ABSTRACT India has a long history of economic linkages with the EU member states. In recent perio... more ABSTRACT India has a long history of economic linkages with the EU member states. In recent period, the volumes of Indo-EU trade both in case of merchandise products and services have considerably increased and a number of investment collaboration opportunities are emerging. Since 2007 the two sides are engaged in the negotiations on concluding a Bilateral Trade and Investment Agreement (BTIA), which is expected to augment the present level of economic exchange further. Once completed in coming months, the BTIA will be the biggest trade agreement involving India, surpassing its earlier RTA with the ASEAN countries. However, while EU and India can collaborate in several spheres, the potential conflict of interest may not be uncommon either. In particular, the provision of farm subsidies offered by the EU to local producers, imposition of anti-dumping measures on several Indian export categories in EU markets, barriers on movement of professionals, EU interest in inclusion of several WTO-Plus provisions in the agreement etc. are among the concern areas of India. By looking at the trade data and the negotiating dynamics, the present analysis attempts to understand the challenges and opportunities for India in the EU market. The paper concludes that India needs to focus on augmenting its competitiveness for benefiting from the integration exercise.

Since joining the EU, the analyzed countries have developed ODA legislation and an institutional framework and increased financing in development co-operation. Being a member of the EU and DAC, all V4 countries also have their legal and financial obligations in the area of development co-operation. The shared experience of those countries in creating and implementing their development policy gives reason to investigate their aid systems, development policy challenges and implementation of their commitments as a group of donors. The chapter presents the chronological evolution of the common commercial policy (CCP) over the d... more The chapter presents the chronological evolution of the common commercial policy (CCP) over the decades of European integration since the Treaty of Rome to the latest modifications embodied in the Lisbon Treaty. The policy is considered as one the most “European” and “common” among all activities realized within the EU, thus presenting strongly internal and external aspects of integration in the European continent. The shape of the policy has resulted from relevant provisions concerning the principles of the commercial policy, contained in both primary and secondary law, and in broader terms, from the concepts of the integration process, primarily a customs union and common market. Over recent decades the CCP has been evolving from a customs union created by countries of the EEV to the complex policy of economic relations with the rest of the world. The scope of the policy has changed several times, adapting to the global economic environment and challenges appearing both within and outside the EC/EU. The primary core of the policy encompassed only trade in goods, while new treaties in the 1990s, and especially the Lisbon Treaty, extended the definition of commercial policy to such aspects as trade in services, commercial aspects of intellectual property rights and investments. The final shape of the policy is a result of consensus, achieved with strong difficulties between the Commission, favoring a wide and dynamic interpretation of the CCP scope on the one hand and the EC/EU Member States, stressing the need of individual national control over the policy actions on the other. The supportive role in the shaping of the policy was played by the European Court of Justice through its historic and crucial opinions. Nowadays, the policy, as defined in the Treaty of Lisbon, is largely considered to be a relatively comprehensive platform of the EU economic relations with third countries and other international economic organizations.
In 2013 the European Union and Japan launched negotiations on a new trade and economic agreement,... more In 2013 the European Union and Japan launched negotiations on a new trade and economic agreement, of which the strategic aim is to create a free trade area between the parties (EU-Japan FTA). The new comprehensive agreement should include a broad spectrum of economic issues not only traditionally relating to tariffs, trade in goods and services, but also more broadly to non-tariff barriers and trade procedures, FDI, IPR, competition policy, public procurement, etc. For the EU the negotiations and agreement are an opportunity to improve openness of the Japanese market for European exporters and investors and to abandon many non-tariff barriers that have a burdensome effects on trade and investments. The general objective of the paper is to identify main barriers/challenges for European enterprises in access to the Japanese market for European goods, services and investments. The conducted analysis brings the following general conclusion: the existing barriers are mostly non-tariff barriers (there are relatively low tariffs for goods imported to Japan from the EU), which are both the biggest challenge for EU negotiators in improving access to the Japanese market and one of the main stumbling blocks slowing down the progress of the whole EU-Japan FTA negotiations.

Firstly, the article presents briefly South Korea as a trade and economic partner in the present global economy as well as bilateral EU–Korean economic co-operation. Subsequently, it concentrates on strategies and motives of both partners for starting negotiations on a new FTA. It also presents main commitments included in the agreement concluding with the general impact of the FTA on the EU and South Korea.

Celem tych rozmów jest wynegocjowanie kompleksowych umów handlowych ustanawiających między stronami strefy wolnego handlu nowego typu. W 2013 r. UE rozpoczęła rokowania na ten temat z Japonią – jedną z największych światowych gospodarek i ważnym partnerem gospodarczo--handlowym UE na kontynencie azjatyckim. Umowa ta jest zaliczana do grupy tzw. porozumień megaregionalnych, obejmujących swoim zasięgiem partnerów o dużym potencjale gospodarczym i mających znaczący wpływ na globalne przepływy handlowe i inwestycyjne. Negocjowane porozumienie jest kolejnym, po Korei Południowej i Singapurze, które ma być zawarte z wysoko rozwiniętym krajem azjatyckim. Dla Japonii umowa ta będzie okazją do zmniejszenie ceł w dostępie do europejskiego rynku dla swoich produktów przemysłowych i zapewnienia sobie niedyskryminacyjnego dostępu do rynku UE, szczególnie w kontekście rosnącej presji konkurencyjnej ze strony tych krajów, które już wynegocjowały podobne umowy. Z kolei dla Unii Europejskiej negocjowane porozumienie jest szansą na szersze otwarcie japońskiego rynku i zniesienie wielu barier pozataryfowych utrudniających dostęp i funkcjonowanie europejskich eksporterów i inwestorów na japońskim rynku. Celem artykułu jest identyfikacja najważniejszych wyzwań w zakresie zwiększenia dostępu do japońskiego rynku dla europejskich towarów, usług oraz inwestycji. W artykule podjęto próbę przedstawienia najważniejszych barier w dostępie do rynku Japonii z perspektywy europejskich przedsiębiorstw, co automatycznie pozwala na zestawienie najważniejszych wyzwań, przed jakimi stoją negocjatorzy KE.

The dynamic expansion of regionalism in the world trade system has induced a wide debate on its i... more The dynamic expansion of regionalism in the world trade system has induced a wide debate on its influence of multilateral agreements. It has also become an enormous challenge for the European common commercial policy (CCP) which task is to position the European Union optimally in the world trade system. In this context the noticeable change of ideology and approach to the shape of the EU’s common commercial policy may be observed. The originally declared attachment to multilateral agreement (so called “Lamy doctrine”) is gradually being replaced by a new approach, emphasizing the importance of the regional dimension of the EU trade policy (Global Europe). This way, the European Union joined the process of regionalisation of trade observed around the world.

We wrześniu 2014 r. przedstawiciele Unii Europejskiej oraz Kanady zaprezentowali oficjalnie tekst Kompleksowej umowy gospodarczej i handlowej (Comprehensive Trade and Economic Agreement – CETA). Nowa umowa jest kolejnym dwustronnym porozumieniem o wolnym handlu wynegocjowanym przez UE, w tym pierwszym z krajem należącym do grupy G-7. Negocjacje nad nową umową trwały pięć lat. Wśród najważniejszych kwestii spornych znalazły się m.in. eksport europejskich serów do Kanady i eksport kanadyjskiej wołowiny na rynek UE. Zgodnie z umową, najpóźniej w ciągu siedmiu lat od jej wejścia w życie, bezcłowy handel powinien objąć wszystkie towary przemysłowe i rybołówstwa oraz większość produktów rolnych. Porozumienie, oprócz głębokiej liberalizacji handlu towarami i usługami, reguluje także kwestie dostępu do sektora zamówień publicznych i bezpośrednich inwestycji zagranicznych, w tym wzajemną ochronę inwestycji. Szczególnie ta ostatnia kwestia budzi w dalszym ciągu sprzeciw niektórych środowisk i polityków, co może negatywnie wpłynąć na proces ratyfikacji i opóźnić moment wejścia w życie nowego porozumienia.

