Right to Counsel

En las páginas que siguen se formula el modelo que emerge de la experiencia de ese piloto, de la revisión de literatura especializada y del análisis de derecho comparado.
Para ello, en el primer capítulo se efectúa un planteamiento del problema, con un especial análisis crítico del único estudio nacional sobre el tema, a la época del piloto; en el capítulo II se presentan los diversos componentes del modelo, con desglose de cada uno y su justificación; en el tercer capítulo se presenta el rol del abogado del niño y sus funciones principales; luego, en el cuarto capítulo, se enuncian y explican someramente un conjunto de conocimientos extra jurídicos indispensables para quien ejerce como abogado de un niño en un sistema proteccional, finalmente, en el quinto capítulo, se visitan los actuales temas problemáticos en materia de representacipon jurpidica de niños.

The Founding Fathers designed the Sixth Amendment in such a way as to put the burden to prove an individual guilty upon the prosecution. This is called an accusatorial justice system. If it were an inquisitorial justice system, guilt would be established during the interrogation process. In other words, the Framers knew of Queen Mary being tried and executed, and deprived of an attorney, and did not want a repeat of this in America.

Today, the right to counsel for the accused is recognized in the course of criminal proceedings in most legal systems. International law pursues this right along with other human rights. International law has focused on the right to counsel at two levels: First that, international courts, such as the International Criminal Court, apply these rules in their own rules of procedure and in their own practice; and Second that, states in their national legal systems don’t fail to grant this right to the accused. International law has established bodies to ensure human rights at the level of states. One of these bodies is the Human Rights Committee, which has formed according to the International Covenant on Civil and Political Rights (1966). This article intends to investigate the right to counsel in the Procedure of the Human Rights Committee. The outcome of this writing is that the Committee develops the right to counsel and interprets the right to defense set forth in the Covenant to the right to counsel with many of its requirements.

this paper contains a response to why child support should be increased or decreased when there are changes in circumstances. the system frequently does not work.- Especially - when one party has income off the books - or who has a crooked lawyer or biased judge. 
      The paper gives an example of how fixed or variable costs  can change.  but are frequently not considered.
