Jurisdiction 1. The Court has jurisdiction over this matter pursuant to 28 U.S.C. 1334. This is
a core proceeding within the meaning of 28 U.S.C. 157(b)(2). 2. 3. Venue is proper pursuant to 28 U.S.C. 1408 and 1409. The statutory bases for the relief requested herein are section 502 of the
Bankruptcy Code, 11 U.S.C. 101-1330 (the Bankruptcy Code), and Rule 3007 of the Federal Rules of Bankruptcy Procedure (the Bankruptcy Rules). Background 4. On May 17, 2005 (the Petition Date), the Debtors filed their voluntary petitions
for relief under chapter 11 of the Bankruptcy Code. The Debtors are operating their businesses and managing their properties as debtors in possession pursuant to sections 1107(a) and 1108 of the Bankruptcy Code. No trustee or examiner has been appointed in these cases. On the Petition Date, the Court entered an order jointly administering these cases pursuant to Bankruptcy Rule 1015(b). 5. On May 24, 2005, the United States trustee appointed an official committee of
unsecured creditors pursuant to section 1102 of the Bankruptcy Code. Schedules And Proofs Of Claim 6. On August 12, 2005, the Debtors filed with the Court their Statements of
Financial Affairs and Schedules of Assets and Liabilities (the Schedules). 7. By order of the Court dated May 26, 2005 [Docket No. 139], the Debtors retained
Kurtzman Carson Consultants, LLC as their official claims and noticing agent. 8. By order of the Court dated November 22, 2005 [Docket No. 1803] (the
Bar Date Order), the Court established January 11, 2006 (the Bar Date), as the deadline by which all creditors, subject to certain stated exceptions, were required to file their proofs of claim

in the Debtors chapter 11 cases. In accordance with the Bar Date Order, the Debtors mailed written notice of the Bar Date (the Bar Date Notice) to, among others, all creditors listed on the Schedules. The Bar Date Notice was also published in local and national newspapers. Such service and publication provided adequate notice of the Bar Date to all parties in interest. Objection To Original Claims 9. The Original Claims identified on Exhibit B are those proofs of claim that the
particular creditor later amended by filing the proofs of claim designated as Surviving Claims on Exhibit B. Absent granting the Sixth Omnibus Objection, the claims database reflects both the Original Claims and the Surviving Claims. Accordingly, the Debtors request disallowance of the Original Claims. The Debtors reserve their right to further object to any of the
Surviving Claims listed on Exhibit B on any ground whatsoever. Notice 10. The Sixth Omnibus Objection (with exhibits) and a notice thereof will be served
upon the Core Group as required by the Case Management Procedures.2 In addition, each Affected Entity will be served with the Sixth Omnibus Objection (without Exhibit B), a notice thereof and a customized exhibit with claim specific detail. In light of the nature of the relief requested herein, the Debtors submit that such notice is sufficient under Bankruptcy Rule 3007 and no other or further notice of the Sixth Omnibus Objection need be given. No Prior Request 11. No prior request for the relief sought in the Sixth Omnibus Objection has been
made to this or any other court.
