Mediation

Mediator neutrality has attracted significant criticism in recent decades. Some authors, such as Laurence Boulle, have suggested that these criticisms can be avoided by focusing instead on mediator impartiality. This shift is now enshrined in mediator codes of conduct in several jurisdictions, including Australia. This article argues that mediator impartiality fails to provide a tenable foundation for mediation ethics. The concept either reproduces the traditional problems of mediator neutrality or offers mediators and parties little practical guidance in understanding the mediator’s ethical role. In either case, the notion of mediator impartiality itself is effectively empty, meaning it cannot supply a solid foundation for ethical practice.

В книге представлены учебные и методические материалы по семейной финансовой медиации, используемые в Carolina Dispute Settlement Services (г. Роли, Северная Каролина, США). Описаны наиболее распространенные подходы к организации и ведению процесса семейной медиации в практике США. Освоение предложенных приемов модерации коммуникации между сторонами сделает процесс медиации семейных конфликтов более глубоким и эффективным. В книгу включены некоторые нормативные и правовые документы штата Северная Каролина, регулирующие подготовку медиаторов, их профессиональную деятельность и ответственность.
Материалы мануала могут быть полезны медиаторам, педагогам, психологам, социальным работникам, конфликтологам, юристам, студентам, обучающимся по соответствующим специальностям, и всем, кто заинтересован в конструктивном разрешении семейных и других видов конфликтов.

The legislator, during the last reform of family law in Greece, in 1983, introduced joint physical custody of parents for all children. The court would decide on everything if the parents disagreed, both in the marriage and during the separation or divorce. The judges stubbornly refused to deal with the child rearing and therefore a divergent jurisprudence arose around the best interests of the child: in its name, the judge presumably removes custody from capable and good parents while refusing to do so for incompetent and bad parents. Social services do not exist, the courts just issue a decision meanwhile there is no mean of direct enforcement of such a decision. Parental alienation and emotional abuse is met in the Court’s decisions. Judges continue to refuse taking any action and questioning their jurisprudential custom. Instead of protecting children and parents, the legal system protects the civil code. However, the challenge of raising a child belongs to the parents and not to the judge. Facing Family Violence and Parental Alienation in Greece is not possible without the introduction of shared parenting, including the legal presumption of shared parenting.

of how mediation can be used as an alternative to, or alongside, judicial review and to provide practical assistance to those practitioners who are, or who may be, considering mediation as a route for resolving public law disputes, particularly judicial review claims. Includes mediated case studies.

With all the turmoil and conflict taking place around the world, it is often tempting to think of the Western Balkans as yesterday’s problem. While it is true that the prospect of armed conflict has diminished significantly over the past two decades, there are still issues that contribute to a broader sense of instability. Until recently, three major issues undermined the region’s path towards ‘normality,’ whatever that may mean in the current international environment. The first, and most intractable of these is Bosnia and Herzegovina. Even though it has been over 20 years since the 1995 Dayton Agreement ended the vicious and bloody war in the country, Bosnia remains deeply divided. The second issue is Kosovo. The February 2008 unilateral declaration of independence remains a source of deep divisions, both regionally and internationally. Last, and truly least, was the so-called Macedonia name issue. Although viewed by many outsiders as a somewhat bizarre, if not wholly ridiculous, issue, the effects of the dispute were anything but laughable. It led to the wholesale corruption of the Macedonian state and impeded the general process of Euro-Atlantic integration in Southeast Europe. And yet, after 25 years, the issue has finally been resolved.

This paper examines the effectiveness of the EU’s performance in mediation and dialogue by studying the Belgrade-Pristina Dialogue from external and internal perspectives. Based on the academic literature on mediation and local-level dialogue, we suggest an analytical framework for assessing mediation success. Separating the concepts of success into internal and external perspectives allows for a more nuanced and elaborate analysis of the mediation process and its implications at the local level. This analytical framework is applied to both the high-level dialogue between Pristina and Belgrade representing Track I mediation and local-level dialogue in line with Track II mediation.
I have authored case study, which focuses on local-level dialogue in the context of the Belgrade-Pristina talks. An analysis of Track II initiatives demonstrates a lack of EU interest in supporting local-level dialogue – dialogue that is crucial to the successful implementation and durability of peace in the region. The other main finding is that there is a lack of coordination of Track I and Track II dialogue efforts by the EEAS.

