Estoria de España fue compuesta por la iniciativa y bajo la tutoría del rey de Castilla y León Alfonso X el Sabio (1252—1284) y abarca desde el periodo del legendario Hércules (el poblador de España) hasta la muerte del rey Fernando III el Santo (1217—1252), padre del Rey Sabio. El primer tomo de la presente edición incluye artículos introductorios y la parte inicial del texto de la crónica dedicada al periodo desde la población de la Península y hasta el reinado del imperador romano Constantino el Grande. El libro está destinado a investigadores medievalistas, especialistas en la cultura e historia de España, estudiantes así como a todos los interesados en la historia e historiografía de la Edad Media occidental.

Работа посвящена анализу «горизонтальных» внутриобщественных связей «дружбы и доверия», пронизыва... more Работа посвящена анализу «горизонтальных» внутриобщественных связей «дружбы и доверия», пронизывавших и объединявших все общество средневековых Кастилии и Леона. На материале широкого диапазона нормативных и нарративных источников XI – XIII вв. рассматривается суть данных отношений и круг охваченных ими людей. Вторая часть исследования посвящена анализу двух составов преступлений, измены (aleve) и предательства (traición), нарушавших, прежде всего, связи дружбы, доверия и вассальной верности. Особое внимание в исследовании уделяется проблемам истории языка, социальной истории и истории права.

" El libro es dedicado a la investigación fue el léxico del Derecho penal de Castilla medieval co... more " El libro es dedicado a la investigación fue el léxico del Derecho penal de Castilla medieval como este último fue reflejado en la “Partida Septima” de Alfonso el Sabio. El concepto del yerro utilizado, como es sabido, en las Partidas para significar cualquier delito, devino para mi el punto de partida. Por cierto ha sido imposible de investigar el yerro sin prestar atención al léxico del Derecho Romano penal y también ál del Derecho Canónico del Decretum Gratiani. Es porque he dividido mi trabajo en tres partes principales, la primera de las cuales fue dedicada al problema de la construcción del concepto del delictum en el lenguaje de los juristas romanos, la segunda trataba de la evolución del citado concepto en la tradición jurídica y teológica de la Península Ibérica de los ss. VI – XIII y solamente en la última, i.e. tercera, parte he analizado el concepto del yerro en las Siete Partidas.
Según lo antedicho, las fuentes principales de mi investigación se dividieron en los tres grupos principales. El primer grupo contuvo los textos de la tradición romana literaria y jurídica, desde Plauto y Terencio y hasta la codificación Teodosiana y las interpretaciones del Breviario. El segundo grupo incluyó los textos de la tradición pirenaica medieval jurídica y teológica y el tercero y último – los textos de la tradición del Derecho Común, desde el Cuerpo del Derecho Civil de Justiniano y hasta las Siete Partidas. Repasando las conclusiones de la investigación, es posible fijar las siguientes posiciones:
1. Conforme a mi punto de vista, el latín jurídico como el lenguaje profesional de los jurisconsultos apareció no antes del periodo del Principado. Esta afirmación puede ser confirmada por tres argumentos consiguientes:
a) hacia los años 30 del s. II AD se acabó de formarse el cuerpo principal de los actos normativos (se trata ante todo del Edictum Perpetuum) que devino después la base para los cometarios jurídicos; b) en la misma época, gracias al aparición de los primeros textos didáctico-jurídicos (Massurii Sabini de iure civile libri III; después – las Institutiones de Gayo y Florentino), es posible hablar de la formación de la ciencia del derecho civil romano; c) por fin en este periodo se apareció y se desarolló el género de los comentarios jurídicos (ante todo Commentaria ad edictum y ad Sabinum). El mérito principal de las obras deste género fué la elaboración del aparato categorial y de la terminología jurídica.
2. Consiguientemente antes que investigar la terminología jurídica tuve que examinar la historia del uso de los terminos que me interesaban en los textos de las fuentes narrativas de la época antecedente al Principado, i.e., – de la época de la República Romana. En los textos narrativos del citado periodo se usaron siete terminos principales para denominar la infracción de la ley: delictum, crimen, maleficium, peccatum, facinus, flagitium, scelus. De estos solamente los tres primeros y, en medida cosí inconsiderable, el cuarto, entraron en el lenguaje jurídico del periodo clásico (véase los apéndices 1 y 2). De estas palabras, lá del crimen fué la más técnica, gracias a su uso activo en los textos legislativos de la época de Sulla y del Julio Cesar. El delictum en principios se usaba para designar la transgresión de la ley en general y después – para marcar la infracción civil que daba al demandante el derecho de la exigir los daños y perjuicios al demandado. Las dos palabras restantes – maleficium и peccatum, – se usaron, en su mayor parte, como los sinonimos del crimen y del delictum.
