Director of Int'l Programs.
Shai received his Ph.D. from the Zvi Meitar Center for Advanced Legal Studies at Tel Aviv University and his LLB (cum laude) from Bar- Ilan University and was admitted to the Israeli Bar Association. Until 2011, he worked as a lawyer at S. Horowitz & Co. law firm, where he specialized in commercial litigation, dispute resolution, planning and construction, and administrative law. He served as a teaching assistant in property law and theories of property at Tel Aviv University, Bar-Ilan University, and Sapir College. Let me start from the end: recent years indicate that the world is moving in the right direction ... more Let me start from the end: recent years indicate that the world is moving in the right direction by increasing environmental awareness and attempting to deal with immediate and long-term environmental threats on an ongoing basis. But the path to achieving these results—like any transition from one point to another—involves significant costs for some and severe consequences for others. Responsible governments, operating in accordance with the Precautionary Principle, will not sit and wait for the threat to materialize, but will act—whether through regulation or various market incentives—to thwart it. Despite the urgency of tackling environmental challenges, current property laws do not provide governments with instruments to estimate the costs and distributive consequences of their actions in advance. Therefore, current property laws adversely affect the willingness of governments to address environmental challenges and the public legitimacy of environmental regulation. This Article proposes an innovative model for governments to address environmental challenges, which includes identifying the unique characteristics of environmental regulations. Environmental regulation is characterized by urgency, absence of scientific certainty, irreversibility, and sometimes cross-border damage. When examined through the main justifications for compensation—efficiency and fairness¬—these characteristics enable decision-makers to formulate a clear policy in cases where environmental regulation harms private property. Specifically, the balance between these characteristics of environmental regulation allows decision-makers to know in advance the costs of regulation and the distributive implications of its implementation. This information enables governments to select the appropriate governmental power to exercise in response to any threat and the extent of their liability to compensate injured property owners. The ability of decision-makers to know in advance the economic and social costs of environmental regulation increases the effectiveness and fairness of government action. This knowledge strengthens the ability of governments to deal with growing environmental threats.
The development of environmental law starting in the mid-20th century involved constant tension w... more The development of environmental law starting in the mid-20th century involved constant tension with private property. Attempts to protect the dwindling natural resources, extinct species of animals, and ecosystems at risk have often encountered obstacles when they demanded interference with private property. Although the theoretical roots of private property do not justify its transformation into an environmental obstacle and, to a large extent, attach importance to environmental values in justifying private property rights, it was private property that stood at the forefront of legal conflicts that revolved around attempts to expand the environmental protection of natural resources. The reason for turning private property into an obstacle to a proper environmental policy stems from adopting a concept according to which private property protects only human interests and values. In contrast, environmental interests that cannot be converted into human terms remain outside private property boundaries. This either-or concept, or as William Baxter termed it in 1974, "peoples or penguins," harms the ability of courts and other decision-makers to implement a proper and effective environmental policy because it prioritizes human interests over those of nature and its resources. This Article claims there is no reason for the decision-makers to be forced to choose between people and penguins since the interests of both humans and nature can normatively, and practically should, find expression in private property. Private property as a legal institution is an arena for value discussion as well as for making balances between values that are perceived as necessary for society. Crucially, the prevailing conception of property ownership is premised on the notion that property rights are applied equally to all owners in matters relating to the control and management of that property. When this assumption proves not to reflect reality, it can have devastating consequences for those most in need of the support ostensibly provided by welfare law. The present qualitative empirical study examines two