Este artigo, utilizando a catástrofe ambiental de Mariana/MG como pano de fundo, dedica-se ao est... more Este artigo, utilizando a catástrofe ambiental de Mariana/MG como pano de fundo, dedica-se ao estudo da relação entre o Direito e os desastres, visando chamar atenção da comunidade jurídica para uma temática ainda pouco conhecida e estudada no Brasil. Nesse sentido, a pesquisa teve, como objetivos, investigar o que é um desastre para o Direito, bem como a forma com que o ordenamento jurídico se relaciona com o fenômeno catastrófico, visando saber se medidas podem ser tomadas a fim de evitar e/ou reparar o dano advindo dos desastres. Assim, valendo-se da pesquisa bibliográfica e documental, analisou-se a proteção jurídica contra desastres, realizada através da gestão de riscos e perigos catastróficos, além da aplicação do instituto da responsabilidade civil aos danos oriundos de desastres.
This article, using environmental disaster Mariana/MG as a backdrop, is dedicated to the study of the relationship between law and disasters, aiming to draw attention of the legal community for a subject still little known and studied in Brazil. In this sense, the research had as objective to investigate what a disaster for the law, and the way in which the law relates to the catastrophic phenomenon to clarify whether steps can be taken to prevent and / or repair the damage arising from disasters. Thus, making use of bibliographic and documentary research, analyzed the legal protection against disasters, carried out by managing risks and catastrophic risks in addition to the implementation of the liability to institute disaster arising damage.

O presente trabalho objetiva investigar a relação entre o Direito e os desastres, tendo, como par... more O presente trabalho objetiva investigar a relação entre o Direito e os desastres, tendo, como parâmetro de análise, os termos do acórdão proferido na Apelação Cível nº 0025225-19.2005.8.19.0021, que foi prolatado pelo Tribunal de Justiça do Estado do Rio de Janeiro. A problemática central está focada na percepção da existência ou não de uma relação entre a aludida ciência e o mencionado fenômeno e qual as ilações que poderiam ser tiradas dessa constatação. Nesse sentido, o trabalho é construído em quatro partes. A primeira dedica a apresentar o caso em análise, de forma a viabilizar a compreensão do acórdão eleito para o início da investigação apresentada. A segunda, por sua vez, volta-se para verificar a proteção jurídica contra os desastres, focando-se a análise, sobretudo, na realidade jurídico-normativa da legislação brasileira. A terceira parte do trabalho dirige a atenção para a compreensão da tutela ambiental preventiva, a partir da gestão de riscos e perigos catastróficos. A quarta e última parte é dedicada para a compreensão da tutela ambiental reparadora e, de forma mais específica, para a responsabilidade civil em matéria catastrófica. A investigação valeu-se da pesquisa bibliográfica e documental, tendo ainda se servido do método de abordagem qualitativo de análise de dados.
This study aims to investigate the relation between law and disasters, having as analysis parameter the terms of the judgment delivered in the Civil Appeal No. 0025225-19.2005.8.19.0021, which was rendered by the Rio de Janeiro State Court. The main question is focused on the perception of whether or not there is a relation between the alluded science and the mentioned phenomenon, and what are the conclusions that could be drawn from this finding. In this sense, the work is constructed in four parts. The first is dedicated to present the case in question, in order to facilitate the understanding of the judgment elected to start the presented research. The second, in turn, turns to verify the legal protection against disasters, focusing the analysis, especially, on the legal-normative reality of the Brazilian Law. The third part of the work directs attention to the understanding of the preventive environmental protection based on risk and catastrophic dangers management. The fourth and final part is devoted to the understanding of restorative environmental protection and, more specifically, to the civil liability for catastrophic matter. The research drew on bibliographic and documentary research, and still drew on qualitative approach method of data analysis.