3. Hacia el fin del periodo clásico de la historia del Derecho romano, i.e. cerca de la segunda mitad del s.III, los juristas comenzaron de usar el concepto del delictum en el sentido más amplio y comun, en contrapeso al termino crimen que se usaba para designar las infracciones concretas. Tal cambio en el uso de los terminos que se usaron antes para marcar las infracciones privadas y públicas consiguientemente, se explica, antes todo, por la “desprivatisación” (la definición de J. Burillo) del Derecho privado y la desaparición real del limite entre el Derecho público y Derecho privado en el fin del Principado y, sobre todo, durante la época del Dominado. El sistema de la terminología jurídica clásica non pudo desaparecer enteramente pero fué vulgarizado muy gravemente, que se puede ver, por ejemplo, analizando los textos del Codigo Teodosiano. Entre las palabras usadas para marcar las infracciones de nuevo se comenzaron de nuevo de usar los scelus, facinus y flagitium, expulsados del léxico jurídico en el periodo clásico.
4. La vulgarisación del latín jurídico y, sobre todo, del parte dél examinada en esta investigación, fué intensificada y acrecentada por la cristianización paulatina de la cultura romana en Europa en general y en la Península Ibérica en particular. La cultura jurídica del Reino Visigodo y de los sus descendientes – los reinos de Asturia y León y, mas tarde, de León y Castilla, – se desarollaba bajo la fuerte influencia de las obras y de las ideas de St. Jeronimo, St. Agustino, St. Gregorio el Magno y por cierto, de St. Isidoro de Sevilla y St. Tajon de Zaragoza. Gracias a todos estos y algunos otros pensadores los conceptos del peccatum y delictum se unieron en uno concepto del pecado del carácter sintético: la prevalencia del peccatum con sus aspectos valorativos y éticos había, como consecuencia, la construcción de las multiples clasificaciones de los peccata y, en mismo tiempo, la expulsión del delictum del léxico jurídico, como mínimo, hasta la época de la recepción del Derecho Común.
5. El reinado del Alfonso X el Sabio se puede caracterizarse como el periodo inicial de la formación de la terminología jurídica romance. La necesidad de su aparición fué condicionada no solamente por las peculiaridades de la política exterior y interior del Rey Sabio, pero también por las exigencias de la práctica jurídica real de León y Castilla. La formación del Derecho nuevo en los cuadros del proceso de la recepción del Ius Commune exigía el nuevo lenguaje profesional. Este lenguaje se desarollaba en dirección a la formalización de los conceptos generalizados y a la construcción de las clasificaciones genéricas de distintas instituciones jurídicas.
Las “Siete Partidas” de Alfonso el Sabio pueden ser consideradas como el monumento del proceso de la recepción del Ius commune pero no del resultado de ésta: como podemos ver, las construcciones jurídicas recibidas en las “Partidas” son, en medida considerable, imperfectas – por ejemplo, en el caso del yerro es posible fijar en el texto todos los requisitos necesarios de este concepto pero no se puede trovar su definición genérica. Lo mismo podemos constatar en quanto a las obligaciones ex delicto.
6. El concepto romance yerro es un sinónimo del delictum como este último se usaba en el léxico jurídico del periodo postclásico. Este planteamiento puede ser probado por la coincidencia de las acepciones principales del termino yerro con lás del concepto antecedente – el pecado – por un lado y con las acepciones del termino posterior – el delito – por otro lado. Este, en su turno hace posible y conveniente la investigación del problema de las obligaciones nacidos del yerro en las “Partidas” como la forma recibida de las obligationes ex delicto.
