The Unwritten Brazilian Constitution offers an unexplored topic outside Portuguese language: the ... more The Unwritten Brazilian Constitution offers an unexplored topic outside Portuguese language: the leading cases on human rights in the Brazilian Supreme Court (Supremo Tribunal Federal – STF). The Brazilian Constitution of 1988 represents an institutional framework able to restructure the relationship between the powers after the military dictatorship. The constituents drafted the Brazilian Constitution in order to set an extensive system of judicial protection for fundamental rights, by means of several instruments that have strengthened access to the Judiciary. Because the Brazilian Constitution has an extensive list of fundamental rights, the STF was called to interpret them several times and it developed an unwritten understanding of these fundamental rights. These decisions are not available to the international community since they are not translated to English. Based on this gap, this original book illustrates the main rulings on human rights analyzed by great scholars in Brazil. The text presents a deep discussion regarding the characteristics of the cases and demonstrates how the STF has built the legal arguments to interpret the extension of the fundamental rights.
O controle judicial de constitucionalidade corresponde a uma das diferentes perspectivas pelas qu... more O controle judicial de constitucionalidade corresponde a uma das diferentes perspectivas pelas quais a tensao entre constitucionalismo e democracia pode ser expressa. A razao para isso reside no fato de que as decisoes politicas originarias da representacao popular (democracia) sao revistas por uma corte judicial nao eleita (constitucionalismo). Ha uma tradicao teorica critica em torno do deficit democratico das cortes constitucionais, por outro lado, tais instituicoes se encontram amplamente disseminadas nas democracias contemporâneas, impondo, portanto, uma forma de adequacao entre esses conceitos conflitantes. Por essa razao, pretende-se introduzir a democracia agonista de Chantal Mouffe como um conceito que incorpora a forma pela qual as sociedades contemporâneas sao constituidas. Essa construcao teorica traz a importância do dissenso sobre o conceito de democracia. Alem disso, o presente artigo busca acrescentar a discussao uma perspectiva institucional para a democracia agonista, especialmente no âmbito do controle judicial de constitucionalidade, no Brasil. Conclui-se que a tensao entre constitucionalismo e democracia inerente ao controle de constitucionalidade pode ser mitigada por meio de uma interpretacao compartilhada entre cortes e parlamentos, principalmente via emenda constitucional.

The criticisms toward judicial review from Richard Bellamy and Jeremy Waldron's political con... more The criticisms toward judicial review from Richard Bellamy and Jeremy Waldron's political constitutionalism approach demonstrate that they do not exclude constitutional courts entirely, as they accept mechanisms of legislative responses, except constitutional amendments. This paper concludes that the high number of constitutional amendments in Brazil does not mitigate judicial review critiques. The extensive structure of the Brazilian Constitution imposes frequent changes, which do not modify its essence. Furthermore, the possibility of judicial review over constitutional amendments represents that constitutional court could overrule legislative response.

There are numerous systematic unconstitutional omissions that seriously violate fundamental rights, generating in the State a vast structural failure that can not be restored by the constitutional remedies hitherto envisaged. The institute of the Unconstitutional State of Things, originated in Colombia and procedurally innovative, tries to overcome this failure, and because it is an activist deploy.