Comprehensive Economic and Trade Agreement – a New Dimension of the European Union’s Relations with Canada
In September 2014, the representatives of the European Union and Canada officially announced the final text of Comprehensive Economic and Trade Agreement – CETA. The new document is the EU subsequent bilateral free trade agreement, and the first concluded with a G-7 country. The negotiations between the Parties took five years. Among the most contentious issues were exports of European cheese to Canada and exports of Canadian beef to the EU. According to the agreement, all trade in manufactured foods and fisheries and almost all trade in agricultural products will be liberalised within maximum seven years since the entry of the agreement into force. The agreement, apart from the deep liberalisation of trade in goods and services, includes among others provisions on public procurement and foreign direct investment, together with investment protection standards. The latter regulation has been especially controversial and is still contested by some organisations and politicians, what may adversely affect the ratification process and delay the entry of the agreement into force.

Akcesja państw z Europy Środkowej i Wschodniej do Unii Europejskiej w 2004 i 2007 r. była momentem, w którym przed tymi krajami otworzyły się nowe możliwości w zakresie dalszego rozwoju. Pełne członkostwo we Wspólnocie oznaczało dla tych krajów dostęp do wsparcia zachodzących w tych krajach procesów modernizacji gospodarczej i społecznej. Członkostwo to wiązało się jednocześnie z przyjęciem szeregu nowych zobowiązań. Jednym z takich obszarów, w których państwa UE-10 przyjęły na siebie nowe zobowiązania, było wsparcie na rzecz rozwoju najuboższych krajów na świecie. Włączenie do Unii Europejskiej, będącej największym w skali świata dostarczycielem pomocy rozwojowej, oznaczało dla krajów UE-10 konieczność stworzenia odpowiedniego systemu prawno-instytucjonalnego, jak również nałożyło szereg zobowiązań w zakresie zwiększenia środków finansowych przekazywanych na te cele zarówno poprzez instrumenty unijne (budżet UE, Europejski Fundusz Rozwoju – EFR), jak i w wymiarze dwustronnym. Zdobycie statusu pełnoprawnego członka UE oznaczało jednocześnie dla państw UE-10 konieczność przyjęcia celów i zasad zdefiniowanych w ramach wspólnotowej polityki współpracy rozwojowej (development policy). Celem artykułu jest przedstawienie udziału państw UE-10 w unijnej polityce na rzecz wspierania rozwoju. Artykuł składa się z czterech części. Na wstępie opisano ogólne założenia polityki rozwojowej UE. Następnie przedstawiono miejsce Unii oraz jej państw członkowskich w globalnym systemie pomocy rozwojowej. W części trzeciej scharakteryzowano najważniejsze wyzwania, z jakimi musiały się zmierzyć państwa UE-10 w pierwszej dekadzie swojego członkostwa w odniesieniu do kształtowania i zarządzania w tym obszarze. Ostatnia część jest poświęcona analizie podstawowych danych dotyczących pomocy rozwojowej przekazywanej przez kraje UE, z uwzględnieniem kontekstu polityki rozwojowej całej Unii Europejskiej.

Dynamiczny rozwój indyjskiej gospodarki, jak również wysoki poziom ochrony krajowego rynku, sprawiają, że kraj ten jest jednym z priorytetowych partnerów handlowych, z którymi Unia chce zawrzeć dwustronną umowę SWH. Nowe porozumienie powinno regulować nie tylko zasady obrotu towarowego, ale także wzajemny dostęp do rynku usług, zasady przepływu inwestycji, politykę konkurencji oraz kwestie odnoszące się do prawnej ochrony własności intelektualnej. Mimo składanych już kilkukrotnie deklaracji, toczących się od ponad pięciu lat rokowań nie udało się jak dotychczas zakończyć. Wśród najważniejszych kwestii spornych, stojących na drodze do osiągnięcia ostatecznego porozumienia, znalazły się: dostęp europejskich samochodów do indyjskiego rynku, produkcja leków generycznych w Indiach, liberalizacja sektora usług czy dostęp dla europejskich firm do indyjskiego rynku zamówień publicznych. Wskazane trudności uniemożliwią zapewne osiągnięcie porozumienia przed końcem 2012 r., co deklarowały dotychczas obydwie strony.
"India as a Strategic Partner of the European Union – towards a Free Trade Agreement"
In 2007, the European Union started together with the Republic of India negotiations on the creation of free trade area. Dynamic development of the Indian economy as well as a relatively high level of domestic market protection in relations with the EU makes the country one of the priority partners for concluding a new bilateral free trade agreement. The agreement should regulate not only trade in goods, but also reciprocal access to the service sectors, foreign direct investments, competition policy as well as issues related to intellectual property rights. Despite the previously declared deadlines, the negotiations are still ongoing. There are many contentious issues occurring during negotiations. The most important and destructive for the negotiations are: an access for European car producers to the Indian market, production of generic medicines in India, liberalisation of trade in services as well as an access for European companies to the Indian market of public procurement. The mentioned contentious issues probably make the final agreement unlikely by the end of 2012.

W czerwcu 2012 r. Unia Europejska podpisała z sześcioma państwami Ameryki Środkowej (Gwatemala, Honduras, Kostaryka, Nikaragua, Panama i Salwador) układ o stowarzyszeniu, zawierający kompleksowe regulacje w dziedzinie współpracy politycznej i rozwojowej oraz wymiany handlowej. Nowa umowa zakłada m.in. utworzenie pomiędzy partnerami strefy wolnego handlu. Postępujący proces ratyfikacji sprawił, że w ostatnich miesiącach wchodziła w życie stopniowo w poszczególnych krajach część handlowa umowy stowarzyszeniowej. Zgodnie z przyjętą umową, w ciągu 10 kolejnych lat bezcłowy handel powinien objąć większość towarów przemysłowych i produktów rybołówstwa. Liberalizacji ulegnie także handel artykułami rolnymi (szczególnie po 6-letnim okresie przejściowym). W umowie przewidziano przy tym dodatkowe preferencje dla krajów Ameryki Środkowej w zakresie eksportu bananów na rynki państw UE. Umowa zakłada także usuwanie barier pozataryfowych oraz reguluje, zgodnie z aktualnym podejściem UE, takie zagadnienia jak: handel usługami, ochronę własności intelektualnej, bezpośrednie inwestycje zagraniczne, kwestie zamówień publicznych i politykę konkurencji. Nowe porozumienie jest istotne dla obydwu stron z uwagi na zmiany (od 1 stycznia 2014 r.) w powszechnym systemie preferencji celnych UE (GSP), jak również szereg zawartych i negocjowanych przez państwa Ameryki Środkowej dwustronnych umów handlowych z krajami trzecimi.

Association Agreement between the European Union and Central America
In June 2012, the European Union signed with six countries of Central America (Costa Rica, Guatemala, Honduras, Nicaragua, Panama, El Salvador) the Association Agreement, including comprehensive regulations on political dialogue, development cooperation and trade. The new agreement inter alia establishes the free trade area between the parties. Last months of the ratification process have resulted in implementing the trade pillar of the agreement in all countries of the Central America region. According to the agreement, almost all trade in manufactured goods and fisheries should be eliminated within ten years. Trade in agricultural products will be also highly liberalised (especially after the six-year transition period). The agreement also includes additional preferences for CA countries in exporting bananas to the EU market as well as regulations on the abolition of non-tariff barrier. It also regulates, in line with the current EU trade strategy, issues such as trade in services, intellectual property rights, foreign direct investments, public procurement, and competition policy. The new agreement is also important for both parties in the context of modifications in the EU’s Generalised System of Preferences (to be implemented starting the 1 January 2014) as well as a series of concluded and negotiated by the CA countries bilateral trade agreements with third countries.