Entre los indicios genéricos del yerro, según los resultados de mi investigación, es posible nombrar la capacidad del sujeto del delito, su mala intención, la realización de la dicha intención y la totalidad de los agravantes distintos para cada delito concreto. Como los indicios específicos de los yerros se pueden ser considerados el objeto y el tipo de la infracción de la ley. La totalidad de estos indicios tan genéricos como específicos permite al investigador de construir la clasificación non-contradictoria y lógica de las transgresiones de la ley descritas en las “Partidas”. In the reign of Alphonse the Sage (1252 - 1284) this word was used by court lawyers for signifying any crime without making difference. On the basis of information discerned from the bilingual texts (such as the Etymologiae of Isidor of Sevilla, Fuero Juzgo, etc.) the author shows that originally the yerro was an ethic concept and only starting with the Alphonse's linguistic re6 form it had gradually acquired religious and juridical connotations.

The focus is on two chapters of the “Second Partida”, which contains detailed regulation of the social and political structure of the kingdom. In addition to the “Second Partida”, the author examines this concept in the acts of Cortes of Alfonso’s reign, in other legal codes of the Wise King (“Fuero Real” and “Especulo”), as well as in the “Chronicle of Alfonso X”. The use of the latter source is because, although it was compiled later (c. 1348), it contains texts written under Alfonso X. According to the study results, the author identifies several central registers of the use of the concept of tierra in the texts he selected. En este trabajo se propone un análisis que explique la existencia de tendencias narrativas dentro... more En este trabajo se propone un análisis que explique la existencia de tendencias narrativas dentro del proceso redaccional de las Siete Partidas, el cual se revela en su tradición manuscrita. La perspectiva con la cual abordo el problema es teórica, pero tiene como punto de partida el trabajo textual que sobre la obra se ha hecho, y vengo haciendo, en los últimos años. En este sentido, el análisis posee dos dimensiones: por un lado, el problema textual. Por el otro, la propuesta intelectual que pone un énfasis en el fenómeno de la reescritura, y el cambio, como necesidad. La hipótesis central, entonces, es que dada la existencia de dos tendencias al interior de la tradición de las Partidas, estas nos permiten entender en clave dinámica el funcionamiento del texto tanto desde una perspectiva sincrónica como diacrónica. 6. El concepto romance yerro es un sinónimo del delictum como este último se usaba en el léxico jurídico del periodo postclásico. Este planteamiento puede ser probado por la coincidencia de las acepciones principales del termino yerro con lás del concepto antecedente – el pecado – por un lado y con las acepciones del termino posterior – el delito – por otro lado. Este, en su turno hace posible y conveniente la investigación del problema de las obligaciones nacidos del yerro en las “Partidas” como la forma recibida de las obligationes ex delicto.
Entre los indicios genéricos del yerro, según los resultados de mi investigación, es posible nombrar la capacidad del sujeto del delito, su mala intención, la realización de la dicha intención y la totalidad de los agravantes distintos para cada delito concreto. Como los indicios específicos de los yerros se pueden ser considerados el objeto y el tipo de la infracción de la ley. La totalidad de estos indicios tan genéricos como específicos permite al investigador de construir la clasificación non-contradictoria y lógica de las transgresiones de la ley descritas en las “Partidas”. Using various sources, including the narrative, normative and documental ones, the author describ... more Using various sources, including the narrative, normative and documental ones, the author describes the process of genesis of the concept of "misdemeanor" ( yerro ) in the Castilian language. In the reign of Alphonse the Sage (1252 - 1284) this word was used by court lawyers for signifying any crime without making difference. On the basis of information discerned from the bilingual texts (such as the Etymologiae of Isidor of Sevilla, Fuero Juzgo, etc.) the author shows that originally the yerro was an ethic concept and only starting with the Alphonse's linguistic re6 form it had gradually acquired religious and juridical connotations.

The focus is on two chapters of the “Second Partida”, which contains detailed regulation of the social and political structure of the kingdom. In addition to the “Second Partida”, the author examines this concept in the acts of Cortes of Alfonso’s reign, in other legal codes of the Wise King (“Fuero Real” and “Especulo”), as well as in the “Chronicle of Alfonso X”. The use of the latter source is because, although it was compiled later (c. 1348), it contains texts written under Alfonso X. According to the study results, the author identifies several central registers of the use of the concept of tierra in the texts he selected. In the texts of the acts of the Cortes, “Fuero Real” and “Especulo”, this word most often means either land, as a territory covered by the jurisdiction of the king or judges, or as an object of private property rights. The idea of the issue was suggested by P. Hadot’s paper (1979) “Les divisions des parties de la p... more The idea of the issue was suggested by P. Hadot’s paper (1979) “Les divisions des parties de la philosophie dans l'Antiquité”, where he singles out three types of the philosophical divisions in Antiquity. One of them is the Eleusinian type, within which philosophical ascension is seen as a sort of religious initiation. This division, particularly popular in Platonism, has attracted a lot of scholarly attention both from the historians of religion and from the historians of philosophy.
