EN PRESENCIA DE DIOS,
Nosotros los Representantes del pueblo nicaragüense, reunidos en Asamblea Constituyente, decretamos y sancionamos la siguiente
CONSTITUCIÓN POLÍTICA
Título I. De la Nación
Artículo 1.º Nicaragua es Nación libre, soberana e independiente. Su territorio, que también comprende las islas adyacentes, está situado entre los océanos Atlántico y Pacífico, y las Repúblicas de Honduras y Costa Rica.
Artículo 2.º La soberanía es una, inalienable e imprescriptible, y reside esencialmente en el pueblo, de quien derivan sus facultades los funcionarios que la Constitución y las leyes establecen. En consecuencia, no se podrá celebrar pactos o tratados que se opongan a la independencia e integridad de la Nación, o que afecten de algún modo su soberanía, salvo aquellos que tiendan a la unión con una o más de las Repúblicas de Centro América.
Artículo 3.º Los funcionarios públicos no tienen más facultades que las que expresamente les da la ley. Todo acto que ejecuten fuera de ella es nulo.
