El modelo constitucional educativo español actual cumple 33 años de vigencia en el 2018. Uno de sus rasgos más destacables es la financiación estatal de los establecimientos docentes privados que reúnan las condiciones exigidas por la Ley. El sostenimiento económico público de los centros privados constituye un ejemplo de un derecho constitucional de configuración legal. El legislador ha articulado este derecho a través de un sistema de conciertos educativos que suscita muchos interrogantes, sobre todo por su otorgamiento restrictivo al estar supeditado a la planificación educativa estatal. En el fondo de la controversia constitucional subyace la calificación de la educación como un servicio público o como un servicio de interés público.

The current Spanish constitutional educational model is Thirty-three years old in 2018. One of its most outstanding features is the state funding of private educational establishments that meet the conditions required by Law. The public economic sustainability of private schools is an example of a legally-based constitutional right. The legislation articulates this right through a system of educational agreements that raises many questions, especially as regards its restrictive granting, being subject to State educational planning. At the bottom of the constitutional controversy lies the definition of education as a public service or a service of public interest.

Dames en heren, geachte aanwezigen, In deze woelige tijden zijn de blikken gericht op de overkant van de oceaan. Zo ook op Donald Trumps beoogde minister van Onderwijs Betsy de Vos. Deze steenrijke dame is afkomstig uit het plaatsje Holland in Michigan, waar ze in een SGP-achtig milieu is opgegroeid. Ze is omstreden, omdat ze met haar filantropische stichting sinds twintig jaar ijvert voor scholen op religieuze grondslag, en ook wil dat die met publiek geld kunnen worden betaald. Critici stellen dat de enorme uitbreiding van deze scholen sinds een aantal jaar leidt tot segregatie, omdat ze het openbaar onderwijs leegzuigen, en slecht zijn voor de kwaliteit van het onderwijs. Nederland heeft de twijfelachtige eer tien jaar vooruit te lopen op Amerika voor wat betreft de opkomst van het nieuwe populisme. Voor wat betreft deze bekend in de oren klinkende discussie lopen we zelfs honderd jaar op Amerika voor: in 1917 hebben we met de financiële gelijkstelling de schoolstrijd beëindigd. Cruciaal in die oplossing, zo laat ik in mijn boek zien, was de voorwaarde dat de overheid een dikke vinger in de pap kreeg-een voorwaarde waar Betsy de Vos het hoogstwaarschijnlijk niet mee eens zal zijn. Doordat het zich invocht, raakte het bijzonder onderwijs bovendien gaandeweg gevestigd en raakte het op allerlei manieren met de overheid verstrengeld-zo waren tal van ministers uit het bijzonder onderwijs afkomstig of ermee verwant. Overheid en bijzonder onderwijs staan dus niet tegenover elkaar, al was dat wel de retoriek vanuit de schoolstrijd. Precies vanwege de oplossing in de financiële gelijkstelling kwam vanaf 1917 de vraag op tafel die centraal staat in het boek Heer en Meester: van wie is die christelijke school? Was die school alleen het eigendom van een particuliere groep of van de samenleving als geheel? Het verwijt van segregatie ging vooral op voor de verzuilde tijd, maar ik laat ook zien dat het bijzonder onderwijs ook toen al gericht was op het bijdragen aan heel de samenleving. In het toen nog overwegend christelijke Nederland nam het ook kinderen op die maar heel vagelijk met haar grondslag verbonden waren. In Heer en Meester laat ik zien dat de ontzuiling eigenlijk niet zo'n enorm probleem was voor het bijzonder onderwijs-het heeft die in feite goed doorstaan, door intern steeds diverser te worden en ruimte te bieden aan de persoonlijke invulling van de identiteit door leerkrachten. Een veel grotere uitdaging vormt de bestuurlijke concentratie, de schaalvergroting en verzakelijking sinds de jaren tachtig, waardoor een vocabulaire van 'maatschappelijk ondernemerschap' dominant werd.

In Belgium and the Netherlands, most schools are state-funded, faith-based (mainly Catholic and Protestant) schools, but today this majority of Christian schools is no longer in accordance with the religious view of many parents and students. This, in turn, can lead to a restriction of parental school choice. In this contribution, we will focus on the differences between the Flemish and the Dutch education systems and argue why, in spite of a comparable legal and financial framework, the Dutch educational system is, compared to the Flemish system, better able to guarantee this school choice. The main reasons for this claim are (1) the diversity between different faith-based schools in the Netherlands compared to a more or less mono-religious model in Flanders; (2° the diversity within faith-based schools in the Netherlands, compared to the centralized governance of most Flemish faith-based (Catholic) schools; and (3) the policy of including religious symbols in most Dutch schools, versus a policy of exclusion in most Flemish schools.
