Guiado por esse objetivo, procedo recordando (i) a aparição da historiografia jurídica sobre as revistas, detendo-me na sequência (ii) em algumas questões conceituais, assim como (iii) em várias advertências práticas – colhidas da minha própria experiência – que convém ter em consideração quando se estudam esses materiais. Entretenho-me, na continuidade, em um (iv) rápido balanço dos repertórios e inventários consultados nesta fase, embrionária, do trabalho. Tratando-se de um projeto ambicioso – descrito sumariamente no (V) desfecho destas páginas – que só pode ser realizado por uma rede de pesquisadores, convido o leitor interessado a se somar aos nossos esforços.

At his colleagues request, his previous experience in the study and edition of the draft Civil Code of 1821 led him to write repeatedly about codification. The result, conveniently arranged, is in the hands of the reader.
The article analyzes the historical process of legal cod-ification during the liberal Triennium. ... more The article analyzes the historical process of legal cod-ification during the liberal Triennium. The research examines the circumstances and constitutional condi-tions of elaboration, possible models and parallel texts, and the content of the Penal Code and the in-complete draft of the Civil Code. The article investi-gates the relationship between such codes, recalling the doctrinal proposals and the strategies followed during their elaboration process, as well as undertak-ing a cross-reading of their texts. Comparing the Spanish codes with other texts will make it possible to highlight their uniqueness in a legislative history that was not yet dominated by the Napoleonic Cinq codes.

Am... more The article presents a work plan on the legal journals published in Spain, Portugal and the in American republics that were once their colonies (ca.1830-1950). Our aim is, firstly, to recall the origins of legal historiography on journals. We focus, secondly, on some conceptual issues and, thirdly, on several practical caveats, gathered from my own experience, that should be taken into consideration when studying these materials. We do then a quick review of the repertories and inventories consulted in this embryonic phase of the work. We finally describe briefly how ambitious the project is. Since it can only be carried out by a group of researchers, we invite interested readers to join our efforts.

Desde el ángulo de observación que ofrece la experiencia española --el caso de un ordenamiento jurídico con cultura pero sin texto de código, hasta finales del siglo XIX-- se abordan cuestiones teóricas y se estudian procesos de circulación de textos legales y doctrinas: de Francia a Montenegro y Alemania, de España a Portugal y Colombia.
The book brings together studies on codification in historical and comparative perspective. From the angle of observation offered by the Spanish experience - the case of a legal system impregnated with a code culture but without a code as a text until the end of the 19th century - the author addresses theoretical questions and studies processes of circulation of legal texts and doctrines from France to Montenegro and Germany, from Spain to Portugal and Colombia.
Estudio del (incompleto) proyecto de Código civil elaborado por las Cortes en 1821, en el marco d... more Estudio del (incompleto) proyecto de Código civil elaborado por las Cortes en 1821, en el marco de las ideas y textos de la codificación civil europea del momento y de la Constitución de 1812. Se reconstruye la vida parlamentaria del intento de las Cortes y las biografías de los diputados que estuvieron tras su elaboración, en particular el valenciano Nicolás Mª Garelly. El análisis de tres relevantes cuestiones abordadas por Garelly y sus colegas –la teoría de la ley, las condiciones que afectaban el estatuto jurídico de los individuos, los derechos civiles de éstos− completa la monografía, que incluye una nueva edición del folleto impreso (en diciembre de 1821) que constituye nuestra única fuente de conocimiento.
A study of the (incomplete) draft of the Civil Code drawn up by the Cortes in 1821, within the framework of the ideas and texts of the contemporary European codification. It reconstructs the parliamentary life of the text in the Spanish Cortes and the biographies of the deputies who worked on it, in particular Nicolás Mª Garelly. The analysis of three relevant issues addressed by Garelly and his colleagues – namely the theory of legislation, the conditions affecting the legal status of individuals, their civil rights - completes the monograph, which also includes a new edition of the printed booklet (December 1821) that constitutes our sole source of knowledge.

Studies on Spanish legal journals of the 19th and 20th centuries (La Escuela del Derecho, Revista... more Studies on Spanish legal journals of the 19th and 20th centuries (La Escuela del Derecho, Revista de los Tribunales, Revista General de Legislación y Jurisprudencia, Revista de Ciencias Jurídicas y Sociales) and on issues of legal relevance addressed by the daily press (the crime in Calle de Fuencarral, the celebrity of Cesare Lombroso). There are two theses - one, in fact - that run through the works. The first deals with the dominant model of the lawyer in liberal Spain. The old Ciceronian lawyer was replaced in the 1880s by a 'scientific' jurist; an extraordinary example was Rafael de Ureña and the law review that he created at the University of Madrid. Secondly, it is maintained that before those years and even after, there were no great differences between the so-called "legal reviews" and the "political journals", due to the invasive projection of the same public discourse. The Sevillian lawyer and politician Joaquín Francisco Pacheco, founder of professional magazines but also of newspapers, can embody like no other the archetype of the jurist-public man who, like Cicero, acted in defence of his sponsored but also in favour of the collective cause
Se reproduce el discurso de ingreso de Rafael de Ureña y Smenjaud (1852-1930) en la Real Academia... more Se reproduce el discurso de ingreso de Rafael de Ureña y Smenjaud (1852-1930) en la Real Academia de Ciencias Morales y Políticas (1912). “Una tradición jurídica española” estudiaba los fueros de la Extremadura castellano-aragonesa que consagraron la potestad sobre los hijos como el poder “conjunto y solidario” del padre y de la madre, lo que Ureña presentó en abierto contraste con la solución “romana” (esto es, no o poco ‘española’) del criticado Código civil. El estudio de Carlos Petit examina, a partir del argumento y de las fuentes abordados en el discurso, la posición de Ureña en la historiografía jurídica española, una especialidad constituida como disciplina en torno a Eduardo de Hinojosa y Naveros (1852-1919), archivero y medievalista y maestro de algunos de los fundadores del influyente Anuario de Historia del Derecho Español (1924). A ese fin se recuperan algunos documentos inéditos y varios recuerdos que ilustran los particulares de la revista indicada.

Le riviste "consorelle" hanno rappresentato uno strumento privilegiato di comunicazione scientifica e di politica culturale, rivelandosi luoghi di elaborazione e di intersezione di saperi e pratiche diversi, in grado di formare, orientare, condizionare i principali protagonisti del dibattito penalistico tra Otto e Novecento, non solo in Italia. Questa 'tribuna' fa emergere un quadro fortemente dinamico, complesso e articolato, attraverso il quale è possibile mettere a fuoco alcuni snodi cruciali del rapporto tra opinione pubblica, cultura giuridica, giustizia penale e garanzia delle libertà.

Con el abogado-orador como modelo de jurista perfecto y piedra de toque de la referida cultura, se analizan sucesivamente las prácticas universitarias (lecciones, discursos de apertura, oposiciones a cátedra), la profesión forense (saberes, bibliotecas, gestos...) con atención particular a la literatura sobre elocuencia y, en fin, la actividad parlamentaria y legislativa. Se pretende así observar desde nuevas perspectivas los textos del momento liberal.

This volume examines the lives of twenty key personalities in Spanish legal history, in particular how their Christian faith was a factor in molding the evolution of law.
