The paper discusses the role of welfare systems on migration and contribution of immigrants to un... more The paper discusses the role of welfare systems on migration and contribution of immigrants to unemployment rates in Germany. With the use of European Labour Force Survey Data for 2010 and 2011, we estimate a series of logistic regressions in order to quantify the effect of immigration on unemployment. We conclude that most of the differences between unemployment rates of immigrants compared to natives in Germany can be explained by different characteristics (such as age, sex, education or type of job) of immigrants compared to natives. After controlling for such characteristics, the probability for an immigrant to be unemployed is only a fraction above that for a comparable native. Additionally, we make a separate analysis for immigrants from the EU only. Our results show that the effects are much smaller for the EU immigrants, and even insignificant after other observable characteristics have been accounted for.

Some countries perceive immigration as a threat and consider limitations to their social security system to protect the domestic economy. Within the European Union, both the economic and the legal side of the issue must be taken into account. The paper presents an empirical analysis of natives’ and immigrants’ unemployment rates in EU15 countries and discusses a possible use of the findings in intra-EU migration policy. Using Labour Force Survey Data for 2012, we estimate a series of logistic regressions in order to compare the immigrant/native unemployment rates, considering the differences in the structure of both subpopulations (in terms of age, sex, education and types of jobs). We conclude that a substantial part of the gap between natives’ and immigrants’ unemployment rates can be explained by these additional characteristics in most of the EU15 countries.

Seit mehr als 16 Jahren ist die Existenzsicherung für Asylbewerber und vollziehbar ausreisepflich... more Seit mehr als 16 Jahren ist die Existenzsicherung für Asylbewerber und vollziehbar ausreisepflichtige Personen sowie deren Familienangehörige abschließend im Asylbewerberleistungsgesetz (AsylbLG) geregelt. Art und Umfang der dort vorgesehenen Leistungen sind seit dessen Inkrafttreten im Wesentlichen unverändert geblieben – auch die Sätze der Regelleistungen. Das Urteil des Bundesverfassungsgerichts zur Verfassungsmäßigkeit der Regelsätze der Grundsicherung für Arbeitsuchende (SGB II) fordert indes, dass Regelsätze nachweislich bedarfsdeckend sein müssen. Diese Aussage bietet daher Anlass, die Leistungen nach dem AsylbLG einer Prüfung zu unterziehen. Dem BVerfG ist diese Frage inzwischen zur Entscheidung vorgelegt worden (LSG NRW, Beschluss v. 26. 7. 2010 – L 20 AY 13/09).

Für wirtschaftlich inaktive Unionsbürger*innen hat sich das Gericht auf den Standpunkt gestellt, dass infolge eines „Erst-Recht“-Schlusses aus § 7 Abs. 1 S. 2 Nr. 2 SGB II und § 23 Abs. 3 S. 1 SGB XII ein Anspruch auf existenzsichernde Leistungen ausgeschlossen sei, solche aber im Ermessenswege nach § 23 Abs. 1 S. 2 SGB XII gewährt werden müssten. Ab dem sechsten Monat des Aufenthalts umfasse dies jedenfalls die Hilfen zum Lebensunterhalt.

Es war die Frage zu entscheiden, ob Unionsbürger*innen einen Anspruch auf Existenzsicherungsleistungen in Deutschland haben, wenn sie wirtschaftlich inaktiv sind oder sich ihr Aufenthalt allein aus dem Zweck der Arbeitssuche ergibt. Eines der drei entschiedenen Verfahren betraf die Klage der Familie Alimanovic, die das Bundessozialgericht im letzten Jahr dem Europäischen Gerichtshof zur Entscheidung vorgelegt hatte. Dieser kam in seinem Urteil vom 15.09.2015 zu dem Schluss, dass der in § 7 Abs. 1 S. 2 Nr. 2 SGB II geregelte Ausschluss von arbeitssuchenden Unionsbürger*innen von Arbeitslosengeld II-Leistungen mit europäischem Recht vereinbar ist und löste damit das Spannungsverhältnis zwischen europäischem Aufenthalts- und Koordinierungsrecht zulasten Letzerem auf. Dem Bundessozialgericht oblag es nun, die verfassungsrechtlichen Folgen, namentlich im Hinblick auf das Grundrecht auf Gewährleistung eines menschenwürdigen Existenzminimums, zu bestimmen. Der erste Teil dieser Besprechung befasst sich mit den Erwägungen des Bundessozialgerichts zur Bestimmung der anwendbaren Normen für die Gruppen der arbeitssuchenden und wirtschaftlich inaktiven Unionsbürger*innen, wie sie in dem als Medieninformation zur Verfügung gestellten Terminbericht referiert werden.

Der jüngst durch das Kabinett beschlossene Entwurf eines Gesetzes zur Änderung des Asylbewerberleistungsgesetzes und des Sozialgerichtsgesetzes ist der Versuch, diese zukünftig transparent, realitäts- und bedarfsgerecht zu bemessen. Dabei versäumt der Gesetzgeber, sich zugleich einer dringend gebotenen Revision des Rechts auf Krankenbehandlung der AsylbewerberInnen und ihnen gleichgestellter Gruppen anzunehmen.

Dabei stellt er fest, dass der Gleichlauf zwischen Versicherungs- und Subsistenzsicherungsrecht unzureichend ist, da Legitimationsdefizite und materielle Deckungslücken bestehen. Daher wird ein existenzsicherungsrechtlicher Gesundheitsbegriff vorgeschlagen und beleuchtet, der sich am bio-statistischen Krankheitsmodell orientiert und durch die Grundbefähigungslehre angereichert wird.
