In this article, the authors compare alternative conflict resolution mechanisms in Colombia and Russia. In the former, conciliation is the most developed alternative dispute resolution mechanism, while in the latter, mediation is the most developed. In order to deepen this comparison, a qualitative research of interpretative nature has been developed with the support of bibliographic-documentary material. The main conclusion is that access to justice is a human right that has been positivized as a fundamental right in the constitutions of both Colombia and Russia. However, the Colombian Constitution allows individuals to exercise their jurisdictional functions on a temporary basis, unlike the Russian Constitution, which only authorizes judges from the Federation to exercise their jurisdictional functions. While conciliation in Colombia is developed and implemented through State-supervised Conciliation and Arbitration Centers, mediation in Russia is in its initial phase and has gradually gained acceptance in society. In both states, the implementation of alternative dispute resolution mechanisms has been driven by the need to decongest the courts and tribunals of ordinary justice. Therefore, it is useful to insist on the massive use of these instruments to make possible a justice that comes from the parties in conflict, that can repair the relations of the subjects in dispute and that tends towards the construction of more peaceful societies.

In Italy the government is planning to reduce the length of civil trials by 40%. This is one of the commitments with the EU in order to receive the necessary funding to restart the country and its economy after the Covid-19 pandemic.
On June 16, 2021, the Minister of Justice submitted its proposals for changes to civil process and ADRs to Parliament, which reflect the recommendations made by the Luiso Commission. With regard to mediation:
-. tax benefits;
-. increase of the subjects covered by mandatory mediation;
-. more effectiveness of mediation ordered by the judge;
-. clarification of the mediation proceeding to make it more effective;
- involvement of the public administration;
- quality of training.
Moreover the Government has foreseen 5 million euro expenditure in 2022 and 60 million from 2023 for mediation.

Bu çalışmamızda, fikri ve sınai haklarla ilgili uyuşmazlıklarda kanun koyucu tarafından dava şartı olarak öngörülen arabuluculuğun kapsamı ele alınmıştır. Çalışmada Türk Ticaret Kanunu'nun tabiri ile "fikri mülkiyet hukukuna dair mevzuatla" ilgili dava şartı arabuluculuğun sınırları ve hangi tür davaların bu kapsamda kaldığı irdelenmiş, bir vakanın dava şartı arabuluculuk sınırları içinde kalması için aranan şartlar açıklanmıştır. Kanuni ismi dava şartı olsa da uygulamada, gerek hukukçular gerekse diğer kişiler tarafından konuya ilişkin olarak sıklıkla "zorunlu" kavramının kullanıldığı da göz önüne alınarak, çalışma boyunca bu iki kavrama da yer verilmiştir. Çalışmamızda ilk olarak arabuluculuğun ayrı bir müessese halinde hukuk sistemimize girişi ve sonrasında işçi-işveren uyuşmazlıklarıyla başlamak üzere zorunlu/ dava şartı arabuluculuğun hukuk sistemimizdeki seyri kısaca açıklanmıştır. Ardından, çalışmanın kapsamına inilerek, fikri ve sınai mülkiyet hukukundaki zorunlu arabuluculuk kurumu irdelenmiş ve son bölümde çalışma toparlanarak sona erdirilmiştir. Çalışmamızda zorunlu arabuluculuğa ilişkin genel teorik bir malumat verilmiş olmakla birlikte, yer yer uygulamaya dair bilgiler aktarılmış ve bazı öneriler dile getirilmiştir.

The article deals with the categories of mediability and arbitrability of a legal dispute, identifies their individual general and special characteristics. Taking into account the current legal regulation and doctrinal approaches, the author analyzes the correlation of the concepts of mediability, arbitrability and jurisdiction. It offers its own conclusions regarding the assessment of the mediability and arbitrability of a legal dispute, based on the understanding of the legal relationship structure existing in the theory of law.

