The problem that we deal with in this article is about the status of feedback loops that human societies requires against its functioning biases and through which members of partial groups of this society find an external legal recourse. We try to show that the common approach isn’t self-sufficient and suppose the intervention of an external institution which should be enabled to arbitrate conflicts between communities and their members.
La confiance en matière médicale concerne tout à la fois, et de manière liée, la relation singuli... more La confiance en matière médicale concerne tout à la fois, et de manière liée, la relation singulière du patient et du personnel soignant, et l’organisation des soins ou, plus généralement, des pratiques devant promouvoir la santé. La mise en œuvre des politiques de santé concerne simultanément ces deux niveaux décisionnels et c’est aussi le cas pour les raisons de la confiance ou de la méfiance que suscitent ces politiques. En effet, c’est essentiellement à cause de l’impact prévisible sur les soins et l’accès aux soins que la confiance est accordée ou refusée aux politiques de santé. Or la définition des politiques, dans ce domaine comme dans d’autres, fait intervenir des principes généraux qui servent à décrire et à mettre en débat les finalités et les moyens déployés. Dans le cas de la médecine, la référence aux principes généraux apparaît tout à la fois \_essentielle\_ (à cause de l’attachement largement partagé à des principes déontologiques traditionnels, à cause du lien avec des thématiques de justice sociale et politique et tout d’abord à cause du rôle des principes dans la délibération publique) et \_problématique\_ (car les principes généraux peuvent évidemment servir à cautionner des pratiques contestées par les uns ou les autres). Sur le versant problématique, une dimension s\_tratégique\_ apparaît inévitablement dans un domaine où certains objectifs sont partagés, mais d’autres non, en sorte que l’interprétation devient un enjeu à part entière. En inscrivant notre réflexion dans des développements récents en théorie politique, nous voudrions proposer une sorte d’anatomie de la défiance à l’endroit des politiques de santé. Ces jugements associent habituellement des composantes independantes des contextes particuliers (telles que des « \_place\_holder;grands principes \_place\_holder;» mobilisant des notions de reference assez generales), la reference a des situations generiques ou typiques et des elements tenant a des circonstances precises. Si l'on s'accorde sur cette configuration, on doit s'attendre a ce que l'usage de notions generales de reference et de jugements prescriptifs generiques soit, dans les fonctionnements institutionnels, tres dependant des aspects contextuels. On peut, des lors, former la conjecture que le maniement de ces notions et jugements comporte une dimension constructive, passant notamment par l'elaboration d'interpretations successives permettant de s'adapter a des contextes renouveles. Néanmoins on ignore, pour une large part, dans quelle mesure ils sont l’objet d’une réappropriation normative par les acteurs et comment ils structurent les pratiques. Nous avons interrogé ces processus dans le champ de la psychiatrie, en nous fondant sur un recueil de données qualitatives. Celui-ci nous a permis de saisir les interprétations de l’éthique médicale émergeant des discours des soignants en psychiatrie et d’identifier sa nature. Nous en exposerons les facettes en tentant d’abord de comprendre le sens conféré à l’exclusion de l’éthique du champ de leur pratique par certains médecins. Puis nous saisirons les contours se dessinant empiriquement de l’éthique en psychiatrie pour autant qu’elle repose sur une réinterprétation de principes canoniques de l’éthique médicale. Nous montrerons enfin que cette éthique de l’action se conçoit comme une éthique que la philosophie morale décrirait comme particulariste.
The principles of medical ethics are quite well defined. Nevertheless we still do not know how they are appropriated by actors neither how they structure the practices. We investigated these processes in the field of psychiatry through qualitative interviews. This survey allowed us to grasp the interpretations of medical ethics in this field. We will present them and try firstly to understand the meaning of the exclusion of ethics by some medicals from the framework of their practices. Then we will try to draw the meaning of ethics in psychiatry rising from empirical discourses and grounded on fundamental principles of medical ethics. Finally, we will demonstrate that this ethics of action can be interpreted as a kind of particularist ethics.

