BIRs new rule on receipts draws mixed reactions


TACLOBAN CITY- Business groups based in this city have dierent takes on the new and controversial rule of the Bureau of Internal Revenue on issuances of new receipts.
For Go Tic Ching, who is the president of the Tacloban Filipino-Chinese Chamber of Commerce and Industry, he said that they are not opposing this new policy of the BIR. The chamber is supporting this policy of the BIR. In fact, all the 120 members of the chambers were already informed about its (effectivity) and have agreed to comply with it, Ching said. He added that the new policy is for the good of the country and the government as its intention is to minimize if not solve cases of issuances of fake receipts, among others. However, a businessman who belong to the more than 100 Leyte Chamber of Commerce and Industry (LCCI), issued his strong opposition to this new policy of the BIR. While we cannot do anything about it except to eventually follow it, its a lot hassle on our part. Imagine, its already middle part of the year and we have to print new receipts just to comply with this BIR rule, the businessman, who asked not to be identified for fear of reprisal from the BIR, said. The businessman, who once served as an official of the LCCI, said that hundreds of booklets that he had printed earlier would go to waste because of this new policy of the BIR.

Fire hits Catarman commercial center


CATARMAN,N.Samar- A commercial building located at the business center of this town was hit by a fire yesterday morning. The commercial building that was totally consumed by fire was the Old Catarman Market Chenda Comercial Building located Brgy. Narra near Jollibee Fast Food and Land Bank of the Philippines. The fire started at around 8:20 a.m. and was declared under control at around 9:45 a.m. In an interview, Fire Insp. Hermy Bolosino disclosed that they experienced a hard time in putting off the fire because of the low pressure of the water at the fire hydrant coming from the Catarman Water District. Diniploy ko agad ang lahat na fire truck natin kaya lang nahirapan kami dahil sa kakulangan ng tubig mula sa Catarman Water District, Bolosino said. The razed commercial building , which was owned by the local government of Catarman, was occupied by 15 stalls like groceries, rice traders, a restaurant, a bakeshop and others. As of press time,fire officials has yet to disclose the damage caused by the fire incident but believed to run into millions of pesos. Fire Insp. Bolosino also disclosed that based on their initial investigation, the fire probably originated from a faulty electrical wiring at the second floor of the two-storey commercial building. Pulis Got Talent to showcase EV cops singing, dancing skills


CAMP KANGLEON, Palo, Leyte Ever heard a policeman singing to the latest pop tune? Maybe. But how about cops dancing to the groove of Psys Gentleman, Zedds Clarity or even the Harlem Shake? Beat it? For a change, instead of seeing men in uniform patrolling the streets catching criminals, the public will witness the singing and dancing talents of police officers as the Police Regional Office 8 (PRO8) will sponsor a one-night show as part of the celebration of the Pintados-Kasadyaan Festival in honor of the Sr. Sto. Nio de Leyte in the evening of June 12, coinciding with the commemoration of the nations independence. Dubbed as Pulis Got Talent, the show is a singing and group dance competition between PRO8 personnel from the Regional Headquarters, Police Provincial Offices, City Police Offices, Regional Public Safety Battalion 8 and the different National Support Units based in the region and will be held at Tacloban Citys RTR Festival Parks. Aside from investigation and law enforcement skills, our policemen also have singing and dancing talents and they will be showing it in a friendly contest, said Chief Supt. Elmer Ragadio Soria, PRO8 director. Soria said this is the first time that PRO8 will be participating in the month-long festivities which is the 27th Pintados and 18th Kasadyaan joint celebration for this year. PRO8 steps up security for Independence Day celebration


