La gestión de la movilidad humana en España y la UE ha estado presidida en las últimas décadas po... more La gestión de la movilidad humana en España y la UE ha estado presidida en las últimas décadas por una orientación de seguridad que no prioriza reforzar una perspectiva de Derechos Humanos. La generalización del uso de las nuevas tecnologías en el control migratorio y fronterizo añade nuevos retos en esta materia, como una configuración político-jurídica de su aplicación respetuosa con los derechos fundamentales de las personas migrantes durante todo su periplo migratorio. En el presente artículo analizamos el estado en que se encuentra este proceso a nivel europeo y español, que desafortunadamente incide en la misma línea que en la etapa “analógica”, proponiendo alternativas para una aplicación “virtuosa” de las nuevas tecnologías a la gobernanza de la movilidad humana.
Management of human mobility in Spain and EU in the last decades has been presided for a security guideline that doesn’t prioritize a Human Rights perspective. Generalization of using new technologies in borders control and in migration policies brings new challenges in this field, such as achieving a legal-political configuration of its implementation respectful with fundamental rights of migrant people during hole migratory journey. This paper analyzes the current situation of this process at Spanish and European level, that unfortunately continues the same line of “analogical stage”, proposing “virtuous” alternatives of new technologies applications to human mobility governance.

Habiendo transcurrido cerca de una década del inicio, en el marco del art. 13.2 CE, del segundo p... more Habiendo transcurrido cerca de una década del inicio, en el marco del art. 13.2 CE, del segundo proceso de suscripción de tratados bilaterales para el reconocimiento del derecho de sufragio local a personas extranjeras residentes en España de algunas nacionalidades, es un buen momento para realizar un balance respecto a la incidencia práctica de los mismos. Tras haber desplegado sus efectos en dos convocatorias electorales (municipales de 2011 y 2015), y a las puertas de los comicios locales de 2019, el nivel de participación de los potenciales beneficiarios de los tratados ha sido muy escaso. En este artículo se analizan críticamente estos instrumentos internacionales, ofreciendo alternativas para avanzar realmente en los derechos de participación política de los residentes extranjeros.

Estos retos se pueden calificar como sistémicos, ya que cuestionan estructuralmente el con-cepto de ciudadanía, tanto en sus dimensiones subjetiva y objetiva como en las herramientas jurídico-formales que precisa para su desarrollo. En el presente artículo también analizamos las dificultades específicas que la digitalización y las nuevas tecnologías representan para derechos fundamentales clave en la perspectiva liberal de la ciudadanía y para el principio de igualdad material, así como las respuestas alternativas que desde las ciencias políticas y jurídicas se están alumbrando.
Citizenship, as a legal and political instrument for the ownership and the exercise of Fundamental Rights, faces serious challenges in the context of the digital era and the global expansion of new technologies. These challenges can be named as systemic as they structurally question the concept of citizenship, both in its subjective and objective dimensions and in the legal tools that it requires for its development. This article also analyses the particular obstacles that the digitization and new technologies represent for Fundamental Rights, key in the liberal perspective of citizenship and for the principle of material equality, as well as alternative proposals from legal and political sciences.

Policies and normative tools that are been applied in the border control and management of migratory flows on the Southern Border don’t correspond with the reality of these phenomena. That situation contradicts their stated goals (preventing human trafficking, encouraging regular migration, fighting international terrorism...) and it is causing serious human rights violations against migrants as “collateral damage”. In this article we analyze main political–legal contradictions associated with the process of outsourcing border control driven by the EU and Spain. Besides, we pay attention to the perversion that represents conditioning the development cooperation to the control of migratory flows, and the questioning of the Rule of Law linked to the arbitrary expellings (and other similar practices) carried out at the Spanish and European borders.

