A ciência hegemônica considera que existem apenas dois corpos sexuados: o masculino e o feminino,... more A ciência hegemônica considera que existem apenas dois corpos sexuados: o masculino e o feminino, o que se denomina "dimorfismo sexual". Contudo, as evidências revelam que os corpos de homens e mulheres variam imensamente. O presente artigo pretende problematizar o discurso científico hegemônico, o qual estabelece apenas o corpo masculino típico e o corpo feminino típico como normais e, com isso, enquadra todos os corpos que fogem aos modelos típicos como errados ou patológicos. A pesquisa realizada foi bibliográfica e documental. O artigo foi dividido em três tópicos: o primeiro apresenta uma breve história da construção das noções hegemônicas sobre os corpos sexuados; o segundo tópico apresenta como os corpos atípicos são remodelados pelo discurso científico a fim de considerá-los errados e patológicos, ao invés de variações da natureza; e, por fim, o terceiro apresenta uma nova forma de olhar todos os corpos sexuados.

Para tan... more RESUMO: O presente artigo pretendeu analisar a natureza jurídica das uniões simultâneas. Para tanto, fez-se um desenvolvimento histórico, com fins a determinar os elementos caracterizadores das relações familiares. Posteriormente, analisou-se o papel da monogamia e do dever de fidelidade na ordem jurídica brasileira. Por fim, perquirimos a natureza jurídica das diversas possibilidades de uniões simultâneas. Como método de abordagem utilizou-se a dialética. Já a técnica de coleta de dados foi a pesquisa bibliográfica, com análise de julgados, de livros e artigos, impressos ou eletrônicos. O estudo revelou que o tema é ainda muito polêmico, posto que relaciona-se com os valores morais da sociedade brasileira, há muito sedimentados, inclusive juridicamente, tais como a fidelidade e a monogamia. O estudo revelou que os direitos reprodutivos vêm sendo, efetiva e legitimamente, exercidos em larga escala pelas pessoas. A consagração normativa, no âmbito internacional, constitucional e infraconstitucional, dos direitos reprodutivos tem por fim garantir a liberdade reprodutiva, salvaguardando a autodeterminação das pessoas. Violar a decisão alheia sobre o exercício da parentalidade ocasiona impactos negativos no direito ao desenvolvimento da personalidade, ocasionando danos materiais e morais indenizáveis.
A partir do reconhecimento jurídico da união civil por pessoas do mesmo sexo, seja pela união est... more A partir do reconhecimento jurídico da união civil por pessoas do mesmo sexo, seja pela união estável seja pelo casamento, poder-se-ia pensar que as pessoas LGBTs têm alçado maior visibilidade e inclusão. Isto seria, entretanto, verdadeiro? Objetiva-se, no presente artigo, realizar uma análise de acórdãos do Tribunal de Justiça de São Paulo, a fim de averiguar a (não) atuação deste Tribunal no combate à LGBTfobia e na promoção da inclusão e visibilidade das pessoas LGBTs. A escolha pelo referido Tribunal justifica-se pelo fato de a cidade de São Paulo sediar o maior evento da comunidade LGBT, no Brasil, a Parada do Orgulho LGBT, bem como pelo fato de ser reconhecida, nacional e internacionalmente, pelo suposto respeito às diferenças e pela inclusão das diversidades. Possuirá, assim, o presente texto três fases: sendo apresentado, no primeiro momento, a ordem simbólica heteronormativa conjuntamente com o conceito de LGBTfobia; posteriormente, serão apresentadas as jurisprudências analisadas; por fim, mediante aprofundamento do conteúdo dos acórdãos, serão averiguadas/constatadas as dificuldades de acesso à justiça pela população LGBT brasileira.