Still, the historians of religion turn to be more interested in the literal level of the metaphor, for it allows to specify our ideas about the religion of the Greeks, whereas Platonic scholars are more focused on the figurative level, i.e. in what lies “behind” the metaphor. However, the metaphor is not only an embellishment or a parable: to a great extent, it constructs our conception of the philosophical reality. In this regard, the very fact of auto-definition of philosophy in religious terms presents an independent historical and philosophical interest.
This question inevitably leads us to a more general question of the relation between the philosophical and the religious discourses in antiquity. The difference between the two is not reducible to the difference between the "rational" and the "irrational". Philosophers (at least, ancient philosophers) reflect on things divine either arguing with traditional views on what is fitting for god, or re-interpreting them by means of complex hermeneutic procedures. On the other hand, early Christianity naturally embraces philosophy not only as a specific set of theoretical propositions or methods, but also as a way of life oriented towards the true and aimed at the assimilation with God.
Articles for this issue should be submitted no later than September the 15th 2018. All articles undergo double peer-review procedure. According to the open access policy of the Journal, they will be available online right after the publication.

Critical reconsideration and verification of the various disputable current issues as well as a profound revaluation of the questions already raised to achieve a high degree of scientific perfection – that is the modus pursued by the scholars of the Humanities since the Ancient Greece. Different modes of thinking (being voiced in the academic environment) determine different ways of answers concerning methodology as well as descriptive-positive aspects. The organizers announce the call for papers addressed those participants who are interested in comprehension of the current processes of the reflection in the history of philosophy and theology; philosophy of language and logic; ontology and gnoseology; philosophy of communication. The conference will focus on various ways of modeling different philosophic problems trajected through the prism of social and cultural codes, as well as different obstacles in translation from ancient and modern languages, correction and development of the conceptual framework in the humanities. An interdisciplinary approach allows the Conference to engage different sections of human sciences, particularly, history of literature and language, epistemology, hermeneutics, significant issues of socio-cultural communication, etc. The specialty of the Conference of 2018 will be its orientation towards the History of Concepts (Begriffsgeschichte), as a most relevant for a present-day humanitarian knowledge strategical and methodological guideline. Our first plenary session named "Understanding ancients, understanding like ancients" will be dedicated to the problem of the ancient philosophical text's interpretation. The philosophical text is a result of multiple interpretations: written fixation of an oral teaching, copying and editing process, translations and scholarly commentaries. These are the stages of the complicated interpretative process which preconditions our understanding of an ancient text. Our awareness of this complexity is therefore necessary for a valid interpretation. Nevertheless, we often tend to approach ancient authors as if they were our school-mates, and carelessly ‘extract’ philosophical doctrines ‘from’ their texts as if these texts were mere ‘containers,' devoid of any philosophical significance. So, the first scope of the plenary session will be to discuss hermeneutical problems related to ‘understanding the ancients.' As the second part of the title suggests, the ancients themselves paid much attention to the questions of interpretation, so our hermeneutical efforts are inevitably determined, to a greater or lesser degree, by ancient tradition. It is in Antiquity that the question "how to understand" (be that oracles, Plato, the Scripture or ourselves) was formulated for the first time, and we construct our interpretations either in polemics or agreement with the answers given to us. In ‘understanding the ancients’ we are bound to understand ‘like ancients.' Within the frames of the second plenary session, we propose to discuss the problematics of the History of Concepts and its relations with the Political Philosophy and the History of Political Thought of Russia and Europe from XV to XX cent. Among the possible speakers are Claudio Sergio Nun Ingerflom (CNRS, Paris – CONICET, Buenos-Aires), Constantine Yerusalimsky (RSUH, Moscow) and Michael Velizhev (HSE, Moscow). The third plenary session will traditionally be dedicated to the problems of the correlation between the language, gnoseology, logic, and