L’auteur rend compte des développements induits par le numérique jusque dans des secteurs restés dans un premier temps à l’écart du changement. Elle analyse les fondements et les outils de la politique culturelle et elle en dessine les principales évolutions.
À partir d’un retour sur les fondements de ce droit, ce livre de deux économistes montre la tension permanente entre la recherche de la diffusion la plus large des œuvres de l’esprit et la volonté de protéger, respecter et rémunérer la création. Il propose tout à la fois un état des lieux de la pensée économique sur le droit d’auteur et une synthèse originale des principaux débats sur la légitimité, le champ d’application et les enjeux stratégiques de ce droit.
L’économie du patrimoine ne saurait se résumer à la question de ses retombées sur d’autres activités ; pourtant, la tentation de s’y référer est toujours présente, au risque de l’instrumentalisation d’une culture conçue comme créatrice d’emplois et génératrice de revenus. On discutera de la pertinence et des limites de la thématique des retombées.
Le premier chapitre dessine les territoires du patrimoine. Il en montre les facteurs d’élargissement, et spécifie les caractéristiques économiques des biens et des services. Dans le deuxième chapitre, il est fait état des éléments qui déterminent la consommation de patrimoine. Celle-ci n’est pas indifférente à la montée des coûts de conservation (ch. 3), souvent justifiés au titre des retombées économiques du patrimoine et des perspectives de valorisation de sites et de lieux particulièrement attractifs (ch. 4). Parce que le patrimoine relève de la mémoire et de l’histoire, la question de sa propriété et de l’encadrement juridique le plus approprié évolue dans le temps. Comment articuler instruments juridiques et réglementaires et subventions ? Jusqu’à quel point les pouvoirs publics doivent-ils intervenir ? Quelles politiques mener, quelle est la dépense publique optimale et sa raison d’être, et à quel niveau intervenir (ch. 5) ? Ces questions se posent aujourd’hui au niveau mondial, notamment dans le cadre de la politique patrimoniale menée par l’UNESCO mais faiblement dotée de moyens ; faut-il s’acheminer vers ce qu’on nous pourrions qualifier de droit d’ingérence patrimoniale (ch. 6) ?
A l’heure numérique, il faut tout réinventer. C’est ce que tente cet essai, qui met en cause les séparations familières entre le journal et le livre, le blog et l’article, le manuscrit et le texte édité. Le numérique modifie tous les aspects de la chaîne de l’imprimé et remet en perspective le métier de tous ceux qui y travaillent
La politique culturelle semble en effet bien paradoxale : elle entend protéger les activités culturelles d’une trop forte emprise de l’économie, mais elle met en avant avec un enthousiasme de néophyte les retombées économiques de la culture. Elle prône l’ancrage dans les territoires mais demeure bien parisienne. Elle défend une exception française face à la mondialisation mais semble perdre pied dans le concert des nations. Prompte à défendre le droit des auteurs, elle se heurte aux pratiques effectives des internautes. Elle peine à définir des modalités vertueuses d’accompagnement de la révolution numérique. Elle entend soutenir la diversité mais se trouve sommée de mieux distribuer ses aides et de les recentrer. Elle doit afficher des résultats de court terme quand la culture a trait avant tout aux rythmes longs de la création, de la préservation des patrimoines, de la formation des publics.