Este escenario incrementa notablemente el riesgo de que sean víctimas de vulneraciones a sus derechos humanos, poniendo de manifiesto el alto nivel de impunidad de los estados que cometen estas violaciones. Ante esta realidad, y mediante un análisis comparativo de la jurisprudencia emanada de los sistemas re-gionales de protección europeo e interamericano, se indaga en la posibilidad de que los inmigrantes irregulares o indocumentados sean incluidos en el concepto de "grupo vulnerable". El significado de esta expresión está siendo configurado en instancias de justicia internacional, específicamente en la jurisprudencia del Tribunal Europeo de Derechos Humanos y de la Corte Interamericana de Derechos Humanos. La investiga-ción concluye que la consolidación de tal interpretación facilitaría el acceso a dichas instancias jurisdiccionales y representaría una herramienta de protección frente a prácticas discriminatorias de los estados de tránsito y acogida. De la misma manera, abriría la posibilidad para los migrantes internacionales irregulares de ser acreedores de las "medidas de discriminación positiva" que algunas sentencias han impuesto a los estados y que han sido concebidas específicamente para estos grupos. The vulnerability of undocumented international immigrants from a legal perspective Abstract This article analyses, from an eminently legal perspective, the particularly vulnerable situation of migrants in an irregular situation. This irregular status notably increases migrants' risk of suffering human rights violations, underscoring the high level of impunity enjoyed by states that commit such violations. Faced with this state of affairs, and by means of a comparative analysis of the case law emanating from European and inter-American regional legal systems, this study explores the possibility of irregular or undocumented migrants being included in the classification of "vulnerable group". The meaning of this expression is being shaped in international courts of justice, and in particular the European Court of Human Rights and Inter-American Court of Human Rights. The study concludes that establishing this interpretation would facilitate access to those judicial bodies, offering an instrument to protect irregular migrants against the discriminatory practices engaged in by transit and host countries. Equally, it opens up the possibility of international migrants in an irregular situation benefit-ting from the "positive discrimination" measures handed down in some states and designed specifically to tackle such groups.

Nearly a decade after the beginning of the second signing process of bilateral treaties to the recognition of the right to suffrage at the local level to foreign residents in Spain of some nationalities, within the framework of article 13.2 of Spanish Constitution, it’s time to make a balance regarding the practical incidence of that process. After having developed its effects in two electoral calls (municipal elections of 2011 and 2015), and at the gates of the local elections of 2019, the level of participation of potential beneficiaries of the treaties has been very low. This article analyses from a critical point of view these international instruments, offering alternatives to really advance in the recognition of the rights of political participation of foreign residents.

En la misma línea, la jurisprudencia constitucional determina una interpretación general «pro ejercicio» de los derechos fundamentales que debe informar toda la práctica administrativa. Sin embargo, en el ámbito del derecho de sufragio se han sucedido decisiones político-administrativas que, por acción u omisión, ponen en cuestión ese mandato constitucional y las citadas directrices del Alto Tribunal. En este artículo analizamos aquellas que afectan a las personas españolas residentes en el exterior, a las extranjeras residentes en España y a las afectadas por la exclusión social, proponiendo alternativas para su superación.
Principle of material equality, recognized by article 9.2 of Spanish Constitution, demands to Administration proactive politics in order to guarantee an effective exercise of fundamental rights. In the same way, the Spanish constitutional jurisprudence determines a general interpretation “pro exercise” of the fundamental rights, which has to inform whole administrative practise. However, in matter of right of suffrage have been made political and administrative decisions that, by action or omission, compromise that constitutional command and mentioned guidelines of the High Court. In this article we analyse those decisions that affect to Spanish residents abroad, to foreign residents in Spain and to people in social exclusion situation, with the aim of proposing alternatives to overcome this problem.

Indagamos en las causas de las migraciones contemporáneas, prestando especial atención al concepto de vulnerabilidad, a los conflictos y a los espacios de vulneración generalizada de los Derechos Humanos. Se realiza una revisión crítica de los instrumentos políticos–jurídicos que regulan a nivel global y regional la protección internacional y la libertad de circulación que deberían facilitar una movilidad humana por vías legales y seguras, y las vulneraciones de derechos en los flujos migratorios en tránsito y en frontera.

Indagamos en las causas de las migraciones contemporáneas, prestando especial atención al concepto de vulnerabilidad, a los conflictos y a los espacios de vulneración generalizada de los Derechos Humanos. Se realiza una revisión crítica de los instrumentos políticos–jurídicos que regulan a nivel global y regional la protección internacional y la libertad de circulación que deberían facilitar una movilidad humana por vías legales y seguras, y las vulneraciones de derechos en los flujos migratorios en tránsito y en frontera.