In every case of domestic violence there are two over riding interests which should be guarded carefully-protecting the victim from further abuse and empowering the victim to take back control over her life 1. Those opposed to Mediation where domestic violence is present argue that mediation legitimizes violence rather than punishing abusers, places the victim at risk for further abuse and results in unfair agreement; since the imbalance of power between the male and the female spouse is palpable in such cases. However, commentators who support Mediation in cases involving domestic violence argue that mediation can be used in responding to domestic violence, where the traditional court system has failed in responding to domestic violence; mediation empowers participants to end violence within their relationship by serving as a model of conflict resolution; and allows them to create guidelines to govern future interaction 2. To elaborate further on the supporting view, this commentary is an attempt to examine how Mediation in cases of domestic violence restores the imbalance of power present in such disputes. It strongly supports the idea that Mediation is a tool that empowers the female spouse in such a situation.

ARABULUCULUK VE SİNGAPUR SÖZLEŞMESİ
Arabuluculuk, alternatif uyuşmazlık çözüm yöntemleri içerisinde yer alan ve günden güne gelişen bir uyuşmazlık çözüm yöntemidir. Arabuluculuğun yargılama temelli uyuşmazlık çözüm yöntemlerine nazaran önemli avantajları bulunmaktadır. Bu avantajlarının varlığına rağmen mühim derecede zayıf bir yönü de bulunmaktadır. Bu zayıf yönü, arabuluculuk faaliyeti sonucunda elde edilen arabuluculuk anlaşma belgesinin sınır ötesi icrası oluşturmaktadır. Arabuluculuk anlaşma belgesi, kural olarak, tarafların üzerinde mutabık kaldıkları hususları yerine getirmeyi taahhüt ettikleri bir sulh sözleşmesidir. Yerine getirilmeyen diğer sözleşmelerin icrası gibi arabuluculuk anlaşma belgesinin icrası için de dava açılmak zorunda kalınır ise, arabuluculuk etkin bir uyuşmazlık çözüm yöntemi olma özelliğine sahip olamayacaktır. Bu zayıf durumu bertaraf edebilmek amacıyla Singapur Sözleşmesi hazırlanmıştır. Singapur Sözleşmesi'nin kapsamına giren ticari nitelikteki arabuluculuk anlaşma belgeleri, Sözleşme'de belirtilen şartları sağlamak kaydıyla, âkit ülkelerde icra edilebilecek veya kesin delil olarak yararlanılabilinecektir. Elinizdeki bu çalışmada, arabuluculuk anlaşma belgelerinin sınır ötesi icrasını ve kesin delil etkisini düzenleyen Singapur Sözleşmesi detaylı bir şekilde ele alınmıştır.

The COVID-19 pandemic blew-up in early 2020 in Hong Kong and Italy. Among other consequences, many court hearings were postponed and the backlog increased. The use of ODR has been enhanced in both countries (and all over the world) but in completely different ways.

The Mornington Island Restorative Justice program (MIRJ) is an innovative and community driven dispute resolution initiative. This CBA values the social impacts (impact on society’s wellbeing) of the program in economic terms. The MIRJ program returns economic benefits that far exceed its economic costs. This is true both for the decision to establish the program in 2008, and for the decision in 2015 to continue the program. Sensitivity analysis shows this is a very robust conclusion.

Est-ce qu’un linguiste envisage la médiation de la même façon qu’un juriste ou un didacticien ? Est-ce que la médiation cognitive a quelque chose à voir avec la médiation interculturelle et la médiation institutionnelle ? Est-ce que le médiateur culturel, le médiateur social et le médiateur urbain exercent le même travail ? Lorsque la médiation apparaît dans des textes ou des discours, on saisit sommairement à quoi elle renvoie, d’autant plus que sa définition s’enrichit des connaissances, des compétences, des pratiques et des situations propres aux domaines qui la concernent.