Son usage, c'est-à-dire la privation de liberté, n'est pas sans toutefois poser à certains professionnels des questions cliniques et éthiques. Une enquête qualitative menée dans ce champ nous permettra d'envisager ce que l'analyse de conflits normatifs, saisis au coeur des pratiques, peut apporter à la théorie morale et au débat sur l'existence et la réalité des dilemmes moraux. Afin de comprendre s'il existe de réels dilemmes moraux en psychiatrie et si ces derniers s'expliquent par la nature des devoirs en présence ou bien se résolvent dans de simples problèmes épistémiques, nous reviendrons dans un premier temps sur les arguments proposés par la philosophie morale, en la matière, puis nous envisagerons les formes de résolution de ce qui peut se présenter subjectivement comme des dilemmes moraux en psychiatrie ainsi que les aspects de l'ignorance épistémique qui peuvent se trouver à leur fondement.
Abstract : Because of its historical evolution in France and of the status of the psychiatric patients, the psychiatry in France has the use of the legitimate constraint. The use of the constraint and the restriction of liberty arise some ethical and clinical issues to some psychiatrists. A qualitative survey in this field will allow understanding what an analysis of practices can provide to moral theory and its debates on moral dilemmas. We will consider the issue of whether moral dilemmas in psychiatry are soluble in epistemic problems or if they are due to irreconcilable norms, firstly by considering the debate in moral philosophy concerning moral dilemmas. Then we will analyse the subjective solutions found to normative conflicts in psychiatry and we will finally try to discuss the epistemic uncertainty at their origin.

Pourtant et du fait des conditions sociales et culturelles d'accès à cette dernière, tous les citoyens de nos démocraties ne participent pas en tant que pairs à l'interaction politique. Dans ce contexte, l'éducation à la citoyenneté qui fait l'objet de préoccupation renouvelée de la part des gouvernants a un rôle à jouer. Cependant, pour garantir à chacun les moyens d'une telle parité de participation à la vie politique publique, cette éducation doit être repensée et envisagée non plus seulement dans les termes d'une éducation républicaine à la citoyenneté mais bien plutôt comme une éducation à une citoyenneté multiculturelle et ouverte aux différences.

dans le débat et de sa mise en oeuvre dans l’action, en tant que principe possédant une portée générale. L’article propose une description des problèmes spécifiques que comporte, à cet égard, le choix des interprétations. Cette description conduit à une appréciation
positive du nouveau rôle dévolu aux démarches participatives dans la discussion des enjeux éthiques et des risques acceptables.
ABSTRACT. — With the precautionary principle, knowledge, risk assessment and action come together. Considered from an ethical and political point of view, this encompassing principle is a challenge for institutions and the general public, both in debates and when it comes to acting upon it in concrete settings. In this contribution, we attempt to describe the specific problems which arise from the choice of interpretations.
With a view to the ethical problems at stake, this leads us to a positive appreciation of the renewed attention paid to participatory endeavours for the purpose of discussing the critical ethical issues and the level of acceptable risks.

Anomie, exclusion, désaffiliation, fracture sociale, autant de notions qui peuplent le discours politique et social et qui prétendent exprimer un affaiblissement des liens sociaux voire de la cohésion sociale. Notre propos vise, d’une part, à cerner les conditions théoriques de pertinence d’emploi de ces notions et, d’autre part, à montrer que, bien qu’étant utiles pour décrire des situations individuelles, elles ne permettent aucunement, comme telles, de conclure à un état de la cohésion macrosociale, en l’occurrence à sa dissolution. Anomie et exclusion ne sont opératoires, dans cette dernière perspective, que lorsqu’elles sont explicitées et associées à des évolutions structurelles. Nos analyses permettront ainsi d’opérer une dissociation précise des champs de pertinence des notions de lien social et de cohésion sociale.

Abstract
The political and social debates often allude to exclusion, disaffiliation, anomy. These notions are used to express a weakening of social ties or social cohesion. This paper aims, firstly, to identify the pertinent theoretical framework of use of these concepts. Although useful for describing individual situations, these concepts do not immediately lead to conclusions about a state of macro-social cohesion and, in this case, to conclusions about its dissolution. Anomie and exclusion are relevant to deduce a lack of social cohesion only when they concern and are related to structural changes. Thus this paper will help make a clear distinction between the fields of relevance of the two concepts: social link and social cohesion.