Relacje EWG/UE z krajami AKP sięgają samego początku integracji europejskiej, będąc niejako naturalnym następstwem kolonialnej przeszłości wielu państw europejskich. Rozpoczynając formalną współpracę na podstawie traktatu rzymskiego, poprzez zawierane na przestrzeni lat kolejne umowy, obydwie strony doszły do kolejnego ważnego momentu w kształtowaniu wzajemnych relacji, jakim było podpisanie w 2000 r. Umowy o partnerstwie z Kotonu. Jednym z fundamentalnych założeń nowego porozumienia było wynegocjowanie umów o partnerstwie gospodarczym (UPG) na poziomie poszczególnych regionów AKP, które począwszy od 1.01.2008 r. miały stać się prawną podstawą współpracy gospodarczo-handlowej. Wiele kwestii spornych, które wyniknęły podczas toczących się negocjacji (tempo i zakres liberalizacji, stosowanie KNU, handel usługami, „kwestie singapurskie”) uniemożliwiło osiągnięcie porozumienia w założonym czasie. Spośród regionów jedynie państwa Karaibów podpisały z UE pełną UPG w założonym czasie. Wiele innych państw AKP, które pierwotnie parafowały treść przejściowych UPG w dalszym ciągu ich nie podpisało lub nie ratyfikowało. W tej sytuacji (wrzesień 2011 r.) Komisja Europejska przedstawiła nową propozycję, która ma uporządkować pozostający w zawieszeniu od prawie 4 lat układ. Wydaje się prawdopodobne, że w obliczu obecnej sytuacji na świecie (kryzys gospodarczy oraz problemy z zakończeniem rundy dauhańskiej) wynegocjowanie pełnych UPG ze wszystkimi regionami AKP będzie trudne i odległe w czasie.
The EU Economic Partnership Agreements with ACP Countries – a New Dimension or an Uncompleted Concept?
The EU-ACP relations have a long historical perspective relating to the legacy of colonialism. The evolution of the relations, starting formally with the Treaty of Rome, is currently at another milestone. In 2000, a new agreement was concluded - the Cotonou Partnership Agreement - that is a legal basis of relations between the EU and ACP countries until 2020. Parallel the parties started negotiations on the Economic Partnership Agreements (EPAs) in regional configuration that should, according to primary assumptions, create between the partners a free trade area in the future perspective. The preliminary deadline for concluding the EPAs (1 January 2008) has not been achieved. Many contentious issues that occurred and were highlighted during the long negotiation process (pace and scope of trade liberalisation, MFN clause, trade in services, “Singapore issues”) have made impossible to achieve a final agreement. Among the seven ACP regions that negotiate the EPAs only the Caribbean region has concluded and signed so far a full regional Economic Partnership Agreement. There are still even problems with signing and ratifying interim EPAs by those countries, which preliminary initialled the agreements. The current global processes (economic crisis and problems with concluding DDA) make the process of negotiations more difficult than ever.

Źródłem problemów jest nie tylko ostatni kryzys finansowy, lecz również: niekorzystny kierunek zmian struktury demograficznej ludności (starzenie się społeczeństwa), wzrastające zanieczyszczenie środowiska i zmiany klimatyczne, migracje spoza Unii, terroryzm, handel narkotykami, wykluczenie społeczne związane w istotnym stopniu z bezrobociem, bezpieczeństwo energetyczne, nadmierne zadłużenie sektora finansów publicznych, niewystarczająca innowacyjność gospodarki itd. Dodatkowo przedłużające się oczekiwanie na wyraźne ożywienie gospodarcze i rozwiązanie największego problemu społecznego, jakim jest bezrobocie, wywołuje kolejne niekorzystne zjawiska, takie jak rosnące nastroje antyeuropejskie i kryzys wewnętrznej solidarności będącej podstawą istnienia i funkcjonowania Unii. Źródłem problemów jest nie tylko ostatni kryzys finansowy, lecz również: niekorzystny kierunek zmian struktury demograficznej ludności (starzenie się społeczeństwa), wzrastające zanieczyszczenie środowiska i zmiany klimatyczne, migracje spoza Unii, terroryzm, handel narkotykami, wykluczenie społeczne związane w istotnym stopniu z bezrobociem, bezpieczeństwo energetyczne, nadmierne zadłużenie sektora finansów publicznych, niewystarczająca innowacyjność gospodarki itd. Dodatkowo przedłużające się oczekiwanie na wyraźne ożywienie gospodarcze i rozwiązanie największego problemu społecznego, jakim jest bezrobocie, wywołuje kolejne niekorzystne zjawiska, takie jak rosnące nastroje antyeuropejskie i kryzys wewnętrznej solidarności będącej podstawą istnienia i funkcjonowania Unii. Tym i wielu innym problemom stojącym przed poszczególnymi państwami oraz przed całą Unią Europejską poświęcona była konferencja „Unia Europejska wobec wyzwań przyszłości" zorganizowana przez Katedrę Europeistyki Uniwersytetu Ekonomicznego w Poznaniu w ramach Centrum Doskonałości Jeana Monneta w kwietniu 2015 roku. Przedstawione w tej publikacji referaty dotyczą szerokiej gamy aspektów instytucjonalnych, społecznych, gospodarczych, środowiskowych, prawnych, finansowych i handlowych. Zawarte w poszczególnych tekstach wnioski, poza walorem poznawczym i naukowym, mogą też zostać wykorzystane w podejmowanych w różnych miejscach i przez różne gremia decyzjach - co stanowi wymiar praktyczny niniejszej książki.

Na przestrzeni kolejnych dziesięcioleci stosunki z tymi krajami ulegały jednak silnym przeobrażeniom. Zmiany modelu wzajemnej współpracy dokonywane były przede wszystkim w oparciu o zmieniające się koncepcje rozwoju najbiedniejszych państw, próby zdynamizowania gospodarczego państw rozwijających się, odpowiednie zabezpieczenie wzajemnych interesów, ale także jako odpowiedź na niepowodzenia wcześniej realizowanych strategii. Książka ma na celu przedstawienie ewolucji stosunków pomiędzy Unią Europejską a krajami Afryki, Karaibów i Pacyfiku (AKP). Zrozumienie zmieniającego się modelu współpracy pomiędzy obydwoma partnerami, jak również próby zakreślenia kształtu wzajemnych relacji w przyszłości, są kluczowymi elementami niezbędnymi dla szerszego zrozumienia podejmowanych przez Unię Europejską działań w relacjach z państwami trzecimi, w tym przede wszystkim z krajami rozwijającymi się.
ABSTRACT India has a long history of economic linkages with the EU member states. In recent perio... more ABSTRACT India has a long history of economic linkages with the EU member states. In recent period, the volumes of Indo-EU trade both in case of merchandise products and services have considerably increased and a number of investment collaboration opportunities are emerging. Since 2007 the two sides are engaged in the negotiations on concluding a Bilateral Trade and Investment Agreement (BTIA), which is expected to augment the present level of economic exchange further. Once completed in coming months, the BTIA will be the biggest trade agreement involving India, surpassing its earlier RTA with the ASEAN countries. However, while EU and India can collaborate in several spheres, the potential conflict of interest may not be uncommon either. In particular, the provision of farm subsidies offered by the EU to local producers, imposition of anti-dumping measures on several Indian export categories in EU markets, barriers on movement of professionals, EU interest in inclusion of several WTO-Plus provisions in the agreement etc. are among the concern areas of India. By looking at the trade data and the negotiating dynamics, the present analysis attempts to understand the challenges and opportunities for India in the EU market. The paper concludes that India needs to focus on augmenting its competitiveness for benefiting from the integration exercise.

