1. Should we think of “conflicts as property” as Nils Christie suggests?
2. What are the advantages and disadvantages to this way of thinking?
3. Does Christie’s argument force us to think differently about the function(s) and role(s) of law in modern societies?

RESUMO: O garantismo penal de Ferrajoli tem conquistado, desde o início do século, inúmeros adeptos entre os juristas brasileiros. De base neocontratualista, esta tendência político-criminal tem como objetivo racionalizar o poder punitivo. Diferencia-se das perspectivas minimalistas clássicas por possuir um acento pessimista quanto ao exercício do Direito Penal, tendente ao abuso. Tal ceticismo, porém, não significa a possibilidade de superar as fundações do aparato repressivo do Estado. Neste artigo, problematizamos as críticas de Ferrajoli aos fluxos abolicionistas. Apontamos percursos libertários e chamamos a atenção para os limites da teoria, reconhecidos pelo próprio italiano, mas ignorados por boa parte de seus seguidores. Argumentamos, ao fim, como o garantismo penal constitui, ele próprio, uma teoria irrealizável, suas vinculações com a metafísica e a necessidade de repensar a punição a partir daquilo que a desnuda, ou seja, a dor.

ABSTRACT: From the beginning of the century, Ferrajoli´s penal guaranteeism has been accepted by several Brazilian jurists. Foregrounded on neo-contractualism, the political-criminal trend aims at the rationalization the punishing authority. It is different from the classical minimalist perspectives since it contains a pessimist strain with regard to the exercise of Penal Law, with a trend towards abuse. Skepticism does not mean overcoming the bases of the State´s law reinforcement apparatus. Current paper problematizes Ferrajoli´s criticism against the Abolitionists´flows.

In this paper we will discuss the main ideas of the best-known authors of abolitionist perspective: Nils Christie, Louk Hulsman and Thomas Mathiesen. We present their main contributions, such as their analysis on crime language, the victim role and social strategies for successful crime control. Although these perspectives may vary from each other, it is undeniable their power to rethink a mass incarceration context. To think about delegitimization is not utopian. The true utopia is to still believe on the eternal liberal promise of suitable punishing.

A tese examina o problema do hiperencarceramento brasileiro dos anos 2000
até 2016 à luz da Teoria Abolicionista Penal. Os dados referentes ao perfil dos sujeitos
apenados são analisados buscando compreender qual o espectro do dito “criminoso”.
Neste sentido, há o encontro com predisposições do sistema de justiça criminal marcados pela seletividade penal, a dita cifra-negra do crime. Nesta investigação, analisa-se
como o perfil dos indivíduos presos é sobretudo de jovens, negros, pobres, com baixa
escolaridade, sem emprego e moradia fixos. Esta imagem possibilita que reflexões a
respeito da criminalização da pobreza sejam conjecturadas. Logo, diante deste procedimento a tese apresenta a Teoria Abolicionista Penal que denuncia a falibilidade da
instituição penitenciária em promulgar as ilusões re e promove reflexões sobre alternativas à punição para a resolução de conflitos. As contribuições dos principais autores
abolicionistas penais: Löuk Hulsman; Nils Christie; Thomas Mathiesen e Sebastian
Scheerer são tratadas na tese afim de elucubrar sobre o fenômeno do hiperencarceramento brasileiro e a escolha punitiva por parte da justiça penal. Questionamentos a
respeito da vigência da instituição penitenciária e da privação da liberdade são realizados para além das propostas comumente aviltadas de reformas prisionais.Promovemos
a discussão a respeito das alternativas possíveis à lógica da punição, priorizando o
enaltecimento de condutas desencarceradoras previstas no Código Penal brasileiro
que podem ser colocadas em prática. As entrevistas realizadas pela autora com os
professores Eugênio Raúl Zaffaroni; Gabriel Ignácio Anitua e Sebastian Scheerer foram
anexadas ao final do presente trabalho.

La distancia entre los participantes del proceso penal es un factor clave que facilita y favorece que las reacciones sean altamente punitivas. En presencia de proximidad y conocimiento considerar un asunto penal se convierte en un tema de mayor complejidad en el contexto del cual los participantes son compelidos a buscar soluciones más allá de la imposición de castigo. La justicia restaurativa es una forma factible de aplicar esos postulados.  /// The distance between the participants of the criminal trial is a key factor that eases and favors the reactions to be highly punitive. In presence of proximity and knowledge, to consider a criminal issue becomes a matter of great complexity in the context of which the participants are compelled to look after solutions that transcend the imposition of a punishment. The restorative justice is a feasible way to apply those postulates.

The role of victims is increasingly central to discussions in, and practices of, international criminal law. This increased attentiveness to victims, I argue, is leading to a visual and discursive specification of victimhood. Drawing on criminologist Nils Christie’s theorizing of victimhood, and identifying practices inside and outside the international criminal law courtroom, I discuss the social, political and legal construction of an ‘ideal’ victim. The features of an ‘ideal’ victim of international crime are identified as being: (i) weakness and vulnerability; (ii) dependency and (iii) grotesqueness. The features coalesce into a feminized, infantilized and racialized stereotype of victimhood. I argue that this problematic construction of the ‘ideal’ victim is to be contextualized within the ‘attention economy’. The ‘attention economy’ views attention as a finite and highly in-demand resource that rewards the extreme and spectacular at the expense of the moderate and considered.