représentations typiques de la cohésion sociale analogues dans cinq pays européens (Espagne, France,
Grande-Bretagne, Pologne et Suisse). Nous montrons comment ces représentations caractéristiques de
la cohésion façonnent les attitudes individuelles ainsi que les représentations morales des individus
concernant la société dans son ensemble ainsi que des dimensions comme le mérite, la justice sociale,
les fonctions de l’État. Nous procédons en justifiant, dans un premier temps, le choix de ces pays et le
cadre théorique dans lequel s’inscrit notre recherche. Nous esquissons ensuite ces représentations
typologiques de la cohésion pour finalement identifier les différences nationales affectant ces
représentations. L’analyse permet notamment de montrer que les préoccupations des citoyens relatives
à la cohésion sociale et à sa permanence sont largement partagées en Europe, y compris dans des pays
de tradition sociale variée et entrés dans l’Union européenne à des dates fort différentes.
Résumé : Les recherches en épigénétique connaissent aujourd’hui un essor remarquable qui pousse c... more Résumé : Les recherches en épigénétique connaissent aujourd’hui un essor remarquable qui pousse certains investigateurs à s’interroger sur la mise en œuvre de politiques de santé susceptibles de convoquer l’épigénétique dans une perspective préventive. Dans ce qui suit, nous interrogerons le sens d’une translation des résultats de l’épigénétique en politiques publiques puis la possibilité de convoquer l’argument de la prévention à l’appui de ce discours. Nous analyserons enfin le glissement, inhérent à certains processus sociaux dans lesquels des protagonistes de la recherche en épigénétique s’inscrivent, de la protection des populations à leur contrôle. À l’encontre des présupposés sous-jacents à ces initiatives, nous montrerons que les résultats mis en évidence par l’épigénétique posent prioritairement une question de responsabilité politique plutôt que de responsabilité individuelle, la première appelant moins des programmes à destination de groupes spécifiques qu’une réponse à l’inégale répartition des coûts sociaux sur l’ensemble de la population.

Abstract: Epigenetics research has nowadays an important development. Concerned by prevention issues, some of its investigators would like to promote health policies based on their latest discoveries in epigenetics. In this paper, we will question the relevance of a direct application of epigenetics results in public health policies. Then we will analyse the opportunity to use the argument of precaution in this perspective. Finally we will examine the shift to protection of population to their control. This shift, inherent to certain social processes, is also perceptible in this proactive tendency in epigenetics. Against it, we demonstrate that epigenetics results raise mainly issues of political responsibility rather than issues of individual responsibility but the first one involved less programs targeting particular social groups of the society that a specific attention to the unequal distribution of social burdens on the whole society.

Among the other possibilities that can be used after a person’s death, purchase or systematic removal have been a priori rejected. However, we will show that the appeal to individual altruism have resulted in some of the aporias of the present situation. Subsequently, we will consider how systematic organ removal from deceased persons can be made acceptable in liberal and democratic societies. Finally, we will suggest that individual choices with regard to systematic organ removal could well be registered in a way that allows proper implementation of present French legislation.

The reference to domination plays a cardinal role in his analysis. Yet in the contemporary context, the identification of “subordinate classes” has nothing immediate. In order to assess the variability of interpretations and judgments relating to justice and injustice, according to social positions, we will consider, firstly, the limits of the Honnethian dichotomous interpretation, regarding social justice issues. Then about theses issues we propose a reassessment of criticism against the thesis about the argumentative coherence of common moral consciousness. We finally show that the projection of registers of discourse on socially distinct categories is not longer relevant today.

Afin de comprendre s'il existe de réels dilemmes moraux en psychiatrie et si ces derniers s'expliquent par la nature des devoirs en présence ou bien se résolvent dans de simples problèmes épistémiques, nous reviendrons dans un premier temps sur les arguments proposés par la philosophie morale, en la matière, puis nous envisagerons les formes de résolution de ce qui peut se présenter subjectivement comme des dilemmes moraux en psychiatrie ainsi que les aspects de l'ignorance épistémique qui peuvent se trouver à leur fondement.
Abstract : Because of its historical evolution in France and of the status of the psychiatric patients, the psychiatry in France has the use of the legitimate constraint. The use of the constraint and the restriction of liberty arise some ethical and clinical issues to some psychiatrists. A qualitative survey in this field will allow understanding what an analysis of practices can provide to moral theory and its debates on moral dilemmas. We will consider the issue of whether moral dilemmas in psychiatry are soluble in epistemic problems or if they are due to irreconcilable norms, firstly by considering the debate in moral philosophy concerning moral dilemmas. Then we will analyse the subjective solutions found to normative conflicts in psychiatry and we will finally try to discuss the epistemic uncertainty at their origin.

