Yenny Vega Cárdenas
Yenny Vega Cárdenas is President of the International Observatory on the Rights of Nature, Expert member of UN Harmony with Nature chapter, and Special rapporteur in the Research project conducted by the Max Plank Institute on Rights of Nature, Globalization and Legal Pluralism.
She has been involved in the recognition of Rights and Personhood to the Magpie River, first in Canada’s history.
Lawyer in Quebec (Canada) and in Colombia, with a Master's degree in Business Law and a Ph.D. in Water Law in North America from a Canadian University, she teaches Public International Law, Water & Governance and Comparative Law at numerous Universities in Canada and Latin America.
As a researcher in the Global Justice & Human Rights project, she has conducted extensive research in the field of Water Law and the Human Right to Water and Sanitation. She has published several scientific articles in English, French and Spanish and is often invited to participate in national and international conferences related to water issues.
She co-directed recently a multilingual collective book related to the recognition of Nature and Rivers as subject of Rights. “A personhood and Rights for the Saint-Lawrence River and other rivers of the world”.

extractive economies do not contribute positively to the eradication of poverty, discrimination and inequality. On the contrary, these problems seem to worsen in such economies, increasing the levels of corruption, inequality and violence. While advocates of these activities emphasize the advantages of developing extractive industries, their critics underline the environmental, political and social consequences of this industry. It is undeniable, however, that the main cause of social and environmental conflicts in the world, including the violation of fundamental, cultural and environmental rights, is the commodification and exploitation of nature. The global character of extractive industries demands a more comprehensive theory of justice that considers the global challenge
and state sovereignty, as well as the complexity that characterizes this type of problem in terms of space, time, agents and subjects. Political philosophers, mostly Anglo-American, have developed various theoretical approaches to global justice that refer to development, redistribution, environmental protection, solidarity, responsibility, the protection of human rights and equity.
This article seeks to analyze the extent to which the concept of global justice can contribute to a better understanding and resolution of socio-environmental conflicts related to extractive industries.

En segundo lugar, además de clasificar y de presentar los diferentes métodos que se han venido desarrollando en Derecho Comparado, ofrece consejos prácticos de cómo hacer una investigación comparativa.
Dada la falta de literatura de lo que sería un aperçu général de los diversos métodos existentes y de los procedimientos o pasos que se sugieren seguir, el presente libro tiene como objetivo el plantear caminos de ruta para los investigadores que quieren desarrollar trabajos científicos comparados.
En tercer lugar, el presente texto tiene igualmente como objetivo, el de ir más allá del método funcional y del escepticismo metodológico que reina en la actualidad al respecto. Busca establecer una guía clara, en lo posible, para aquellos que buscan modelos o herramientas al momento de construir un análisis comparativo del Derecho.
El texto contribuye a la unificación y edificación del desarrollo de una metodología del Derecho Comparado.
El investigador podrá, en consecuencia, escoger qué método se adecua más a los objetivos que persigue con su estudio (para qué se hace, qué se pretende hacer, a dónde se quiere llegar), pero también de la materia misma de investigación, del nivel de profundidad y de detalle con que se tratarán los temas (macro o micro comparación) y del número de sistemas que se compararán.
El presente manual se divide en tres partes. La primera, relacionada con los aspectos epistemológicos de la metodología del Derecho Comparado; la segunda parte, trata en detalle cada una de las posturas o métodos que se han venido desarrollando en Derecho Comparado, y la tercera parte, los pasos generales metodológicos que un investigador debe desarrollar para emprender estudios comparativos.
