So sei jene Erklärung nämlich einerseits ein revolutionärer, politischer Akt, der andererseits jedoch eine Entpolitisierung zur Folge habe. Mit ihm wird die bürgerliche Gesellschaft als Raum privater Willkür und Interessenbefriedigung emanzipiert und der Politik als " Naturbasis " vorausgesetzt, die politisch nur noch zu verwalten, nicht aber zu gestalten sei. Dies nennt Menke die " Naturalisierung des Sozialen ", die er als den kennzeichnenden Mechanismus des bürgerlichen Rechts ausmacht, den es zu verstehen gelte, um das Rätsel der bürgerlichen Revolution zu lösen. Dafür bedarf es in seinen Augen einer Formanalyse der bürgerlichen Rechte, die er in Kritik der Rechte unternimmt. Sie konfrontiert die bürgerlichen Rechte mit " ihrer Genesis, ihrem Grund ". Diese Genealogie ist für Menke der einzige Weg einer " wahren Kritik " dieses Rechts, die schließlich zu dessen Überwin-dung und hin zu einem " neuen Recht " führen soll. Menke verfolgt drei Ziele. Er möchte erstens Form und Funktionsweise des modernen Rechts aufzeigen, zweitens eine spezifische Art der Kritik von Recht etablieren und aus der Formanalyse drittens Hinweise darauf destillie-ren, wie eine " wahre Gestalt " des modernen Rechts aussehen könnte. Er gebraucht dabei sowohl historische als auch begriffliche Einsichten: So zeigt er zum einen auf, wie sich das bürgerliche Recht als eine Gestalt des modernen Rechts aus den traditionellen Rechtsgestalten des athenischen und römischen Rechts entwickelt (Teil I) und welche gesellschaftlichen Formatio-nen damit einhergehen (Teil III). Zum anderen stehen auf begrifflicher Ebene das rechtskonstitutive Verhältnis von Form und Materie (Teil II) sowie die Form juridischen Urteilens im Mittelpunkt (Teil IV). Im ersten Teil, Geschichte: Die Legalisierung des Natürlichen, zeichnet Menke die Entwicklung vom traditionellen Recht der Gerechtigkeit zum modernen Recht der Legalität nach.
