The four horsemen of the Apocalypse - Death, Famine, Plague, and War - have traced a bloody cause of sorrow, destruction, and devastation through human history. Technology has now made it frequently possible to overcome two of the dreaded horsemen, Plague and Famine. Encounters with the third horseman, Death, have been postponed by that same technology; in many parts of the world, for example, average life expectancy has substantially risen. Ironically, while technology blunted the impact of these three horsemen, it has made all the more dreadful the ravages of the fourth horseman, War. This refers to the absolute deadliness of nuclear technology, and the increasing lethality of non-nuclear technology, such as poison gases, "smart bombs", and chemical and biological agents. The purpose of this paper is twofold. On the one hand, the paper attempts to rebut the propositions of the classical doctrine of j i W , showing that these propositions were predicated on a set of legal rulings (ahkiirn sharfyyuh) pertaining to specific questions which arose under particular historical conditions, namely, the armed struggle between the Islamic state during the Abbiisl era, and the various European dynasties. The paper further attempts to demonstrate that classical jurists did not intend to develop a holistic theory with universal claims. The paper aspires, on the other hand, to introduce a more comprehensive conception of war and peace which takes into account the Qur’nic and Prophetic statements in their totality. This new perception is then used to establish the fundamental objectives of war as well as the basic conditions of peace.
The only Islamic state that has its own nuclear arsenal is Pakistan. However, several Islamic state and non-state actors are purported to be seeking their own nuclear weapons. These actors include Iran and Al-Qaeda, both of whom have attacked American and Western targets in the past. Islamic leaders and religious scholars have made arguments claiming Islamic moral norms prohibit the possession and use of nuclear weapons. Yet, other arguments have been made asserting the possession and use of such weapons is permitted. Given the grave consequences of a nuclear-armed Iran or Al-Qaeda for the West, understanding what Islam says about the bomb is critical. A simple exploration of Islamic principles of warfare derived from the Quran, the actions of the Prophet Muhammad, the teachings of Islamic scholars, and the actions of Islamic states as well as non-state actors lend credibility to the argument that possession and use of nuclear weapons is permitted. Furthermore, a review of the gradual acceptance of the tactic of suicide bombing by Muslims show that any obstacles to the permissibility of the possession and use of nuclear weapons can be overcome. The notion that Islam prohibits nuclear weapons is mistaken and relying on such a notion to help in advancing nuclear non-proliferation efforts in the Islamic world is dangerous. The implications of this permissibility are serious for not just the West but also for the Islamic world. They would not just be threatened by nuclear-armed Islamic states and non-state actors but would risk losing the chance at holding the moral high ground in the debate over the conduct of warfare.