cases in which such adverse consequences are felt: in the two largest minority communities in Israel—the Palestinians and the Ultraorthodox Jews (Charedi). Courts have struggled to find a dividing line between the two, but for their efforts we are left only with is a disjointed array of legal tests, each one as flawed as the next. Legal theorists, for their part, must shoulder some of the blame — no single theory can identify the point at which community need outweighs private property rights. Even well-developed theories thus fail to translate into practical application. But this Article is resolved to bridge that gap. This Article presents a novel theory that provides a unified normative framework for evaluating government interference with private property. Hodges recognized the constitutional right of same-sex couples to marry in all fifty states. The Court premised its ruling on the understanding that a person's ability to marry another person of his or her choosing is one of the most fundamental liberties protected by the Constitution. Some regard the Court's ruling in Obergefell v. Hodges as the end of a long fight for the liberation of the institution of marriage from the shackles of tradition. Yet others, who oppose same-sex marriage for religious reasons, regard it as another ultra-liberal intervention by the state — one which further weakens their ability to exercise their values and beliefs. This Article argues that individuals who live in highly cooperative common interest communities s... more This Article argues that individuals who live in highly cooperative common interest communities should— in certain instances— be entitled to additional compensation or other remedies when their property is taken through eminent domain. The exclusive takings remedy of monetary compensation equal to the fair market value of the property cannot always account for loss of communality. This Article offers guidelines for allocation of additional remedies (monetary and in-kind) that recognize such loss. This proposal is grounded in a pluralistic conception of property, which holds that the state should support individuals’ use of property as a social instrument to fulfill diverse values and beliefs. To that end, the state should balance several factors to determine whether a member of a community, or a community as a whole, should be entitled to remedies for communal loss: (1) the size and scope of the taking within the community; (2) the role, if any, of the community’s cooperation in its members’ realization of a shared conception of the good; (3) the community’s social legitimacy as determined primarily by its structural openness, that is, its members’ ability to simultaneously belong to other communities; and (4) the community’s ability to self-rehabilitate as determined by its political and economic strength. The state should also consider these factors in determining which of several types of remedies for communality loss would be most appropriate.
המחקר העכשווי על החברה החרדית בישראל מזהה בה תהליכים מקבילים: מחד גיסא כוחות מודרניים מקדמים את ה... more המחקר העכשווי על החברה החרדית בישראל מזהה בה תהליכים מקבילים: מחד גיסא כוחות מודרניים מקדמים את השתלבותה בחברה הכללית, ומאידך גיסא כוחות שמרניים פועלים לביצור התבדלותה מהחברה הכללית. במחקרנו ביקשנו לאמוד את השפעת משבר הקורונה על תהליכים אלו. בהתבסס על נתונים ראשוניים הכוללים ראיונות עומק עם חרדים וניתוח כתבות עיתונות ודוחות מחקר, אנו טוענים כי התפרצות מגפת הקורונה אתגרה את העקרונות הבסיסיים שהחרדיות מושתתת עליהם: התבדלות מרצון מהחברה הכללית, ניתוק מאמצעי התקשורת, עצמאות קהילתית וקשר מצומצם עם מוסדות המדינה, וחשיבותו של לימוד התורה. המצב החדש קידם דפוסי התמודדות סותרים בחברה החרדית – התגוננות והקצנת החרדיות לעומת אתגור ההנהגה החרדית ושחיקת מעמדה. היחלשותם של גבולות המגזר אמנם אינה תופעה חדשה, אך משבר הקורונה העצים תהליכים שנחשבו עד כה שוליים במגזר, ויש להניח כי החברה החרדית תידרש להם גם לאחר שוך המגפה.
Contemporary research on the ultra-orthodox society in Israel identifies parallel processes in which modern forces within the ultra-orthodox society promote integration while conservative parties, on the other hand, struggle to preserve the separative character of the community. This study estimates the impact of the Covid-19 crisis on these processes. Based on preliminary data, including in-depth interviews with ultra-orthodox individuals, and analysis of press articles and research reports, we argued that the outbreak of Covid-19 challenged the ultra-orthodox community's fundamental principles. The Covid-19 epidemic challenges the community's voluntary separation from the liberal society, its prohibition on the consumption of external media, its tendency to limit its interaction with state institutions, and the importance the community attributes to religious studies. These challenges led to conflicting patterns within the ultra-orthodox community. While the erosion of the fundamental community principles is not a new phenomenon, the Covid-19 crisis has intensified processes that have hitherto been considered on the community's margins.