ontology. Journal of Higher School of Economics (June 2022) Co-editors: Alexander Marey (NRU HSE) & Daniel Panateri (Conicet-Unsam) Modern dictionaries and encyclopaedias generally define authority according to Max Weber’s conception as one’s possibility to make another person do something or not to do according to the subject of power’s will, even if it is contrary to his desire. It is a so-called “conative theory of power”. However, this conception is relatively young because it is a product of modern culture. Medieval culture cultivated another view on power and authority based on the Christian (on one side) and the Ancient Roman (on another) foundations. It is worth taking into account also the ideas on power elaborated by non-christian philosophers. Within this frame, we would like to invite colleagues around the world to provide their perspectives and thoughts about the Medieval and Early Modern conceptions of power and authority. With this proposal, we seek to discuss the principal conceptual models and discursive modes which were used to think of power. We would like to suggest that proposals focus on specific thinkers or jurists (as Bartolo di Sassoferrato, Marsilio di Padua, Giles of Rome, etc.) and their conceptions or development of some theory or concept. Según lo antedicho, las fuentes principales de mi investigación se dividieron en los tres grupos principales. El primer grupo contuvo los textos de la tradición romana literaria y jurídica, desde Plauto y Terencio y hasta la codificación Teodosiana y las interpretaciones del Breviario. El segundo grupo incluyó los textos de la tradición pirenaica medieval jurídica y teológica y el tercero y último – los textos de la tradición del Derecho Común, desde el Cuerpo del Derecho Civil de Justiniano y hasta las Siete Partidas. Repasando las conclusiones de la investigación, es posible fijar las siguientes posiciones:
1. Conforme a mi punto de vista, el latín jurídico como el lenguaje profesional de los jurisconsultos apareció no antes del periodo del Principado. Esta afirmación puede ser confirmada por tres argumentos consiguientes:
a) hacia los años 30 del s. II AD se acabó de formarse el cuerpo principal de los actos normativos (se trata ante todo del Edictum Perpetuum) que devino después la base para los cometarios jurídicos; b) en la misma época, gracias al aparición de los primeros textos didáctico-jurídicos (Massurii Sabini de iure civile libri III; después – las Institutiones de Gayo y Florentino), es posible hablar de la formación de la ciencia del derecho civil romano; c) por fin en este periodo se apareció y se desarolló el género de los comentarios jurídicos (ante todo Commentaria ad edictum y ad Sabinum). El mérito principal de las obras deste género fué la elaboración del aparato categorial y de la terminología jurídica.
2. Consiguientemente antes que investigar la terminología jurídica tuve que examinar la historia del uso de los terminos que me interesaban en los textos de las fuentes narrativas de la época antecedente al Principado, i.e., – de la época de la República Romana. En los textos narrativos del citado periodo se usaron siete terminos principales para denominar la infracción de la ley: delictum, crimen, maleficium, peccatum, facinus, flagitium, scelus. De estos solamente los tres primeros y, en medida cosí inconsiderable, el cuarto, entraron en el lenguaje jurídico del periodo clásico (véase los apéndices 1 y 2). De estas palabras, lá del crimen fué la más técnica, gracias a su uso activo en los textos legislativos de la época de Sulla y del Julio Cesar. El delictum en principios se usaba para designar la transgresión de la ley en general y después – para marcar la infracción civil que daba al demandante el derecho de la exigir los daños y perjuicios al demandado. Las dos palabras restantes – maleficium и peccatum, – se usaron, en su mayor parte, como los sinonimos del crimen y del delictum.
3. Hacia el fin del periodo clásico de la historia del Derecho romano, i.e. cerca de la segunda mitad del s.III, los juristas comenzaron de usar el concepto del delictum en el sentido más amplio y comun, en contrapeso al termino crimen que se usaba para designar las infracciones concretas. Tal cambio en el uso de los terminos que se usaron antes para marcar las infracciones privadas y públicas consiguientemente, se explica, antes todo, por la “desprivatisación” (la definición de J. Burillo) del Derecho privado y la desaparición real del limite entre el Derecho público y Derecho privado en el fin del Principado y, sobre todo, durante la época del Dominado. El sistema de la terminología jurídica clásica non pudo desaparecer enteramente pero fué vulgarizado muy gravemente, que se puede ver, por ejemplo, analizando los textos del Codigo Teodosiano. Entre las palabras usadas para marcar las infracciones de nuevo se comenzaron de nuevo de usar los scelus, facinus y flagitium, expulsados del léxico jurídico en el periodo clásico.