Cet ouvrage questionne « l’essentiel de la médiation » suivant le regard des sciences humaines et sociales. Des scientifiques, experts, professionnels apportent des éclairages par une approche globalement pluridisciplinaire et quelquefois interdisciplinaire, à partir des sciences du langage, sciences de l’information et de la communication, sciences de l’éducation, sociologie, philosophie, droit. A Lei nº 13.467 de 2017 inseriu na CLT inovações relativas a duas fórmulas alternativas à jurisdição contenciosa trabalhista, a cláusula compromissória de arbitragem e o processo de jurisdição voluntária de homologação de acordo extrajudicial. Existe, contudo, uma forte resistência no âmbito da magistratura do trabalho, bem como na doutrina clássica, às vias alternativas à Justiça do Trabalho. Existem alguns “mitos” apresentados como dogmas insuperáveis pelos que negam a admissibilidade da mediação extrajudicial e da arbitragem como meios de solução de conflitos individuais trabalhistas. Os principais argumentos apresentados se referem às teses da indisponibilidade absoluta de todos os direitos trabalhistas, da ideia de que apenas um juiz do trabalho reúne as condições necessárias à adequada composição de um conflito individual trabalhista e, ainda, da suposta existência de uma ameaça à Justiça do Trabalho caso ocorra o uso intensivo dessas vias alternativas. Por meio de uma análise crítica da realidade dos órgãos do Judiciário Trabalhista, formulada em observações extraídas da realidade cotidiana desse ramo da Justiça, será desenvolvido um esforço para superar tais dogmas e demonstrar a admissibilidade das fórmulas alternativas, desde que satisfeitas algumas condições mínimas de aplicabilidade. Em seguida, serão examinados criticamente os dispositivos da Lei nº 13.467 de 2017 que disciplinam essas vias alternativas, com o objetivo de descrever as novas técnicas colocadas à disposição dos sujeitos da relação de emprego para dirimir seus conflitos individuais. Ao final, será enfatizada a importância da participação dos juízes, dos mediadores e dos árbitros no processo de fortalecimento da Justiça do Trabalho.

From restorative justice literature in general. two conceptions of restorative justice processing can be discerned. The one is a
modest conception based on individual (dispositional) theories of crime and the other is an expansive view which is closer to peacebuilding and has a further distinction. One distinction is based on situational theories of crime which hold that structural factors are responsible for crime. The other distinction is based on integrative theories of crime which hold that there is an interaction between individual and structural factors that produce crime and that structural factors should be taken into account during restorative justice processing.

Mediation as a dispute resolution method is being rediscovered today in Western legal systems. Modern jurisdictions now tend to promote mediation according to a 'formal legislative approach', based on recommendations issued by international organizations, in response to the pressure of public opinion that shows discontent with constant crisis in the justice system. The EU Directive of 2008 on civil and commercial mediation has in vague terms imposed the obligation to ensure the quality of mediation services, and by declaring as desirable only a certain level of training for mediators, it has left it up to member states to decide whether to make accreditation compulsory. In such a framework, where there is likely to be a further push towards regulation, we need to discuss what the basic skills of a mediator are. The point is that the mediator's professionalism is not easily pigeonholed in a set of disciplinary skills. The mediation model that the European Union has sought to promote and regulate is highly legal, but good mediation skills are not necessarily the same as the ones required to earn a degree in law and then pass the bar exam. University education must not necessarily train mediators, but rather form professionals who should be aware of the skills needed in mediation, or who know enough about mediation to direct their clients to mediation when the need arises. In order to prepare for anticipated future disputes and discern when to negotiate and when to fight, it becomes important to simulate conflict experientially, and to field-test what works in managing it, and when possible, in solving it. Simulating conflict using audio recordings, videos, and feedback reports allows the teacher to make the learner relive what happened: decisive moments, what could have been said differently or better, what should have not been said, posture, signs of nervousness, proxemics, all that which makes us feel more comfortable or uncomfortable in a situation. Empirical research using a socio-psychological paradigm has shown, for example, that mediators are assessed as effective when they are able to create an atmosphere of trust in mediation meetings, adapting flexibly to the situation, and transmitting energy, optimism and a non-judgmental attitude.