The chapter presents the chronological evolution of the common commercial policy (CCP) over the d... more The chapter presents the chronological evolution of the common commercial policy (CCP) over the decades of European integration since the Treaty of Rome to the latest modifications embodied in the Lisbon Treaty. The policy is considered as one the most “European” and “common” among all activities realized within the EU, thus presenting strongly internal and external aspects of integration in the European continent. The shape of the policy has resulted from relevant provisions concerning the principles of the commercial policy, contained in both primary and secondary law, and in broader terms, from the concepts of the integration process, primarily a customs union and common market. Over recent decades the CCP has been evolving from a customs union created by countries of the EEV to the complex policy of economic relations with the rest of the world. The scope of the policy has changed several times, adapting to the global economic environment and challenges appearing both within and outside the EC/EU. The primary core of the policy encompassed only trade in goods, while new treaties in the 1990s, and especially the Lisbon Treaty, extended the definition of commercial policy to such aspects as trade in services, commercial aspects of intellectual property rights and investments. The final shape of the policy is a result of consensus, achieved with strong difficulties between the Commission, favoring a wide and dynamic interpretation of the CCP scope on the one hand and the EC/EU Member States, stressing the need of individual national control over the policy actions on the other. The supportive role in the shaping of the policy was played by the European Court of Justice through its historic and crucial opinions. Nowadays, the policy, as defined in the Treaty of Lisbon, is largely considered to be a relatively comprehensive platform of the EU economic relations with third countries and other international economic organizations.
In 2013 the European Union and Japan launched negotiations on a new trade and economic agreement,... more In 2013 the European Union and Japan launched negotiations on a new trade and economic agreement, of which the strategic aim is to create a free trade area between the parties (EU-Japan FTA). The new comprehensive agreement should include a broad spectrum of economic issues not only traditionally relating to tariffs, trade in goods and services, but also more broadly to non-tariff barriers and trade procedures, FDI, IPR, competition policy, public procurement, etc. For the EU the negotiations and agreement are an opportunity to improve openness of the Japanese market for European exporters and investors and to abandon many non-tariff barriers that have a burdensome effects on trade and investments. The general objective of the paper is to identify main barriers/challenges for European enterprises in access to the Japanese market for European goods, services and investments. The conducted analysis brings the following general conclusion: the existing barriers are mostly non-tariff barriers (there are relatively low tariffs for goods imported to Japan from the EU), which are both the biggest challenge for EU negotiators in improving access to the Japanese market and one of the main stumbling blocks slowing down the progress of the whole EU-Japan FTA negotiations.

Firstly, the article presents briefly South Korea as a trade and economic partner in the present global economy as well as bilateral EU–Korean economic co-operation. Subsequently, it concentrates on strategies and motives of both partners for starting negotiations on a new FTA. It also presents main commitments included in the agreement concluding with the general impact of the FTA on the EU and South Korea.

Celem tych rozmów jest wynegocjowanie kompleksowych umów handlowych ustanawiających między stronami strefy wolnego handlu nowego typu. W 2013 r. UE rozpoczęła rokowania na ten temat z Japonią – jedną z największych światowych gospodarek i ważnym partnerem gospodarczo--handlowym UE na kontynencie azjatyckim. Umowa ta jest zaliczana do grupy tzw. porozumień megaregionalnych, obejmujących swoim zasięgiem partnerów o dużym potencjale gospodarczym i mających znaczący wpływ na globalne przepływy handlowe i inwestycyjne. Negocjowane porozumienie jest kolejnym, po Korei Południowej i Singapurze, które ma być zawarte z wysoko rozwiniętym krajem azjatyckim. Dla Japonii umowa ta będzie okazją do zmniejszenie ceł w dostępie do europejskiego rynku dla swoich produktów przemysłowych i zapewnienia sobie niedyskryminacyjnego dostępu do rynku UE, szczególnie w kontekście rosnącej presji konkurencyjnej ze strony tych krajów, które już wynegocjowały podobne umowy. Z kolei dla Unii Europejskiej negocjowane porozumienie jest szansą na szersze otwarcie japońskiego rynku i zniesienie wielu barier pozataryfowych utrudniających dostęp i funkcjonowanie europejskich eksporterów i inwestorów na japońskim rynku. Celem artykułu jest identyfikacja najważniejszych wyzwań w zakresie zwiększenia dostępu do japońskiego rynku dla europejskich towarów, usług oraz inwestycji. W artykule podjęto próbę przedstawienia najważniejszych barier w dostępie do rynku Japonii z perspektywy europejskich przedsiębiorstw, co automatycznie pozwala na zestawienie najważniejszych wyzwań, przed jakimi stoją negocjatorzy KE.

The dynamic expansion of regionalism in the world trade system has induced a wide debate on its i... more The dynamic expansion of regionalism in the world trade system has induced a wide debate on its influence of multilateral agreements. It has also become an enormous challenge for the European common commercial policy (CCP) which task is to position the European Union optimally in the world trade system. In this context the noticeable change of ideology and approach to the shape of the EU’s common commercial policy may be observed. The originally declared attachment to multilateral agreement (so called “Lamy doctrine”) is gradually being replaced by a new approach, emphasizing the importance of the regional dimension of the EU trade policy (Global Europe). This way, the European Union joined the process of regionalisation of trade observed around the world.

We wrześniu 2014 r. przedstawiciele Unii Europejskiej oraz Kanady zaprezentowali oficjalnie tekst Kompleksowej umowy gospodarczej i handlowej (Comprehensive Trade and Economic Agreement – CETA). Nowa umowa jest kolejnym dwustronnym porozumieniem o wolnym handlu wynegocjowanym przez UE, w tym pierwszym z krajem należącym do grupy G-7. Negocjacje nad nową umową trwały pięć lat. Wśród najważniejszych kwestii spornych znalazły się m.in. eksport europejskich serów do Kanady i eksport kanadyjskiej wołowiny na rynek UE. Zgodnie z umową, najpóźniej w ciągu siedmiu lat od jej wejścia w życie, bezcłowy handel powinien objąć wszystkie towary przemysłowe i rybołówstwa oraz większość produktów rolnych. Porozumienie, oprócz głębokiej liberalizacji handlu towarami i usługami, reguluje także kwestie dostępu do sektora zamówień publicznych i bezpośrednich inwestycji zagranicznych, w tym wzajemną ochronę inwestycji. Szczególnie ta ostatnia kwestia budzi w dalszym ciągu sprzeciw niektórych środowisk i polityków, co może negatywnie wpłynąć na proces ratyfikacji i opóźnić moment wejścia w życie nowego porozumienia.

Comprehensive Economic and Trade Agreement – a New Dimension of the European Union’s Relations with Canada
In September 2014, the representatives of the European Union and Canada officially announced the final text of Comprehensive Economic and Trade Agreement – CETA. The new document is the EU subsequent bilateral free trade agreement, and the first concluded with a G-7 country. The negotiations between the Parties took five years. Among the most contentious issues were exports of European cheese to Canada and exports of Canadian beef to the EU. According to the agreement, all trade in manufactured foods and fisheries and almost all trade in agricultural products will be liberalised within maximum seven years since the entry of the agreement into force. The agreement, apart from the deep liberalisation of trade in goods and services, includes among others provisions on public procurement and foreign direct investment, together with investment protection standards. The latter regulation has been especially controversial and is still contested by some organisations and politicians, what may adversely affect the ratification process and delay the entry of the agreement into force.

