Pacifism and just war theory share the same binary approach to analyze the morality of war. Accor... more Pacifism and just war theory share the same binary approach to analyze the morality of war. According to binarism, any war is either morally justified or morally unjustified and when waging a war is morally unjustified, not waging that war is morally justified. Moral tragedy pacifism, advocated by Nicholas Parkin, argues that while waging war is always morally unjustified, on some occasions not waging war may also be morally unjustified. On those occasions, agents face a moral tragedy, in which there is no morally justified choice all things considered. In this essay, I present three arguments against moral tragedy pacifism and indirectly in favor of binarism.

In June 2020, Ruth Macklin published a critical essay against a guideline from the General Health... more In June 2020, Ruth Macklin published a critical essay against a guideline from the General Health Council (Consejo de Salubridad General) of México that recommends using age as a tie-breaking criterion to allocate scarce therapeutic resources. The guideline bases this recommendation on the complete-lives principle. In this paper I reconstruct and reject the three arguments presented by Macklin against the complete-lives principle. Subsequently, I formulate three objections of my own to this principle.

In his recent article, Yabar argues that people in extreme poverty should be prioritized in the d... more In his recent article, Yabar argues that people in extreme poverty should be prioritized in the distribution of SARS-CoV2 vaccines because they are the most vulnerable group in the pandemic. Though his text focuses on Peru, its relevance extends to other Latin American and developing countries. While his interesting proposal offers the worthy pursuit of addressing social injustice in vaccination programs, Yabar's text lacks clarification of the relevant idea of "vulnerability", without which the central rationale for prioritizing people living in extreme poverty is not adequately appreciated. I offer two definitions of vulnerability to argue that prioritizing the poorest for intrinsic reasons may lead to not saving as many lives as possible and is therefore not acceptable.

Being a pacifist who refrains from lethal violence is considered a praiseworthy commitment but no... more Being a pacifist who refrains from lethal violence is considered a praiseworthy commitment but not morally obligatory. One reason for denying that pacifism is morally obligatory is the high cost that would be implied for agents under attack, who cannot defend their own lives. Thus, pacifists are usually seen as lambs between lions and, therefore, pacifism is seen as morally over-demanding. In this paper, I intend to clarify the over-demandingness objection and to show its limits against pacifism. First, I argue that the cost of an act is neither a necessary nor sufficient condition to determine its obligatory nature. Second, arguing from an analogy to Batman, I maintain that there is a plausible moral obligation to never use lethal violence against another human being that arises from adopting a specific social role, namely, the leadership of a pacifist movement.

En el marco de dicha indagación, Vidiella sostuvo que existe una incompatibilidad entre la idea de razón pública defendida por John Rawls y la concepción deliberativa de la democracia. Dicha crítica deliberacionista contra la propuesta rawlsiana puede desagregarse en tres tesis: tesis del autogobierno procedimental, tesis sobre el uso crítico de la razón y tesis sobre el trato desigualitario. El presente artículo argumenta en contra de dichas tesis y en defensa de la compatibilidad de la idea de razón pública rawlsiana y la democracia deliberativa.

La publicación del proyecto de sentencia del ministro González Alcántara Carrancá en el sitio web... more La publicación del proyecto de sentencia del ministro González Alcántara Carrancá en el sitio web de la SCJN y su eventual aprobación por la Primera Sala produjo un cimbronazo en el debate público mexicano. El objetivo de este ensayo es reconstruir el argumento central ofrecido por el ministro y formularle dos críticas. Más específicamente, sostengo que (1) un estado laico puede erogar recursos públicos para la preservación del patrimonio cultural identitario de la comunidad, patrimonio que en el caso del pueblo mexicano es indisociable de una impronta religiosa específica, a saber, católica y (2) que el contenido del proyecto puede implicar una pendiente resbaladiza conceptual que atenta contra el ejercicio de libertad religiosa.

La crítica deliberacionista de Vidiella contra la propuesta rawlsiana puede desagregarse en dos tesis: tesis del autogobierno procedimental y tesis sobre el uso crítico de la razón. Argumentaré en contra de dichas tesis y en defensa de la compatibilidad de la idea de razón pública rawlsiana y la democracia deliberativa.

In doing so they assume that there is no relevant normative difference between the distribution of unallocated therapeutic resources and the distribution of therapeutic resources that have already been allocated. Consequently, they affirm that the moral criterion to be applied in both decisions is the same. In the present work, I argue that there is a relevant normative difference between these decisions and that the moral criterion to be applied in both decisions must be different. © 2021 Sociedad Argentina de Analisis Filosofico. Sterba fundamenta ese deber trazando una analogía con una serie de casos en los que común-mente se aceptaría algún grado de sacrificio en beneficio de terceros. En el presente trabajo, sostengo que el argumento formulado por Sterba llega a la conclusión correcta, pero es invalido. Asimismo, señalo dos argumentos diferentes que podrían utilizarse para fundamentar la existencia de un de-ber de sacrificar la propia vida para salvar la de terceros. Abstract In a very short article, James Sterba argues that there is a moral duty to sacrifice one's life to save the lives of others. Sterba justifies this duty by drawing an analogy with a series of cases in which some degree of sacrifice would be commonly accepted for the benefit of third parties. In this paper, I argue that Sterba's argument reaches the correct conclusion, but is invalid. In addition, I point out two different arguments to support the existence of a duty to sacrifice one's life to save the lives of others.

Sostengo que ambas premisas pueden ser rechazadas, de manera indirecta (en el caso de la premisa empírica) o directa (en el caso de la premisa normativa). La conclusión es que el asociacionismo coercionista no prueba la existencia de una discontinuidad normativa entre el plano doméstico y el plano global.

En el primero se discute acerca de la permisibilidad moral de la tortura en circunstancias excepcionales y las características que la convierten en una práctica, prima facie, inmoral. En el segundo se evalúan las posibles consecuencias de diferentes modelos de legislación (absolutista, institucionalista y legalista) para dar una respuesta a las situaciones del mundo real. El presente trabajo se inscribe en este segundo nivel y se propone analizar críticamente las propuestas legislativas de Jeff McMahan y Alan Dershowitz. Asimismo, busca ofrecer una exploración preliminar de las ventajas del modelo legalista.

Busco mostrar que el valor intrínseco que dicho experimento le otorga a la objetividad debe ser rechazado desde el utilitarismo y que la subjetividad cuenta como una condición necesaria y suficiente para la evaluación moral. Asimismo, concluiré que el utilitarismo de satisfacción de preferencias para mantenerse dentro de los límites del utilitarismo debe considerarse como un consecuencialismo de estados mentales amplio.

El hecho de que las personas estén divididas razonablemente por creencias omniabarcantes que reconocen como verdaderas y valiosas, establece inconvenientes en relación con la legitimidad de las decisiones políticas, su estabilidad y la justicia de las instituciones democráticas. Los teóricos de la democracia deliberativa resaltan la importancia del razonamiento público entre ciudadanos que se reconocen mutuamente como libres e iguales. Se analiza el componente normativo de este tipo de propuestas y el ideal de razón pública que permite su mejor desarrollo.