Sistematik teknikler uygulayarak, görüşmek ve müzakerelerde bulunmak amacıyla tarafları bir araya getiren; onların birbirlerini anlamalarını ve bu suretle çözümlerini kendilerinin üretmesini sağlamak için aralarında iletişim sürecinin kurulmasını gerçekleştiren, tarafların çözüm üretemediklerinin ortaya çıkması halinde çözüm önerisi de getirebilen uzmanlık eğitimi almış olan tarafsız ve bağımsız bir üçüncü kişinin katılımıyla ve ihtiyari olarak yürüttükleri uyuşmazlık çözüm yöntemi olan Arabuluculuk, 6325 sayılı yasa ile Türkiye’de ilk olarak 2012 yılında uygulanmaya başlanmıştır.
2012 yılından günümüze kadar geçen kısa sürede etkin şekilde uygulanmaya başlayan arabuluculuk, ihtiyari olmasının yanında, 01.01.2018 tarihinden itibaren iş hukukundan kaynaklanan davalarda zorunlu bir yöntem olarak uygulanmaya başlanmış ve 7036 sayılı kanun ile 1950 tarihli İş Mahkemeleri Kanununda köklü değişiklikler meydana getirmiştir. Zorunlu arabuluculuk yöntemi neticesinde elde edilen veriler nazara alınarak, bu arabuluculuk türünün uygulanacağı alanlar genişletilmiş ve 01.01.2019 tarihi itibariyle ticari davalardan kaynaklı uyuşmazlıklar için de zorunlu arabuluculuk yöntemi getirilmiştir.
6325 sayılı yasaya bu değişiklikler neticesinde gerek ihtiyari arabuluculuk türünde gerekse zorunlu arabuluculuk türünde uygulanmak üzere yeni hükümler eklenmiş, bazı hükümler kaldırılmış ya da mevcut hükümlere eklemeler yapılmıştır. Kısa denilecek süreç içerisinde arabuluculuk yönteminin benimsenmesi ve çeşitli değişiklikleri getirmesi, yöntemin ileride de günün koşullarına göre şekillenebileceği konusunda sinyaller vermektedir.
Yargı yoluna nazaran hızlı, daha az masraflı, tarafların sürece daha fazla dahil olduğu ve bunun sonucu olarak taraflar arasındaki uyuşmazlığın üçüncü bir kişi tarafından değil de bizzat uyuşmazlık yaşayan taraflarca çözülmesi esas olduğundan bugüne kadar alışılagelen yöntemlerden, özellikle yargıdan ayrılmaktadır.
Çalışmaya konu olan ve arabuluculuk yöntemi ile mukayese ettiğimiz bir diğer yöntem ise, ilham kaynağının Osmanlı İmparatorluğu devlet yöntemi olduğu belirtilen, ancak bugün anladığımız şekilde ilk kez İsveç’te ortaya çıkan ombudsmanlık (Kamu Denetçiliği Kurumu) yöntemidir. Türkiye’de Kamu Denetçiliği Kurumunun oluşturulması adına süreç dahilinde çeşitli girişimler gerçekleştirilse de nihayetinde 2010 yılında yapılan Anayasa değişikliğine ilişkin referandum neticesinde Anayasada yer almış ve 2012 yılında 6328 sayılı Kamu Denetçiliği Kurumu Kanunu tesis edilmiştir.
Bireyin idare gücü karşısında korunması amacına hizmet eden denetim türü olan ombudsmanlık, idarenin işlem ve eylemlerinden ötürü, bireylerin şikayetleri ile harekete geçen, geniş yetkilerin tanındığı, denetlemenin yapıldığı ancak bağlayıcı kararların verilemediği, bu kararların parlamento ve kamuoyu ile paylaşıldığı bir süreç olarak tanımlanmaktadır. Burada da arabuluculukta olduğu gibi yargı yoluna nazaran daha hızlı, masrafsız yöntem olması, ayrıca hukuka aykırılığın yanında yerindeliğin de denetlendiği bir süreç olması Kurumu idari yargıdan farklı bir şekilde konumlandırılmasına neden olmaktadır.
Gerek arabuluculuk gerek ombudsmanlık yöntemleri aynı dönemde çıkmış iki yasa olarak biri özel hukuk uyuşmazlıklarında diğeri ise kamu hukuku uyuşmazlıklarında yaşanan ihtilafların çözümünde etkin yollar olma yolunda hızlı bir şekilde ilerlemektedir. 6325 sayılı Hukuk Uyuşmazlıklarında Arabuluculuk Kanunu ve 6328 sayılı Kamu Denetçiliği Kurumu Kanunu düzenlemeleri incelendiğinde, her iki yöntemin birbiri ile benzerlik ve farklılık gösterdiği görülmektedir.
Kısa sürede büyük gelişim gösteren arabuluculuk ve ombudsmanlık, ilerleyen süreçte daha da yaygınlaşarak, uygulanacağı alanlar bakımından çeşitleneceği, birden fazla alana sirayet ederek mevcut uyuşmazlıkların barışçıl bir yolla çözülmesine vesile olacakları tartışma götürmemektedir.