Akcesja państw z Europy Środkowej i Wschodniej do Unii Europejskiej w 2004 i 2007 r. była momentem, w którym przed tymi krajami otworzyły się nowe możliwości w zakresie dalszego rozwoju. Pełne członkostwo we Wspólnocie oznaczało dla tych krajów dostęp do wsparcia zachodzących w tych krajach procesów modernizacji gospodarczej i społecznej. Członkostwo to wiązało się jednocześnie z przyjęciem szeregu nowych zobowiązań. Jednym z takich obszarów, w których państwa UE-10 przyjęły na siebie nowe zobowiązania, było wsparcie na rzecz rozwoju najuboższych krajów na świecie. Włączenie do Unii Europejskiej, będącej największym w skali świata dostarczycielem pomocy rozwojowej, oznaczało dla krajów UE-10 konieczność stworzenia odpowiedniego systemu prawno-instytucjonalnego, jak również nałożyło szereg zobowiązań w zakresie zwiększenia środków finansowych przekazywanych na te cele zarówno poprzez instrumenty unijne (budżet UE, Europejski Fundusz Rozwoju – EFR), jak i w wymiarze dwustronnym. Zdobycie statusu pełnoprawnego członka UE oznaczało jednocześnie dla państw UE-10 konieczność przyjęcia celów i zasad zdefiniowanych w ramach wspólnotowej polityki współpracy rozwojowej (development policy). Celem artykułu jest przedstawienie udziału państw UE-10 w unijnej polityce na rzecz wspierania rozwoju. Artykuł składa się z czterech części. Na wstępie opisano ogólne założenia polityki rozwojowej UE. Następnie przedstawiono miejsce Unii oraz jej państw członkowskich w globalnym systemie pomocy rozwojowej. W części trzeciej scharakteryzowano najważniejsze wyzwania, z jakimi musiały się zmierzyć państwa UE-10 w pierwszej dekadzie swojego członkostwa w odniesieniu do kształtowania i zarządzania w tym obszarze. Ostatnia część jest poświęcona analizie podstawowych danych dotyczących pomocy rozwojowej przekazywanej przez kraje UE, z uwzględnieniem kontekstu polityki rozwojowej całej Unii Europejskiej.

Dynamiczny rozwój indyjskiej gospodarki, jak również wysoki poziom ochrony krajowego rynku, sprawiają, że kraj ten jest jednym z priorytetowych partnerów handlowych, z którymi Unia chce zawrzeć dwustronną umowę SWH. Nowe porozumienie powinno regulować nie tylko zasady obrotu towarowego, ale także wzajemny dostęp do rynku usług, zasady przepływu inwestycji, politykę konkurencji oraz kwestie odnoszące się do prawnej ochrony własności intelektualnej. Mimo składanych już kilkukrotnie deklaracji, toczących się od ponad pięciu lat rokowań nie udało się jak dotychczas zakończyć. Wśród najważniejszych kwestii spornych, stojących na drodze do osiągnięcia ostatecznego porozumienia, znalazły się: dostęp europejskich samochodów do indyjskiego rynku, produkcja leków generycznych w Indiach, liberalizacja sektora usług czy dostęp dla europejskich firm do indyjskiego rynku zamówień publicznych. Wskazane trudności uniemożliwią zapewne osiągnięcie porozumienia przed końcem 2012 r., co deklarowały dotychczas obydwie strony.
"India as a Strategic Partner of the European Union – towards a Free Trade Agreement"
In 2007, the European Union started together with the Republic of India negotiations on the creation of free trade area. Dynamic development of the Indian economy as well as a relatively high level of domestic market protection in relations with the EU makes the country one of the priority partners for concluding a new bilateral free trade agreement. The agreement should regulate not only trade in goods, but also reciprocal access to the service sectors, foreign direct investments, competition policy as well as issues related to intellectual property rights. Despite the previously declared deadlines, the negotiations are still ongoing. There are many contentious issues occurring during negotiations. The most important and destructive for the negotiations are: an access for European car producers to the Indian market, production of generic medicines in India, liberalisation of trade in services as well as an access for European companies to the Indian market of public procurement. The mentioned contentious issues probably make the final agreement unlikely by the end of 2012.

W czerwcu 2012 r. Unia Europejska podpisała z sześcioma państwami Ameryki Środkowej (Gwatemala, Honduras, Kostaryka, Nikaragua, Panama i Salwador) układ o stowarzyszeniu, zawierający kompleksowe regulacje w dziedzinie współpracy politycznej i rozwojowej oraz wymiany handlowej. Nowa umowa zakłada m.in. utworzenie pomiędzy partnerami strefy wolnego handlu. Postępujący proces ratyfikacji sprawił, że w ostatnich miesiącach wchodziła w życie stopniowo w poszczególnych krajach część handlowa umowy stowarzyszeniowej. Zgodnie z przyjętą umową, w ciągu 10 kolejnych lat bezcłowy handel powinien objąć większość towarów przemysłowych i produktów rybołówstwa. Liberalizacji ulegnie także handel artykułami rolnymi (szczególnie po 6-letnim okresie przejściowym). W umowie przewidziano przy tym dodatkowe preferencje dla krajów Ameryki Środkowej w zakresie eksportu bananów na rynki państw UE. Umowa zakłada także usuwanie barier pozataryfowych oraz reguluje, zgodnie z aktualnym podejściem UE, takie zagadnienia jak: handel usługami, ochronę własności intelektualnej, bezpośrednie inwestycje zagraniczne, kwestie zamówień publicznych i politykę konkurencji. Nowe porozumienie jest istotne dla obydwu stron z uwagi na zmiany (od 1 stycznia 2014 r.) w powszechnym systemie preferencji celnych UE (GSP), jak również szereg zawartych i negocjowanych przez państwa Ameryki Środkowej dwustronnych umów handlowych z krajami trzecimi.

Association Agreement between the European Union and Central America
In June 2012, the European Union signed with six countries of Central America (Costa Rica, Guatemala, Honduras, Nicaragua, Panama, El Salvador) the Association Agreement, including comprehensive regulations on political dialogue, development cooperation and trade. The new agreement inter alia establishes the free trade area between the parties. Last months of the ratification process have resulted in implementing the trade pillar of the agreement in all countries of the Central America region. According to the agreement, almost all trade in manufactured goods and fisheries should be eliminated within ten years. Trade in agricultural products will be also highly liberalised (especially after the six-year transition period). The agreement also includes additional preferences for CA countries in exporting bananas to the EU market as well as regulations on the abolition of non-tariff barrier. It also regulates, in line with the current EU trade strategy, issues such as trade in services, intellectual property rights, foreign direct investments, public procurement, and competition policy. The new agreement is also important for both parties in the context of modifications in the EU’s Generalised System of Preferences (to be implemented starting the 1 January 2014) as well as a series of concluded and negotiated by the CA countries bilateral trade agreements with third countries.

Relacje EWG/UE z krajami AKP sięgają samego początku integracji europejskiej, będąc niejako naturalnym następstwem kolonialnej przeszłości wielu państw europejskich. Rozpoczynając formalną współpracę na podstawie traktatu rzymskiego, poprzez zawierane na przestrzeni lat kolejne umowy, obydwie strony doszły do kolejnego ważnego momentu w kształtowaniu wzajemnych relacji, jakim było podpisanie w 2000 r. Umowy o partnerstwie z Kotonu. Jednym z fundamentalnych założeń nowego porozumienia było wynegocjowanie umów o partnerstwie gospodarczym (UPG) na poziomie poszczególnych regionów AKP, które począwszy od 1.01.2008 r. miały stać się prawną podstawą współpracy gospodarczo-handlowej. Wiele kwestii spornych, które wyniknęły podczas toczących się negocjacji (tempo i zakres liberalizacji, stosowanie KNU, handel usługami, „kwestie singapurskie”) uniemożliwiło osiągnięcie porozumienia w założonym czasie. Spośród regionów jedynie państwa Karaibów podpisały z UE pełną UPG w założonym czasie. Wiele innych państw AKP, które pierwotnie parafowały treść przejściowych UPG w dalszym ciągu ich nie podpisało lub nie ratyfikowało. W tej sytuacji (wrzesień 2011 r.) Komisja Europejska przedstawiła nową propozycję, która ma uporządkować pozostający w zawieszeniu od prawie 4 lat układ. Wydaje się prawdopodobne, że w obliczu obecnej sytuacji na świecie (kryzys gospodarczy oraz problemy z zakończeniem rundy dauhańskiej) wynegocjowanie pełnych UPG ze wszystkimi regionami AKP będzie trudne i odległe w czasie.
The EU Economic Partnership Agreements with ACP Countries – a New Dimension or an Uncompleted Concept?
The EU-ACP relations have a long historical perspective relating to the legacy of colonialism. The evolution of the relations, starting formally with the Treaty of Rome, is currently at another milestone. In 2000, a new agreement was concluded - the Cotonou Partnership Agreement - that is a legal basis of relations between the EU and ACP countries until 2020. Parallel the parties started negotiations on the Economic Partnership Agreements (EPAs) in regional configuration that should, according to primary assumptions, create between the partners a free trade area in the future perspective. The preliminary deadline for concluding the EPAs (1 January 2008) has not been achieved. Many contentious issues that occurred and were highlighted during the long negotiation process (pace and scope of trade liberalisation, MFN clause, trade in services, “Singapore issues”) have made impossible to achieve a final agreement. Among the seven ACP regions that negotiate the EPAs only the Caribbean region has concluded and signed so far a full regional Economic Partnership Agreement. There are still even problems with signing and ratifying interim EPAs by those countries, which preliminary initialled the agreements. The current global processes (economic crisis and problems with concluding DDA) make the process of negotiations more difficult than ever.