Pourtant et du fait des conditions sociales et culturelles d'accès à cette dernière, tous les citoyens de nos démocraties ne participent pas en tant que pairs à l'interaction politique. Dans ce contexte, l'éducation à la citoyenneté qui fait l'objet de préoccupation renouvelée de la part des gouvernants a un rôle à jouer. Cependant, pour garantir à chacun les moyens d'une telle parité de participation à la vie politique publique, cette éducation doit être repensée et envisagée non plus seulement dans les termes d'une éducation républicaine à la citoyenneté mais bien plutôt comme une éducation à une citoyenneté multiculturelle et ouverte aux différences.

positive du nouveau rôle dévolu aux démarches participatives dans la discussion des enjeux éthiques et des risques acceptables.
ABSTRACT. — With the precautionary principle, knowledge, risk assessment and action come together. Considered from an ethical and political point of view, this encompassing principle is a challenge for institutions and the general public, both in debates and when it comes to acting upon it in concrete settings. In this contribution, we attempt to describe the specific problems which arise from the choice of interpretations.
With a view to the ethical problems at stake, this leads us to a positive appreciation of the renewed attention paid to participatory endeavours for the purpose of discussing the critical ethical issues and the level of acceptable risks.

Anomie, exclusion, désaffiliation, fracture sociale, autant de notions qui peuplent le discours politique et social et qui prétendent exprimer un affaiblissement des liens sociaux voire de la cohésion sociale. Notre propos vise, d’une part, à cerner les conditions théoriques de pertinence d’emploi de ces notions et, d’autre part, à montrer que, bien qu’étant utiles pour décrire des situations individuelles, elles ne permettent aucunement, comme telles, de conclure à un état de la cohésion macrosociale, en l’occurrence à sa dissolution. Anomie et exclusion ne sont opératoires, dans cette dernière perspective, que lorsqu’elles sont explicitées et associées à des évolutions structurelles. Nos analyses permettront ainsi d’opérer une dissociation précise des champs de pertinence des notions de lien social et de cohésion sociale.

Abstract
The political and social debates often allude to exclusion, disaffiliation, anomy. These notions are used to express a weakening of social ties or social cohesion. This paper aims, firstly, to identify the pertinent theoretical framework of use of these concepts. Although useful for describing individual situations, these concepts do not immediately lead to conclusions about a state of macro-social cohesion and, in this case, to conclusions about its dissolution. Anomie and exclusion are relevant to deduce a lack of social cohesion only when they concern and are related to structural changes. Thus this paper will help make a clear distinction between the fields of relevance of the two concepts: social link and social cohesion.

représentations typiques de la cohésion sociale analogues dans cinq pays européens (Espagne, France,
Grande-Bretagne, Pologne et Suisse). Nous montrons comment ces représentations caractéristiques de
la cohésion façonnent les attitudes individuelles ainsi que les représentations morales des individus
concernant la société dans son ensemble ainsi que des dimensions comme le mérite, la justice sociale,
les fonctions de l’État. Nous procédons en justifiant, dans un premier temps, le choix de ces pays et le
cadre théorique dans lequel s’inscrit notre recherche. Nous esquissons ensuite ces représentations
typologiques de la cohésion pour finalement identifier les différences nationales affectant ces
représentations. L’analyse permet notamment de montrer que les préoccupations des citoyens relatives
à la cohésion sociale et à sa permanence sont largement partagées en Europe, y compris dans des pays
de tradition sociale variée et entrés dans l’Union européenne à des dates fort différentes.
Résumé : Les recherches en épigénétique connaissent aujourd’hui un essor remarquable qui pousse c... more Résumé : Les recherches en épigénétique connaissent aujourd’hui un essor remarquable qui pousse certains investigateurs à s’interroger sur la mise en œuvre de politiques de santé susceptibles de convoquer l’épigénétique dans une perspective préventive. Dans ce qui suit, nous interrogerons le sens d’une translation des résultats de l’épigénétique en politiques publiques puis la possibilité de convoquer l’argument de la prévention à l’appui de ce discours. Nous analyserons enfin le glissement, inhérent à certains processus sociaux dans lesquels des protagonistes de la recherche en épigénétique s’inscrivent, de la protection des populations à leur contrôle. À l’encontre des présupposés sous-jacents à ces initiatives, nous montrerons que les résultats mis en évidence par l’épigénétique posent prioritairement une question de responsabilité politique plutôt que de responsabilité individuelle, la première appelant moins des programmes à destination de groupes spécifiques qu’une réponse à l’inégale répartition des coûts sociaux sur l’ensemble de la population.