Board of Education, the U.S. Supreme Court created a presumption that segregation equals discrimination. However, alongside this assertion, American space has become increasingly separate. A socio-legal analysis identifies three generations of spatial segregation in the United States and calls for recognizing the fourth generation—separate, therefore equal—in which minority communities require voluntary self-segregation to achieve equality. This fourth generation of spatial separation requires the law to embrace a protective role, by which it will defend the ability of minority communities to segregate spatially, the autonomy of individual community members, and the welfare of the society at large.

The legal doctrine of adverse possession is recognized in most western jurisdictions. The doctrin... more The legal doctrine of adverse possession is recognized in most western jurisdictions. The doctrine enables the transfer of legal title to property upon the fulfillment of certain conditions, one of which is that the property should have been occupied without the owner’s consent. The origins of adverse possession can be found in several traditional justifications, all of which aim to explain the transfer of title from the owner to the possessor against the owner’s will. One justification seeks to punish owners for ‘sleeping on their rights’, another justification focuses on the possessors and their ongoing connection to the property and finally, a third justification explains the title transfer in utilitarian terms of aggregate welfare. While legislators and courts have used these traditional justifications for centuries, this article argues that they fail to provide a coherent basis for the continued use of the adverse possession doctrine in today’s world. In their modern day application, some of the traditional justifications collapse logically, while others fail to take into account changes in land-registry systems and technology.
Despite the failures of the traditional justifications for the doctrine, this article rejects the potential conclusion that the doctrine should be abandoned altogether. Instead, it is argued that a modern justification for adverse possession should be adopted, one that relies on the potential distributive effects of its implementation. Explanation is given for why this distributive justification is not be affected by changes in land registration, technology or, the reduction in the cost of obtaining information, which erode the doctrine's traditional justifications. To maintain consistency and avoid undermining the rule of law, this article provides alternative justifications that could be used by the courts to determine the proper implementation of the adverse possession doctrine.

The Israeli Ultraorthodox community struggles, ever since the state of Israel was established, for cultural, social and legal autonomy. In some cases, these struggles moved from the general public and political spheres into the legal sphere. Wherever the ultraorthodox community sought-after legal recognition for its autonomy, Israeli law has rejected these claims, for the most part, excluding claims related to spatial segregation on behalf of the ultraorthodox community, with an emphasis on land allocation for segregated settlement. The recognition of legitimate systems to permit these segregated communities to exclude non-ultraorthodox members.
The article points out that the normative basis of Israeli law's angle towards the ultra-Orthodox community is foundational pluralism that recognizes the right of non-liberal communities to still act by their communities' internal norms. However, whereas adopting a foundational pluralistic conception as a basis for policy towards non-liberal communities requires adherence to three conditions; - preventing the externalization of internal community norms into the general society - Preventing the widening of the damage to the individual members of the autonomous community, and examining the extent to which the community needs the state's support in implementing its members' shared conception of the good - The Israeli law addresses the former and gave up the other two. This partial adoption of the foundational pluralistic conception is expressed by the insistence of Israeli law to prevent externalization of inner community norms to the general society, but the failure to comply with the other two conditions, namely preventing the expansion of damage to members of the community and the extent of the community's need in state support.
This article points to the tensions arising from the partial adoption of a foundational pluralistic conception, which is primarily two: first, the Israeli law disregard of the possible harm caused by the implementation of such policy on individual members autonomy and the second, the failure to distinguish between the various ultraorthodox communities in accordance with their unique characteristics. In light of these tensions, the article argues that as long as the Israeli law seeks to establish a comprehensive policy for dealing with the ultraorthodox community in its entirety of demands for autonomy, it must establish its policy on a foundational conception of pluralism, while adhering to its three conditions.