Through a combination of political economy and radical mediation theory, this dissertation argues that current ‘YouTube Stars’ can be understood as a particularly virulent strain of ‘homo æconomicus’, who are produced and commodified through the techno-capitalist structures of the platform. YouTube culture has transformed since its inception in 2005 to increasingly become a conduit for commercial interests, and successful vloggers are nodes in this capitalist flow: absorbing, transforming and spreading the neoliberal political rationality of the platform. I analyse how mainstream vloggers are emerging through and are entangled with the neoliberal rationality of the complex commercial interests, structures and technological affordances of the platform. I conclude by considering the ethical ramifications of, and possible solutions to, the commodification of the self on YouTube vlogs.

This article argues that the post-Dayton political organisation of Bosnia represents an exemplary illustration of the difficulties associated with the empirical application of the pluralist model of “consociational democracy”. The country’s political system has been predicated on the existence of consensus and the spirit of cooperation among the three ethnic groups without, however, offering any electoral or political incentives to their leaderships to cooperate. Also, the inclusion of several elements to the Dayton accords of a partition approach to conflict resolution has even encouraged the ethnic leaderships to maintain their nationalistic programs and their endeavours to exploit the aforementioned power-sharing arrangements. Indeed, the structural deficiencies of the Dayton agreement have permitted nationalists to continue implementing their ethnic
agendas and have accounted for the slow progress towards the implementation of the Bosnian peace process. Therefore, this article elaborates on the international policies in Bosnia, aimed at transforming the country into a viable multiethnic state, and highlights the significance of motivations for implementing the peace process.

This article reflects on the judicialization of social relationships under the rule of the Welfare State, its consequences on the phenomenon of litigation and on the need of alternatives disputes resolutions. The bottom line is the paradigm of the Welfare State, through the democratization and reallocation of the Judicial Power as depositary of social demands and guardian of fundamental rights, justifying the expansion of its role. We will also approach the instrumentalization of the process and its pacification mission, linking to the non-adversarial processos positived under the influence of the third wave of “Access to Justice” movement.

This paper focuses on the effects of nonbinding recommendations on bargaining outcomes. Recommendations are theorized to have two effects: they can create a focal point for final bargaining positions, and they can decrease outcome uncertainty should dispute persist. While the focal point effect may help lower dispute rates, the uncertainty reduction effect is predicted to do the opposite for risk-averse bargainers. Which of these effects dominates is of critical importance in the optimal design of alternative dispute resolution (ADR) procedures, which are becoming increasingly utilized to help resolve disputes in a variety of settings. We theoretically examine the effects of recommendations on the bargaining contract zone. Our theoretical framework, which allows bargainers ’ final positions to influence a binding outcome should negotiations fail, provides for a more stringent test of focal points than previously considered. In this introductory essay, we build on the articles in this special issue to provide a novel theoretical framework for the understanding of current and future trends in the digitalisation of teaching and learning in Nordic higher education (HE). We highlight three key elements. Context is critical and should be systematically expanded to include not only the immediate context of the virtual and blended classroom, but also the broader organisational and national contexts within which digital learning takes place. The involvement of individual actors, higher education institutions and national policy-making agencies in the development and implementation of digitalisation policy ideas and practices is also shaped by multiple mediations, which include the mediating role of technology itself, but also of other human, organisational and policy actors, ideas and practices. Finally, digitalisation of HE teaching and learning can lead to a variety of gradual or more radical digital transformations, operating at multiple scales and with multiple potential positive or negative effects. This framework helps put into focus the key question of how to go about searching for a flexible set of "Nordic characteristics" that might affect digitalisation of teaching and learning in the Nordic region, albeit in uneven and diverse ways. While it is too early to provide a systematic analysis of the impact of the rapid digitalisation of Nordic HE teaching and learning spurred by the Covid-19 pandemic, we make some preliminary observations that offer this emerging theoretical framework as a way to assess these trends both before and after the pandemic.

Jedna od dilema koja se pojavljuje u mnogim zemljama koje su odlučile uvesti postupak medijacije (mirenja) u svoj sustav rješavanja sporova jest u kojoj mjeri uvesti elemente obvezatnosti u postupak medijacije. Kada se prije par desetljeća inicijalno pojavila ova dilema, javio se i strah da bi se uvođenjem obvezne medijacije na neki način postavila prepreka strankama da ostvare pristup pravosuđu. Nisu se tada razmatrale mogućnosti uvođenja djelomične obvezatnosti pojedinih elemenata medijacije. Tradicionalno se smatralo da se uvođenjem obvezatne medijacije, kao uvjeta pokretanja parničnog postupka narušavaju istovremeno dva načela. Prvo načelo za koje se tvrdilo da ga može narušiti obvezna medijacija jest načelo prava pristupa sudu utjelovljeno u brojnim međunarodnim konvencijama.