Geralmente associados às causas excludentes de responsabilidade, considerar a responsabilidade civil por danos decorrentes de desastres naturais parece algo desafiador. Sob esse aspecto, a possibilidade de reparação dos danos catastróficos é cogitada no cenário de um Estado Socioambiental de Direito proposto pela Constituição da República Federativa do Brasil. Nessa linha, o presente artigo foi desenvolvido em três partes. A primeira foi dedicada ao estudo da relação entre os desastres e o Direito. A segunda é focada na análise dos deveres de proteção ambiental inerentes a um Estado Socioambiental de Direito. A terceira e última parte foi dedicada a averiguar a possibilidade de imputação da responsabilidade civil por danos catastróficos ao Estado Socioambiental do Direito. Com o objetivo em referência, a pesquisa foi primordialmente bibliográfica e documental, e o seu procedimento foi concentrado nos métodos qualitativo e dedutivo de análise de dados. Os resultados e conclusões sugeridos pelo presente trabalho apontam na direção da responsabilização civil do Estado por danos catastróficos, devido ao descumprimento dos deveres diante da gestão dos riscos e perigos catastróficos, bem como diante dos patamares mínimos para a concretização da vida humana em níveis dignos e também devido à faceta socioambiental assumida pelo Brasil no Texto Constitucional de 1988.
ABSTRACT: This article is dedicated to the study of natural disasters and specially the harms produced by them. Generally associated to the exemptions for legal responsibility, considering the civil liability for damages due to natural disasters seems something challenging. Under this aspect, the possibility of repairing catastrophic damages is cogitated in the scenario of a Social-Environmental State of Law proposed by the Constitution of the Federative Republic of Brazil. In this approach, the present article was developed in three parts. The first one was dedicated to the study of the relation between the disasters and the Law. The second is focused on the analysis of the environmental protection duties inherent in a Social-Environmental State of Law. The third and last part was dedicated to ascertain the possibility of imputation of the civil liability for catastrophic damages to the Social-Environmental State of Law. Aiming this target, the research was mainly bibliographic and documentary, and its procedure was concentrated on the qualitative and deductive methods of data analysis. The results and conclusions suggested by this article point at the direction of the State's civil liability for catastrophic damages due to the noncompliance of its duties before the management of catastrophic risks and hazards, as well as before the minimum standards for the materialization of the human life in worthy levels and also due to the Social-Environmental facet assumed by Brazil in its Constitutional Text of 1988 .

Diferente do que comumente se imagina, os desastres não estão distantes da realidade próxima. O c... more Diferente do que comumente se imagina, os desastres não estão distantes da realidade próxima. O corolário mais evidente de tais eventos é o dano catastrófico, uma espécie de dano ambiental que traz consigo lesões patrimoniais e extrapatrimoniais, além de grandes prejuízos de ordem econômica, mormente para aqueles indivíduos sem acesso aos direitos sociais mais básicos. Tal situação se torna ainda mais grave quando entram em cena as mudanças climáticas, as quais representam um risco catastrófico, haja vista aumentarem a vulnerabilidade e a exposição, fazendo com que o contexto ganhe contornos de injustiça ambiental. Considerando que existem mecanismos de gerenciamento e enfrentamento de riscos e perigos catastróficos, o Estado Socioambiental de Direito deve observar seus deveres de proteção ambiental e tomar medidas eficazes para mitigar as consequências danosas de tais eventos. Contudo, uma vez verificado o dano, é necessário que haja a compensação, a qual é feita através do instituto jurídico da responsabilidade civil. Entretanto, a doutrina civilista, ainda muito influenciada pela tradição liberal individualista, considera estes casos como causas excludentes de responsabilidade, não havendo, portanto, a reparação dos lesados. Por tais motivos, buscou-se encontrar dentro do complexo arcabouço jurídico maneiras mais rápidas e eficazes de compensação das vítimas de desastres, procurando flexibilizar os elementos da responsabilidade civil tanto no campo do direito material quanto do direito processual. Nesse sentido, utilizou-se do método dedutivo quando da análise de dados, iniciando-se nas teorias e normas para depois se chegar aos fenômenos específicos; adotou-se também o método monográfico, cotejando e sintetizando dentre os variados posicionamentos doutrinários aqueles que apresentam as melhores alternativas possíveis de resolução do problema da reparação de danos advindos das catástrofes naturais. Ademais, o trabalho se valeu da forma de pesquisa bibliográfica, isto é, tomou como base o conjunto de livros e demais escritos sobre o tema, além da pesquisa documental, qual seja, buscou-se na jurisprudência nacional caminhos possíveis a se trilhar quando diante de uma catástrofe natural. Uma vez realizada a pesquisa, restou demonstrado que, diante dos deveres de proteção ambiental e da legislação vigente, a responsabilidade civil nesses casos, amiúde, é do Estado Socioambiental de Direito, que se omite em cumprir suas obrigações. No entanto, há diversos entraves à reparação das vítimas dos desastres, tais como a mora em se obter uma tutela jurisdicional, bem como as teorias que excluem a responsabilidade do ente de direito público. Todavia, buscando uma flexibilização com vistas à compensação dos lesados, ficou assentado, em síntese, que responsabilidade estatal, no que diz respeito ao campo do direito material, deve ser considerada como extracontratual; solidária e objetiva, sendo adotadas a teoria do risco integral e a teoria das probabilidades. Já na esfera do direito processual, o magistrado da demanda pode lançar mão da teoria dinâmica do ônus da prova, porém, melhor seria se a causa fosse resolvida através de um meio alternativo de resolução de conflitos, como o design de sistema de disputas, contudo, falta vontade política nesse sentido.