The Israeli expropriation laws establish quite a simple formula, according to which the state, or... more The Israeli expropriation laws establish quite a simple formula, according to which the state, or other competent authorities, may expropriate property rights for the realization of public needs in return for compensation given to the property owners. The compensation within the Israeli expropriation laws is predicated on a universal standard intended to express the market value of the taken property rights. Although there are exceptions to this compensation standard, these are limited in scope, and the granting of some of them depends on the discretion of the authorities. Although the Israeli expropriation laws' compensation policy aims to provide fair and just compensation, it fails to do so. The reason for this is that the establishment of a universal compensation standard leads, in some cases, to under-compensation. In addition, the current compensation policy is failing to realize the corrective conception of justice, which is declared to be the underlying conception of justice of the Israeli expropriation laws. This failure is due to the current compensation policy's disregard for the variance that prevails in the circumstances of expropriations, in the characteristics of the property owners and in the features of the properties. In this sense, the current compensation policy favors simplicity and certainty over the attainment of justice. This article calls for a reform of the Israeli expropriation laws' compensation policy, which aims to ensure a high level of simplicity and certainty alongside an expansion of the laws' adherence to justice. The proposed reform calls for expanding the range of remedies available to owners subject to expropriation so that the Israeli expropriation laws can embody financial premiums, in-kind remedies, and indirect remedies. Expanding the range of remedies given to the authorities use will allow addressing differences among expropriations' consequences, property owners and features of properties. To avoid ad hoc adjudication and practical assessment difficulties, this Article proposes the categorization of the different prototype failures that characterize current expropriation law. The proposed remedial scheme, therefore, will allow Israeli expropriation laws to strive for more just compensation, without compromising completely on certainty and simplicity.
דיני הנטילה השלטונית של זכויות במקרקעין בישראל מאפשרים למדינה, או לרשויות אחרות המוסמכות לכך בדין, להפקיע זכויות במקרקעין לשם מימושו של צורך ציבורי בתמורה למתן פיצוי לבעלי הזכויות הניטלות. ככלל, הפיצוי המוענק לבעלי הזכויות במקרקעין מושתת על סטנדרט אחיד שנועד לבטא את שוויין השוקי של הזכויות שניטלו. קיימים אומנם חריגים לכלל זה, אולם אלה מצומצמים בהיקפם, וחלקם מותנים בשיקול-דעתן של הרשויות. מאמר זה טוען כי חרף חתירתה של מדיניות הפיצוי בדיני הנטילה השלטונית בישראל להעניק פיצוי נאות והוגן לבעלי הזכויות במקרקעין, היא כושלת במימוש שאיפתה זו. הסיבה לכך נעוצה בפיצוי-החסר המשתלם לעיתים לבעלי הזכויות במקרקעין בשל ביסוסה של מדיניות הפיצוי על סטנדרט פיצוי אחיד. נוסף על כך, המדיניות הנוהגת כושלת בהגשמת תפיסת הצדק שדיני הנטילה השלטונית בישראל פועלים לאורה – תפיסת הצדק המתקן – וזאת בשל התעלמותה מהשונוּת הקיימת בין בעלי הזכויות הניטלות במקרקעין במקרים של נטילות שלטוניות וכן ממאפייני הנכסים עצמם. במובן זה, מדיניות הפיצוי הנוהגת בדיני הנטילה השלטונית מבכרת פשטות וּודאות משפטית על השגת צדק בנסיבותיה של כל נטילה שלטונית. המאמר קורא לרפורמה במדיניות הפיצוי בדיני הנטילה השלטונית של מקרקעין בישראל, שתאפשר ביסוסה של מדיניות פיצוי אשר תשמור על רמת ודאות גבוהה, מחד גיסא, אך תהא צודקת מזו הנוהגת כיום, מאידך גיסא. רפורמה מוצעת זו מושתתת על שני אדנים מרכזיים. האחד הוא הטמעה סדורה של מנעד הסעדים שיעמדו לרשויות בעת ביצוע נטילה שלטונית של זכויות במקרקעין. במסגרת זו המאמר מציע כי מדיניות הפיצוי בדיני הנטילה השלטונית תכלול גם סעדים בעין )ובראשם הענקת דיור חלופי או העתקה(, פרמיות כספיות קבועות או משתנות וכן סעדים עקיפים, ובכלל זה, בין היתר, הלוואות בריביות נמוכות, מענקים וכן הקלה בחסמים ביורוקרטיים. עיגונו של מנעד סעדים בדין יאפשר להפוך את הפיצוי בדיני הנטילה השלטונית לאמצעי להשגת תוצאה צודקת, תוך הבחנה בין נסיבותיהן השונות של נטילות שלטוניות כמו-גם בין מאפייניהם השונים של הנכסים המופקעים ושל בעליהם. האדן האחר שהרפורמה מושתתת עליו הוא שרטוט קווי מתאר לשימוש ראוי במנעד הסעדים המוצע, תוך יצירת קטגוריות על בסיס האתגרים שדיני הנטילה השלטונית ניצבים בפניהם. קטגוריזציה זו תמתן את החשש מפני פגיעה ביציבות ובוודאות המאפיינות את דיני הנטילה השלטונית.