Negocjowane porozumienie jest kolejnym, po Korei Południowej i Singapurze, które ma być zawarte z wysoko rozwiniętym krajem azjatyckim. Dla Japonii umowa ta będzie okazją do zmniejszenie ceł w dostępie do europejskiego rynku dla swoich produktów przemysłowych i zapewnienia sobie niedyskryminacyjnego dostępu do rynku UE, szczególnie w kontekście rosnącej presji konkurencyjnej ze strony tych krajów, które już wynegocjowały podobne umowy. Z kolei dla Unii Europejskiej negocjowane porozumienie jest szansą na szersze otwarcie japońskiego rynku i zniesienie wielu barier pozataryfowych utrudniających dostęp i funkcjonowanie europejskich eksporterów i inwestorów na japońskim rynku.
Celem artykułu jest identyfikacja najważniejszych wyzwań w zakresie zwiększenia dostępu do japońskiego rynku dla europejskich towarów, usług oraz inwestycji. W artykule podjęto próbę przedstawienia najważniejszych barier w dostępie do rynku Japonii z perspektywy europejskich przedsiębiorstw, co automatycznie pozwala na zestawienie najważniejszych wyzwań, przed jakimi stoją negocjatorzy KE.

We wrześniu 2014 r. przedstawiciele Unii Europejskiej oraz Kanady zaprezentowali oficjalnie tekst Kompleksowej umowy gospodarczej i handlowej (Comprehensive Trade and Economic Agreement – CETA). Nowa umowa jest kolejnym dwustronnym porozumieniem o wolnym handlu wynegocjowanym przez UE, w tym pierwszym z krajem należącym do grupy G-7. Negocjacje nad nową umową trwały pięć lat. Wśród najważniejszych kwestii spornych znalazły się m.in. eksport europejskich serów do Kanady i eksport kanadyjskiej wołowiny na rynek UE. Zgodnie z umową, najpóźniej w ciągu siedmiu lat od jej wejścia w życie, bezcłowy handel powinien objąć wszystkie towary przemysłowe i rybołówstwa oraz większość produktów rolnych. Porozumienie, oprócz głębokiej liberalizacji handlu towarami i usługami, reguluje także kwestie dostępu do sektora zamówień publicznych i bezpośrednich inwestycji zagranicznych, w tym wzajemną ochronę inwestycji. Szczególnie ta ostatnia kwestia budzi w dalszym ciągu sprzeciw niektórych środowisk i polityków, co może negatywnie wpłynąć na proces ratyfikacji i opóźnić moment wejścia w życie nowego porozumienia.

Comprehensive Economic and Trade Agreement – a New Dimension of the European Union’s Relations with Canada
In September 2014, the representatives of the European Union and Canada officially announced the final text of Comprehensive Economic and Trade Agreement – CETA. The new document is the EU subsequent bilateral free trade agreement, and the first concluded with a G-7 country. The negotiations between the Parties took five years. Among the most contentious issues were exports of European cheese to Canada and exports of Canadian beef to the EU. According to the agreement, all trade in manufactured foods and fisheries and almost all trade in agricultural products will be liberalised within maximum seven years since the entry of the agreement into force. The agreement, apart from the deep liberalisation of trade in goods and services, includes among others provisions on public procurement and foreign direct investment, together with investment protection standards. The latter regulation has been especially controversial and is still contested by some organisations and politicians, what may adversely affect the ratification process and delay the entry of the agreement into force.

Akcesja państw z Europy Środkowej i Wschodniej do Unii Europejskiej w 2004 i 2007 r. była momentem, w którym przed tymi krajami otworzyły się nowe możliwości w zakresie dalszego rozwoju. Pełne członkostwo we Wspólnocie oznaczało dla tych krajów dostęp do wsparcia zachodzących w tych krajach procesów modernizacji gospodarczej i społecznej. Członkostwo to wiązało się jednocześnie z przyjęciem szeregu nowych zobowiązań. Jednym z takich obszarów, w których państwa UE-10 przyjęły na siebie nowe zobowiązania, było wsparcie na rzecz rozwoju najuboższych krajów na świecie. Włączenie do Unii Europejskiej, będącej największym w skali świata dostarczycielem pomocy rozwojowej, oznaczało dla krajów UE-10 konieczność stworzenia odpowiedniego systemu prawno-instytucjonalnego, jak również nałożyło szereg zobowiązań w zakresie zwiększenia środków finansowych przekazywanych na te cele zarówno poprzez instrumenty unijne (budżet UE, Europejski Fundusz Rozwoju – EFR), jak i w wymiarze dwustronnym. Zdobycie statusu pełnoprawnego członka UE oznaczało jednocześnie dla państw UE-10 konieczność przyjęcia celów i zasad zdefiniowanych w ramach wspólnotowej polityki współpracy rozwojowej (development policy). Celem artykułu jest przedstawienie udziału państw UE-10 w unijnej polityce na rzecz wspierania rozwoju. Artykuł składa się z czterech części. Na wstępie opisano ogólne założenia polityki rozwojowej UE. Następnie przedstawiono miejsce Unii oraz jej państw członkowskich w globalnym systemie pomocy rozwojowej. W części trzeciej scharakteryzowano najważniejsze wyzwania, z jakimi musiały się zmierzyć państwa UE-10 w pierwszej dekadzie swojego członkostwa w odniesieniu do kształtowania i zarządzania w tym obszarze. Ostatnia część jest poświęcona analizie podstawowych danych dotyczących pomocy rozwojowej przekazywanej przez kraje UE, z uwzględnieniem kontekstu polityki rozwojowej całej Unii Europejskiej.
"India as a Strategic Partner of the European Union – towards a Free Trade Agreement"
In 2007, the European Union started together with the Republic of India negotiations on the creation of free trade area. Dynamic development of the Indian economy as well as a relatively high level of domestic market protection in relations with the EU makes the country one of the priority partners for concluding a new bilateral free trade agreement. The agreement should regulate not only trade in goods, but also reciprocal access to the service sectors, foreign direct investments, competition policy as well as issues related to intellectual property rights. Despite the previously declared deadlines, the negotiations are still ongoing. There are many contentious issues occurring during negotiations. The most important and destructive for the negotiations are: an access for European car producers to the Indian market, production of generic medicines in India, liberalisation of trade in services as well as an access for European companies to the Indian market of public procurement. The mentioned contentious issues probably make the final agreement unlikely by the end of 2012.
W czerwcu 2012 r. Unia Europejska podpisała z sześcioma państwami Ameryki Środkowej (Gwatemala, Honduras, Kostaryka, Nikaragua, Panama i Salwador) układ o stowarzyszeniu, zawierający kompleksowe regulacje w dziedzinie współpracy politycznej i rozwojowej oraz wymiany handlowej. Nowa umowa zakłada m.in. utworzenie pomiędzy partnerami strefy wolnego handlu. Postępujący proces ratyfikacji sprawił, że w ostatnich miesiącach wchodziła w życie stopniowo w poszczególnych krajach część handlowa umowy stowarzyszeniowej. Zgodnie z przyjętą umową, w ciągu 10 kolejnych lat bezcłowy handel powinien objąć większość towarów przemysłowych i produktów rybołówstwa. Liberalizacji ulegnie także handel artykułami rolnymi (szczególnie po 6-letnim okresie przejściowym). W umowie przewidziano przy tym dodatkowe preferencje dla krajów Ameryki Środkowej w zakresie eksportu bananów na rynki państw UE. Umowa zakłada także usuwanie barier pozataryfowych oraz reguluje, zgodnie z aktualnym podejściem UE, takie zagadnienia jak: handel usługami, ochronę własności intelektualnej, bezpośrednie inwestycje zagraniczne, kwestie zamówień publicznych i politykę konkurencji. Nowe porozumienie jest istotne dla obydwu stron z uwagi na zmiany (od 1 stycznia 2014 r.) w powszechnym systemie preferencji celnych UE (GSP), jak również szereg zawartych i negocjowanych przez państwa Ameryki Środkowej dwustronnych umów handlowych z krajami trzecimi.

