    In the pages of LA LEY, on February 27, professors Walter F. Carnota and Lucas de Venezia addressed the topic of the use of generative AI by the Judiciary, in particular at the time of sentencing. This raised, in the reader's mind, the issue of its upstream use, for writs not issued by, but intended for, the Judiciary. Indeed, if the reasoning of a legal opinion must identify the Law (Act or precedent) on which it rests, the same is true of any writ submitting claims or raising defenses. A few days later, the lawyer for the plaintiff in Mata v. Avianca unwillingly provided an answer to this question. He presented, on March 1, a document written by a chatbot , in which he cited jurisprudential precedents that had, among other defects, that of being non-existent. The initiative raised a certain number of condescending smiles, but the Federal Judge for the Southern district of New York did not think it was funny.

In this universe, fact and rules on citizenship, immigration and sanctuary leading to a socially preferred equilibrium can be tested—without the unbearable cost to society that enactment without testing would have (We would not want the “confusion, violence and tragic ending” mentioned in the cover of a 2007 recording of La Straniera spilling out into real life.).
