Import/Export L'esportazione è una nozione che contiene al suo interno due aspetti tra loro disti... more Import/Export L'esportazione è una nozione che contiene al suo interno due aspetti tra loro distinti, pur se strettamente correlati: l'aspetto doganale e l'aspetto fiscale Dal punto di vista doganale l'esportazione è un regime a cui viene vincolata la merce destinata a lasciare il territorio doganale comunitario Dal punto di vista fiscale l'esportazione è invece definita dall'articolo 8 primo comma lettere a e b del D.P.R. 633/72 che individua e disciplina le cosiddette cessioni all'esportazione individuando alcuni precisi requisiti che devono essere necessariamente rispettati per poter qualificare una cessione come cessione all'esportazione: • si deve trattare di cessioni di beni e quindi, ai sensi dell'articolo 2 del D.P.R. 633/72, di atti a titolo oneroso che importano trasferimento della proprietà ovvero costituzione o trasferimento di diritti reali di godimento su beni di ogni genere; • i beni ceduti devono essere trasportati fuori dal territorio della Comunità Europea con trasporto a cura o a nome del cedente (art. 8 primo comma lettera a) o a cura e a nome del cessionario non residente (art. 8 primo comma lettera b). In questo ultimo caso (lettera b) l'esportazione si dovrà perfezionare entro novanta giorni dalla consegna; • l'esportazione deve risultare da documento doganale, o da vidimazione apposta dall'ufficio doganale su un esemplare della fattura ovvero su un esemplare della bolla di accompagnamento emessa a norma dell'art. 2 del D.P.R. 6 ottobre 1978, n. 627, o, se questa non e' prescritta, sul documento di cui all'articolo 21, quarto comma, secondo periodo. Documenti da presentare obbligatoriamente: a) fattura commerciale o documento fiscale equipollente; b) documento bancario attestante l'avvenuto pagamento della vendita all'estero (escluso per le cessioni a titolo gratuito); c) dichiarazione di avvenuto smarrimento o mancata restituzione dell'esemplare n. 3 del D.A.U.; d) dichiarazione con cui si attesti che la merce esportata ha raggiunto il Paese terzo di destinazione. e) per trasporti effettuati via mare, copia conforme del contratto di trasporto unico a destinazione di Paese Terzo; f) per trasporti effettuati via aerea copia conforme del contratto di trasporto unico a destinazione di Paese terzo; g) per trasporti effettuati per ferrovia copia conforme del contratto di trasporto unico a destinazione di Paese terzo; h) trasporti effettuati a mezzo posta copia conforme del bollettino postale.
