Secara etimologi, sadd al-dhara’i terdiri dari dua suku kata yang saling berkaitan yaitu kata dhari’ah dan kata sadd. Dhari’ah (dhara’i –red) adalah sebuah kata yang memiliki persamaan makna dengan kata wasilah, yang berarti berlaku untuk selamanya. Sadd adalah sebuah kata yang berarti larangan atau halangan. Secara harfiah, sadd al-dhara’i merupakan suatu bentuk larangan untuk melakukan sebuah perbuatan yang dapat menghasilkan sesuatu yang haram dan berlaku untuk selamanya. Hal ini sesuai dengan hasil analisis perbandingan dengan prinsip yurisprudensi lainnya, bahwa sadd al – dhara’i merupakan salah satu jenis yurisprudensi yang berlaku ketika ketidaksesuaian antara apa yang dimaksud dengan apa yang dihasilkan, dalam tinjauan nilai – nilai halal dan haram yang berlaku, terjadi. Sehingga dapat disimpulkan bahwa sadd al – dhara’i adalah salah satu prinsip yurisprudensi Islam mengenai larangan yang berlaku untuk selamanya ketika melakukan sebuah perbuatan yang dapat menghasilkan sesuatu yang haram atau dengan kata lain sadd al-dhara’i merupakan aturan untuk selalu berbuat kebaikan.

Syatibi's Perspective of Maqasid al-Syari'ah: The substance of maqasid al-syariah is maslahah (welfare, benefit and utility). This means that the purpose of the Islamic law is to realize the benefit and protect human being from adventageus effects and social problems. A well-known Moslem scholar in discussing maqasid al-syariah is al-Syatibi. He says that the unification of Islamic law indicates the unification of its origin and its aim. Therefore, al-Syatibi develops the concept of the intention of legislation based on his basic thought that the final aim of the institutionalization of Islamic law is the benefit of human being. The renewal of Islamic law is relevant with the concept of al-Syatibi's intention of legislation. This is because the substance of the intention of legislation is to realize the benefit of human being and guarantee the Moslem's happiness. Pendahuluan Seorang mujtahid secara imperative harus memahami intensi legislasi (maqasid al-syari'ah) dalam rangka mengembangkan pemikiran hukum dalam Islam dan untuk menjawab persoalan-persoalan hukum kontemporer yang kasusnya tidak termaktub secara eksplist dalam nas (al-Qur'an dan Sunnah). Lebih dari itu tujuannya adalah untuk mengetahui apakah suatu kasus masih dapat diterapkan berdasarkan suatu ketentuan hukum, atau karena adanya perubahan struktur sosial, atau hukum tersebut tidak dapat diterapkan lagi. Intensi legislasi menjadi kunci lagi keberhasilan seorang mujtahid dalam menetapkan ketentuan hukum terhadap berbagai persoalan hukum yang terjadi dalam masyarakat. Tentu yang dimaksud dengan persoalan hukum di sini adalah hukum yang berkenaan dengna bidang mu'amalah dan adat (tradisi lokal) dan tidak menyentuh persoalan hukum yang berkaitan dengan ibadah. Novialdi, Maqasid al-Syari'ah dalam Perspektif al-Syatibi 129 Substansi kajian intensi legislasi (maqasid al-syari'ah) adalah maşlahah (wefare, benefit dan utility). Artinya, tujuan pokok dan utama pelembagaan hukum dalam Islam adalah untuk merealisir kemaslahatan dan menghindarkan manusia dari berbagai macam kesulitan dan kemudaratan. Untuk itu, Allah SWT. dalam mentransformulasikan hukum Islam (dalam konteks syari'ah) kepada makhluknya mengandung maksud-maksud, motif-motif dan tujuan-tujuan sebagai sasaran akhir yang ingin dicapai, yang kesemuanya itu adalah untuk kepentingna dan kemaslahatan makhluknya baik di dunia maupun di akhirat. Salah seorang ulama yang terkenal dalam pembahasan masalah intensif legislasi (maqâsid al-syari'ah) ini adalah al-Syâtibî) yang berpendapat bahwa kesatuan-kesatuan hukum Islam berarti kesatuan dalam asal muasalnya, lebih-lebih dalam maksudnya. Untuk itu, al-Syâtibî mengembangkan konsep intensi legislasi dengan pijakan bahwa tujuan akhir pelembagaan hukum Islam adalah untuk kemaslahatan manusia. 1 Untuk itu tulisan singkat ini akan mencoba mengelaborasi lebih jauh tentang bagaimana substansi intensi legislasi (maqasid al-sayari'ah) dan begaimana keterkeitannya dengan pembaharuan metodologi hukum dalam Islam.
Arabic is a language selected as the source language used in the Qur'an. The manners and language accuracy is preserved with the systematic method outlined by a discipline known as Tajwid. Therefore, this study will examine aspects of Arabic linguistics applied by the reader in determining waqaf while reciting the Quran. The objectives of this study are to determine the factors of tendency among respondents when they select a place to do waqaf, analyze the aspects of Arab linguistics applied and to describe the requirements of waqaf in Qur'an recitation. This study employs a qualitative method with samples of seven respondents who have prior knowledge of Arabic. Data is gathered by recording which includes the Quran recitation followed by and interview. Findings of this study show that there are several factors that contribute to the high tendency among respondents to perform waqaf in Qur'an recitation. The most prominent factors are the influence of breathing, existing knowledge of tajwid and the habits of daily reading. In addition, the linguistic aspects of Arabic used in the waqaf are syntax and semantics. In conclusion, the need to apply the knowledge of Arabic language in waqaf is to determine the accuracy of meaning in waqaf in reciting the al-Quran. Therefore, the application of linguistic knowledge in reading Arabic and understanding al-Quran is significant in order to comprehend the contents of al-Qur'an in general and to determine the accuracy of meaning and sentence structure in waqaf in particular.
