This anthology critically interrogates the present conjuncture and effects of rules of internatio... more This anthology critically interrogates the present conjuncture and effects of rules of international law relating to the Third World in our globalized context, by asking representatives of the anglophone critical movement Third World Approaches to International Law (TWAIL) to subject their ideas for the first time to strict scrutiny of a francophone readership. The book draws on a selected range of translated classics and new texts, both in English and French, in critical Third World international legal scholarship as well as legal-academic writing seriously engaged with them in exploring ways of shaping reform strategies and transformative politics.

S’inspirant des écrits du philosophe italien Antonio Gramsci et du courant néo gramscien de relat... more S’inspirant des écrits du philosophe italien Antonio Gramsci et du courant néo gramscien de relations internationales, cet article examine les interventions militaires entreprises au cours de l’année 2011 par les États occidentaux (et avalisées par le Conseil de sécurité de l’Organisation des Nations unies) en Libye et en Côte d’Ivoire. Il étaye la proposition selon laquelle l’une des fonctions fondamentales du droit international et de l’idéologie « droits-de-l’hommiste » est de légitimer ce type d’interventions militaires entreprises par les États – et principalement celles des États occidentaux – afin de défendre ce que ceux-ci considèrent comme étant leurs intérêts. Cette légitimation, qui se perçoit par la constitution du « consentement spontané » des différents acteurs du système international à l’endroit de l’ordre établi, est un moment constitutif de l’« hégémonie » occidentale et a comme effet de réduire la contestation face aux actes de coercition qui sont commis à travers...

Il permet à l’auteur de proposer des réflexions sur certains sujets, notamment sur l’indétermination dans le droit, la « politique » des droits humains, ainsi que le potentiel émancipateur du droit international. La recension des trois ouvrages est également un prétexte pour faire une présentation plus large de ces nouvelles dans les approches critiques et les replacer dans le contexte des études critiques qu’a connu le droit international au cours du dernier siècle. Cet article cherche à démontrer que ces nouvelles approches se caractérisent du fait qu’elles font une critique à la fois épistémologique et normative des approches dominantes en droit international, ce qui n’était pas le cas des approches critiques précédentes.

Plus particulièrement, notre argument sera le suivant : dans Le Capital, Marx a bien mis en relief que la raison d’être du mode de production capitaliste était la création de profits pour la classe capitaliste. Or l’une de ses thèses les plus controversées est celle que Marx appelle la « loi de la baisse tendancielle du taux de profit » qui, à cause de la modification historique de la composition organique du capital, a comme effet d’amener « tendanciellement » ces taux de profit à un niveau insuffisant pour garantir l’accumulation du capital et la survie du capitalisme. If one wants to get a grasp on the international institutional arrangement of what J. G. Ruggie c... more If one wants to get a grasp on the international institutional arrangement of what J. G. Ruggie called “embedded liberalism,” which included the General Agreement on Tariffs and Trade (GATT), one must first carefully examine the conditions that made the regime of accumulation called Fordism possible. More precisely, it is essential to grasp how the particular evolution of class struggle in the US strongly influenced the organization of capitalism in this country, and subsequently the international institutions at the core of the embedded liberalism. Simply put, the thesis defended in this article is that the evolution of class struggle in the US in the 1930s and the following decades has been the main influence in the shaping of Fordism and an undervalued factor in the creation of the GATT. The GATT, in other words, is an agreement that strongly corresponds to the necessity of the management of the class struggle associated with Fordism.