In this article, the authors compare alternative conflict resolution mechanisms in Colombia and Russia. In the former, conciliation is the most developed alternative dispute resolution mechanism, while in the latter, mediation is the most developed. In order to deepen this comparison, a qualitative research of interpretative nature has been developed with the support of bibliographic-documentary material. The main conclusion is that access to justice is a human right that has been positivized as a fundamental right in the constitutions of both Colombia and Russia. However, the Colombian Constitution allows individuals to exercise their jurisdictional functions on a temporary basis, unlike the Russian Constitution, which only authorizes judges from the Federation to exercise their jurisdictional functions. While conciliation in Colombia is developed and implemented through State-supervised Conciliation and Arbitration Centers, mediation in Russia is in its initial phase and has gradually gained acceptance in society. In both states, the implementation of alternative dispute resolution mechanisms has been driven by the need to decongest the courts and tribunals of ordinary justice. Therefore, it is useful to insist on the massive use of these instruments to make possible a justice that comes from the parties in conflict, that can repair the relations of the subjects in dispute and that tends towards the construction of more peaceful societies.

Research on cultural industries suggests that the constant and rapid change to digital technologies used by creative practitioners requires that they continually upgrade their skills in order to remain relevant in their occupations. In this article, we present the results of an investigation into the mediation of Photoshop, focusing on how this digital imaging appli-cation software and its content are used to mediate access to cultural work. Teaching and learning Photoshop is presented as a key set of practices for digitally mediated cultural work, raising interesting paradoxes concerning Photoshop’s status as a digital imaging standard and how it is used by practitioners to negotiate access to occupations. The findings are drawn from two phases of an ongoing research project that includes interviews with practitioners in Canada and the United Kingdom and participant observation in a Greater Vancouver higher education institution.

Abstract: This essay examines the contribution that ‘artistic insights’ can offer to the theory and
practice of peacebuilding, thereby taking into account the reflections of two pioneers in the field,
Howard Zehr and John William Cooley. The first Author – widely considered as the ‘grandfather’ of
restorative justice – has often taken profit by his expertise as a photographer, which affected his
perspective(s) on justice both at a theoretical and a practical level. Conversely, Cooley – whose vital
contribution to the theory of civil mediation is mostly connected to binding it to (a classical approach
to legal) argumentation – has reflected on the role of music in the theory and practice of mediation.
He suggested, in fact, a parallelism between being a mediator and a musician (both considered as a
performer and as a composer). Through different disciplines and metaphoric images, both Zehr and
Cooley show how arts can help reflecting on the perspective and angle through which a justice
process is understood, envisioned and put into practice.
Abstract: Il saggio dedica l’attenzione al contributo di pensiero di due maestri del peacebuilding,
Howard Zehr e John William Cooley, esaminando le riflessioni che entrambi hanno dedicato
all’influenza che una determinata disciplina artistica ha avuto sul versante sia teorico che pratico del
loro impegno nella pacificazione dei conflitti. Nel caso di Zehr, si considera il contributo che la
fotografia ha avuto nel contesto della riflessione dell’Autore in tema di restorative justice; per quanto
concerne Cooley – cui va riconosciuto il merito di aver riconnesso la metodologia della mediazione
civile all’argomentazione, in particolare di matrice classica – si ripercorrono le riflessioni dell’Autore
in tema di musica (e sul contributo che l’essere compositore ed esecutore può esercitare sulla

This study aims to improve current understanding of how the relationship between perceived math ability and math achievement may be mediated or moderated by levels of anxiety about math, considering intellectual abilities, gender, and school year. In this study, participants were 2,245 Spanish students (7th to 10th grade). All completed the FennemaSherman Mathematics Attitudes Scales and the Sternberg Triarchic Abilities Test. The main results showed that (i) perceivedcompetence is a potent predictor of achievement (the higher the perceived competence, the better the performance in mathematics), (ii) anxiety about mathematics significantly mediates the relationship between perceived competence and math achievement (although the effect is small), and (iii) levels of anxiety condition the intensity of the effect of perceived competence on math achievement (at high levels of anxiety the effect size of the relationship between perceived competence and achievement is large, whereas at low levels of anxiety the effect is small).

