Castro Rivera y Víctor E. Orozco Solano, con una reflexión preliminar de Diego Valadés, es un esfuerzo intelectual ejemplar, valioso por su contenido claro, sistemático, crítico y constructivo sobre la justicia constitucional y el desempeño de los tribunales constitucionales en Costa Rica, Cuba, El Salvador, Guatemala, Honduras, Nicaragua, Panamá y República Dominicana. La autoría estuvo a cargo de expertos cuya trayectoria acredita una larga dedicación a la ciencia del Derecho, a saber, Víctor Eduardo Orozco Solano; Luis Alberto Pérez Llody, Jorge Olver Mondelo Tamayo y Daniel Reyna Parga; Ernestina del Socorro Hernández Campos; Mauro Salvador Chacón Lemus; Rafael Antonio López Murcia y Carlos Josué Padilla Eveline; Edwin Castro Rivera y Sergio J. Se trata de un esfuerzo colectivo de investigadores, jueces constitucionales e interamericanos y ... more Se trata de un esfuerzo colectivo de investigadores, jueces constitucionales e interamericanos y otros operadores jurídicos, dirigido a identificar los fundamentos del derecho constitucional común latinoamericano, así como a fomentar debates académicos y diálogos interjurisdiccionales que favorezcan su consolidación.
El libro que hoy ponemos en manos de las y los lectores intenta, precisamente, entre otros propósitos, sentar las bases para la comparación del papel institucional de la jurisdicción constitucional en distintos ordenamientos jurídicos de la región. Pero las diferencias que pueden ser constatadas no desvirtúan la existencia de corrientes armonizadoras e integradoras que han dado lugar a modelos o arquetipos construidos en Latinoamérica y que influyen en la evolución global de nuestros sistemas de jurisdicción constitucional.
La especificidad de esta obra, en relación con otras publicaciones en temáticas similares, radica en haberse construido a partir de unos parámetros y un esquema de desarrollo común que favoreciera la aproximación comparativa y que estimulara el abordaje de asuntos que actualmente son de enorme relevancia en la jurisdicción constitucional latinoamericana, y de esta manera complementar los análisis contenidos en los manuales o textos habituales de consulta. En este sentido, el volumen II de esta obra se centrará en los estudios transversales.

del siglo XXI que inauguró una nueva ola
de crisis de la democracia en América Latina.
A partir de entonces, el país se sumergió
en una profunda inestabilidad política
que derivó en una situación de inconstitucionalidad
permanente y de anormalidad
democrática, hasta el punto de ser considerado
en la actualidad una autocracia.
Este libro analiza los elementos centrales
de la Constitución hondureña, la cual incluye
una serie de contenidos vinculantes
que instauran un régimen republicano,
democrático, representativo y cuyo
fin supremo es la dignidad humana, pero
que convive con una práctica de fraudes
electorales, concentración de poder, militarización
de todos los espacios de la vida
pública, violaciones a derechos humanos,
impunidad estructural y corrupción generalizada
que alteran la esencia misma del
Estado de derecho. A pesar del abismo entre
lo que sucede en la realidad y lo que
dice la Constitución, esta sigue siendo el
referente para la consolidación de una
institucionalidad democrática sólida que
responda a las necesidades básicas de la
población, reduzca las grandes desigualdades
y actúe conforme a las exigencias
básicas del Estado de derecho que garantiza
el artículo 1 constitucional: el imperio
de la ley, la separación de poderes, el
control de la legalidad y el respeto a los
derechos humanos.

Frente a esta cuestión, diversos mecanismos internacionales de protección de derechos humanos han hecho importantes recomendaciones al Estado hondureño, dejando sobre la mesa la relación intrínseca entre el derecho al medio ambiente y otros derechos humanos, como el derecho a la salud, la integridad personal y la vida, entre otros.
Este libro incluye, a lo largo de veinte capítulos diseminados en cinco secciones, una serie de análisis de las recomendaciones hechas por diversos mecanismos que van desde el Examen Periódico Universal, relatorías especiales y algunos comités de tratados en el ámbito de la ONU, hasta los órganos del Sistema Interamericano de Derechos Humanos.