Abstract: Epigenetics research has nowadays an important development. Concerned by prevention issues, some of its investigators would like to promote health policies based on their latest discoveries in epigenetics. In this paper, we will question the relevance of a direct application of epigenetics results in public health policies. Then we will analyse the opportunity to use the argument of precaution in this perspective. Finally we will examine the shift to protection of population to their control. This shift, inherent to certain social processes, is also perceptible in this proactive tendency in epigenetics. Against it, we demonstrate that epigenetics results raise mainly issues of political responsibility rather than issues of individual responsibility but the first one involved less programs targeting particular social groups of the society that a specific attention to the unequal distribution of social burdens on the whole society.

Among the other possibilities that can be used after a person’s death, purchase or systematic removal have been a priori rejected. However, we will show that the appeal to individual altruism have resulted in some of the aporias of the present situation. Subsequently, we will consider how systematic organ removal from deceased persons can be made acceptable in liberal and democratic societies. Finally, we will suggest that individual choices with regard to systematic organ removal could well be registered in a way that allows proper implementation of present French legislation.

The reference to domination plays a cardinal role in his analysis. Yet in the contemporary context, the identification of “subordinate classes” has nothing immediate. In order to assess the variability of interpretations and judgments relating to justice and injustice, according to social positions, we will consider, firstly, the limits of the Honnethian dichotomous interpretation, regarding social justice issues. Then about theses issues we propose a reassessment of criticism against the thesis about the argumentative coherence of common moral consciousness. We finally show that the projection of registers of discourse on socially distinct categories is not longer relevant today.

Une étude systématique des discours politiques de 1980 à aujourd’hui a permis de mettre en évidence une inflexion notable du vocabulaire de la radicalisation entre 2003 et 2008, puis à partir de 2012 où il est employé pour désigner l’« ennemi intérieur ». À partir de 2012, les acteurs politiques font progressivement passer le terme du champ des rapports politiques partisans et des luttes sociales au registre du terrorisme et de l’islam pour concentrer quasiment exclusivement son usage aux questions religieuses. Dans cet article, nous mettrons donc en évidence les opérations de désignation de l’ennemi intérieur et de territorialisation de la menace qui lui est associée, spécifiquement localisée dans les « quartiers ». Nous montrerons que la « radicalisation » sert d’opérateur, dans le discours politique, au glissement du registre de l’adversaire politique à celui de l’ennemi voire du terroriste. A systematic study of political discourses since 1980 to nowadays shows a notable reorientation in the vocabulary of radicalization from 2003 to 2008, and since 2012 where it is used to refer to the “enemy within”. Since 2012, the word “radicalization” is not used, in political discourses, to qualify political or social issues, related to politics or social reforms, but only to consider religious issues, and specially Islam and terrorism. This paper will underline designation processes of the “enemy within” and the related territorialisation of the threat in the suburbs (les “quartiers”). La critique radicale des sociétés occidentales modernes – et post-modernes – n’est pas nouvelle. ... more La critique radicale des sociétés occidentales modernes – et post-modernes – n’est pas nouvelle. Elle remonte, en France, avec la tradition anarchiste à la fin du XIXe siècle. Les luttes de la gauche révolutionnaire émaillent le XXe siècle et atteignent leur apogée entre la fin des années 60 et les années 80. Notre contribution au panorama ici proposé des pensées critiques visera à présenter la critique de la société capitaliste, portée par Action Directe (AD). Nous envisagerons exclusivement Action Directe, dans la mesure où il s’agit du groupe français qui est allé le plus loin dans l’usage des armes, ce qui pourrait contribuer à mettre en perspective la violence qui a récemment été déployée par des groupes salafistes dans l’hexagone. La critique portée par AD, loin d’être un simple nihilisme, se pense comme un travail d’émancipation sociale et vise à œuvrer à la production d’un nouvel ordre social. Dans ce qui suit et après avoir rappelé quelques événements marquants de l’itinéraire d’AD, j’exposerai les principaux points de la dénonciation sociale portée par le groupe. J’esquisserai l’idéal social qu’il porte et aborderai enfin les arguments de légitimation de la violence révolutionnaire.

