Rafael D Brown
Prof. Rafael Dean Brown received his Juris Doctor from Case Western Reserve University School of Law and his B.A. English (magna cum laude) from Case Western Reserve University. He joined the Qatar University College of Law in 2015, where he teaches in the Legal Skills Department. He serves on the Qatar University Faculty Senate, Vice Chair of Faculty Affairs, and is an Affiliate Member of the Center for Law and Development. His research interests include artificial intelligence, cybersecurity, arbitration, litigation, legal writing, legal skills, and legal research. In his prior teaching appointment at Qatar University, Prof. Brown was Assistant Director of Academic Support at the Case Western Reserve University School of Law’s LL.M. in U.S. and Global Legal Studies Program, where he taught legal research, writing and analysis to foreign trained lawyers from over 60 different countries in a span of over nine years. He was also Adjunct Professor of Law for four years teaching U.S. Evidence Law. Additionally, he co-taught the Foreign Graduate Seminar and Doing Business in the U.S. Dr. Brown was also the Director of the Summer Language and Law Institute and the Case-Nyenrode Business Law Summer Program at Case Western Reserve University School of Law for over ten years.In addition to teaching at Case Western Reserve University School of Law, Prof. Brown has conducted training programs in India, Sri Lanka, the U.S.A., and the Philippines on the legal process outsourcing industry. He has served as the Chief Knowledge Officer for an Indian legal process outsourcing firm. He was a Director and Advisor for a Sri Lankan legal process outsourcing and LPO Academy. As an entrepreneur, he is the Founder and Owner of a retail store, an IT start-up, and a digital media start-up.Prof. Brown is also a Member of the Ohio Bar. He practiced law in Cleveland, Ohio for over twelve years and was Managing Partner at Brown, Zydorek and Kats LLP, where his practice focused on civil litigation, employment law, personal injury, real estate, franchising, and start-ups.Prof. Brown has been a presenter at the Global Legal Skills Conference in Chicago, Illinois

This article discusses the three primary challenges to the enforcement of emergency arbitrator decisions: (A) the nature of emergency arbitrator decisions, (B) the requirement of finality of an arbitral award, and (C) the nature of an emergency arbitrator. These challenges to enforcement have posed and will continue to pose a significant challenge to courts. The limited number of cases, thus far, portend a landscape of conflicting decisions that pave the way for further challenges to the enforcement of emergency arbitrator decisions.
The article concludes by recommending measures that will increase the enforceability of emergency arbitrator decisions, highlighting the necessity of amending the New York Convention if emergency arbitration is to become a permanent feature of international arbitration.
