In Constitutional Principles of Local Self-Government in Europe Giovanni Boggero offers a meticul... more In Constitutional Principles of Local Self-Government in Europe Giovanni Boggero offers a meticulous account of the defining features of European constitutional local government law using both an international and comparative law perspective. The book argues that differences between local government systems in Europe, typical examples of internal affairs of a State, can be smoothed away by construing a consistent system of constitutional principles to be coherently applied at domestic level across the whole European legal space. This system can be best grasped by looking at the European Charter of Local Self-Government, which embodies a concept of self-government rooted in common legal traditions, and at its subsequent practice within the Council of Europe.

parziale. L'Italia sembra anzi aver abbassato il livello delle garanzie per le cure all'estero, sollevando
così problemi non solo di compatibilità con il diritto UE, ma anche con la Costituzione

Das Ziel dieses Beitrags ist es, die Hauptfaktoren, die lokale Körperschaften im italienischen Re... more Das Ziel dieses Beitrags ist es, die Hauptfaktoren, die lokale Körperschaften im italienischen Rechtsbereich auslösen, zu analysieren und sie mit Umwälzungen in anderen europäischen Staaten im Kontext der Wirtschafts-und Finanzkrise zu vergleichen. Im Beitrag wird zunächst der Frage nachgegangen, wie die italienischen Provinzen reorganisiert wurden, um dann weiter zu ergründen, wie und in welchem Umfang inter-kommunale Kooperation und Fusionen von Kleinstgemeinden bewerkstelligt wurden. Trotz eines sehr eng begrenzten Rechtsrahmens wurde das italienische Lokalsystem gemäß einer präzisen Idee reformiert, die allzu abgesonderte Bereiche der Lokalregierung zu überwinden vermochte und kleine und ineffiziente Körperschaften zusammenführte.

This article deals with the parents' right to choose between registering their children for cante... more This article deals with the parents' right to choose between registering their children for canteen meals or providing them with a " home-made lunch " to eat at school with their fellow-pupils. The Court of Appeal of Turin acknowledged this individual right, being the lunch-break a crucial part of the school time, which should enable pupils to socialise, to learn about community and nutrition and to be aware of the virtues of a healthy and balanced diet. Dining is therefore as such an educational experience which can be subsumed under the constitutional right to receive an education under Article 34, para. 2 of the Italian Constitution. If everyone has the right to free primary education, it means that the school canteen lunch, being conditioned on payment, cannot be the only way in which the right to the dining-time can be fulfilled. The acknowledgment of such a right by courts, however, cast into doubt administrative discretion by the State in arranging public services and risks of making it dependant upon mere wishes of its citizens.

L'articolo analizza le implicazioni del referendum costituzionale del 4 di-cembre 2016 sulla rifo... more L'articolo analizza le implicazioni del referendum costituzionale del 4 di-cembre 2016 sulla riforma dell'ordinamento delle aree vaste (legge Delrio). Tale riforma, adottata con legge ordinaria in attesa della revisione del Ti-tolo V della Costituzione, ha impropriamente riconfigurato Province e Città metropolitane anticipando alcune delle modifiche costituzionali. La Corte costituzionale ne ha giudicato la compatibilità sulla base di una lettura dei parametri costituzionali orientata dalla riforma costituzionale in itine-re. Ora, con la mancata promulgazione di quest'ultima, la costituzionalità di alcune disposizioni della legge Delrio torna in discussione, in particolar modo la questione dei soggetti titolari e delle modalità del riordino delle funzioni amministrative, della legittimazione democratica degli organi di governo e del grado di autonomia finanziaria degli enti di area vasta.

This paper follows up on the effects of Judgment No. 238/2014 by the Italian Constitutional Court. On grounds of both the substantive and procedural legal ambiguity of the ruling, Italian municipal courts have been confronted with the dilemma of either upholding State immunity and complying with the International Court of Justice's judgment or denying State immunity and following the decision of the Constitutional Court. It is condended that the Constitutional Court would have had jurisdiction to carry out a reassessment of customary international law on State immunity without taking for granted the appraisal by the International Court of Justice. On this basis, it could have avoided to resort to the so-called “counter-limits” doctrine for refraining from giving application to international law, finding instead that State immunity for international crimes committed on the territory of the forum State can be denied under both international and domestic constitutional law. Even if this did not amount to full adherence to Article 59 of the ICJ's Statute in procedural terms, it would have meant compliance with the substance of international law at issue. Yet, an attempt to overcome the “Triepelian approach” of the Constitutional Court has recently been made along most original, albeit problematic lines by Italian municipal courts.

After an historical overview of previous attempts to set up metropolitan cities in Italy (1), it summarizes the main statutory provisions of the Delrio Law (No. 56/2014) through which metropolitan
cities finally came into operation (2) and it provides an analysis of its implementation, thereby attempting to make clear whether increased institutional pluralism and differentiation in the local government system will strengthen or weaken Italian regionalism (3). The conclusion will argue that, while the enactment of local government reforms combined with the entering into force of a significant constitutional amendment will increasingly diminish the role of the Regions, metropolitan cities, due to their ambivalent nature, still lack any propulsive thrust and face the risk of being marginalized until a consistent legal framework for their proper funding is laid down (4).