Les recherches presentees interviennent dans un contexte scientifique marque par des efforts significatifs pour mieux comprendre l'emergence de nouvelles formes de coordination institutionnelle. Certains enjeux importants des contributions contemporaines concernent l'interpretation des normes ethiques telles qu'elles sont mobilisees dans les institutions, en particulier lorsque celles-ci ont des attributions qui, dans leurs frontieres exactes, sont susceptibles d'evoluer a la lumiere des changements dans l'interpretation des normes de reference. Lorsqu'on les saisit conjointement avec les institutions, les references ethiques sont a examiner sous l'angle du rapport que l'on entretient avec elles, une fois qu'elles sont posees et servent de reference. Ce n'est pas la simplement un a-cote de l'ethique, qui aurait trait a une concretisation institutionnelle ou a des prolongements par essence separes d'elle. La vie ethique elle-meme est tributaire du debat qui prend forme dans les institutions qui contribuent a la formation des normes servant de reference. C'est dans cette perspective que l'on se propose de preciser des aspects qui sont susceptibles de distinguer les references ethiques des autres references normatives. Par comparaison avec les normes juridiques, en particulier, certains aspects paraissent distinctifs ou, du moins, particulierement remarquables \_place\_holder;: l'aspiration a donner une pleine autorite aux formulations retenues (a l'echelon des principes, et meme si les sanctions associees sont faibles ou inexistantes) \_place\_holder;; l'importance donnee a des principes tres generaux mais inevitablement ambigus et appelant des interpretations. Des lors, on peut estimer qu'il faut mettre en question le schema classique d'apres lequel les principes ethiques n'auraient d'efficience, de validite et d'occasions de concretisation qu'a proportion de leur expression dans des normes proprement juridiques ou dans la structure formelle des pouvoirs. L'ethique compte en tant que telle, pas seulement dans le dialogue ethique pur, mais aussi dans les echanges et les processus institutionnels. Au demeurant, le caractere frequemment general et ambigu des references ethiques n'est sans doute pas seulement a envisager comme une imperfection. On peut s'interesser aux caracteristiques qui en resultent, du point de vue de la coordination institutionnelle des agents sociaux et du travail collectif dans les institutions. Les recherches en sciences politiques ou en economie (R. Calvert et J. Johnson, R. Matland, A. Jones et J. Clark) ont mis en relief les specificites du comportement institutionnel que permettent ou favorisent l'ambiguite et la generalite des principes, objectifs ou regles. D'autres recherches (B. Reynaud, J. Ferejohn, J. Backhaus) ont mis en avant les aspects proprement institutionnels des processus d'interpretation, de mise en oeuvre ou d'application des principes, objectifs ou regles C'est ainsi que l'on a pu mettre en evidence le role important des principes generaux (notamment des principes ethiques relatifs a la participation, a la bonne deliberation, a la cohesion sociale, a l'egalite) dans certaines des transitions observees dans l'autorite reelle comparee des institutions. Cela conduit a s'interroger, du point de vue de l'ethique, sur les leçons a tirer d'apports recents de la recherche, tels les progres dans la comprehension de l'opposition entre pouvoir reel et pouvoir formel, des phenomenes de migration de l'autorite et de filtrage evolutif des raisons dans les deliberations institutionnelles. Le moment d'une premiere synthese est donc venu. Les contributions reunies abordent, sous differents angles, le recours aux principes ethiques dans les institutions et dans les rapports entre institutions. Mais l'intérêt philosophique de la question cosmopolitique dépasse très largement ce cadre. Elle atteste d'abord que la théorie politique de Kant ne se limite pas une théorie de l'Etat. Il doit y avoir un en deçà et un au-delà de l'Etat, où la politique dépasse l'idée de peuple pour atteindre celle d'humanité. En ce sens, Kant est l'antidote de Carl Schmitt, qui portait en lui la haine de l'idée cosmopolitique. Cet antagonisme théorique entre Schmitt et Kant, entre le poison et le remède, est largement attesté dans ce volume. Ce qui montre à quel point nous avons besoin aujourd'hui du cosmopolitisme de Kant, pour penser le passage de la guerre à la paix, la place de l'hôte étranger dans nos sociétés complexes et la nouvelle configuration d'un monde globalisé.

