Rosanna Amato is researcher at the Institute of Legal Informatics and Judicial Systems of the National Research Council of Italy (IGSG-CNR), where she also worked as a doctoral associate from 2010 to 2014 and conducted post-doctoral research from 2016 to 2022.
In 2014, she obtained a double PhD degree in European Union Law from the University of Bologna and the University of Strasbourg, after defending a thesis on network cooperation mechanisms within the EU Area of Freedom, Security and Justice and their impact on the functioning of mutual recognition instruments and mutual assistance procedures.
She has mainly worked on research projects concerning judicial and police cooperation, also in the view to support the digitalisation of these procedures. Furthermore, she has taken part in projects concerning judicial corruption and methodologies for judicial evaluation.
Currently, her work mainly concerns the interaction between victims of crime and the justice system, especially victims of gender-based and domestic violence

Victims of recurrent crimes, particularly Intimate Partner Violence (IPV) victims, encounter uniq... more Victims of recurrent crimes, particularly Intimate Partner Violence (IPV) victims, encounter unique challenges with the criminal justice system. The risk of repeat violence and retaliation deters them from engaging with legal processes, emphasising the critical need for effective protection measures in domestic and cross-border contexts. Protection orders, pivotal in preventing further victimisation, primarily operate within the issuing State, which has prompted the European Union to establish legal instruments based on the principle of mutual recognition to extend their applicability beyond national borders. Despite this, these measures are strikingly underused. This article delves into the root causes of this underutilisation and questions the overall usability of these measures by its beneficiaries. It also explores potential legal and non-legal solutions to transform them into a tangible resource for victims of recurring crimes across the EU.

An effective legal framework for judicial cooperation in the field of the service of documents is... more An effective legal framework for judicial cooperation in the field of the service of documents is a keystone for the effective functioning of the area of freedom, security and justice, as referred to in the Treaty on the EU. In particular, the proper service of a claim to the addressee is a necessary step for starting a proceeding and, simultaneously, an essential requirement for exercising the right of defence. The EU has adopted specific provisions to remodel the traditional channel of documents’ transmission with smoother solutions that assist cross-border judicial proceedings. Despite this, the European service procedure is not that straightforward and can still be very complex for most users, causing additional costs and legal uncertainty. Against this background, this article explores how the cross-border service of documents works in practice. It presents the findings resulting from empirical exploratory research carried out in Italy to assess the concrete use and usability of the European rules adopted to simplify, speed up and reduce the costs of cross-border service of judicial and extrajudicial documents in civil and commercial matters, also in the view to support a possible digitalisation of the procedure. Building on empirical data, the paper brings to light the existing hiatus between the service procedure ‘on the books’ and the reality of how the relevant provisions are applied daily, so as to provide solid ground for reflecting on the current situation and on the impact that the recast Regulation 2020/1784/EU, which took effect in July 2022, will have to the supranational system of cross-border service of documents, in particular concerning the potential of the use of ICT to support it

Intimate Partner Violence (IPV) is the main pathology that occurs within interpersonal relations,... more Intimate Partner Violence (IPV) is the main pathology that occurs within interpersonal relations, and women are the chief victims in an overwhelming majority of cases. At present, a well-established international legal framework is in place that defines IPV as violating internationally recognized human rights. However, the application of these standards has proven difficult because it requires multilayered arrangements to be effective. This paper investigates whether and how police authorities and the justice system – as parts of the victims’ support network – can assist victims in escaping from violence and restoring normality to their lives. The focus is on the gap between the law in the book and the law in action. To this end, the paper presents the findings of an Italian case study based on both document analysis and field research. The main aim is to bring to light organizational problems that can seriously jeopardize the effectiveness of systems to shield IPV victims and the full enjoyment of their individual rights

This thesis deals with the legal analysis of the network-based form of cooperation between nation... more This thesis deals with the legal analysis of the network-based form of cooperation between national authorities of the EU Member States within the AFSJ, with a view to evaluate its contribution and potential. The dissertation is divided into two parts. The first one portrays the emergence of networking and analyzes the driving factors (both legal and structure-related), which have triggered such a process. Attention is paid to the legal instruments applying both the principle of mutual recognition and the principle of availability. The rationale is to identify the obstacles hindering the implementation of the cooperation procedures and to highlight the role played by networks in this respect. The second part examines the main networks operating in the JHA field, with a special focus on the features characterizing these arrangements and their methods of operation. Finally, the main features of a ―EU network model of cooperation‖ are identified as well as the role played by such a model in respect to the exercise of the EU competences in the AFSJ.