Resumo Tendo em vista a positivação do princípio da igualdade, o Código Civil brasileiro de 2002 ... more Resumo Tendo em vista a positivação do princípio da igualdade, o Código Civil brasileiro de 2002 (CC/02) utiliza uma linguagem neutra, objetivando atender à igualdade entre os gêneros. Nesta senda, o CC/02 estabelece os direitos e deveres conjugais, os quais são dirigidos a ambos os cônjuges. Em caso de descumprimento, as sanções impostas referem-se, principalmente, à perda do direito ao uso do sobrenome matrimonial e à natureza da verba alimentar. De acordo com a lei civil brasileira, os deveres conjugais são direcionados igualmente a ambos os cônjuges que, simetricamente, sofreriam as consequências pelo descumprimento. Tal fato seria, contudo, verdadeiro? Em outras palavras: como o cumprimento dos deveres conjugais e as suas consequências jurídicas atingem homens e mulheres?O objetivo do presente trabalho consiste em analisar como os deveres conjugais e as consequências jurídicas da culpa são dirigidos a homens e mulheres. A pesquisa revelou que igualdade formal não é suficiente para a efetivação da igualdade material entre os gêneros. A origem sexista dos deveres conjugais somadas à realidade dificulta uma aplicação igualitária da lei. Sob um falso discurso de igualdade, os dispositivos legais relativos aos deveres conjugais e às sanções por descumprimento acabam por ratificar a dominação masculina. O padrão masculino é colocado como paradigma, desconsiderando o universo feminino. A neutralidade do discurso jurídico não foi pensada para incluir as mulheres. Pierre Bourdieu aponta que a visão androcêntrica impõe-se como neutra e dispensa os discursos que a legitimam. Assim, o Direito, pretensamente neutro, acaba repetindo e recriando a ordem desigual. Um dos problemas jurídicos ocasionados pela reprodução assistida e pela consequente possibilidade de crioconservar embriões humanos consiste em estabelecer um conceito jurídico para o nascituro e para o próprio embrião congelado. O artigo 2º, do Código Civil brasileiro, dispõe que a personalidade inicia-se com o nascimento com vida, mas a lei põe a salvo, desde a concepção, os direitos do nascituro. Diante da nova realidade científica, surgem, então, algumas dúvidas: em consiste a expressão " desde a concepção " utilizada pelo código civil, para fins a proteger os direitos do nascituro? Em outras palavras, o conceito de nascituro abrange o embrião humano " in vitro " ? Em que consiste o embrião humano congelado para o Direito? Os embriões humanos congelados têm resguardado o direito fundamental à vida? Há vida no embrião congelado? O objetivo do presente trabalho consistiu em buscar delimitar um conceito jurídico para o nascituro, bem como procurar definir a natureza jurídica do embrião humano " in vitro ". O estudo demonstrou que " Embrião congelado " , " nascituro " e " pessoa " são conceitos e categorias jurídicos distintas, com regimes jurídicos distintos. O " embrião crioconservado " ainda não possui uma definição jurídica pelo Ordenamento Jurídico brasileiro. Instado a se manifestar sobre o início da vida humana, o Supremo Tribunal Federal entendeu, por maioria, que não há vida humana no embrião crioconservado, motivo pelo qual liberou as pesquisas com células-tronco embrionárias, na forma como colocada pelo artigo 5º, da Lei 11.105/2005. " Nascituro " é aquele ser concebido e ainda não nascido a quem a lei resguarda direitos, tendo em vista a possibilidade de nascer com vida. O conceito de nascituro não deve abranger o embrião congelado, pois a lei protegeu os direitos do nascituro ante a perspectiva latente de ele vir a nascer com vida, o que não ocorre enquanto o embrião estiver congelado em laboratório. Hoje, é possível afirmar que, para o Supremo Tribunal Federal, o conceito de nascituro não abrange o embrião " in vitro " , do contrário, as pesquisas com células-tronco teriam sido proibidas. " Pessoa " , por sua vez, é aquele que pode ser sujeito de direito, ou seja, é aquele que tem personalidade jurídica. Para o Direito brasileiro, tem personalidade jurídica aquele que já nasceu e que se encontra vivo. Assim, se nem o nascituro tem personalidade jurídica, que dirá o embrião congelado. One of the legal problems caused by assisted reproduction and the consequent possibility of cryopreserved human embryos is to establish a legal concept to the unborn baby and the embryo frozen. Article 2 of the Brazilian Civil Code, provides that personality begins at birth with life, but the law puts the saved, from conception, the rights of the unborn. Facing the new scientific reality, there are some questions: what does the expression " from conception " used by the Civil Code mean? In other words, does the term include the human embryo in vitro? What is the human embryo frozen for the Low? Do the Frozen human embryos have safeguarded the fundamental right to life? Is there life in the frozen embryo? The aim of this study was to seek to define a legal concept for the unborn, and seek to define the legal nature of the human embryo in vitro. The study showed that "frozen embryo", "unborn child" and "person" are distinct legal concepts and categories, with different legal systems. The "cryopreserved embryo" does not have a legal definition by the Brazilian legal system. Asked to speak about the beginning of human life, the Supreme