But the path to achieving these results—like any transition from one point to another—involves significant costs for some and severe consequences for others. Responsible governments, operating in accordance with the Precautionary Principle, will not sit and wait for the threat to materialize, but will act—whether through regulation or various market incentives—to thwart it. Despite the urgency of tackling environmental challenges, current property laws do not provide governments with instruments to estimate the costs and distributive consequences of their actions in advance. Therefore, current property laws adversely affect the willingness of governments to address environmental challenges and the public legitimacy of environmental regulation. This Article proposes an innovative model for governments to address environmental challenges, which includes identifying the unique characteristics of environmental regulations. Environmental regulation is characterized by urgency, absence of scientific certainty, irreversibility, and sometimes cross-border damage. When examined through the main justifications for compensation—efficiency and fairness¬—these characteristics enable decision-makers to formulate a clear policy in cases where environmental regulation harms private property. Specifically, the balance between these characteristics of environmental regulation allows decision-makers to know in advance the costs of regulation and the distributive implications of its implementation. This information enables governments to select the appropriate governmental power to exercise in response to any threat and the extent of their liability to compensate injured property owners. The ability of decision-makers to know in advance the economic and social costs of environmental regulation increases the effectiveness and fairness of government action. This knowledge strengthens the ability of governments to deal with growing environmental threats.

Attempts to protect the dwindling natural resources, extinct species of animals, and ecosystems at risk have often encountered obstacles when they demanded interference with private property. Although the theoretical roots of private property do not justify its transformation into an environmental obstacle and, to a large extent, attach importance to environmental values in justifying private property rights, it was private property that stood at the forefront of legal conflicts that revolved around attempts to expand the environmental protection of natural resources. The reason for turning private property into an obstacle to a proper environmental policy stems from adopting a concept according to which private property protects only human interests and values. In contrast, environmental interests that cannot be converted into human terms remain outside private property boundaries. This either-or concept, or as William Baxter termed it in 1974, "peoples or penguins," harms the ability of courts and other decision-makers to implement a proper and effective environmental policy because it prioritizes human interests over those of nature and its resources. This Article claims there is no reason for the decision-makers to be forced to choose between people and penguins since the interests of both humans and nature can normatively, and practically should, find expression in private property. Private property as a legal institution is an arena for value discussion as well as for making balances between values that are perceived as necessary for society. The exclusion of environmental values from the value clarification conducted to define the scope of property rights is not only a normative failure but also harms the ability to deal effectively and adequately with pressing environmental challenges. Crucially, the prevailing conception of property ownership is premised on the notion that property rights are applied equally to all owners in matters relating to the control and management of that property. When this assumption proves not to reflect reality, it can have devastating consequences for those most in need of the support ostensibly provided by welfare law. This Article argues that individuals who live in highly cooperative common interest communities s... more This Article argues that individuals who live in highly cooperative common interest communities should— in certain instances— be entitled to additional compensation or other remedies when their property is taken through eminent domain. The exclusive takings remedy of monetary compensation equal to the fair market value of the property cannot always account for loss of communality. This Article offers guidelines for allocation of additional remedies (monetary and in-kind) that recognize such loss. This proposal is grounded in a pluralistic conception of property, which holds that the state should support individuals’ use of property as a social instrument to fulfill diverse values and beliefs. To that end, the state should balance several factors to determine whether a member of a community, or a community as a whole, should be entitled to remedies for communal loss: (1) the size and scope of the taking within the community; (2) the role, if any, of the community’s cooperation in its members’ realization of a shared conception of the good; (3) the community’s social legitimacy as determined primarily by its structural openness, that is, its members’ ability to simultaneously belong to other communities; and (4) the community’s ability to self-rehabilitate as determined by its political and economic strength. The state should also consider these factors in determining which of several types of remedies for communality loss would be most appropriate.