4. La vulgarisación del latín jurídico y, sobre todo, del parte dél examinada en esta investigación, fué intensificada y acrecentada por la cristianización paulatina de la cultura romana en Europa en general y en la Península Ibérica en particular. La cultura jurídica del Reino Visigodo y de los sus descendientes – los reinos de Asturia y León y, mas tarde, de León y Castilla, – se desarollaba bajo la fuerte influencia de las obras y de las ideas de St. Jeronimo, St. Agustino, St. Gregorio el Magno y por cierto, de St. Isidoro de Sevilla y St. Tajon de Zaragoza. Gracias a todos estos y algunos otros pensadores los conceptos del peccatum y delictum se unieron en uno concepto del pecado del carácter sintético: la prevalencia del peccatum con sus aspectos valorativos y éticos había, como consecuencia, la construcción de las multiples clasificaciones de los peccata y, en mismo tiempo, la expulsión del delictum del léxico jurídico, como mínimo, hasta la época de la recepción del Derecho Común.
5. El reinado del Alfonso X el Sabio se puede caracterizarse como el periodo inicial de la formación de la terminología jurídica romance. La necesidad de su aparición fué condicionada no solamente por las peculiaridades de la política exterior y interior del Rey Sabio, pero también por las exigencias de la práctica jurídica real de León y Castilla. La formación del Derecho nuevo en los cuadros del proceso de la recepción del Ius Commune exigía el nuevo lenguaje profesional. Este lenguaje se desarollaba en dirección a la formalización de los conceptos generalizados y a la construcción de las clasificaciones genéricas de distintas instituciones jurídicas.
Las “Siete Partidas” de Alfonso el Sabio pueden ser consideradas como el monumento del proceso de la recepción del Ius commune pero no del resultado de ésta: como podemos ver, las construcciones jurídicas recibidas en las “Partidas” son, en medida considerable, imperfectas – por ejemplo, en el caso del yerro es posible fijar en el texto todos los requisitos necesarios de este concepto pero no se puede trovar su definición genérica. Lo mismo podemos constatar en quanto a las obligaciones ex delicto.

Consiguientemente antes que investigar la terminología jurídica tuve que examinar la historia del uso de los terminos que me interesaban en los textos de las fuentes narrativas de la época antecedente al Principado, i.e., – de la época de la República Romana. En los textos narrativos del citado periodo se usaron siete terminos principales para denominar la infracción de la ley: delictum, crimen, maleficium, peccatum, facinus, flagitium, scelus. De estos solamente los tres primeros y, en medida cosí inconsiderable, el cuarto, entraron en el lenguaje jurídico del periodo clásico (véase los apéndices 1 y 2). De estas palabras, lá del crimen fué la más técnica, gracias a su uso activo en los textos legislativos de la época de Sulla y del Julio Cesar. El delictum en principios se usaba para designar la transgresión de la ley en general y después – para marcar la infracción civil que daba al demandante el derecho de la exigir los daños y perjuicios al demandado. Las dos palabras restantes – maleficium и peccatum, – se usaron, en su mayor parte, como los sinonimos del crimen y del delictum.
3. Hacia el fin del periodo clásico de la historia del Derecho romano, i.e. cerca de la segunda mitad del s.III, los juristas comenzaron de usar el concepto del delictum en el sentido más amplio y comun, en contrapeso al termino crimen que se usaba para designar las infracciones concretas. Tal cambio en el uso de los terminos que se usaron antes para marcar las infracciones privadas y públicas consiguientemente, se explica, antes todo, por la “desprivatisación” (la definición de J. Burillo) del Derecho privado y la desaparición real del limite entre el Derecho público y Derecho privado en el fin del Principado y, sobre todo, durante la época del Dominado. El sistema de la terminología jurídica clásica non pudo desaparecer enteramente pero fué vulgarizado muy gravemente, que se puede ver, por ejemplo, analizando los textos del Codigo Teodosiano. Entre las palabras usadas para marcar las infracciones de nuevo se comenzaron de nuevo de usar los scelus, facinus y flagitium, expulsados del léxico jurídico en el periodo clásico.