Association Agreement between the European Union and Central America
In June 2012, the European Union signed with six countries of Central America (Costa Rica, Guatemala, Honduras, Nicaragua, Panama, El Salvador) the Association Agreement, including comprehensive regulations on political dialogue, development cooperation and trade. The new agreement inter alia establishes the free trade area between the parties. Last months of the ratification process have resulted in implementing the trade pillar of the agreement in all countries of the Central America region. According to the agreement, almost all trade in manufactured goods and fisheries should be eliminated within ten years. Trade in agricultural products will be also highly liberalised (especially after the six-year transition period). The agreement also includes additional preferences for CA countries in exporting bananas to the EU market as well as regulations on the abolition of non-tariff barrier. It also regulates, in line with the current EU trade strategy, issues such as trade in services, intellectual property rights, foreign direct investments, public procurement, and competition policy. The new agreement is also important for both parties in the context of modifications in the EU’s Generalised System of Preferences (to be implemented starting the 1 January 2014) as well as a series of concluded and negotiated by the CA countries bilateral trade agreements with third countries.

wymiar relacji czy niedokończona koncepcja?
Relacje EWG/UE z krajami AKP sięgają samego początku integracji europejskiej, będąc niejako naturalnym następstwem kolonialnej przeszłości wielu państw europejskich. Rozpoczynając formalną współpracę na podstawie traktatu rzymskiego, poprzez zawierane na przestrzeni lat kolejne umowy, obydwie strony doszły do kolejnego ważnego momentu w kształtowaniu wzajemnych relacji, jakim było podpisanie w 2000 r. Umowy o partnerstwie z Kotonu. Jednym z fundamentalnych założeń nowego porozumienia było wynegocjowanie umów o partnerstwie gospodarczym (UPG) na poziomie poszczególnych regionów AKP, które począwszy od 1.01.2008 r. miały stać się prawną podstawą współpracy gospodarczo-handlowej. Wiele kwestii spornych, które wyniknęły podczas toczących się negocjacji (tempo i zakres liberalizacji, stosowanie KNU, handel usługami, „kwestie singapurskie”) uniemożliwiło osiągnięcie porozumienia w założonym czasie. Spośród regionów jedynie państwa Karaibów podpisały z UE pełną UPG w założonym czasie. Wiele innych państw AKP, które pierwotnie parafowały treść przejściowych UPG w dalszym ciągu ich nie podpisało lub nie ratyfikowało. W tej sytuacji (wrzesień 2011 r.) Komisja Europejska przedstawiła nową propozycję, która ma uporządkować pozostający w zawieszeniu od prawie 4 lat układ. Wydaje się prawdopodobne, że w obliczu obecnej sytuacji na świecie (kryzys gospodarczy oraz problemy z zakończeniem rundy dauhańskiej) wynegocjowanie pełnych UPG ze wszystkimi regionami AKP będzie trudne i odległe w czasie.
The EU Economic Partnership Agreements with ACP Countries – a New Dimension or an Uncompleted Concept?
The EU-ACP relations have a long historical perspective relating to the legacy of colonialism. The evolution of the relations, starting formally with the Treaty of Rome, is currently at another milestone. In 2000, a new agreement was concluded - the Cotonou Partnership Agreement - that is a legal basis of relations between the EU and ACP countries until 2020. Parallel the parties started negotiations on the Economic Partnership Agreements (EPAs) in regional configuration that should, according to primary assumptions, create between the partners a free trade area in the future perspective. The preliminary deadline for concluding the EPAs (1 January 2008) has not been achieved. Many contentious issues that occurred and were highlighted during the long negotiation process (pace and scope of trade liberalisation, MFN clause, trade in services, “Singapore issues”) have made impossible to achieve a final agreement. Among the seven ACP regions that negotiate the EPAs only the Caribbean region has concluded and signed so far a full regional Economic Partnership Agreement. There are still even problems with signing and ratifying interim EPAs by those countries, which preliminary initialled the agreements. The current global processes (economic crisis and problems with concluding DDA) make the process of negotiations more difficult than ever.

We wrześniu 2014 r. przedstawiciele Unii Europejskiej oraz Kanady zaprezentowali oficjalnie tekst Kompleksowej umowy gospodarczej i handlowej (Comprehensive Trade and Economic Agreement – CETA). Nowa umowa jest kolejnym dwustronnym porozumieniem o wolnym handlu wynegocjowanym przez UE, w tym pierwszym z krajem należącym do grupy G-7. Negocjacje nad nową umową trwały pięć lat. Wśród najważniejszych kwestii spornych znalazły się m.in. eksport europejskich serów do Kanady i eksport kanadyjskiej wołowiny na rynek UE. Zgodnie z umową, najpóźniej w ciągu siedmiu lat od jej wejścia w życie, bezcłowy handel powinien objąć wszystkie towary przemysłowe i rybołówstwa oraz większość produktów rolnych. Porozumienie, oprócz głębokiej liberalizacji handlu towarami i usługami, reguluje także kwestie dostępu do sektora zamówień publicznych i bezpośrednich inwestycji zagranicznych, w tym wzajemną ochronę inwestycji. Szczególnie ta ostatnia kwestia budzi w dalszym ciągu sprzeciw niektórych środowisk i polityków, co może negatywnie wpłynąć na proces ratyfikacji i opóźnić moment wejścia w życie nowego porozumienia.

Comprehensive Economic and Trade Agreement – a New Dimension of the European Union’s Relations with Canada
In September 2014, the representatives of the European Union and Canada officially announced the final text of Comprehensive Economic and Trade Agreement – CETA. The new document is the EU subsequent bilateral free trade agreement, and the first concluded with a G-7 country. The negotiations between the Parties took five years. Among the most contentious issues were exports of European cheese to Canada and exports of Canadian beef to the EU. According to the agreement, all trade in manufactured foods and fisheries and almost all trade in agricultural products will be liberalised within maximum seven years since the entry of the agreement into force. The agreement, apart from the deep liberalisation of trade in goods and services, includes among others provisions on public procurement and foreign direct investment, together with investment protection standards. The latter regulation has been especially controversial and is still contested by some organisations and politicians, what may adversely affect the ratification process and delay the entry of the agreement into force.

