En él, el juicio de quien reconstruye, su valoración acerca de los acontecimientos que se dispone a relatar, determina la acción narrativa final. Esta visión, en principio ajena a una perspectiva jurídica, es compartida por el haber jurisprudencial del Tribunal constitucional español sobre el derecho a la información entre 1980 y 2005; así lo muestra este estudio, con la comparación entre las nociones de “verdad informativa” característica de la Periodística, y la de “información veraz” de la jurisprudencia constitucional. Para el Tribunal constitucional, la clave de una información veraz es la diligencia profesional, proporcionada y razonable, del periodista, algo que no resulta asimilable a “una concordancia entre la información difundida y la verdad material u objetiva de los hechos narrados”, ni “equivale a realidad incontrovertible de los hechos”, sino que ...

Hacia algo mas de un ano le habian diagnosticado un cancer de mama. Dio batalla a la enfermedad con todo el animo del que solo Mateye era capaz; y, cuando llego el momento, nos ayudo a todos a acompanarla en su transito al Cielo.
This article aims to show the current situation surrounding the right to privacy in the Spanish l... more This article aims to show the current situation surrounding the right to privacy in the Spanish legal system. First of all, we look at the regulations governing the right to privacy and at the characteristics of the Spanish protection of privacy. In the second part of the paper, we consider the current regulations on personal data protection as the grounds for new ways of protecting privacy. Finally, the paper shows how two new rights have emerged from the legal discourse on privacy and, overall, from the regulation of the protection of personal data: informative self-determination and the right to be forgotten. This study focuses on the latter, due to the prominent role of Spanish judges in shaping the incipient right to be forgotten via inter-action with the European Court of Justice in 2014.

Google Spain (May 2014). Despite the controversy raised by this resolution, the right to be forgotten is actually a new expression of the European system of protection of personal data. The chapter aims to show the development of the right to be forgotten in Spain and, in this process, the relevance of the two main Spanish cases, Mario Costeja v Google Spain and Les Alfacs v Google Spain which represent both the personal aspects and corporate interests in the right to be forgotten.

The possibility of taping live images without having to move a TV camera in courtroom, o even better, being able to transmit news, perceptions or opinions during judicial proceedings by Social Media (over all Twitter) not only has changed the way in which journalists work, but it has also suppose a series of benefits and risks for the judicial proceeding itself. In the same way that in the late 1990s, the O. J. Simpson trial (USA) wasthe reference for the debate on the access of TV cameras in Courts, today, the Oscar Pistorius (South Africa) is the field of proofs to visualize those changes that Twitter has introduced in the journalistic coverage of Courts

The passing of the Telecommunications reform Law in Mexico, in April 2013, has been one of the ac... more The passing of the Telecommunications reform Law in Mexico, in April 2013, has been one of the achievements of the Pacto por México (“Agreement for Mexico”), a pact signed in December 2012 by the federal government and the three major political parties to pass reforms aimed at the consolidation of a society respectful of human rights and the development of the country’s economic and social spheres. Within the telecommunications reform and the broadcasting system, the main challenges currently are: 1) the regulation of the right of reply; 2) the redistribution of the “must carry” and “must offer” obligations among TV companies; 3) the measures that must be applied to the dominant TV companies and Telecom operators to facilitate media plurality; and 4) the creation of the new telecommunications authority: the Instituto Federeal de Telecomunicaciones (“Federal Telecommunications Institute”), aka IFT.
Within this context, a very interesting aspect is the debate about the Right of Reply and its regulation, which is related to the right to freedom of expression and the participation of citizens in the media. Recently, in December 2013, Mexico’s Chamber of Deputies (Cámara de Diputados) passed the draft law to regulate constitutional article 6, which covers the right of reply.

Considerando la multidimensionalidad del descontento, entenderemos a la desafección como el componente que más se relaciona con aquello que Putnam y Goss denominan “las condiciones previas fundamentales para una democracia efectiva”. En virtud de la evidencia sobre los efectos democráticos de las campañas, sugeriremos que la publicidad electoral nos podría ayudar a enfrentar el declive del sentido cívico de nuestros individuos desde su dimensión actitudinal, lo que tendría implicancias concretas en la calidad de nuestro sistema democrático.
