Through a comparative analysis of recent decisions, the paper investigates whether the possibility of patenting human genome might be able to answer fundamental questions of combining research, innovation and human rights in an acceptable way.

of the ... more In a comparative perspective the article analyzes some case-studies (USA, UK and Germany)
of the use of sunset rules (or clause). This analysis is aimed at identifying some possible
replicable solutions in the Italian legal system (at state and regional levels) of the introduction
of these clauses, qualifies both as a tool to achieve better regulation goals, and to contribute to
the production of “flexible” regulations.
L’articolo analizza in prospettiva comparata alcune esperienze (USA, Regno Unito e
Germania) di utilizzo delle sunset rules, ovvero delle clausole di autoabrogazione espressa
contenute in alcune tipologie di provvedimenti normativi. L’analisi comparata è finalizzata ad
individuare alcune possibili soluzioni replicabili nel nostro ordinamento (sia a livello statale
sia regionale) di introduzione di questo istituto, qualificabile sia come strumento per realizzare
la qualità della regolazione, sia per contribuire alla produzione di una regolazione “flessibile”.

The article, after briefly outlining the most important principles of cross-border health care ri... more The article, after briefly outlining the most important principles of cross-border health care right established by the Court of Justice of the European Union, aims to analyse the recent judgement of this Court on the Petru case (C-268/2013). In this decision, the European judge examines a case related to structural weaknesses (lack of medicines and medical staff) of a national health care system for the first time. In such circumstances, taking into consideration medical and pathological patient’s conditions, the State of residence cannot refuse to authorise cross-border health care.

countries in or... more The article aims to examine labour policies and labour legislations of the BRICS
countries in order to highlight any common trend in this topic between these five Nations. For
this purpose, the article is divided into two different levels of anal
ysis: firstly, an examination of
the institutional activities of cooperation and exchange between the BRICS countries to resemble
regarding national labour legislations; secondly, an analysis of three case studies (China, India and
Brazil).
In the first pa
rt, in particular, we examine how labour policies have been taken into account in
the institutional activities of the five countries Leaders, which were gathered mainly from the
BRICS Summits’ statements and from the first Trade Union meetings of these cou
ntries.
In the second part, we analyse the labour legislations, with particular reference to the
introduction of the labour flexibility within the three selected legal orders (China, India and
Brazil), in order to identify differences and the first elemen
ts of convergence of the national rules.

L’analisi d’impatto delle regolazione (AIR) è uno degli strumenti principali per il miglioramento... more L’analisi d’impatto delle regolazione (AIR) è uno degli strumenti principali per il miglioramento della qualità della regolazione (c.d. better regulation ), che consente al decisore pubblico di valutare anteriormente gli effetti (impatti) sui destinatari di ipotesi alternative di intervento, garantendo ad esso di poter adottare una decisione più consapevole ed informata.
Tale metodologia è oggi abbastanza diffusa tra i diversi legislatori (o in termini più generali, regolatori), non costituendo più uno strumento di appannaggio dei soli esecutivi centrali nazionali, ma anche dei decisori di altri livelli (Unione Europea e in qualche caso anche le Regioni). In tale panorama non fanno eccezione le autorità amministrative indipendenti, le quali nel nostro ordinamento dal 2003 hanno l’obbligo di dotarsi di questa tecnica.
Anche in altre esperienze nazionali, le autorità indipendenti hanno spesso adottato la metodologia AIR per supportare le proprie decisioni regolatorie. Il Regno Unito rappresenta sicuramente una delle esperienze più avanzate e consolidate in tale ambito, anche in questo caso sia a livello di governo centrale sia di regolatori indipendenti.
Il presente elaborato mira ad approfondire l’esperienza in materia di Impact Assessment (IA) dell’Office of Gas and Electricity Markets (OFGEM). L’OFGEM è la struttura di supporto alla Autorità per l’energia e il gas del Regno Unito (Gas and Electricity Markets Authority, GEMA) ed insieme regolano il mercato dell’energia elettrica e del gas. Tale autorità ha una conoscenza piuttosto avanzata della metodologia, tanto da incardinarla all’interno di una vera politica di miglioramento della regolazione e da aver sviluppato, non una semplice AIR per la valutazione degli impatti economici delle proposte di intervento, ma un’analisi più complessa come l’environment impact assessment (EIA) per la misurazione degli effetti sull’ambiente. Lo scopo principale, pertanto, di questo paper è, dopo aver presentato la politica di qualità della regolazione dell’autorità britannica, soffermarsi, innanzitutto, sulla metodologia IA ed individuare le caratteristiche che ci consentono di classificarla come una EIA; successivamente analizzare alcuni casi specifici al fine di verificare sia la concreta quantificazione degli effetti sull’ambiente delle proposte regolatorie, sia la rilevanza di tali effetti nell’ambito dell’intera analisi.

Information and Communication Technology (ICT), Internet and Big Data 1 have been having strong i... more Information and Communication Technology (ICT), Internet and Big Data 1 have been having strong influence on our daily life. It is against this background that even more traditional sector, such as health care, has to deal with. Substantial progress has been made in recent years regarding new ways of providing health care, reshaping the very concept of health care somehow. We are challenging innovative paths in this sector (i.e. predictive medicine, personalised medicine, digital health, telemedine 2) but, at the same time, we should consider consequent implications in terms of data protection right (health care data is sensitive personal data, according to the EU regulation). In particular, we should point out legal consequences regarding at least three different " levels of use " of health care data: what and how is going to share; for which purpose(s) and how and who is going to store/retain this type of data. In order to investigate this challenging relationship between health care data protection and ICT, the paper is divided in three parts. Firstly, it clarifies the main definitions using in this sector (e-health, medical apps, m-health) in order to find common notions. Secondly, it analyses and compares the EU, the US and Australian legislations of medical apps to highlight shared solutions and weaknesses in those regulations. Finally, it addresses newly possible legal answers to better balance the protection of health care data right and the new (bio)technologies iure condendo.