Akcesja państw z Europy Środkowej i Wschodniej do Unii Europejskiej w 2004 i 2007 r. była momentem, w którym przed tymi krajami otworzyły się nowe możliwości w zakresie dalszego rozwoju. Pełne członkostwo we Wspólnocie oznaczało dla tych krajów dostęp do wsparcia zachodzących w tych krajach procesów modernizacji gospodarczej i społecznej. Członkostwo to wiązało się jednocześnie z przyjęciem szeregu nowych zobowiązań. Jednym z takich obszarów, w których państwa UE-10 przyjęły na siebie nowe zobowiązania, było wsparcie na rzecz rozwoju najuboższych krajów na świecie. Włączenie do Unii Europejskiej, będącej największym w skali świata dostarczycielem pomocy rozwojowej, oznaczało dla krajów UE-10 konieczność stworzenia odpowiedniego systemu prawno-instytucjonalnego, jak również nałożyło szereg zobowiązań w zakresie zwiększenia środków finansowych przekazywanych na te cele zarówno poprzez instrumenty unijne (budżet UE, Europejski Fundusz Rozwoju – EFR), jak i w wymiarze dwustronnym. Zdobycie statusu pełnoprawnego członka UE oznaczało jednocześnie dla państw UE-10 konieczność przyjęcia celów i zasad zdefiniowanych w ramach wspólnotowej polityki współpracy rozwojowej (development policy). Celem artykułu jest przedstawienie udziału państw UE-10 w unijnej polityce na rzecz wspierania rozwoju. Artykuł składa się z czterech części. Na wstępie opisano ogólne założenia polityki rozwojowej UE. Następnie przedstawiono miejsce Unii oraz jej państw członkowskich w globalnym systemie pomocy rozwojowej. W części trzeciej scharakteryzowano najważniejsze wyzwania, z jakimi musiały się zmierzyć państwa UE-10 w pierwszej dekadzie swojego członkostwa w odniesieniu do kształtowania i zarządzania w tym obszarze. Ostatnia część jest poświęcona analizie podstawowych danych dotyczących pomocy rozwojowej przekazywanej przez kraje UE, z uwzględnieniem kontekstu polityki rozwojowej całej Unii Europejskiej.
"India as a Strategic Partner of the European Union – towards a Free Trade Agreement"
In 2007, the European Union started together with the Republic of India negotiations on the creation of free trade area. Dynamic development of the Indian economy as well as a relatively high level of domestic market protection in relations with the EU makes the country one of the priority partners for concluding a new bilateral free trade agreement. The agreement should regulate not only trade in goods, but also reciprocal access to the service sectors, foreign direct investments, competition policy as well as issues related to intellectual property rights. Despite the previously declared deadlines, the negotiations are still ongoing. There are many contentious issues occurring during negotiations. The most important and destructive for the negotiations are: an access for European car producers to the Indian market, production of generic medicines in India, liberalisation of trade in services as well as an access for European companies to the Indian market of public procurement. The mentioned contentious issues probably make the final agreement unlikely by the end of 2012.
W czerwcu 2012 r. Unia Europejska podpisała z sześcioma państwami Ameryki Środkowej (Gwatemala, Honduras, Kostaryka, Nikaragua, Panama i Salwador) układ o stowarzyszeniu, zawierający kompleksowe regulacje w dziedzinie współpracy politycznej i rozwojowej oraz wymiany handlowej. Nowa umowa zakłada m.in. utworzenie pomiędzy partnerami strefy wolnego handlu. Postępujący proces ratyfikacji sprawił, że w ostatnich miesiącach wchodziła w życie stopniowo w poszczególnych krajach część handlowa umowy stowarzyszeniowej. Zgodnie z przyjętą umową, w ciągu 10 kolejnych lat bezcłowy handel powinien objąć większość towarów przemysłowych i produktów rybołówstwa. Liberalizacji ulegnie także handel artykułami rolnymi (szczególnie po 6-letnim okresie przejściowym). W umowie przewidziano przy tym dodatkowe preferencje dla krajów Ameryki Środkowej w zakresie eksportu bananów na rynki państw UE. Umowa zakłada także usuwanie barier pozataryfowych oraz reguluje, zgodnie z aktualnym podejściem UE, takie zagadnienia jak: handel usługami, ochronę własności intelektualnej, bezpośrednie inwestycje zagraniczne, kwestie zamówień publicznych i politykę konkurencji. Nowe porozumienie jest istotne dla obydwu stron z uwagi na zmiany (od 1 stycznia 2014 r.) w powszechnym systemie preferencji celnych UE (GSP), jak również szereg zawartych i negocjowanych przez państwa Ameryki Środkowej dwustronnych umów handlowych z krajami trzecimi.

Association Agreement between the European Union and Central America
In June 2012, the European Union signed with six countries of Central America (Costa Rica, Guatemala, Honduras, Nicaragua, Panama, El Salvador) the Association Agreement, including comprehensive regulations on political dialogue, development cooperation and trade. The new agreement inter alia establishes the free trade area between the parties. Last months of the ratification process have resulted in implementing the trade pillar of the agreement in all countries of the Central America region. According to the agreement, almost all trade in manufactured goods and fisheries should be eliminated within ten years. Trade in agricultural products will be also highly liberalised (especially after the six-year transition period). The agreement also includes additional preferences for CA countries in exporting bananas to the EU market as well as regulations on the abolition of non-tariff barrier. It also regulates, in line with the current EU trade strategy, issues such as trade in services, intellectual property rights, foreign direct investments, public procurement, and competition policy. The new agreement is also important for both parties in the context of modifications in the EU’s Generalised System of Preferences (to be implemented starting the 1 January 2014) as well as a series of concluded and negotiated by the CA countries bilateral trade agreements with third countries.

wymiar relacji czy niedokończona koncepcja?
Relacje EWG/UE z krajami AKP sięgają samego początku integracji europejskiej, będąc niejako naturalnym następstwem kolonialnej przeszłości wielu państw europejskich. Rozpoczynając formalną współpracę na podstawie traktatu rzymskiego, poprzez zawierane na przestrzeni lat kolejne umowy, obydwie strony doszły do kolejnego ważnego momentu w kształtowaniu wzajemnych relacji, jakim było podpisanie w 2000 r. Umowy o partnerstwie z Kotonu. Jednym z fundamentalnych założeń nowego porozumienia było wynegocjowanie umów o partnerstwie gospodarczym (UPG) na poziomie poszczególnych regionów AKP, które począwszy od 1.01.2008 r. miały stać się prawną podstawą współpracy gospodarczo-handlowej. Wiele kwestii spornych, które wyniknęły podczas toczących się negocjacji (tempo i zakres liberalizacji, stosowanie KNU, handel usługami, „kwestie singapurskie”) uniemożliwiło osiągnięcie porozumienia w założonym czasie. Spośród regionów jedynie państwa Karaibów podpisały z UE pełną UPG w założonym czasie. Wiele innych państw AKP, które pierwotnie parafowały treść przejściowych UPG w dalszym ciągu ich nie podpisało lub nie ratyfikowało. W tej sytuacji (wrzesień 2011 r.) Komisja Europejska przedstawiła nową propozycję, która ma uporządkować pozostający w zawieszeniu od prawie 4 lat układ. Wydaje się prawdopodobne, że w obliczu obecnej sytuacji na świecie (kryzys gospodarczy oraz problemy z zakończeniem rundy dauhańskiej) wynegocjowanie pełnych UPG ze wszystkimi regionami AKP będzie trudne i odległe w czasie.
The EU Economic Partnership Agreements with ACP Countries – a New Dimension or an Uncompleted Concept?
The EU-ACP relations have a long historical perspective relating to the legacy of colonialism. The evolution of the relations, starting formally with the Treaty of Rome, is currently at another milestone. In 2000, a new agreement was concluded - the Cotonou Partnership Agreement - that is a legal basis of relations between the EU and ACP countries until 2020. Parallel the parties started negotiations on the Economic Partnership Agreements (EPAs) in regional configuration that should, according to primary assumptions, create between the partners a free trade area in the future perspective. The preliminary deadline for concluding the EPAs (1 January 2008) has not been achieved. Many contentious issues that occurred and were highlighted during the long negotiation process (pace and scope of trade liberalisation, MFN clause, trade in services, “Singapore issues”) have made impossible to achieve a final agreement. Among the seven ACP regions that negotiate the EPAs only the Caribbean region has concluded and signed so far a full regional Economic Partnership Agreement. There are still even problems with signing and ratifying interim EPAs by those countries, which preliminary initialled the agreements. The current global processes (economic crisis and problems with concluding DDA) make the process of negotiations more difficult than ever.
