Social network data mining has a disparate impact through its reliance on predictive analytics, its reproduction of patterns of unfairness, and evasion of privacy protections.  First, this paper will discuss data mining’s disparate impact.  Second, the dangers to consumer privacy when Big Data is used by the private sector and to constitutional norms when used by the government will be identified.  Third, the asymmetric relationship between Big Data and those whom data collection targets will be analyzed through an evaluation of Social Media Data Mining.  The final section of this paper offers recommendations towards a policy framework that ensures all consumers are included in the promise of first class citizenship in the digital age.
