La presente contribución intenta exponer la tensión entre el sistema de medidas de seguridad cura... more La presente contribución intenta exponer la tensión entre el sistema de medidas de seguridad curativas regulado en el Código Penal uruguayo de 1934 (en adelante CP) y las últimas normas aprobadas en materia de derechos de las personas con discapacidad (Convención de los Derechos de las Personas con Discapacidad, ley 18418, en adelante CDPD), salud mental (Ley de Salud Mental, ley 19529, en adelante LSM) y enjuiciamiento penal (Código del Proceso Penal, ley 19293, en adelante CPP), concretamente en lo que refiere a la falta de limitación de la duración temporal de las medidas de seguridad curativas.

El enjuiciamiento de adolescentes que cometen infracciones a la ley penal ha sufrido importantes ... more El enjuiciamiento de adolescentes que cometen infracciones a la ley penal ha sufrido importantes cambios a partir de la aprobación del Código del Proceso Penal y sus posteriores modificaciones. Dos de las más importantes son la inclusión del proceso abreviado para adolescentes (art. 273 bis CPP, en adelante PAA) y del proceso simplificado (art. 273 ter CPP, en adelante PS), estructuras procesales incluidas en el CPP por la Ley 19.889 de Urgente Consideración. Sin que fuera pensado como una estructura procesal para la materia penal de adolescentes, el PS se ha aplicado en la justicia especializada a pesar de los debates en torno a su admisibilidad en este ámbito. En el presente artículo analizo el uso del proceso simplificado en el sistema de justicia penal para adolescentes comparándolo con las demás estructuras procesales vigentes antes y después de la Ley 19.889; e identifico algunas de las posibles razones e incentivos para su uso.

En este capítulo abordamos algunas particularidades del campo de la salud mental expresadas en la... more En este capítulo abordamos algunas particularidades del campo de la salud mental expresadas en las infancias y las adolescencias. Este tema se convierte en uno de los tópicos a atender en el marco de la investigación realizada, dado que niños, niñas y adolescentes son uno de los sectores en condiciones de mayor vulneración a la hora de atender sus dolencias, malestares e incomodidades propias del proceso de vida. Para ello, incorporamos la perspectiva de la interseccionalidad, en la medida que esta nos orienta en una mirada aguda sobre diversos aspectos de la vida de niños, niñas y adolescentes, que involucran a la salud mental como expresión de la diversidad en las circunstancias de vida y los trazos vitales.

El presente trabajo tiene por objetivo ofrecer al lector una síntesis descriptiva de los principa... more El presente trabajo tiene por objetivo ofrecer al lector una síntesis descriptiva de los principales instrumentos jurídicos internacionales y nacionales abocados a prevenir y sancionar el tráfico internacional de menores. Precisamente, se suministra un énfasis particular en la Convención Interamericana sobre Tráfico Internacional de Menores por ser la norma matriz de la materia. El objetivo es problematizar algunos supuestos normativos de este instrumento desde dos dimensiones centrales en su diseño legislativo: la técnica de tipificación penal y sus proyecciones sobre los mecanismos de cooperación penal internacional. La estructura del trabajo busca explorar, desde algunos materiales inusualmente presentes en el discurso especializado, las aristas más relevantes de esta actividad criminal. Por último, se pretende capturar una síntesis interdisciplinaria entre las intersecciones del Derecho Internacional Privado y el Derecho Penal Internacional, justamente, en un punto cardinal de convergencia normativa: el interés superior del menor.
