Throughout Pope Emeritus Benedict XVI's pontificate he spoke to a range of political, civil, academic, and other cultural authorities. These speeches reveal a striking sensitivity to the fundamental problems of law, justice, and democracy. He often presented a call for Christians to address issues of public ethics such as life, death, and family from what they have in common with other fellow citizens: reason. This book discusses the speeches in which the Pope Emeritus reflected most explicitly on this issue, along with commentary from distinguished legal scholars. It responds to Benedict's invitation to engage in public discussion on the limits of positivist reason in the domain of law from his address to the Bundestag. Although the topics of each address vary, they are joined by a series of core ideas whereby Benedict sketches, unpacks, and develops an organic and coherent way to formulate a 'public teaching' on justice and law.

The need for reform in Italian Public Administration is a fact that no longer calls for justification: the increasing divergence between expectations and performance in the public sector appears to expand in inverse proportion to the success rate of the attempts at reform that have successively been made since the 1990s. Taking this reflection as its cue, the book offers the results of a study inspired by the Tuscan regional law 40/2009, exploring the results and prospects of the process of administrative and regulatory simplification, at both national and regional level. The chosen key, which is crucially interdisciplinary, for the very first time probes the profound meshing of legal and economic aspects, offering elements not only of analysis but also of practical application.

"Italy has long been known for its complex bureaucracy, however many steps are being taken to improve the current situation. During the last twenty years, new measures have been put in place to simplify numerous administrative processes in order to reduce costs and improving government services for business and individuals. In this framework the article introduces one of the most important strategies for better regulation implemented by the Italian government during the past legislature, the MOA, a method for measuring the administrative burdens imposed by regulation on business. In the first part the authors describe recent improvements introduced for reducing burdens imposed by regulation, such as the introduction of estimation of burdens during the phase of Regulatory Impact Assessment (RIA) when new regulation has been proposed. In the second part the article discusses both limits of new measures and difficulties that public administrations may face in its application. A further critical point and a challenge is the case law of the Italian Constitutional Court. Indeed, the most recent decisions taken by the Constitutional Court confirm the constitutional nature of the simplification process."

This is the first book published in English to provide to an international audience a comprehensive examination of the Italian Constitutional Court (ItCC) and its principal lines of jurisprudence, historical origins, current engagement with transnational European law, organization, and procedures. In global constitutional dialogue, the voice of the ItCC has been entirely absent due to a relative lack of both English translations of its decisions and of focused scholarly commentary in English. The ItCC represents one of the strongest and most successful examples of constitutional judicial review, and is distinctive in its structure, institutional dimensions, and well-developed jurisprudence. Moreover, the ItCC has developed a unique voice among global constitutional actors in its adjudication of a broad range of topics from fundamental rights and liberties to the allocations of governmental power and regionalism.
