Marta Torre-Schaub is a jurist specialised in Environmental Law and more particularly Climate Change Law from a wide and pluridisciplinary prospect. She is a Senior Professor Researcher at the French National Center of Scientific researches (CNRS) at the Université Paris 1-Sorbonne Institut de sciences juridique et philosophiques de la Sorbonne. She teaches the Environmental Law Courses at the Master of Environmental Law and Sustainable development at Paris 1-Sorbonne University. She leads a Research Program Joint Project on Climate Change Law and Climate Justice with the Sabin Center for Climate Change Law at Columbia University and a Research Program supported by the Mission Droit et Justice (Department of Justice in France) about Climate Change Justice Litigation. She is an apointed expert at the Agence Nationale de la Sécurité Sanitaire de l’alimentation, de l’Environnement et du travail on phytosanitary questions. She is the Founder and Director of a Researchers' Network on « Climate Change Law ». She is the author of several books, essaies, articles and reports. His main books are : « Essai sur la construction juridique de la catégorie de marché » published at LGDJ, Paris en 2002 with the award of PHD Dupin Aîné of the Chancellerie des Universités

Il s'agit également, si l'on suit les définitions les plus courantes, d'une aisance matérielle qui per-met une existence agréable 1. Prenant la notion à rebours et non sans une provocation certaine, Ambrose Bierce, dans son Dictionnaire du diable, le défini comme l'« état d'esprit produit par la contemplation des ennuis d'au-trui 2 ». Notre tâche ici, consistant à explorer des pistes afin de saisir le bien-être du point de vue du droit, nous conduit à nous écarter de ces sens et à ne pas nous satisfaire des chemins qu'ils pourraient ouvrir : la première par son incomplétude, la deuxième par son cynisme évident. Aussi, la question du bien-être appréhendée sous un angle juridique sur-prend-t-elle forcément, tant les juristes semblent peu s'intéresser à ce qui apparaît a priori comme un domaine du non-droit. Pour l'essentiel la notion du bien-être a été réservée aux études philosophiques, dans la recherche d'un meilleur accomplissement de l'homme, ou au domaine de l'écono-mie, dans la recherche notamment d'utilités à l'homme 3. À cela s’ajoute l’inexistence de règles de responsabilité fermes et précises, suffisamment punitives. Dans ce contexte, la notion de justice climatique est très mobilisée. Mais elle n’est pas suffisamment bien définie et donc peu opérationnelle. Parallèlement, on observe la montée d’un contentieux climatique, qui semble être le volet « justiciabilité » de la justice climatique, dans lequel la société civile se saisit du droit et le mobilise devant des institutions judiciaires.

Economic instruments have been internationally recognized as the best way to find a response to climate change. Under the Kyoto Protocol, the European Community and its members States can agree to meet their commitments jointly. The UK Climate Change Program sets out the principles and the administrations?' strategies for tackling climate change. In terms of costs and benefits, the UK Trading Permits Climate Change Scheme is one of the most performant schemes in Europe and probably in the world. This explains the genesis of the UK scheme and how it works. The legal mechanism of this scheme could be a guide and an example for an efficient European program against climate change. The UK scheme seeks to maintain competitiveness of the industries concerned. However, although in economic terms it seems to be an efficient combination of incentive subsidies with the allocative virtues of a market mechanism, it has considerable transaction costs, in particular costs of control, and its legal rules frequently are indeterminate. Yet, this need not be a disadvantage as it allows the system to evolve and to adapt itself to changes of circumstances and of the legal environment.

In light of recent jurisdictional developments, this article underlines the links between legislation, litigation, and public policies to trace ways, progress and obstacles to face it. Those emergent dynamics contribute to build a lasting and sustainable climate change legal regime. Intertwining the different climate disputes in the world and the progress made through the elaboration of different climate laws allow to have a panoramic visibility on this new mode of climate governance which appears in filigree today all over the world and especially in France.

Cette manifestation se pose comme une réflexion collective autour des changements climatiques et du droit. Le colloque propose cette thématique de réflexion afin : - de permettre à tous ceux qui souhaitent y participer de proposer une intervention sur le sujet ; - de poser un regard à la fois critique et constructif sur les rapports qu’entretiennent le droit et les changements climatiques ; - de faire remonter des nouvelles thématiques autour des changements climatiques et du droit ; - d’échanger nos différents points de vue et d’alimenter les réflexions dans une perspective tournée vers l’avenir. Autour de la thématique des relations entre le droit et les changements climatiques, le colloque posera les questions suivantes : - Comment réinterroger le droit à partir des changements climatiques ? - Quels nouveaux paradigmes juridiques posent les changements climatiques ? - Quels instruments juridiques existent aujourd’hui ? Programme du Séminaire 19 octobre 2017 dans le cadre du Cycle de séminaires co-dirigés par Marta ... more Programme du Séminaire 19 octobre 2017 dans le cadre du Cycle de séminaires co-dirigés par Marta Torre-Schaub et Blanche Lormeteau sur Mobilisation du droit, société civile et environnement. Ce cycle de séminaires a pour objectif de favoriser les rencontres entre membres de la société civile et des universitaires (juristes, politistes et sociologues) autour de la mobilisation du droit par les ONG, sous l’aspect des pratiques juridictionnelles et dans une dynamique plus générale de « fabrique » du droit. Les séminaires seront pluridisciplinaires. L’apport d’autres sciences (humaines et sociales) dans cette démarche de réflexions sera enrichissant et nourrira le raisonnement juridique. Les pratiques sociales et militantes inspirées par la mobilisation du droit ainsi restituées, engageront une circulation de savoirs entre « acteurs » de la société civile et de la recherche. Ces séminaires constitueront un espace de réflexion collective visant à engager un dialogue croisé alimentant tant les réflexions de la doctrine juridique que les répertoires d’action de la société civile et les activités des praticiens du droit (avocats et magistrats). Ce cycle de séminaire s’inscrit dans le cadre du projet GIP Justice portant sur Les dynamiques du contentieux climatique : usages et mobilisation du droit face à la cause climatique.

