Protocol 12 incorporated a non-accessory, independent clause which extended protection against discrimination. However, its entry into force has led to the coexistence of two regimes, each with a different scope of protection against racial discrimination. The concurrence of these circumstances indicated the need for a study that analysed recent interpretations by the court, particularly in relation to the new independent nature of protection, the extension to all rights recognised by law and the emergence new scenarios in which racial discrimination has occurred.
