Pour la troisième année consécutive, la chaire PwC de droit fiscal, qui développe ses activités a... more Pour la troisième année consécutive, la chaire PwC de droit fiscal, qui développe ses activités au sein du centre de recherche interdisciplinaire Droit Entreprise et Société (CRIDES) de la faculté de droit de l’UCL, a organisé son cycle de séminaires, intitulé « Les Dialogues de la fiscalité ». La Chaire PwC de droit fiscal poursuit l’objectif de stimuler l’étude et le débat autour de thématiques fiscales actuelles. Sa spécificité réside dans la recherche d’un équilibre entre les positions de tous les acteurs de la fiscalité : personnes chargées de l’application des règles fiscale à tous les niveaux de pouvoir, professionnels du conseil juridique et/ou fiscal et experts issus de l’université ou d’autres centres de recherches reconnus. Par ailleurs, à travers le contenu des thématiques choisies, la Chaire PwC tend également à faire une balance entre les préoccupations des praticiens et des réflexions – plus générales – de politique fiscale. Nous laissons le soin au lecteur d’apprécier si ces objectifs ont été atteints. Cette année encore, nos séminaires ont permis de faire le point sur l’actualité fiscale récente, à un moment où l’on a assisté à une reprise certaine de l’action du gouvernement fédéral dans ce domaine. Il a cependant paru important de couvrir également l’évolution de la matière fiscale dans d’autres cénacles, à savoir au niveau européen, au niveau régional, ou encore d’examiner diverses questions abordées par la jurisprudence nationale et internationale. Le premier séminaire a permis d’aborder certaines nouvelles mesures concernant la fiscalité mobilière, adoptées principalement au niveau fédéral et de les analyser, tant dans leur mise en oeuvre concrète que dans un cadre plus large. En effet, ces mesures poursuivent des objectifs essentiellement budgétaires, et il a paru utile d’offrir aux lecteurs une perspective interdisciplinaire sur celle-ci, en y intégrant l’éclairage d’économistes. Le deuxième séminaire a eu pour objet la fiscalité familiale. Il s’agit d’une matière qui, par ses multiples aspects, concerne pratiquement l’ensemble des contribuables, mais qui bénéficie d’une attention des commentateurs inférieure à d’autres domaines de la fiscalité. Sont ainsi abordées des questions aussi diverses que la planification successorale entre époux, l’utilisation d’une société dans le cadre familial, quelques questions liées à l’assurance-groupe en cas de divorce ou encore le recouvrement des dettes fiscales sur le patrimoine des époux. Le troisième séminaire s’est intéressé de manière spécifique aux évolutions européennes en matière de fiscalité. La Commission européenne s’est, en effet, distinguée durant l’année écoulée par une activité intense, tant sur le versant des propositions de directives fiscales que sur celui des procédures d’infraction contre les Etats membres, certaines ayant dû être tranchées par la Cour de justice. Cette activité de la Commission a porté tant sur les impôts indirects (taxe sur la valeur ajoutée), où différentes initiatives ont été prises ou annoncées, qu’en matière d’impôts directs, où 2011 restera l’année da la proposition d’harmonisation de la base commune consolidée à l’impôt des sociétés (ACCIS). Enfin, le quatrième et dernier séminaire s’est focalisé sur la relation entre l’administration fiscale et le contribuable et, entre autres, sur ce que la jurisprudence a appelé les principes de bonne administration. Après avoir rappelé les origines de ces principes en droit administratif, leurs différentes facettes ont été commentées par des spécialistes renommés en la matière. Le succès qu’a rencontré ce cycle auprès de l’ensemble des acteurs de la fiscalité semblait être un signal tangible du fait que ces séminaires répondent non seulement à un besoin de formation permanente, dans une matière en constante mutation, mais également – comme leur nom l’indique – de dialogues entre des acteurs trop souvent habitués à se cantonner dans un rôle nuisible à l’établissement de relations de respect et de collaboration, préalable indispensable à une juste et correcte application du droit fiscal

Ce deuxieme volume des Dialogues de la fiscalite rassemble les actes des quatre seminaires organi... more Ce deuxieme volume des Dialogues de la fiscalite rassemble les actes des quatre seminaires organises entre janvier et avril 2011 dans la cadre de la Chaire PwC de droit fiscal de l’Universite Catholique de Louvain. Il represente le signe tangible d’une collaboration fructueuse entre le monde academique et le monde de l’entreprise, qui repose avant toute chose sur la confiance et le respect de l’independance des partenaires. La Chaire PwC de droit fiscal a comme objectif de stimuler l’etude et le debat autour de thematiques fiscales actuelles. Sa specificite reside dans la recherche d’un equilibre entre les positions de tous les acteurs de la fiscalite : personnes chargees de l’application des regles fiscale a tous les niveaux de pouvoir, professionnels du conseil juridique et/ou fiscal et experts issus de l’universite ou d’autres centres de recherches reconnus. Par ailleurs, par le contenu des themes choisis, la Chaire tend egalement a faire une balance entre les preoccupations des praticiens et des reflexions – plus generales – de politique fiscale. Nous laissons le soin au lecteur d’apprecier si ces objectifs ont ete atteints. Les themes choisis cette annee refletent l’actualite fiscale nationale et internationale. Le premier seminaire, plus prospectif, brosse a grands traits, une esquisse des grandes mutations que les actuelles crises economiques et politiques pourraient faire subir a notre systeme fiscal : mutations portant tant sur la transformation radicale du policy mix entre les differents impots, voire de la nature de ceux-ci que sur leur repartition institutionnelle entre les differents niveaux de pouvoirs. Le second seminaire explore quelques thematiques a l’intersection entre le droit penal et le droit fiscal, ayant de delicates consequences sur les libertes individuelles des contribuables. Le troisieme seminaire aborde de maniere transversale l’actualite d’un secteur important de notre societe, aux contours parfois indefinis, qualifie – parfois de maniere trop reductrice – de “non-marchand”. Enfin, dans le quatrieme seminaire, l’on revient sur un theme “indemodable”, celui de la fiscalite immobiliere, en adoptant le point de vue de l’investisseur, tant dans un cadre national (et regional) que dans sa dimension transfrontaliere.