L'Accord de Paris met en place un processus pour tenter de préserver l'avenir mais également le p... more L'Accord de Paris met en place un processus pour tenter de préserver l'avenir mais également le présent de la planète. Cependant, cet Accord ne doit pas être lu comme un objet isolé, séparé du mouvement dans lequel il s'insère, il convient de le situer dans « un mouvement sans lequel il n'existerait pas ». Il « n'est pas à lui-même sa propre finalité, mais fait partie d'un processus qui doit être régulièrement actua-lisé ». L'Accord de Paris se pose ainsi comme un texte en mouvement, un texte évo-lutif et non comme une fin en soi. L'Accord en lui-même peut quelque peu décevoir car il ne pose pas d'obligation juridique à proprement parler et, parce qu'il laisse toute initiative dans les mains, des actions volontaires, des pays signataires. Mais nous n'avons pas voulu rester sur cette lecture et nous avons voulu aller en deçà du texte afin de mieux comprendre d'une part d'où il vient et d'autre part l'étendue du mouvement dont il fait partie. Il semblait ainsi important de poser la question de la portée juridique de l'Accord de Paris et de ses suites. Mais pour bien saisir les différentes perspectives d'avenir de l'Accord, il fallait d'abord faire un bilan de ce qu'il contenait et, surtout, de la manière dont il avait été préparé en amont, depuis 2011 lors de la COP à Durban. Les perspectives de l'Accord de Paris peuvent ainsi s'annoncer prometteuses à l'égard de trois questions essentielles : en premier lieu, la question de la solidarité entre pays développés et en voie de développement, deuxièmement, la question de la coopération entre les États et le secteur privé et enfin, la question de la responsa-bilité vis-à-vis du changement climatique. Ces trois notions, si elles apparaissent en filigrane dans l'Accord, n'en sont pas moins présentes et se résument bien dans une notion clé qui émerge dans le Préambule : celle de Justice climatique. La justice cli-matique, concept pas encore bien défini mais qui aurait un pendant pragmatique et opérationnel, concrétisé par l'émergence d'un contentieux climatique un peu par-tout dans le monde. Autant de notions, on le voit, qui apparaissent, se réajustent, évoluent afin de mieux adapter le droit à la contrainte climatique. Cet ouvrage s'interroge ainsi sur l'émergence de nouveaux concepts dans le sillage de l'Accord ainsi que sur l'avenir des dynamiques ainsi créées. Sous la direction de Marta Torre-Schaub, cet ouvrage résolument interdisciplinaire, réunit des grands spécialistes du changement climatique et des négociations in-ternationales en matière environnementale, pour poser leurs regards croisés sur l'Accord de Paris à partir du droit, de la philosophie et des sciences du climat.

Prolongeant et élargissant les réseaux ID, ce nouveau programme de recherche s'inscrit aussi dans le cadre d'une coopération entre le Collège de France et la Fondation Charles Léopold Mayer (recherche « Prendre la responsabilité au sérieux ») et pourrait se développer en relation avec d'autres institutions, comme par exemple l'Academia Sinisa de Taiwan qui mène une recherche sur les « Hybrid Legal Regimes : the case of Taiwan ». Objectifs et méthode Ayant pour ambition d'esquisser, à la lumière du passé et du présent, les conditions de développement d'un futur droit commun, nous proposons d'adopter une méthode dynamique qui considère les pratiques de droit commun comme des processus transformateurs rapprochant les divers systèmes juridiques sans nécessairement les fusionner. Ces processus se sont développés à diverses époques et dans diverses régions du monde. Leur réapparition par fragments dans le sillage de la mondialisation suggère-t-elle la possibilité d'un droit commun mondial sinon universel, du moins « universalisable » ? Pour répondre, nous proposons trois objectifs à cette recherche.

Les differentes contributions ici recueillies montrent l’importance de poser la question climatiq... more Les differentes contributions ici recueillies montrent l’importance de poser la question climatique en termes de responsabilité juridique. Mais la responsabilité, telle qu’elle existe aujourd’hui, si elle est bien un outil essentiel au service de la lutte et de l’adaptation au changement climatique, se voit « interrogée », voire « bousculée », tel un curseur, par les modifications que le changement climatique oblige d’opérer dans le droit. Ce dossier revisite ainsi la responsabilitéjuridique, à la fois en tant que mécanisme du droit mais également en tant qu’institution elle-même, dans l’objectif d’observer ses mutations et les nouvelles normativités qu’elle fait émerger dans le droit actuel.

Les séminaires seront pluridisciplinaires. L’apport d’autres sciences (humaines et sociales) dans cette démarche de réflexions sera enrichissant et nourrira le raisonnement juridique. Les pratiques sociales et militantes inspirées par la mobilisation du droit ainsi restituées, engageront une circulation de savoirs entre « acteurs » de la société civile et de la recherche. Ces séminaires constitueront un espace de réflexion collective visant à engager un dialogue croisé alimentant tant les réflexions de la doctrine juridique que les répertoires d’action de la société civile et les activités des praticiens du droit (avocats et magistrats). Ce cycle de séminaire s’inscrit dans le cadre du projet GIP Justice portant sur Les dynamiques du contentieux climatique : usages et mobilisation du droit face à la cause climatique.