El desarrollo de diferentes técnicas de mediación es una labor importante para dotar a los profesionales del área de instrumentos que permitan cumplir con su tarea. El Método Transcend que se pone a consideración aquí es tan solo una más de estas técnicas. En el presente trabajo se abordará el marco conceptual sobre el que opera, su estructura interna y la mecánica de procedimiento mediante la cual se practica. Diversas consideraciones sobre el proceso y el resultado son también abordadas como puntos referenciales. La descripción que aquí se presenta es superficial, pero estructurada, y aborda por igual consideraciones de orden teórico que práctico. Para profundizar en el contenido y el origen del modelo puede acudirse a la bibliografía citada.

Mandatory mediation is an important topic as it is becomes more and more of a reality. However, questions as to the appropriateness of coercion in requiring attendance at mediation do arise. Accepting that coercing mediation is not an oxymoron, the question then becomes whether the coercion is justified when considering personal rights to self-determination and the inherent freedom of choice that it comes with. It is submitted that it is justified in the circumstances, and that criticisms of said coercion do not stand up to scrutiny. It is submitted that said coercion is less than, and therefore preferable to, judicial coercion. This is especially underlined by mandatory mediation's ability to restore balance where court action places a plaintiff in a stronger position than a defendant.

On August 25, 2021, Law decree 118/2021 came into force, introducing a new proceeding in the Italian legal system, the “Negotiated settlement for the solution of business crisis”, concerning the prevention/management of the business crisis. Many analyses have already been carried out. A crucial aspect has been neglected, the training in negotiation and mediation techniques. How should the training be set up? How to negotiate/mediate the relationship between creditors and debtors, especially banks?

While mediation is a novel institution regarding Turkish Law, its meaning and characteristics are not foreign to any society. Mediation is an institution which aims to resolve disputes between individuals through peaceful means. As such, individuals do not have to go through a corrosive litigation process and it ensures that the dispute is resolved in a fashion which satisfies them, even if in a limited manner.

Law No. 6325 on Mediation in Civil Disputes adopted in 2012 regulates the legal regime of the institution of mediation. The Law entered into force on the 22nd of June 2013. With entry into force of this legislation, the institution of mediation has become a more systematic field necessitating expertise.

This study examines the mediation contract covering the declaration of intent of the parties regarding their will to resolve their disputes by way of mediation, as well as the elements of this contract and other contracts prepared during the mediation phase. In practice, mediation contracts prior to disputes or for existing disputes are rarely observed. Considering that the ideal time to adopt mediation is before the existence of a dispute and that we live in a global age where contracts
with foreigners are wide-spread, this article has been prepared in order to relay information on the functioning of mediation contracts under Turkish law and to eliminate any lack of information on the implementation of these contracts.