Court held, by majority, that there is no human life in the cryopreserved embryo. So, because of the research with embryonic stem cells was allowed as the way by Article 5 of Law 11.105/2005. "Unborn" is that being conceived and unborn whom the law protects rights, in view of the possibility of being born alive. The concept of the unborn should not cover the frozen embryo, because the law protected the rights of the unborn at the prospect of imaging him being born alive, which does not occur while the embryo is frozen in the laboratory. Desse modo, o acompanhamento médico integral é direito das partes envolvidas na realização de um projeto parental. Durante a gestação, a Medicina propicia a realização de exames para detectar anomalias fetais, os chamados diagnósticos pré-natais. Nos países onde o aborto é permitido, o diagnóstico de uma deficiência fetal incurável possibilita o exercício do direito ao aborto, por parte da genitora. Logo, um erro médico consistente na falha em detectar uma anomalia embrionária ou fetal ou na ausência de informação acerca de tal quadro pode ocasionar a perda de uma chance de exercício de uma escolha reprodutiva, mais especificamente a realização ou não de um aborto. É sobre a perda da chance do exercício do direito ao aborto que versam as ações de wrongful birth e wrongful live, cada vez mais comuns nos países onde o aborto é permitido. Indaga-se: o nascimento de uma pessoa deficiente, em razão da falta de um diagnóstico preciso de má formação e da consequente perda da chance do exercício do direito ao aborto, pode ensejar uma reparação civil? O objetivo do presente trabalho consiste justamente em analisar os pressupostos da responsabilidade civil nos casos de wrongful birth e wrongful life. Embora o aborto ainda seja proibido no Brasil, a pesquisa se faz necessária, porque recorrentemente os Tribunais de diversos países têm sido instados a se manifestarem sobre o tema. Logo, é importante que o Brasil participe desta discussão acadêmica, o qual merece debates por ser um tema novo e complexo. Para atingir tal objetivo, realizou-se uma pesquisa bibliográfica, cujo material teórico consistiu em artigos doutrinários e em decisões judiciais. A pesquisa mostrou que os pressupostos da responsabilidade civil encontram-se plenamente atingidos na wrongful birth action, sem que o mesmo ocorra na wrongful live action. Durante a gestação, a Medicina propicia a realização de exames para detectar anomalias fetais, os chamados diagnósticos pré-natais. Possuirá, assim, o presente texto três fases: sendo apresentado, no primeiro momento, a ordem simbólica heteronormativa conjuntamente com o conceito de LGBTfobia; posteriormente, serão apresentadas as jurisprudências analisadas; por fim, mediante aprofundamento do conteúdo dos acórdãos, serão averiguadas/constatadas as dificuldades de acesso à justiça pela população LGBT brasileira.

O método de abordagem foi o dialético. Como técnica de coleta de dados, utilizou-se a pesquisa bibliográfica, com análise de livros e artigos, impressos ou eletrônicos. O estudo revelou que o Direito também é responsável pela criação e pela legitimação da ordem sexual machista e heteronormativa ainda vigentes, conferindo-a a aparência de natural.
Resumo Tendo em vista a positivação do princípio da igualdade, o Código Civil brasileiro de 2002 ... more Resumo Tendo em vista a positivação do princípio da igualdade, o Código Civil brasileiro de 2002 (CC/02) utiliza uma linguagem neutra, objetivando atender à igualdade entre os gêneros. Nesta senda, o CC/02 estabelece os direitos e deveres conjugais, os quais são dirigidos a ambos os cônjuges. Em caso de descumprimento, as sanções impostas referem-se, principalmente, à perda do direito ao uso do sobrenome matrimonial e à natureza da verba alimentar. De acordo com a lei civil brasileira, os deveres conjugais são direcionados igualmente a ambos os cônjuges que, simetricamente, sofreriam as consequências pelo descumprimento. Tal fato seria, contudo, verdadeiro? Em outras palavras: como o cumprimento dos deveres conjugais e as suas consequências jurídicas atingem homens e mulheres?O objetivo do presente trabalho consiste em analisar como os deveres conjugais e as consequências jurídicas da culpa são dirigidos a homens e mulheres. A pesquisa revelou que igualdade formal não é suficiente para a efetivação da igualdade material entre os gêneros. A origem sexista dos deveres conjugais somadas à realidade dificulta uma aplicação igualitária da lei. Sob um falso discurso de igualdade, os dispositivos legais relativos aos deveres conjugais e às sanções por descumprimento acabam por ratificar a dominação masculina. O padrão masculino é colocado como paradigma, desconsiderando o universo feminino. A neutralidade do discurso jurídico não foi pensada para incluir as mulheres. Pierre Bourdieu aponta que a visão androcêntrica impõe-se como neutra e dispensa os discursos que a legitimam. Assim, o Direito, pretensamente neutro, acaba repetindo e recriando a ordem desigual. Um dos problemas jurídicos ocasionados pela reprodução assistida e pela consequente possibilidade de crioconservar embriões humanos consiste em estabelecer um conceito jurídico para o nascituro e para o próprio embrião congelado. O artigo 2º, do Código Civil brasileiro, dispõe que a personalidade inicia-se com o nascimento com vida, mas a lei