The so-called esip-tabal contract is a particular type of agricultural transaction known from Cod... more The so-called esip-tabal contract is a particular type of agricultural transaction known from Codex Hammurabi and the Akkadian legal texts found in Susa. The Akkadian phrase esip-tabal is a statement made by the owner of the field to the other party, which is commonly understood to be a tenant. Modern scholarship first interpreted this contract as a lease. Later it was considered an antichretic loan, a loan in which the creditor takes over the debtor’s agricultural land as security. However, the place of this contract in the long-term history of law is still unknown and scholars have not made any analogies from other legal cultures. Using the methodology of comparative legal history, and drawing especially on Islamic law, this essay offers a new interpretation of the esip-tabal contract as a sale of future crops. The essay then discusses the rationale behind the contract and its possible continuity into later periods.
Every now and again, one is overcome by a sense of utter disbelief. How can it be that some conve... more Every now and again, one is overcome by a sense of utter disbelief. How can it be that some conventional narratives are still so persistent and influential in this day and age? In fact, they are so pervasive that one feels compelled to put pen to paper in order to combat them. Among these narratives, we find the tale of cultural evolution, where law plays a fundamental role as an instrument for rationalizing archaic societies. Having rejected this kind of historiography in his last essay on the early history of law (ZRG RA 127, 1–13), the late Raymond Westbrook instead postulated new paradigms. Moving in the same direction, Philipp Ruch thwarts this story of civilizing progress in a twofold manner: In his eyes, honor and vengeance are not the anthropological factors that law has to contain in order to create civilization. According to Ruch, and the main thrust of his 2016 dissertation, it was in fact law in the context of honor and vengeance that produced emotionality. ..

Bei ihrer wissenschaftsgeschichtlichen Einordnung zeigt sich eine charakteristische Prägung durch den methodischen Ansatz der historischen Rechtsvergleichung wie auch durch eine stark interdisziplinäre Ausrichtung. Stand und Perspektiven der von juristischer Seite betriebenen Keilschriftrechtsgeschichte werden anhand von aktuellen Forschungsvorhaben im Rahmen Frankfurter Verbundprojekte exemplarisch beschrieben. Dabei wird deutlich, dass das Fach, nicht zuletzt aufgrund der vorgenannten Prägung, in hohem Maße anschlussfähig an kulturübergreifende Erkenntnisinteressen ist

The main question of the research is about the formation and typology of the partnership as a legal institution: how did ancient Elamites execute partnership contracts? How were practices of kinship, agriculture, and religion intertwined in the first half of the second millennium? And how might an understanding of these practices contribute to a broader revision of legal history in the region?

Rechtshistorische Studien, die sich explizit den aus Ugarit, dem heutigen Ras Schamra in Syrien, ... more Rechtshistorische Studien, die sich explizit den aus Ugarit, dem heutigen Ras Schamra in Syrien, aus der zweiten Hälfte des zweiten vorchristlichen Jahrtausends überlieferten Quellen widmen, sind innerhalb der Rechtsgeschichte des Alten Vorderen Orients fest etabliert, wenn auch als Ausnahmeerscheinung1)� Obgleich das Korpus der Rechtstexte im engeren Sinn begrenzten Umfang aufweist2), verdient es an der Schnittstelle zwischen den (Rechts)Kulturen Mesopotamiens und der Levante besondere Aufmerksamkeit� Das gilt gleichermaßen für Schriftzeugnisse, die keinen unmittelbaren Rechtsquellencharakter aufweisen, insbesondere Mythen, Ritualtexte und dergleichen mehr, die ihrerseits primär im Fokus verwandter Disziplinen wie der Altorientalistik oder der Theologie stehen. Die von Reinhard Hillmann vorgelegte Untersuchung berücksichtigt ein breites Spektrum unterschiedlicher Textgattungen der ugaritischen, biblischen und altorientalischen Überlieferung mit dem erklärten Ziel einer literarischen Grenzüberschreitung und platziert sie in einen umfassenden Kontext der Eheschließung in den altorientalischen Kulturen� Gleich das erste Kapitel stellt der weiteren Abhandlung einen Abschnitt des sog� NikkalTexts [NK] in Umschrift und Übersetzung voraus. Er enthält die mythologische Erzählung der Anbahnung einer Götterhochzeit, in der der Mondgott Jariḫ bei Ḫarḫab um Nikkal wirbt3), worauf gewissermaßen als Grundkonstellation im Folgenden immer wieder Bezug genommen wird� Drehund Angelpunkt ist dabei der Brautpreis, der bereits zu Beginn der Werbung thematisiert und am Ende der Verhandlungen schließlich abgewogen wird� Diesem einleitenden Blick auf die Brautwerbung schließt sich eine ausführliche Auseinandersetzung mit der Terminologie des Brautpreises in Kapitel 2 an� Ihren Ausgangspunkt markiert das ugaritische Verbum trḫ, das mit dem akkadischen Nomen terḫatu(m) verwandt ist4), welchem im Ugaritischen wiederum das Nomen mhr entspricht.
