Thesis Chapters by Renata B Giacometti
separated into two moments: (1) historical-legislative from the colonial period until the Federal Constitution of 1988, aiming to understand the dynamics of formation of the Brazilian State; (2) historical-legislative from the Federal Constitution from 1988 to the present (2021), focusing on territorial and social rights, aiming to ascertain the presence or absence of
indigenous political autonomy. Based on three approaches, the research goes on to survey the existence or not of political autonomy of Brazilian indigenous peoples. The first approach aims to demonstrate the existence of an economic rationality that directly impacts indigenous territories, based on decolonial and post-developmental theory. The second, the existence of a conflicting power of the Brazilian State in relation to indigenous peoples. The third, the existence of symbolic norms which would be elaborated only to appease social aspirations without effective application in the concrete world. In conclusion, a logic in the formation of
the Brazilian State through economic rationality that permeates our current development model remained evident, going beyond the right-left dichotomy; it was also observed that the indigenous movement can be considered a thought and articulated social movement of political autonomy; finally, the historical survey of indigenous legislation in the period (from 1988 to 2021) demonstrated a repeated attempt to expropriate indigenous territorial rights, suggesting the existence of symbolic norms, as well as advances and setbacks in relation to
the social rights of that same group.
