A teorização da soberania enquanto conceito relacional de poder, que se opõe a outras esferas pot... more A teorização da soberania enquanto conceito relacional de poder, que se opõe a outras esferas potestativas imediatamente concorrentes, de forma a afastá-las, foi utilizada sobretudo enquanto elemento conformador de legitimação e fundamento do Estado Nacional. Tal perspectiva apresenta a soberania como reflexo do poder da sociedade civil organizada e, assim, em sua projeção interna, como poder vinculatório mandamental em relação aos súditos e, em sua projeção externa – trato extraterritorial – na condição recíproca e igualitária dos entes soberanos. Referida teorização se remete, comumente, enquanto marco teórico inicial a Jean Bodin, que teria cinzelado a soberania enquanto summa potestas, é dizer, enquanto afirmação de um poder supremo como síntese do
poder de influência elevado e eminente (ákran éxusian), próximo ao conceito latino de majestas, poder normativo e legislativo senhorial (kyrían arkhê) e poder senhorial de gerir a administração pública (kýrion políteuma). Teorização essa também esboçada pelo pensador Hugo Grotius, com acentuada influência aristotélica, mas que, a despeito da contemporaneidade em relação ao pensador francês, criva a soberania com aspectos de sua formação humanista e teológica, pelo que se empenha no esforço teórico na busca do permanente cuidado com a vida social. Assim, na medida em que aos homens enquanto inerente a sociabilidade com vistas a um fim comum, gozar da proteção das leis, encontra no Estado a sua mais perfeita união, embora adira à ideia de unidade e de total acatamento ao governo do soberano pelo povo, entende que ao poder civil é impositiva a observância dos preceitos que a tal fim o instituíram, é dizer, o soberano deve sempre governar com permanente busca pelo cuidado com a vida social, na perspectiva interna, pelo que se teria,
inclusive, excepcionalmente, em sendo inobservado tal preceito, a possibilidade restritiva de resistência pelo povo. Utiliza ainda a teologia para a busca da paz temporal, pelo que sem retirar do soberano a majestade potestativa, avoca a imprescindível observância da justiça e equidade, além dos preceitos de direito natural – ius gentium – como elementos inafastáveis das relações para além das fronteiras territoriais, o que seria imperioso inclusive quando do estado de guerra. Assim, o presente artigo busca analisar os aspectos valorativos que permearam a construção da ideia de soberania presente nos pensamentos de Hugo Grotius e Jean Bodin, nomeadamente nas obras “Do Direito da guerra e da Paz” e “Os Seis Livros da República”, demonstrando de que forma divergem os pensamentos quando da teorização da soberania e. principalmente, quanto ao direito de resistência, sem que, entretanto, descaracterize sua unidade inerente.

A soberania enquanto afirmação de um poder supremo - summa potestas – no sentido de vincular aos ... more A soberania enquanto afirmação de um poder supremo - summa potestas – no sentido de vincular aos que a ele se encontram subordinados e não reconhecer a nenhum outro como superior, vê-se progressivamente desvirtuado na medida em que com a ascensão do cristianismo, formação do Estado Nacional, formação burocrática técnica dentre outros afastam progressivamente do povo o poder de autodeterminação, primando pela previsibilidade da ordem e segurança, enquanto observância de um procedimentalismo tecnicista e sem conteúdo político. Ainda nessa perspectiva sem qualquer conteúdo axiológico, ainda que legítima, a soberania do Estado vê-se erosionada na medida em que sua base de legitimação e poder efetivo de atuação dentro de seu território encontram-se restringidas por externalidades alheias ao controle interno, decorrentes em grande parte da interconexão global e da internacionalização do processo de elaboração de decisões políticas condicionantes. Nesse contexto, imprescindível se nos mostra o resgate da auto-afirmação local do povo.

A conformação teórica do Estado moderno retira seus fundamentos sobretudo da juspublicística alem... more A conformação teórica do Estado moderno retira seus fundamentos sobretudo da juspublicística alemã e da Escola francesa. A esta se deve não apenas a anterior teorização jurídica da soberania como, corolário da ruptura jacobina, as bases liberais que permeiam a compreensão protetiva do indivíduo. Lança-se, entretanto, o forjar do conceito de nação cuja titularidade repousa a soberania. Da juspublicística alemã, resultado do conformar potestativo tendente à centralidade, resulta erigido o Estado como absorção do político e titular exclusivo do então jurídico. Resta cinzelado senão o Estado de Direito como elemento moral de decisão unitária. Ambos movimentos que racionalizam a conformação teórica para então ajustá-la forçosamente à realidade. O constitucionalismo, portanto, do Novecento pauta-se na compreensão de constituição do Estado. Em sentido inverso, Santi Romano parte do concreto para então constatar o distanciamento teórico da própria realidade. Constata, por conseguinte, senão o que define como crise do Estado moderno. Direciona, assim, a desconstrução teórica a que se propõe senão à própria juspublicística alemã e à escola sociológica de Bordeaux. Da pretensão totalizante do ente abstrato estatal, cinzela aquela que propõe enquanto superação da propalada crise: o institucionalismo jurídico. Assim, pautado no método de procedimento histórico, buscou-se analisar a compreensão dos delineamentos do Estado no pensamento de Santi Romano e, uma vez situados e apreendidos, utilizando-se da trama, verificou-se a correlação com as escolas com as quais dialoga: alemã e francesa. Influxo direto, no que tange à conformação do pensamento constitucional brasileiro, diretamente influenciado pelo pensamento europeu, sobretudo, buscou-se também verificar as influências, apropriações e distanciamentos a partir do pensamento do jurista palermitano, de forma a compreender a sua contextualização no Brasil.