Hoewel er geen recente cijfers of empirisch onderzoek over bestaan, leeft de perceptie dat er steeds meer aansprakelijkheidsclaims worden ingesteld tegen advocaten. In de eerste plaats is het voor cliënten een uitweg om tijdelijk aan de betaling van het ereloon te ontsnappen. Daarnaast vormt het een manier om met de frustratie van het verliezen van een rechtszaak om te gaan. Bovendien voelen veel burgers zich door de opkomst van het internet en andere media beter geïnformeerd. Daardoor zijn ze mondiger geworden en koesteren ze meer concrete verwachtingen ten opzichte van hun raadsman over de uitkomst van een geding. Omwille van de vele rechtspraak en de veelzijdigheid van de problematiek focussen we ons in het eerste hoofdstuk van deze bijdrage op drie grote leerstukken met betrekking tot de aansprakelijkheid van de advocaat (bewijs, verjaring en verlies van een kans). Het grote aantal uitspraken over de aansprakelijkheid van de advocaat is paradoxaal ten opzichte van het aantal vorderingen ingesteld tegen bemiddelaars. In de Belgische gepubliceerde rechtspraak is daar geen enkel voorbeeld van te vinden. Niettemin lijkt het belangrijk om een blik te werpen op de professionele aansprakelijkheid van de bemiddelaar. In de eerste plaats omdat het grootste deel van de bemiddelaars nog steeds advocaten zijn. Bovendien wordt deze methode van alternatieve geschillenoplossing actief gepromoot door de wetgever en worden ieder jaar meer en meer bemiddelaars opgeleid.

Mediation is usually understood as a technique used by an impartial, professional third party for the purpose of assisting parties to the dispute so that they could resolve the conflict between them. The mediator achieves this goal by the use of specialized communication and negotiation techniques.

Mediation is one of the most ancient dispute resolution methods effectively used for centuries. It offers a set of benefits (e.g., mediation increases the control the parties have over the resolution, reduces costs, saves time and energy, it is not mandatory etc.) and thus, makes the resolution of any dispute highly effective.

In the light of aforementioned, mediation is currently being considered in many countries as one of the effective tools used in order to deal with the challenge of interpersonal disputes of the contemporary and complicated character. This aspect of mediation makes it more interesting and attractive, and necessitates in-depth analysis dedicated to the topic of Dispute Mediation.

This paper discusses the history of evolution of dispute mediation. It consists of an introduction, two parts and concluding remarks. The first part looks into the most important details of archaic dispute resolution in various world regions. The second part is titled as ‘Church Dispute Resolution’ and studies several separate topics including the early Church dispute mediation, the Church-State dispute mediation, and the evolution of the modern Church dispute mediation mechanisms.

Parenting Plans have become the default legal document for divorces in Western jurisdictions. A Google search for templates showed 5 vulnerabilities in high-conflict settings that would tend in practice to hamper mediation and promote parental alienation. Our mediation centre/child protection agency has developed an alternative that (1) focuses the parents on the children's developmental needs (2) addresses the separation-based emotions that hamper agreement (3) promotes shared-parenting (4) replaces the rights-based approach with a care-based approach and (5) alerts parents to the consequences of obstruction. Based on UK templates and designed around s18 - s35 of the Children's Act, 38 of 2005 for use in South Africa, it is a generic document for mediators to prepare parents emotionally and practically before finalising parenting plans.