4. La vulgarisación del latín jurídico y, sobre todo, del parte dél examinada en esta investigación, fué intensificada y acrecentada por la cristianización paulatina de la cultura romana en Europa en general y en la Península Ibérica en particular. La cultura jurídica del Reino Visigodo y de los sus descendientes – los reinos de Asturia y León y, mas tarde, de León y Castilla, – se desarollaba bajo la fuerte influencia de las obras y de las ideas de St. Jeronimo, St. Agustino, St. Gregorio el Magno y por cierto, de St. Isidoro de Sevilla y St. Tajon de Zaragoza. Gracias a todos estos y algunos otros pensadores los conceptos del peccatum y delictum se unieron en uno concepto del pecado del carácter sintético: la prevalencia del peccatum con sus aspectos valorativos y éticos había, como consecuencia, la construcción de las multiples clasificaciones de los peccata y, en mismo tiempo, la expulsión del delictum del léxico jurídico, como mínimo, hasta la época de la recepción del Derecho Común.
5. El reinado del Alfonso X el Sabio se puede caracterizarse como el periodo inicial de la formación de la terminología jurídica romance. La necesidad de su aparición fué condicionada no solamente por las peculiaridades de la política exterior y interior del Rey Sabio, pero también por las exigencias de la práctica jurídica real de León y Castilla. La formación del Derecho nuevo en los cuadros del proceso de la recepción del Ius Commune exigía el nuevo lenguaje profesional. Este lenguaje se desarollaba en dirección a la formalización de los conceptos generalizados y a la construcción de las clasificaciones genéricas de distintas instituciones jurídicas.
Las “Siete Partidas” de Alfonso el Sabio pueden ser consideradas como el monumento del proceso de la recepción del Ius commune pero no del resultado de ésta: como podemos ver, las construcciones jurídicas recibidas en las “Partidas” son, en medida considerable, imperfectas – por ejemplo, en el caso del yerro es posible fijar en el texto todos los requisitos necesarios de este concepto pero no se puede trovar su definición genérica. Lo mismo podemos constatar en quanto a las obligaciones ex delicto.
6. El concepto romance yerro es un sinónimo del delictum como este último se usaba en el léxico jurídico del periodo postclásico. Este planteamiento puede ser probado por la coincidencia de las acepciones principales del termino yerro con lás del concepto antecedente – el pecado – por un lado y con las acepciones del termino posterior – el delito – por otro lado. Este, en su turno hace posible y conveniente la investigación del problema de las obligaciones nacidos del yerro en las “Partidas” como la forma recibida de las obligationes ex delicto.
Entre los indicios genéricos del yerro, según los resultados de mi investigación, es posible nombrar la capacidad del sujeto del delito, su mala intención, la realización de la dicha intención y la totalidad de los agravantes distintos para cada delito concreto. Como los indicios específicos de los yerros se pueden ser considerados el objeto y el tipo de la infracción de la ley. La totalidad de estos indicios tan genéricos como específicos permite al investigador de construir la clasificación non-contradictoria y lógica de las transgresiones de la ley descritas en las “Partidas”. "
Still, the historians of religion turn to be more interested in the literal level of the metaphor, for it allows to specify our ideas about the religion of the Greeks, whereas Platonic scholars are more focused on the figurative level, i.e. in what lies “behind” the metaphor. However, the metaphor is not only an embellishment or a parable: to a great extent, it constructs our conception of the philosophical reality. In this regard, the very fact of auto-definition of philosophy in religious terms presents an independent historical and philosophical interest.
This question inevitably leads us to a more general question of the relation between the philosophical and the religious discourses in antiquity. The difference between the two is not reducible to the difference between the "rational" and the "irrational". Philosophers (at least, ancient philosophers) reflect on things divine either arguing with traditional views on what is fitting for god, or re-interpreting them by means of complex hermeneutic procedures. On the other hand, early Christianity naturally embraces philosophy not only as a specific set of theoretical propositions or methods, but also as a way of life oriented towards the true and aimed at the assimilation with God.

So far, we can only publish papers in Russian and in English, but are ready to consider translation into one of these languages for papers submitted in French, Spanish, or German.
Different modes of thinking (being voiced in the academic environment) determine different ways of answers concerning methodology as well as descriptive-positive aspects.