המחקר העכשווי על החברה החרדית בישראל מזהה בה תהליכים מקבילים: מחד גיסא כוחות מודרניים מקדמים את ה... more המחקר העכשווי על החברה החרדית בישראל מזהה בה תהליכים מקבילים: מחד גיסא כוחות מודרניים מקדמים את השתלבותה בחברה הכללית, ומאידך גיסא כוחות שמרניים פועלים לביצור התבדלותה מהחברה הכללית. במחקרנו ביקשנו לאמוד את השפעת משבר הקורונה על תהליכים אלו. בהתבסס על נתונים ראשוניים הכוללים ראיונות עומק עם חרדים וניתוח כתבות עיתונות ודוחות מחקר, אנו טוענים כי התפרצות מגפת הקורונה אתגרה את העקרונות הבסיסיים שהחרדיות מושתתת עליהם: התבדלות מרצון מהחברה הכללית, ניתוק מאמצעי התקשורת, עצמאות קהילתית וקשר מצומצם עם מוסדות המדינה, וחשיבותו של לימוד התורה. המצב החדש קידם דפוסי התמודדות סותרים בחברה החרדית – התגוננות והקצנת החרדיות לעומת אתגור ההנהגה החרדית ושחיקת מעמדה. היחלשותם של גבולות המגזר אמנם אינה תופעה חדשה, אך משבר הקורונה העצים תהליכים שנחשבו עד כה שוליים במגזר, ויש להניח כי החברה החרדית תידרש להם גם לאחר שוך המגפה.
Contemporary research on the ultra-orthodox society in Israel identifies parallel processes in which modern forces within the ultra-orthodox society promote integration while conservative parties, on the other hand, struggle to preserve the separative character of the community. This study estimates the impact of the Covid-19 crisis on these processes. Based on preliminary data, including in-depth interviews with ultra-orthodox individuals, and analysis of press articles and research reports, we argued that the outbreak of Covid-19 challenged the ultra-orthodox community's fundamental principles. The Covid-19 epidemic challenges the community's voluntary separation from the liberal society, its prohibition on the consumption of external media, its tendency to limit its interaction with state institutions, and the importance the community attributes to religious studies. These challenges led to conflicting patterns within the ultra-orthodox community. While the erosion of the fundamental community principles is not a new phenomenon, the Covid-19 crisis has intensified processes that have hitherto been considered on the community's margins.

Board of Education, the U.S. Supreme Court created a presumption that segregation equals discrimination. However, alongside this assertion, American space has become increasingly separate. A socio-legal analysis identifies three generations of spatial segregation in the United States and calls for recognizing the fourth generation—separate, therefore equal—in which minority communities require voluntary self-segregation to achieve equality. This fourth generation of spatial separation requires the law to embrace a protective role, by which it will defend the ability of minority communities to segregate spatially, the autonomy of individual community members, and the welfare of the society at large.

The legal doctrine of adverse possession is recognized in most western jurisdictions. The doctrin... more The legal doctrine of adverse possession is recognized in most western jurisdictions. The doctrine enables the transfer of legal title to property upon the fulfillment of certain conditions, one of which is that the property should have been occupied without the owner’s consent. The origins of adverse possession can be found in several traditional justifications, all of which aim to explain the transfer of title from the owner to the possessor against the owner’s will. One justification seeks to punish owners for ‘sleeping on their rights’, another justification focuses on the possessors and their ongoing connection to the property and finally, a third justification explains the title transfer in utilitarian terms of aggregate welfare. While legislators and courts have used these traditional justifications for centuries, this article argues that they fail to provide a coherent basis for the continued use of the adverse possession doctrine in today’s world. In their modern day application, some of the traditional justifications collapse logically, while others fail to take into account changes in land-registry systems and technology.