El estudio tiene como objetivo mejorar el conocimiento actual sobre cómo la relación entre la capacidad matemática percibida y el rendimiento matemático puede estar mediada, o moderada, por el nivel de ansiedad ante las matemáticas, teniendo en cuenta las habilidades intelectuales, el género y el curso escolar. En el estudio participaron 2,245 estudiantes españoles de 7º a 10º grado. Todos completaron las Escalas de Actitudes Matemáticas Fennema-Sherman y la Escalade Inteligencia Triárquica de Sternberg. Los principales resultados mostraron que (i) la competencia percibida es un potente predictor de rendimiento matemático (cuanto mayor es la competencia percibida mejor es el rendimiento en matemáticas), (ii) la ansiedad ante las matemáticas media significativamente la relación entre la competencia percibida y el rendimiento matemático (aunque el efecto sea pequeño) y (iii) el nivel de ansiedad condiciona la intensidad del efecto de la competencia percibida en el rendimiento matemático (a un nivel de ansiedad elevado el tamaño del efecto de la relación entre la competencia percibida y el logro es grande, mientras que a un nivel bajo el efecto es pequeño).

Through an analysis of the mediative techniques involved in the production of videographic tourist memorabilia (specifically souvenir DVDs of learning to SCUBA dive), in this paper I seek to render visible the often unconsidered aspects of visual media production that result in, not only visual images themselves, but also by extension, the construction of alternate realities of leisure space and tourist performance. A connectionist approach to the study of memory is advocated highlighting that mediatory technologies, whilst acting as stimulants for recollection, actually inform and construct memories rather than transmitting realistic snippets of past experience. In the paper it is questioned whether ‘authenticity’ is a relevant frame of reference bearing in mind that the ‘post-tourist’ is often perfectly aware of the lack of authenticity in many tourist activities and happy to go along with a pretence. With this in mind, the paper concludes by stating that ‘reality’ is arguably being edited-out of memories concerning tourism’s places and practices through the production of commercially driven and produced ‘souvenirs’. For the most part, the paper focuses on the experiences of young tourists between the ages of 18-25, the key demographic attracted to the field site in question.

Mediation ist im deutschsprachigen Raum ein vergleichsweise junges Forschungsfeld. Trotzdem darf es verwundern, wie wenig wissenschaftliche Literatur zum Themenkomplex Geschlecht in der/und Mediation gefunden wurde.
Im Zuge dieses Papers wird der Versuch einer Antwort auf folgende Frage unternommen: Welche Rolle spielt der Faktor Geschlecht in der Mediation auf der Ebene der Mediatorinnen und Mediatoren?
Zwei gegenteilig anmutende Hauptergebnisse, die einander aber nicht ausschließen, können nach Abschluss der Recherche festgehalten werden:
1. Es gibt im Themenfeld Geschlecht und Mediation noch große Forschungslücken zu bearbeiten. Etwa im Bereich der Selbstreflexion von Mediatorin und Mediator, im Ausbildungs- oder Qualitätsentwicklungsbereich.
2. Durch Selbstreflexion, sensible Sprachverwendung, Bewusst-Machen der eigenen Einordnung von Wahrnehmung in Stereotypen kann Mediation von Seiten der Mediatorin/des
Mediators bis zu einem gewissen „menschlichem Grad“ unvoreingenommen und deshalb allparteilich stattfinden.

Es zeigt sich, dass Mediatorinnen und Mediatoren über die unterschiedlichen geschlechtsspezifischen Aspekte zwar Bescheid wissen, aber keine Selbstreflexion in diesem Bereich betreiben. Dies betreffend sollte in Zukunft bereits während der Ausbildungszeit Raum für Bewusstseinsbildung geschaffen werden.

Welche Einflüsse auf das Rezipieren von Kunstwerken wohnen dem Akt des Sprechens inne? Welche Entscheidungen werden hier wie von den Sprechenden getroffen?

Die Seminararbeit «On Translating the Photographic» widmet sich dem Angebot der «Öffentlichen Führungen» als wesentlicher Bestandteil des Vermittlungsprogramms am Fotomuseum Winterthur. Vertieft wird dabei die Sprache als Werkzeug potentieller Wissensproduktion auf ihre vermittlungsbasierende Funktion hin analysiert und in einen sprachwissenschaftlichen Kontext gestellt. Darüber hinaus wird der Leitfrage nachgegangen, inwiefern der Sprache, als übersetzendes Werkzeug zwischen Rezipient_in und Exponat, ein vermittelndes Potenzial innewohnt.

Die Seminararbeit wurde im Zuge die Lehrveranstaltung «Vermittlung in Ausstellungen I» unter der Leitung von Dr. Maren Ziese im Rahmen des Studiengangs MA Art Education Curatorial Studies  im Herbstsemester 2018/19 an der Zürcher Hochschule der Künste eingereicht.