põe a salvo, desde a concepção, os direitos do nascituro. Diante da nova realidade científica, surgem, então, algumas dúvidas: em consiste a expressão " desde a concepção " utilizada pelo código civil, para fins a proteger os direitos do nascituro? Em outras palavras, o conceito de nascituro abrange o embrião humano " in vitro " ? Em que consiste o embrião humano congelado para o Direito? Os embriões humanos congelados têm resguardado o direito fundamental à vida? Há vida no embrião congelado? O objetivo do presente trabalho consistiu em buscar delimitar um conceito jurídico para o nascituro, bem como procurar definir a natureza jurídica do embrião humano " in vitro ". O estudo demonstrou que " Embrião congelado " , " nascituro " e " pessoa " são conceitos e categorias jurídicos distintas, com regimes jurídicos distintos. O " embrião crioconservado " ainda não possui uma definição jurídica pelo Ordenamento Jurídico brasileiro. Instado a se manifestar sobre o início da vida humana, o Supremo Tribunal Federal entendeu, por maioria, que não há vida humana no embrião crioconservado, motivo pelo qual liberou as pesquisas com células-tronco embrionárias, na forma como colocada pelo artigo 5º, da Lei 11.105/2005. " Nascituro " é aquele ser concebido e ainda não nascido a quem a lei resguarda direitos, tendo em vista a possibilidade de nascer com vida. O conceito de nascituro não deve abranger o embrião congelado, pois a lei protegeu os direitos do nascituro ante a perspectiva latente de ele vir a nascer com vida, o que não ocorre enquanto o embrião estiver congelado em laboratório. Hoje, é possível afirmar que, para o Supremo Tribunal Federal, o conceito de nascituro não abrange o embrião " in vitro " , do contrário, as pesquisas com células-tronco teriam sido proibidas. " Pessoa " , por sua vez, é aquele que pode ser sujeito de direito, ou seja, é aquele que tem personalidade jurídica. Para o Direito brasileiro, tem personalidade jurídica aquele que já nasceu e que se encontra vivo. Assim, se nem o nascituro tem personalidade jurídica, que dirá o embrião congelado. Facing the new scientific reality, there are some questions: what does the expression " from conception " used by the Civil Code mean? In other words, does the term include the human embryo in vitro? What is the human embryo frozen for the Low? Do the Frozen human embryos have safeguarded the fundamental right to life? Is there life in the frozen embryo? The aim of this study was to seek to define a legal concept for the unborn, and seek to define the legal nature of the human embryo in vitro. The study showed that "frozen embryo", "unborn child" and "person" are distinct legal concepts and categories, with different legal systems. The "cryopreserved embryo" does not have a legal definition by the Brazilian legal system. Desse modo, o acompanhamento médico integral é direito das partes envolvidas na realização de um projeto parental. Durante a gestação, a Medicina propicia a realização de exames para detectar anomalias fetais, os chamados diagnósticos pré-natais. Nos países onde o aborto é permitido, o diagnóstico de uma deficiência fetal incurável possibilita o exercício do direito ao aborto, por parte da genitora. Logo, um erro médico consistente na falha em detectar uma anomalia embrionária ou fetal ou na ausência de informação acerca de tal quadro pode ocasionar a perda de uma chance de exercício de uma escolha reprodutiva, mais especificamente a realização ou não de um aborto. É sobre a perda da chance do exercício do direito ao aborto que versam as ações de wrongful birth e wrongful live, cada vez mais comuns nos países onde o aborto é permitido. Indaga-se: o nascimento de uma pessoa deficiente, em razão da falta de um diagnóstico preciso de má formação e da consequente perda da chance do exercício do direito ao aborto, pode ensejar uma reparação civil? O objetivo do presente trabalho consiste justamente em analisar os pressupostos da responsabilidade civil nos casos de wrongful birth e wrongful life. Embora o aborto ainda seja proibido no Brasil, a pesquisa se faz necessária, porque recorrentemente os Tribunais de diversos países têm sido instados a se manifestarem sobre o tema. Logo, é importante que o Brasil participe desta discussão acadêmica, o qual merece debates por ser um tema novo e complexo. Para atingir tal objetivo, realizou-se uma pesquisa bibliográfica, cujo material teórico consistiu em artigos doutrinários e em decisões judiciais. A pesquisa mostrou que os pressupostos da responsabilidade civil encontram-se plenamente atingidos na wrongful birth action, sem que o mesmo ocorra na wrongful live action. Para tanto, fez-se um desenvolvimento histórico, com fins a determinar os elementos
caracterizadores das relações familiares. Posteriormente, analisou-se o papel da monogamia e
do dever de fidelidade na ordem jurídica brasileira. Por fim, perquirimos a natureza jurídica das
diversas possibilidades de uniões simultâneas. Como método de abordagem utilizou-se a
dialética. Já a técnica de coleta de dados foi a pesquisa bibliográfica, com análise de julgados,
de livros e artigos, impressos ou eletrônicos. O estudo revelou que o tema é ainda muito
polêmico, posto que relaciona-se com os valores morais da sociedade brasileira, há muito
sedimentados, inclusive juridicamente, tais como a fidelidade e a monogamia.