The organizers announce the call for papers addressed those participants who are interested in comprehension of the current processes of the reflection in the history of philosophy and theology; philosophy of language and logic; ontology and gnoseology; philosophy of communication.
The conference will focus on various ways of modeling different philosophic problems trajected through the prism of social and cultural codes, as well as different obstacles in translation from ancient and modern languages, correction and development of the conceptual framework in the humanities.
An interdisciplinary approach allows the Conference to engage different sections of human sciences, particularly, history of literature and language, epistemology, hermeneutics, significant issues of socio-cultural communication, etc. The specialty of the Conference of 2018 will be its orientation towards the History of Concepts (Begriffsgeschichte), as a most relevant for a present-day humanitarian knowledge strategical and methodological guideline.
Our first plenary session named "Understanding ancients, understanding like ancients" will be dedicated to the problem of the ancient philosophical text's interpretation. The philosophical text is a result of multiple interpretations: written fixation of an oral teaching, copying and editing process, translations and scholarly commentaries. These are the stages of the complicated interpretative process which preconditions our understanding of an ancient text. Our awareness of this complexity is therefore necessary for a valid interpretation. Nevertheless, we often tend to approach ancient authors as if they were our school-mates, and carelessly ‘extract’ philosophical doctrines ‘from’ their texts as if these texts were mere ‘containers,' devoid of any philosophical significance. So, the first scope of the plenary session will be to discuss hermeneutical problems related to ‘understanding the ancients.'
As the second part of the title suggests, the ancients themselves paid much attention to the questions of interpretation, so our hermeneutical efforts are inevitably determined, to a greater or lesser degree, by ancient tradition. It is in Antiquity that the question "how to understand" (be that oracles, Plato, the Scripture or ourselves) was formulated for the first time, and we construct our interpretations either in polemics or agreement with the answers given to us. In ‘understanding the ancients’ we are bound to understand ‘like ancients.'
Within the frames of the second plenary session, we propose to discuss the problematics of the History of Concepts and its relations with the Political Philosophy and the History of Political Thought of Russia and Europe from XV to XX cent. Among the possible speakers are Claudio Sergio Nun Ingerflom (CNRS, Paris – CONICET, Buenos-Aires), Constantine Yerusalimsky (RSUH, Moscow) and Michael Velizhev (HSE, Moscow). The third plenary session will traditionally be dedicated to the problems of the correlation between the language, gnoseology, logic, and ontology. The main argument of this year will be the theory of concepts and its principal questions, like the correlation between the formal and substantial, the problem of universals, issue of the "language of thought" etc.
The list of the sections proposed already includes the panels on: a) the problematics of the constitutional power in the Russian political thought of 1890-1917 (moderator - Andrey Teslya);
b) the correlation between the private and public spaces in the same texts (moderators - Liubov Bibikova, Andrey Teslya);
c) the Post-Kantian philosophical debates on knowledge and the dynamization of the a priori in the long 19th century (moderator - Nadia Moro);
d) the transformations of the phenomenon of the Political, change of its properties and limits (moderators - Alexey Salikov, Alexey Zhavoronkov);
e) the modes of speaking about and with demons in the intellectual culture of the Early-Modern Europe (moderator - Olga Togoeva);
f) the philosophy of conscience and the problem of the free will (moderator - Alexander Mishura).
Indeed, this list is open for your suggestions.
The official language of the conference will be Russian and English.

Modern dictionaries and encyclopaedias generally define authority according to Max Weber’s conception as one’s possibility to make another person do something or not to do according to the subject of power’s will, even if it is contrary to his desire. It is a so-called “conative theory of power”. However, this conception is relatively young because it is a product of modern culture. Medieval culture cultivated another view on power and authority based on the Christian (on one side) and the Ancient Roman (on another) foundations. It is worth taking into account also the ideas on power elaborated by non-christian philosophers.
Within this frame, we would like to invite colleagues around the world to provide their perspectives and thoughts about the Medieval and Early Modern conceptions of power and authority. With this proposal, we seek to discuss the principal conceptual models and discursive modes which were used to think of power. We would like to suggest that proposals focus on specific thinkers or jurists (as Bartolo di Sassoferrato, Marsilio di Padua, Giles of Rome, etc.) and their conceptions or development of some theory or concept. The birth of the philosophical conceptions of power is also a subject of particular interest.