В работе приводятся результаты анкетного исследования сотрудников образовательных учреждений и последующего контент-анализа их ответов на вопросы о том, какие меры по урегулированию споров между детьми они считают наиболее действенными и какие типы конфликтов между детьми они могли бы выделить. Целью исследования являлось выявление типов конфликтов, которые, по мнению сотрудников образовательных учреждений, встречаются наиболее часто и наиболее действенных мер меры по их урегулированию. Материалом исследования послужили данные анкет 35 сотрудников образовательных учреждений. Средний возраст в группе составил 32,5 ± 3,6 года. Стаж работы в среднем составил 9,5 ± 1,2 года. Результаты исследования, полученные с помощью контент-анализа, свидетельствуют, что наиболее частым типом конфликтов, которые указывают сотрудники, являются конфликты, связанные с вопросами лидерства, оскорблений и борьбы. В ответах о наиболее действенных мерах по урегулированию споров преобладали слова «попробовать», «найти», «вмешаться», «спокойно». Выводы по результатам исследования: при том, что наиболее распространенные споры между детьми связаны с проблемами лидерства и борьбы сотрудники обра-зовательных учреждений не имеют надлежащей подготовленности к их решению. This article presents the case for arbitrating the territorial dispute over the West Bank between Israel and the Palestinian Authority. After nearly two decades of intense intermediary activity but with still no signs of progress, and against the inability of the parties themselves to move towards reconciliation, the article argues that as a method of conflict resolution, mediation has exhausted its primary objective – namely the establishing of direct channels of communication between the disputants – and it is now time to examine
alternative methods to conflict resolution. The article debunks the myths surrounding the success of American mediation in the conflict, and uses the historical case of the Taba arbitration between Israel and Egypt to demonstrate under what terms the arbitration of the West Bank dispute might be presented,
while taking into consideration its advantages and drawbacks compared with the more established method of mediation in this conflict.

In einer Übersichtsarbeit über Metaphern als sozialwissenschaftlich relevante Deutungsmuster (Schmitt 2017) fiel auf, dass Konflikte und Konfliktdynamiken mehrfach geschildert wurden. Metaphern generieren (oder repräsentieren) offenbar konflikthafte Sichtweisen, ebenso scheinen sie zur kommunikativen Bearbeitung der Konflikte zu dienen. Forschung, wie Metaphern Konflikte generieren, und wie mit Metaphern umgegangen werden kann, um Konflikte in einer produktiven Weise aufzulösen, ist jedoch erst in Ansätzen verfügbar. Dieser Aufsatz nennt Beispiele für Metaphern in Konflikten und weist auf den erweiterten Metaphernbegriff der kognitiven Linguistik hin. Es folgen Hinweise sowohl für die Forschung zu Konflikten wie für ihre Bearbeitung in der Mediation. Für diese frische Perspektive wird eine rekonstruktive Methode zur Erfassung konflikthafter Metaphern und möglicher Interventionen vorgestellt.

In Italy the government is planning to reduce the length of civil trials by 40%. This is one of the commitments with the EU in order to receive the necessary funding to restart the country and its economy after the Covid-19 pandemic.
On June 16, 2021, the Minister of Justice submitted its proposals for changes to civil process and ADRs to Parliament, which reflect the recommendations made by the Luiso Commission. With regard to mediation:
-. tax benefits;
-. increase of the subjects covered by mandatory mediation;
-. more effectiveness of mediation ordered by the judge;
-. clarification of the mediation proceeding to make it more effective;
- involvement of the public administration;
- quality of training.
Moreover the Government has foreseen 5 million euro expenditure in 2022 and 60 million from 2023 for mediation.

Brand love is an interesting and important concept that required further research in brand management. This study tested the impacts of consumer attitudes, subjective norms, and brand anthropomorphization on brand love and brand forgiveness in the framework provided by the theory of planned behavior. Regression analyses showed that brand anthropomorphization and subjective norms have a signifi cant impact on brand love. Brand love positively infl uences brand forgiveness and acts as a mediator between subjective norms, brand anthropomorphization, and brand forgiveness constructs. Besides mediation, brand anthropomorphization directly infl uences brand forgiveness. The findings of this study contribute to the existing knowledge on brand love and brand forgiveness concepts by presenting empirical research fi ndings that investigate brand love antecedents. This study has also shown the signifi cant impact of anthropomorphizing a brand on brand forgiveness and brand love.
