informato e disposizioni anticipate di trattamento, che stabilisce, con una norma transitoria, l’applicabilità delle proprie previsioni ai «documenti atti ad esprimere le volontà del disponente in merito ai trattamenti sanitari, depositati presso il Comune di residenza o presso un notaio » prima della data di entrata in vigore della legge medesima, sancendone pertanto la retroattività.

Codice dei contratti pubblici. Lo scritto ne analizza le modalità di funzionamento dettate dal d.p.c.m. 10 maggio 2018, n. 76, operando un raffronto con la disciplina francese e con quella di alcune esperienze regionali, in particolare toscana e pugliese. Si evidenziano luci e ombre della disciplina.

The article examines how “equity in healthcare” contributes to realizing “equity in health”, with... more The article examines how “equity in healthcare” contributes to realizing “equity in health”, with particular regard to the role played by administrative plan-ning and organization. After an outline of the principles that inspire the Italian healthcare system, it focuses on the essential levels of healthcare, which should en-sure uniformity in health protection in the whole territory. Some of the included ser-vices show a particular attention to equity, like screenings or integrated care ser-vices, whose beneficiaries are vulnerable individuals. However, notwithstanding the definition of the essential levels, inequalities continue, as it emerges from the analy-sis of three critical issues: co-payment, waiting lists and the North-South divide in health protection. Consequences can be severe: the most disadvantaged slice of the population quite often foregoes treatment. The paper aims at highlighting how solu-tions for these problems depend not only on available economic resources, but also on organizational settings. Finally, some reflections concern how planning and organ-ization of equity affect freedom of self-determination as to health treatment.