La demande insatiable de santé tient-elle lieu, dans nos sociétés, de dérivation à l'angoisse existentielle ? Quel serait l'apport d'un concept normatif de la santé, qui soit perspectiviste et opératoire ? Un concept perspectiviste. Distribuons le concept de santé entre les perspectives différentes des trois personnes pronominales, je, tu, il : la " santé-je ", vécue parte patient, la " santé-tu ", thématisée, comme dans le rapport à son médecin, et la " santé-il ", des politiques publiques notamment. Envisagée dans chacune de ces trois dimensions, la notion de santé se révèle dépendante d'attentes et d'exigences formulées culturellement. The requirement of impartiality that governs this body of laws, and their implementation, is required by the increase of public functions of mutual assistance, by the development of the welfare state, and by the social democratic alternative of liberal theory. Although the liberal state tends towards the conciliation of the requirements of impartiality and the conciliation of the requirements of individuality, it remains unsatisfactory in many ways. Liberal societies impose a limited impartiality, obtained by means of institutions, which require of their members a specific attachment to certain rights and to certain procedures. This task is indeed easier to implement than the institutionalization of a more egalitarian system. It is necessary, however, that we determine up to which point and under which conditions it is possible to establish rights that go beyond traditional fundamental freedoms and extend to legal and political equality. This political and legal equality would make it possible to provide for the elimination of poverty on a constitutional level. In a second step, I would like to inquire to what extent and under which conditions a basic income could be guaranteed beyond the aforementioned fundamental liberties, as well as the political and legal equality. We will then be able to consider the kind of constitutionalization required to guarantee such a basic income, for example, either specific measures or targeted programs under the supervision of the legislative and executive authorities. require legislative and executive authorities to be legally charged with instituting policies and programs that bring about an end to poverty. If these measures can escape the usual sort of political bargaining and from dilution by calculating, self- interested parties, a first step towards a more global socio-economic equality would be made. Thus, it would be more pertinent in the light of the following developments, to consider the conditions of a social and political system, which satisfy the requirements of impartiality more than liberalism does, even in its more egalitarian versions. To accomplish the establishment of a basic income state we must first specify the means that a progressive institutionalization of socio-economic equality might provide. Au-delà des raisons sociohistoriques expliquant cette évolution, les argumentaires développés autour de la propriété commune constituent des motifs explicatifs puissants de la disqualification de cette forme de propriété et, corrélativement, de la promotion de la propriété privée. Nous envisagerons, dans les deux domaines de l’histoire de la philosophie et du droit français, les arguments systématiquement mobilisés dans cette disqualification. Nous soulignerons également que la critique de la propriété commune se fonde corrélativement sur des représentations schématiques du commun pour proposer une détermination de ce dernier susceptible de fonder d’autres approches de la propriété. The social and economical context was confident in the economic argument underlining the inefficiency of common property. The economic argument had a major influence in the disqualification of the latter, especially because it put in light the so-called “tragedy of the commons”. In this paper, we will present a systematic description of the economic arguments against common ownership. Then we will highlight their rhetorical bias, especially the limits of the concept of common property used by neoinstitutional economics. Finally, we will suggest other ways to analyze the raise of rights to private ownership and another interpretation of the common able to sustain new approaches of property. Pourtant un contenu positif peut lui être conférée et c’est à cet objectif que cet article est consacré. Pour ce faire, nous mettrons en premier lieu en évidence les conditions requises pour qu’une pensée de l’inappropriable soit possible et qu’un statut pour ce dernier puisse émerger. Dans un second temps, nous envisagerons les modèles à partir desquels penser l’inappropriable, en l’occurrence l’inaliénabilité, le commun, ainsi que les conditions d’institutionnalisation de l’inappropriable, notamment la garantie de l’usage de tous, la réservation privative des utilités et l’interdiction de l’exclusion. It has been thought as an accidental feature of the legal regime of some entities, such as the commons. Nevertheless a positive status can be conferred to it. This paper aims to define this positive status. In this perspective, we will first identify the requirements for thinking the inappropriable and a status for it. Then, we will consider the models from which the inappropriable can be understood, for example the inalienability and the commons. Finally we will analyse the conditions of institutionalization of the inappropriable, including the guarantee of a universal use, the private reservation of utilities and the prohibition of exclusion. Jusque dans les années 2010, la violence idéologique et politique était appréhendée, en France, à... more Jusque dans les années 2010, la violence idéologique et politique était appréhendée, en France, à partir du champ sémantique du terrorisme. Progressivement, ce terme a cédé le pas à celui de « radicalisation », dont la sphère de pertinence est bien plus étendue que celle du premier. Bien que faisant référence à des phénomènes distincts, leur approche interprétative sur la scène politique a peu évolué. À partir d’une analyse systématique des discours politiques de 1980 à 2016, nous mettrons en évidence les facteurs privilégiés par le politique pour rendre compte de la radicalisation. Trois paradigmes dominants se dessinent : le déterminisme social, l’hypersubjectivation, l’occultation des raisons. Que ce soit à travers une approche subjective ou objective, les facteurs convoqués par le politique pour rationnaliser cette violence participent systématiquement de sa dépolitisation. Abstract: Until the 2010s, the ideological and political violence was described in France by reference to terrorism. Gradually “terrorism” has given way to “radicalization” though the latter has a larger field of application. Although “terrorism” and “radicalization” refer to different phenomena, their interpretations in the political sphere do not differ genuinely. We proceed to a systematic study of French political discourses from 1980 to 2016 to investigate the reasons they raised to explain the radicalizations. Three main paradigms appear: social determinism, a hypersubjectivation, a tendency to hide reasons. The factors political discourses refer to, either in a subjective approach or in an objective approach, lead to a systematic depoliticization of the radicalization processes and the violence they sometimes cause. The principles of medical ethics are quite well defined. Nevertheless we still do not know how they are appropriated by actors neither how they structure the practices. We investigated these processes in the field of psychiatry through qualitative interviews. This survey allowed us to grasp the interpretations of medical ethics in this field. We will present them and try firstly to understand the meaning of the exclusion of ethics by some medicals from the framework of their practices. Then we will try to draw the meaning of ethics in psychiatry rising from empirical discourses and grounded on fundamental principles of medical ethics. Finally, we will demonstrate that this ethics of action can be interpreted as a kind of particularist ethics.
Abstract : Because of its historical evolution in France and of the status of the psychiatric patients, the psychiatry in France has the use of the legitimate constraint. The use of the constraint and the restriction of liberty arise some ethical and clinical issues to some psychiatrists. A qualitative survey in this field will allow understanding what an analysis of practices can provide to moral theory and its debates on moral dilemmas. We will consider the issue of whether moral dilemmas in psychiatry are soluble in epistemic problems or if they are due to irreconcilable norms, firstly by considering the debate in moral philosophy concerning moral dilemmas. Then we will analyse the subjective solutions found to normative conflicts in psychiatry and we will finally try to discuss the epistemic uncertainty at their origin.