Despite the failures of the traditional justifications for the doctrine, this article rejects the potential conclusion that the doctrine should be abandoned altogether. Instead, it is argued that a modern justification for adverse possession should be adopted, one that relies on the potential distributive effects of its implementation. Explanation is given for why this distributive justification is not be affected by changes in land registration, technology or, the reduction in the cost of obtaining information, which erode the doctrine's traditional justifications. To maintain consistency and avoid undermining the rule of law, this article provides alternative justifications that could be used by the courts to determine the proper implementation of the adverse possession doctrine.

The Israeli Ultraorthodox community struggles, ever since the state of Israel was established, for cultural, social and legal autonomy. In some cases, these struggles moved from the general public and political spheres into the legal sphere. Wherever the ultraorthodox community sought-after legal recognition for its autonomy, Israeli law has rejected these claims, for the most part, excluding claims related to spatial segregation on behalf of the ultraorthodox community, with an emphasis on land allocation for segregated settlement. The recognition of legitimate systems to permit these segregated communities to exclude non-ultraorthodox members.
The article points out that the normative basis of Israeli law's angle towards the ultra-Orthodox community is foundational pluralism that recognizes the right of non-liberal communities to still act by their communities' internal norms. However, whereas adopting a foundational pluralistic conception as a basis for policy towards non-liberal communities requires adherence to three conditions; - preventing the externalization of internal community norms into the general society - Preventing the widening of the damage to the individual members of the autonomous community, and examining the extent to which the community needs the state's support in implementing its members' shared conception of the good - The Israeli law addresses the former and gave up the other two. This partial adoption of the foundational pluralistic conception is expressed by the insistence of Israeli law to prevent externalization of inner community norms to the general society, but the failure to comply with the other two conditions, namely preventing the expansion of damage to members of the community and the extent of the community's need in state support.
This article points to the tensions arising from the partial adoption of a foundational pluralistic conception, which is primarily two: first, the Israeli law disregard of the possible harm caused by the implementation of such policy on individual members autonomy and the second, the failure to distinguish between the various ultraorthodox communities in accordance with their unique characteristics. In light of these tensions, the article argues that as long as the Israeli law seeks to establish a comprehensive policy for dealing with the ultraorthodox community in its entirety of demands for autonomy, it must establish its policy on a foundational conception of pluralism, while adhering to its three conditions.

The compensation within the Israeli expropriation laws is predicated on a universal standard intended to express the market value of the taken property rights. Although there are exceptions to this compensation standard, these are limited in scope, and the granting of some of them depends on the discretion of the authorities. Although the Israeli expropriation laws' compensation policy aims to provide fair and just compensation, it fails to do so. The reason for this is that the establishment of a universal compensation standard leads, in some cases, to under-compensation. In addition, the current compensation policy is failing to realize the corrective conception of justice, which is declared to be the underlying conception of justice of the Israeli expropriation laws. In this sense, the current compensation policy favors simplicity and certainty over the attainment of justice. This article calls for a reform of the Israeli expropriation laws' compensation policy, which aims to ensure a high level of simplicity and certainty alongside an expansion of the laws' adherence to justice. The proposed reform calls for expanding the range of remedies available to owners subject to expropriation so that the Israeli expropriation laws can embody financial premiums, in-kind remedies, and indirect remedies. Expanding the range of remedies given to the authorities use will allow addressing differences among expropriations' consequences, property owners and features of properties. To avoid ad hoc adjudication and practical assessment difficulties, this Article proposes the categorization of the different prototype failures that characterize current expropriation law. The proposed remedial scheme, therefore, will allow Israeli expropriation laws to strive for more just compensation, without compromising completely on certainty and simplicity.

