This paper discusses the important legal problems relating to the adoption by the Qatari judiciary of a position on the issue of interest on bank loans, namely, that banks should not take interest on loans granted to their clients. The reason for such a situation is the absence of legal system for bank loans that allow them to agree on interest on bank loans granted by these banks, contrary to what is provided for in some comparative legislation such as the laws of the United Arab Emirates and the State of Kuwait. This study examines the legal system of bank loans in comparative legislation and analyzes the judgments issued by the Qatari judiciary regarding the subject matter of the study. This study emphasizes that Article 70 of the Central Bank of Qatar and Regulation of Financial Institutions Law (law no. 13 of 2012) represented (and still represents) the legal basis for the legality of banks' agreements with their customers on the interest on bank loans. In addition, the study highlighted its disagreement with the decisions issued by the Qatari Court of Cassation, where this court decided the illegality of interest on bank loans and decided to apply the provisions of the Civil Code of Qatar in order to grant compensation to banks as a result of the borrower's late repayment of debt. Key words: Banking loans- Interest- Qatar central bank law- Courts’ judgements - Banking credit- Civil loans.

The value of knowledge-based assets, such as information relating to formulas and technical data,... more The value of knowledge-based assets, such as information relating to formulas and technical data, has increased dramatically in recent years. It is now more important than tangible or physical assets, and corporations need to properly manage these valuable assets in order to maintain their competitiveness in the marketplace. At the same time, proper control over these assets interfaces with other regulations concerning, inter alia, competition and public interest. This paper intends to critically examine laws on the protection of trade secrets in the GCC countries. Special attention is given to Qatar’s Law No. 5 of 2005 on the Protection of Trade Secrets and its reflection in the TRIPs Agreement. As the first legislation to exclusively deal with the topic in the country, its scope and contents are of tremendous interest and significance to those who would like to protect their assets through trade secrets law instead of patent law.