En otros trabajos recientes hemos reflexionado acerca de los retos derivados del desdoble de la dimensión subjetiva de la ciudadanía en un “yo analógico” y en un “yo digital”, de las dificultades de las herramientas jurídicas “tradicionales” para garantizar la indemnidad de los derechos ante demandas y riesgos de reciente aparición o incluso de la emergencia de nuevos ámbitos de proyección de la ciudadanía, como podría ser el metaverso Sin perder de vista esa perspectiva global, en la presente obra queremos centrar nuestro análisis en una realidad en la que se plasman de forma nítida los principales desafíos para el Derecho en el ámbito digital: la difusión del odio y sus consecuencias socio-jurídicas a través de la utilización de las nuevas tecnologías, por una parte, y cómo las estrategias político-normativas para su represión están produciendo externalidades negativas no menores en otros derechos fundamentales, principalmente en las libertades de expresión e información, por otra.

En un mundo con instituciones internacionales con poder vinculante real y legitimadas por el prin... more En un mundo con instituciones internacionales con poder vinculante real y legitimadas por el principio democratico, en unos Estados donde todos sus ciudadanos disfruten de sus derechos en plenitud por el mero hecho de la pertenencia real a la comunidad y de su cultura a traves de la nacionalidad, existiran las condiciones para la deseada ciudadania inclusiva. Quizas esa seria la hora de plantear la posible superacion del Estado-nacion.

Management of human mobility in Spain and EU in the last decades has been presided for a security guideline that doesn’t prioritize a Human Rights perspective. Generalization of using new technologies in borders control and in migration policies brings new challenges in this field, such as achieving a legal-political configuration of its implementation respectful with fundamental rights of migrant people during hole migratory journey. This paper analyzes the current situation of this process at Spanish and European level, that unfortunately continues the same line of “analogical stage”, proposing “virtuous” alternatives of new technologies applications to human mobility governance.
Citizenship, as a legal and political instrument for the ownership and the exercise of Fundamental Rights, faces serious challenges in the context of the digital era and the global expansion of new technologies. These challenges can be named as systemic as they structurally question the concept of citizenship, both in its subjective and objective dimensions and in the legal tools that it requires for its development. This article also analyses the particular obstacles that the digitization and new technologies represent for Fundamental Rights, key in the liberal perspective of citizenship and for the principle of material equality, as well as alternative proposals from legal and political sciences.
Policies and normative tools that are been applied in the border control and management of migratory flows on the Southern Border don’t correspond with the reality of these phenomena. That situation contradicts their stated goals (preventing human trafficking, encouraging regular migration, fighting international terrorism...) and it is causing serious human rights violations against migrants as “collateral damage”. In this article we analyze main political–legal contradictions associated with the process of outsourcing border control driven by the EU and Spain. Besides, we pay attention to the perversion that represents conditioning the development cooperation to the control of migratory flows, and the questioning of the Rule of Law linked to the arbitrary expellings (and other similar practices) carried out at the Spanish and European borders.

Tras haber desplegado sus efectos en dos convocatorias electorales (municipales de 2011 y 2015), y a las puertas de los comicios locales de 2019, el nivel de participación de los potenciales beneficiarios de los tratados ha sido muy escaso. En este artículo se analizan críticamente estos instrumentos internacionales, ofreciendo alternativas para avanzar realmente en los derechos de participación política de los residentes extranjeros.
Nearly a decade after the beginning of the second signing process of bilateral treaties to the recognition of the right to suffrage at the local level to foreign residents in Spain of some nationalities, within the
framework of article 13.2 of Spanish Constitution, it’s time to make a balance regarding the practical incidence of that process. After having developed its effects in two electoral calls (municipal elections
of 2011 and 2015), and at the gates of the local elections of 2019, the level of participation of potential beneficiaries of the treaties has been very low. This article analyses from a critical point of view these
international instruments, offering alternatives to really advance in the recognition of the rights of political participation of foreign residents.
Principle of material equality, recognized by article 9.2 of Spanish Constitution, demands to Administration proactive politics in order to guarantee an effective exercise of fundamental rights. In the same way, the Spanish constitutional jurisprudence determines a general interpretation “pro exercise” of the fundamental rights, which
has to inform whole administrative practise. However, in matter of right of suffrage have been made political and administrative decisions that, by action or omission, compromise that constitutional command and mentioned guidelines of the High Court. In this article we analyse those decisions that affect to Spanish residents abroad, to foreign residents in Spain and to people in social exclusion situation, with
the aim of proposing alternatives to overcome this problem.