This Article proposes an innovative model for governments to address environmental challenges, which includes identifying the unique characteristics of environmental regulations. Environmental regulation is characterized by urgency, absence of scientific certainty, irreversibility, and sometimes cross-border damage. When examined through the main justifications for compensation—efficiency and fairness¬—these characteristics enable decision-makers to formulate a clear policy in cases where environmental regulation harms private property. Specifically, the balance between these characteristics of environmental regulation allows decision-makers to know in advance the costs of regulation and the distributive implications of its implementation. This information enables governments to select the appropriate governmental power to exercise in response to any threat and the extent of their liability to compensate injured property owners. The ability of decision-makers to know in advance the economic and social costs of environmental regulation increases the effectiveness and fairness of government action. This knowledge strengthens the ability of governments to deal with growing environmental threats.
Contemporary research on the ultra-orthodox society in Israel identifies parallel processes in which modern forces within the ultra-orthodox society promote integration while conservative parties, on the other hand, struggle to preserve the separative character of the community. This study estimates the impact of the Covid-19 crisis on these processes. Based on preliminary data, including in-depth interviews with ultra-orthodox individuals, and analysis of press articles and research reports, we argued that the outbreak of Covid-19 challenged the ultra-orthodox community's fundamental principles. The Covid-19 epidemic challenges the community's voluntary separation from the liberal society, its prohibition on the consumption of external media, its tendency to limit its interaction with state institutions, and the importance the community attributes to religious studies. These challenges led to conflicting patterns within the ultra-orthodox community. While the erosion of the fundamental community principles is not a new phenomenon, the Covid-19 crisis has intensified processes that have hitherto been considered on the community's margins.
Despite the failures of the traditional justifications for the doctrine, this article rejects the potential conclusion that the doctrine should be abandoned altogether. Instead, it is argued that a modern justification for adverse possession should be adopted, one that relies on the potential distributive effects of its implementation. Explanation is given for why this distributive justification is not be affected by changes in land registration, technology or, the reduction in the cost of obtaining information, which erode the doctrine's traditional justifications. To maintain consistency and avoid undermining the rule of law, this article provides alternative justifications that could be used by the courts to determine the proper implementation of the adverse possession doctrine.

The Israeli Ultraorthodox community struggles, ever since the state of Israel was established, for cultural, social and legal autonomy. In some cases, these struggles moved from the general public and political spheres into the legal sphere. Wherever the ultraorthodox community sought-after legal recognition for its autonomy, Israeli law has rejected these claims, for the most part, excluding claims related to spatial segregation on behalf of the ultraorthodox community, with an emphasis on land allocation for segregated settlement. The recognition of legitimate systems to permit these segregated communities to exclude non-ultraorthodox members.
The article points out that the normative basis of Israeli law's angle towards the ultra-Orthodox community is foundational pluralism that recognizes the right of non-liberal communities to still act by their communities' internal norms. However, whereas adopting a foundational pluralistic conception as a basis for policy towards non-liberal communities requires adherence to three conditions; - preventing the externalization of internal community norms into the general society - Preventing the widening of the damage to the individual members of the autonomous community, and examining the extent to which the community needs the state's support in implementing its members' shared conception of the good - The Israeli law addresses the former and gave up the other two. This partial adoption of the foundational pluralistic conception is expressed by the insistence of Israeli law to prevent externalization of inner community norms to the general society, but the failure to comply with the other two conditions, namely preventing the expansion of damage to members of the community and the extent of the community's need in state support.
This article points to the tensions arising from the partial adoption of a foundational pluralistic conception, which is primarily two: first, the Israeli law disregard of the possible harm caused by the implementation of such policy on individual members autonomy and the second, the failure to distinguish between the various ultraorthodox communities in accordance with their unique characteristics. In light of these tensions, the article argues that as long as the Israeli law seeks to establish a comprehensive policy for dealing with the ultraorthodox community in its entirety of demands for autonomy, it must establish its policy on a foundational conception of pluralism, while adhering to its three conditions.