ABSTRACT. — With the precautionary principle, knowledge, risk assessment and action come together. Considered from an ethical and political point of view, this encompassing principle is a challenge for institutions and the general public, both in debates and when it comes to acting upon it in concrete settings. In this contribution, we attempt to describe the specific problems which arise from the choice of interpretations.
With a view to the ethical problems at stake, this leads us to a positive appreciation of the renewed attention paid to participatory endeavours for the purpose of discussing the critical ethical issues and the level of acceptable risks.
Anomie, exclusion, désaffiliation, fracture sociale, autant de notions qui peuplent le discours politique et social et qui prétendent exprimer un affaiblissement des liens sociaux voire de la cohésion sociale. Notre propos vise, d’une part, à cerner les conditions théoriques de pertinence d’emploi de ces notions et, d’autre part, à montrer que, bien qu’étant utiles pour décrire des situations individuelles, elles ne permettent aucunement, comme telles, de conclure à un état de la cohésion macrosociale, en l’occurrence à sa dissolution. Anomie et exclusion ne sont opératoires, dans cette dernière perspective, que lorsqu’elles sont explicitées et associées à des évolutions structurelles. Nos analyses permettront ainsi d’opérer une dissociation précise des champs de pertinence des notions de lien social et de cohésion sociale.

This shift, inherent to certain social processes, is also perceptible in this proactive tendency in epigenetics. Against it, we demonstrate that epigenetics results raise mainly issues of political responsibility rather than issues of individual responsibility but the first one involved less programs targeting particular social groups of the society that a specific attention to the unequal distribution of social burdens on the whole society.
