Todo aquello vinculado a la muerte siempre ha suscitado un gran debate y ha generado un gran volu... more Todo aquello vinculado a la muerte siempre ha suscitado un gran debate y ha generado un gran volumen de ref lexiones e interpretaciones, que han venido de una variedad de disciplinas. El modo en el que hemos ido concibiendo la muerte también ha sufrido variaciones significativas con los siglos. Nuestro objetivo en este artículo reside, en primer lugar, en esbozar algunas ideas procedentes de algunos filósofos clásicos de la Historia de la Filosofía para ver cómo se ha caracterizado y reflexionado sobre ello. En segundo lugar, desearíamos mostrar de qué manera han ido evolucionando los valo-res y las creencias en torno a la muerte. Por último, aportamos algunas reflexiones éticas sobre el actual escenario en el que aparece la muerte, y llegamos a la conclusión de que se están recuperando ciertas tradiciones y conceptualizaciones de etapas anteriores.

The Convention on the Rights of Persons with Disabilities is an
international treatise about huma... more The Convention on the Rights of Persons with Disabilities is an international treatise about human rights that was adopted by the United Nations in 2006. Although it is a welcome articulation of the rights of persons with disabilities, a detailed review of the text detects some insufficiencies and challenges, especially when analyzed in light of people with mental illness. This paper aims at revising critically the text of the Convention in order to detect such troubles. It would allow us a better understanding of the text if we really want to protect and defend rights of persons with disabilities. Thus, in this paper the author will revise concepts used by the Committee and the Convention such as “disability”, “legal capacity” and “mental capacity”, “discrimination”. Moreover, according to the concept of “safeguards”, this paper will introduce psychiatric advance directives and shared decision-making as two tools in order to defend persons with mental illness. Both preserve the background of the Convention, such as respect for the dignity and autonomy, provide care without discrimination, and encourage rehabilitation, which implies a better quality of life

En segundo término, exponemos algunos principios deontológicos, unos principios éticos y unas virtudes éticas para guiar la elaboración de la HC y el manejo de su información. En tercero, se examina a quién pertenece y quién puede acceder a la información. Por último, se exponen datos empíricos sobre la opinión de los pacientes y los profesionales sobre los registros médicos.

Para ello, exponemos cuáles son los elementos necesarios: que sea un proceso autónomo, voluntario, informado en cantidad y calidad suficiente, y que la persona tenga competencia para tomar decisiones. Finalmente, analizamos las excepciones que se aceptan, tanto a nivel de praxis médica como de normativa jurídica, para realizar una intervención médica sin el consentimiento del paciente: urgencia, renuncia del paciente a ser informado, privilegio terapéutico e incapacidad para tomar decisiones.