Il 7 agosto 2019, a Singapore, si è tenuta la cerimonia per l'apertura delle sottoscrizioni della Convenzione delle Nazioni Unite sugli accordi internazionali di transazione risultanti dalla mediazione. In tale occasione, già quarantasei Stati, tra cui Stati Uniti, Cina, India e Corea del Sud hanno apposto la loro firma in calce al trattato, mentre, a seguire, altri 20 Paesi hanno già manifestato l'intenzione di aderire al testo, che comunque entrerà in vigore quando almeno tre Paesi firmatari avranno portato a termine l'iter per la ratifica secondo le proprie procedure nazionali. Scopo dichiarato della Convenzione, già denominata "Convenzione di Singapore sulla mediazione", è quello di creare un quadro giuridico armonizzato per la composizione equa ed efficiente delle controversie insorte nelle relazioni commerciali internazionali, riconoscendo il valore della mediazione come metodo di risoluzione amichevole delle controversie nel contesto delle relazioni commerciali internazionali. In buona sostanza, quindi, il trattato intende rappresentare per la mediazione ciò che la Convenzione di New York del 1958 rappresenta attualmente per l'arbitrato, ovvero un testo in base al quale sia possibile ricorrere alla mediazione con la garanzia del successivo "riconoscimento" 1 internazionale dell'accordo transattivo eventualmente raggiunto. In effetti, come noto, l'uso della mediazione come forma di risoluzione alternativa delle controversie di carattere transfrontaliero è certamente scoraggiato dall'impossibilità, pressoché totale, di ottenere un'efficace tutela internazionale dell'accordo transattivo raggiunto dalle parti, a meno che esse non riescano ad "inserire" o riprodurre il contenuto del medesimo accordo all'interno di più comuni formule decisorie arbitrali. 2 1 Nel presente commento alla Convenzione chi scrive intende fare propria questa traduzione del termine anglosassone "reliance", altrimenti traducibile come "affidamento", in quanto il termine "riconoscimento" rende meglio l'idea delle conseguenze legali derivanti dalla richiesta di tutela che le parti, ai sensi dell'articolo 4 della stessa Convenzione, possono formulare avanti l'autorità giudiziaria di ciascuno Stato firmatario. 2 Tali lodi vengono comunemente definiti come "award by consent" o "award on agreed terms". In Italia, peraltro, seppure è ammesso il riconoscimento di lodi stranieri che riproducono i contenuti dell'accordo raggiunto dalle parti, la maggior parte della dottrina nega che il nostro ordinamento consenta agli arbitri di emettere tale tipo di lodo, almeno nell'ambito dell'arbitrato "rituale", in quanto ritenuto contrario alle norme imperative del nostro sistema processuale. La consulenza tecnica ha avuto inizialmente una funzione ancillare nell’ambito della procedura di mediazione, ma è via via cresciuta di importanza soprattutto nelle controversie relative a liquidazione di danno causato da incidente stradale o cattiva sanità, dispute bancarie e finanziarie, esecuzione di lavori edili. E, col tempo, si è posto anche il quesito su di un possibile utilizzo della perizia (ottenuta in mediazione) nel successivo eventuale giudizio, per risparmiare tempo e denaro. Fino a giungere alla disposizione di una CTU consulenza tecnica d’ufficio nell’ambito del giudizio, non soddisfacente, ed il rinvio delle parti in mediazione delegata, con l’indicazione da parte del giudice di “paletti” entro cui gestire quest’ ultima, ricorrendo eventualmente ad una CTM, consulenza tecnica in mediazione. Una “conversione ad U” fino a pochi anni prima inimmaginabile.
Il tutto, tenendo conto che una delle caratteristiche cardine della mediazione è la riservatezza e che una perizia, ottenuta al di fuori del processo, non può essere considerata prova in senso tecnico.

The Mediation Act has been applied in the Republic of Serbia since 2005. In the past period, the application of this Act has pointed out to a number of drawbacks and deficiencies in the system of resolving disputes through mediation. The dominant features of the current mediation system are some inadequate legal solutions, poor organization and insufficient preparation of the courts to internalize mediation, failure to provide relevant information about mediation to litigants and other participants in the judicial process, insufficient judicial training and education of lawyers and parties on mediation and other ADR methods, etc. Considering that the primary purpose of mediation is to diminish the litigation caseload and reduce the costs of court proceedings, the basic goal of introducing mediation into the Serbian legal system has not been accomplished. In order to improve the mediation system, the Serbian authorities launched a public debate in 2010 on designing a new legislative act which would eliminate the shortcomings of previous act and improve the efficiency of mediation. After nearly four years, the extensive debate and confrontation of different mediation concepts led to adopting a new Draft Mediation Act in 2013. As compared to the applicable 2005 Mediation Act, the Draft Mediation Act contains some innovations, such as the enforceability of a mediation agreement under specific conditions and the opportunity of introducing mandatory mediation in some cases. In this paper, the author analyzes the above issues on the basis of findings of economic theory and the results of the empirical study on the efficiency of mediation in Serbia in civil matters. In this context, the author argues that the achievement of the above objectives (to reduce the caseload and legal costs) calls for establishing a sustainable mediation system. In addition to instituting good legal solutions (such as mandatory mediation), the system should be supported by joint efforts and financial resources of responsible institutions and individuals. In a nutshell, mediation may come to life only if the legislative efforts are accompanied by a large-scale social action aimed at promoting this form of dispute resolution.