No presente texto, o juspublicista italiano Santi Romano pretende refutar a teoria de... more No presente texto, o juspublicista italiano Santi Romano pretende refutar a teoria de Georg Jellinek acerca dos Staatsfragmente –frações territoriais dotadas de algumas atribuições do Estado, mas não de todas. Romano, para tanto, descreve a teoria de Jellinek e aponta algumas de suas falhas, sobretudo quanto aos três elementos ‘clássicos’ da estatalidade (povo, território, soberania). Para Jellinek, os Staatsfragmente teriam povo e território, mas não soberania, enquanto que, para Romano, os outros dois elementos seriam meros reflexos: sem ela, não há Estado. Na sequência, compara a situação dos Staatsfragmente com as frações de Comuni e com as colônias. Esses entes pertenceriam respectivamente ao Comune e ao Estado, sem qualquer individualidade. Romano conclui que as reflexões de Jellinek são estimulantes, mas, em última instância, têm falhas lógicas, são excessivamente abstratas e não devem ser adotadas pela teoria do direito público.
ABSTRACT
In this essay, the Italian juspublicist Santi Romano refutes Georg Jellinek's theory of the Staatsfragmente -territorial fractions with some, but not all, of the State's powers. To do so, Romano describes Jellinek's theory and points out some of its flaws, especially regarding the three 'classical' elements of statehood (people, territory, sovereignty). For Jellinek, the Staatsfragmente would have a people and a territory, but no sovereignty, while for Romano, those two elements would be mere reflections of sovereignty: without it, there is no State. He then compares the situation of the Staatsfragmente with the fractions of Comuni and with the colonies. These entities would belong respectively to the Comune and the State, with no individuality. Romano concludes that Jellinek's reflections are stimulating, but are ultimately logically flawed, excessively abstract and should not be adopted by public law theory.

A proposta parte da preocupação em evitar o anacronismo da projeção de conceitos tão marcadamente modernos, como Estado e soberania, na Idade Média, isto é, de noções que tendem a absolutizar e a ver o direito como expressão de um ente político totalizante. Já a noção de autonomia, despida de todo caráter estatalista e entendida como autonomia institucional, permite uma compreensão melhor de uma experiência jurídica pluralista como a medieval, em que o direito é muito mais a ossatura invisível da sociedade e não tanto um reflexo da vontade do poder político, que, por sua vez, imersos em um tecido de relações, pouco atuavam como legisladores ou como soberanos absolutos de determinado território (o que guarda paralelismo com o caráter não absoluto do dominium medieval, instituto de direito privado).

La noción de autonomía, desnuda de todo carácter estatalista y entendidacomo autonomía institucional, permite una comprensión mejor de una experienciajurídica pluralista como la medieval, en que el derecho es mucho más la estructura invisible de la sociedad y no tanto un reflejo de la voluntad del poder político, que, a su vez, inmersos en un tejido de relaciones, poco actuaban como legisladores ocomo soberanos absolutos de determinado territorio (lo que guarda paralelismo conel carácter no absoluto del dominium medieval, instituto de derecho privado).

In this essay, the Italian juspublicist Santi Romano refutes Georg Jellinek's theory of the Staatsfragmente -territorial fractions with some, but not all, of the State's powers. To do so, Romano describes Jellinek's theory and points out some of its flaws, especially regarding the three 'classical' elements of statehood (people, territory, sovereignty). For Jellinek, the Staatsfragmente would have a people and a territory, but no sovereignty, while for Romano, those two elements would be mere reflections of sovereignty: without it, there is no State. He then compares the situation of the Staatsfragmente with the fractions of Comuni and with the colonies. These entities would belong respectively to the Comune and the State, with no individuality. Romano concludes that Jellinek's reflections are stimulating, but are ultimately logically flawed, excessively abstract and should not be adopted by public law theory.
