She has been a researcher at several institutions, including Harvard Law School and Perugia Law School. Her main areas of research include Family Law, Data Protection, Contract Law and Consumer Insolvency Law. She is a legal advisor in these topics. She has participated in the elaboration of the reforms of the Spanish insolvency law, in relation to the second-chance regime for insolvent consumers.
Principal Investigator in several R&D projects of the Ministry of Economy and Competitiveness, on "Marriage and bankruptcy", "The new family before the Public and Private Law", and she is currently leading one about "responsible lending and credit reporting system". En particular, se estudia su consideracion o no como carga del matrimonio y su diferente tratamiento con el gasto por alquiler, los pactos que al respecto pueden incluirse en el convenio regulador y las consecuencias derivadas de su incumplimiento. Tambien, se aborda el problema de hasta que punto pueden incluirse en una sentencia de divorcio contencioso pronunciamientos sobre la forma en que se abona el prestamo hipotecario y las vias de reclamacion por impago de la deuda hipotecaria por uno de los codeudores.

El bloqueo del consumo privado dificulta la reactivación económica, continuando el cierre de empresas con la consiguiente pérdida de puestos de trabajo. Al margen del necesario tratamiento paliativo de la insolvencia de los particulares, es imprescindible introducir cambios legales dirigidos la prevención del sobreendeudamiento privado, que constituye una de las causas de la crisis financiera actual. Como ha señalado en Comité Económico y Social Europeo, “el endeudamiento excesivo de los particulares es un fenómeno que hay que evitar a toda costa” con objeto de que la dramática situación que actualmente hemos padecido no se vuelva a producir. Sin embargo, los esfuerzos legislativos en este terreno de la prevención son limitados.

This paper assesses the credit market implications of the so-called “fresh start” or release of t... more This paper assesses the credit market implications of the so-called “fresh start” or release of the outstanding liability to the debtor insolvent individual. The U.S. experience is highly revealing in this regard, since it has a long tradition and it constitutes the liberal model of recovery for the insolvent person as it provides an automatic debt relief. It values the impact of the limitation on the principle of unlimited liability on the credit costs and the entrepreneurship, as well as the mechanisms for obtaining the debtor's financial information. I conclude with the possible impact that such measure would have in the Spanish law and the obstacles it might find, given our credit concession system and risk measurement procedures, which are indeed affected by the current Spanish Data Protection Act.

El punto de partida es el estudio del problema de la embargabilidad de la vivienda habitual y las consecuencias económicas que conlleva a la luz de las diferentes opciones regulatorias escogidas en otros ordenamientos de nuestro entorno, realizándose propuestas al respecto. Importantes problemas se suscitan cuando el concursado está casado, ya que es necesario cohonestar la normativa concursal con la de los regímenes económico-matrimoniales lo que en ocasiones va a generar disfunciones que son abordadas en el trabajo. El aspecto más complejo tratado en este artículo se centra en el análisis de la nueva regulación de la exoneración del pasivo insatisfecho fruto de la reforma concursal operada por la Ley 16/2022, de 5 de septiembre que va a permitir —al menos nominalmente— que la vivienda no sea ejecutada. Cuando la vivienda está hipotecada y pertenece a ambos cónyuges o miembros de pareja de hecho y solo uno de ellos se declara en concurso se suscitan importantes dificultades interpretativas de la regulación vigente que son estudiadas en el presente trabajo. En particular, se estudia el problema de la evaluacion de la solvencia de los promotores de financiacion, las dificultades de acceso a datos de solvencia fiables. Los fallos de regulacion provocan una importante desproteccion del inversor en este tipo de plataformas. La falta de transparencia en el proceso de evaluacion del riesgo de credito del promotor de la financiacion, la falta de publicidad de datos de morosidad son factores que evidencian la fragil posicion del inversor y una opacidad de datos de solvencia que puede afectar negativamente al funcionamiento del sistema financiero tradicional.
