The aim of this paper is to reconstruct in a historiographical way the legal responses of the Arg... more The aim of this paper is to reconstruct in a historiographical way the legal responses of the Argentine penal codification in cases of crimes committed by the mentally ill. The chosen periodization is connected to normative formulations: in 1877 the province of Buenos Aires adopted the draft Criminal Code elaborated by Carlos Tejedor and in 1921 the current Criminal Code came into force. However, our analysis was to understand the legal culture of that society beyond the legal texts. For this purpose, we used a wide range of sources: norms; legal doctrine analysis; doctoral theses; Criminal Code reform projects; readings of foreign authors by the actors of that time, etc. This paper consists of three parts. Firstly, we analyze the situation that goes from the provincial adoptions of the national projects until the sanction of the Criminal Code of 1886. In this sense, Tejedor's draft Criminal Code and the Ugarriza-Villegas-García draftfor the case of Córdoba were predominant. Secondly, we explore the criticisms that arose as soon as the Criminal Code of 1886 came into force. Thirdly, we analyze what happened regarding the mentally ill in the Criminal Code of 1921, still in force in Argentina with uncountable reforms.

El objetivo de este trabajo es abordar las respuestas institucionales a partir de la fuga de la P... more El objetivo de este trabajo es abordar las respuestas institucionales a partir de la fuga de la Penitenciaría Nacional de Buenos Aires, sucedida en agosto de 1923, una de las más representativas de la historia del penal. El suceso, de amplia cobertura mediática, implicó importantes consecuencias con respecto a la administración del castigo en la prisión modelo del conjunto penitenciario del estado argentino: evidenció algunas de las problemáticas coyunturales del penal porteño como dificultades intrínsecas en la dirección, deficiencias en el orden de la vigilancia y tensiones con la población recluida.
El análisis de la fuga a través de la prensa masiva demuestra los límites de las intenciones regeneradoras de la Penitenciaría Nacional en los momentos de crisis. En este sentido, el artículo se estructura en tres partes. En el primer apartado se desarrolla el contexto en el cual tiene lugar el escape, relacionado principalmente con los cuestionamientos en torno al emplazamiento del penal, que se había proyectado para funcionar en las afueras de una ciudad que se urbanizó a un ritmo mucho más acelerado que lo esperado. Además de la metropolización de los alrededores de la penitenciaría, otros antecedentes de insurrecciones influyen de manera directa en la interpretación de la fuga de 1923, desarrollada en el apartado siguiente a partir de documentación institucional y prensa de época, que sigue de cerca el suceso durante varias semanas. Por último, se abordan las decisiones y propuestas institucionales por parte del Ministerio de Justicia e Instrucción Pública sobre dicha problemática.

Este trabajo, que tiene un carácter preliminar, se propone demostrar la existencia de dos momento... more Este trabajo, que tiene un carácter preliminar, se propone demostrar la existencia de dos momentos diferentes en el intercambio internacional de ideas penitenciarias en Argentina en la primera mitad del siglo xx. Por un lado, consideramos que durante las primeras décadas del siglo xx, las referencias penitenciarias fueron principalmente europeas. En este sentido, la recepción activa de la criminología italiana fue central en las publicaciones académicas argentinas. Por otro lado, nos centramos en la figura de Roberto Pettinato durante las décadas de 1940 y 1950. Pettinato, que fue Director General de Institutos Penales durante el primer peronismo, contribuyó decisivamente al desarrollo de una teoría penitenciaria de alcance transnacional, concretamente latinoamericana, aunque sin descuidar las referencias europeas establecidas anteriormente. Por un lado, consideramos que duran- te las primeras décadas del siglo xx, las referencias penitenciarias fueron principal- mente europeas. En este sentido, la recepción activa de la criminología italiana fue central en las publicaciones académicas argentinas. Por otro lado, nos centramos en la figura de Roberto Pettinato durante las décadas de 1940 y 1950. Pettinato, que fue Director General de Institutos Penales durante el primer peronismo, contribuyó deci- sivamente al desarrollo de una teoría penitenciaria de alcance transnacional, con- cretamente latinoamericana, aunque sin descuidar las referencias europeas estable- cidas anteriormente. Cabe señalar que el establecimiento de estas relaciones científicas y técnicas con América Latina contrasta con la política penitenciaria pro- movida por el Estado argentino en los decenios anteriores. En este sentido, conside- ramos la figura de Pettinato como un paradigma de ruptura respecto de las relacio- nes transnacionales y las prácticas penitenciarias que implementó sin abandonar los postulados de la criminología positivista.

This article analyzes the participation of Argentine delegates in international prison congresses... more This article analyzes the participation of Argentine delegates in international prison congresses held between 1872 and 1950. We argue that the forms of participation can be divided into two. On the one hand, the presence of non-penitentiary experienced representatives, generally diplomats assigned to the places where the congresses were held. On the other hand, the participation of outstanding penitentiary specialists, both for their theoretical training (in Criminal Law) and for their daily management of the Argentinian prisons. For a better development, we will divide the article in two sections. In the first one, it will be dealt with from the first congress held in London (1872) to the sixth one held in Budapest (1905). In the second part, we will analyze from the seventh congress held in Washington (1910) to the last one held in The Hague (1950). It should be noted that for the preparation of this article we have used unpublished material located in the Archive of the Argentine Foreign Office and Ministry of Justice and Education; and other published texts.

El objetivo de este trabajo es analizar y comparar las miradas de Pietro Gori y Eusebio Gómez sob... more El objetivo de este trabajo es analizar y comparar las miradas de Pietro Gori y Eusebio Gómez sobre sus visitas a la penitenciaría de Sierra Chica, publicadas en 1899 y 1906 respectivamente. Los dos estudios indagan en elementos propios de los campos de saber de sus autores: la criminología positivista en el caso del primero, y un emergente penitenciarismo en el segundo. Una comparativa exploratoria entre estas dos posiciones revela percepciones antagónicas sobre una de las principales prisiones de la provincia de Buenos Aires, en la que convergen complejas expectativas técnicas, institucionales y socioculturales.

Los escritos publicados en la revista nos permitieron comprender el contexto ideológico e institucional sobre el cual se pensó la administración penitenciaria en Buenos Aires durante los años veinte. La relectura de las producciones de Gómez a través de las revistas criminológicas previas revela la centralidad de la Penitenciaría Nacional como referencia de la cuestión penitenciaria local.

relación entre la clasificación de penados, las ideas positivistas y el trabajo en las prisiones. Este artículo argumenta que en un
momento de hegemonía de la criminología positivista, las ideas de los penitenciaristas se desarrollaron a traves de prácticas,
procedimientos e intereses específicos.