CAMP KANGLEON, Palo, Leyte - With the election fever gone, the Filipino has shifted to festivities and celebrations for the 115th Independence Day today. These celebrations include flag-raising and wreathlaying ceremonies, parades, and other historical and cultural activities, says PS/Supt. Roel Balintong Acidre, chief, Regional Police Community Relations Division (PCRD). The celebrations might be taken advantage of by the activist/leftist groups which may exploit the event to embarrass the government or instigate violence. PNP PRO8, depending on the prevailing situation, may raise its security alert status ahead of the 115th Independence Day celebrations nationwide out of concerns of a possible criminal acts by lawless elements. We will coordinate with the national and local organizing committees. We will strengthen police visibility and intensify checkpoint operations and mobile and foot patrol in accordance with the Police Integrated Patrol System in all places of engagement in connection with the Independence Day celebration, Acidre said. The PNP will strictly implement the no permit, no rally policy in anticipation of more mass actions in the region. This is to ensure that rallyists will limit their actions within the bounds of the law. Maximum tolerance will be the guiding principle when confronted by any situation that requires police action. Dialogue with the leaders of the rallyists will also be done in this regard. With this, the public is assured of a safe environment during the celebration of Independence Day. (PR)

Under the new policy of the BIR, business owners have to use new receipts effective July 1 or face a sanction. Business owners have also to apply for a new authority to print (ATP) receipts with the BIR not later than April 30 and should issue and use and new receipts starting next month.

TACLOBAN CITY The Department of Education (DepEd) has raised concerns on the presence of fatty and salty foods in school canteens as it deters students growth and mental development. DepEd regional supervising nutritionist Renelda Salar said that many public schools disregard orders by selling foods that are not ideal for growing children. Salar said that the DepEd has been reiterating the promotion of good nutrition by echoing the contents of Department Orders issued on 2005 and 2007. On the paper, we are complete with instructions but the problem is the implementation. Schools are still selling softdrinks and junk foods even if it is not allowed, she said. The problem is not just confined to unhealthy foods but also the absence of canteens inside the school premises, thus prompting children to buy foods outside, which is not totally safe for consumption. Citing the latest survey, Salar said that of the more than 3,000 public schools in the region, only 34% have school -managed canteens, and only 23% have cooperative-managed canteens. Every school must have a school canteen, no matter how small the school and how modest the canteen. In schools

DOST urges SMEs to take advantage of aid to businesses


PALO, LeyteThe Department of Science and Technology (DoST) in Leyte is continuously encouraging small and medium entrepreneurs (SMEs) to take advantage of the assistance it is providing to adopt technology innovations for the improvement of their business operations. Engr. John Glenn Ocaa, DoST Leyte provincial director, said the assistance is under the Small Enterprise Technology Upgrading Program (SETUP), one of DOSTs flagship programs which is a nationwide strategy in response to the call of Pres. Benigno Noynoy Aquino for more focused programs of assistance for SMEs. The program enables firms to address their technical problems through technology transfer and technological interventions to improve productivity through better product quality, human resources development, cost minimization, waste management and other operation-related activities, Ocaa said. It aims to promote countrywide development by upgrading productivity of SMEs through technology application or upgrading. The strategy focuses its interventions on five industry sectors; food processing, furniture, fashion accessories, gifts-toys-houseware and marine, aquatic resources and horticulture. We are open to those who want to avail of SETUP that reaches out to communities by providing more jobs and realize cleaner production technology with minimum environmental impact, Ocaa added. Through the SETUP, beneficiaries are able to get free technical advice from consultants, avail of technical training courses for workers, acquire new equipment to mechanize and improve production line through venture funds, standardize and improve the quality of their products and become competitive. Ocaa added that those who are qualified to apply are existing firms that are based in the Philippines and wholly owned by Filipinos citizens or any small- and medium-scale business firm that can be classified under the identified priority sectors. TACLOBAN CITY Fans filled the Robinsons Place-Tacloban as Markki Stroem serenaded them at the activity area last June 10, 2013, 5:00 in the afternoon. Promoting his first solo album entitled, Thousands of Pieces, the ABS-CBN artist gave an entertaining performance through his songs. Together with him, the Playback dance group from Tacloban also entertained the mass. Produced by the Corner Stone Music, Stroems album is composed of 10 tracks, which includes eight original songs and two covers. The 22-year-old Filipino-Norwegian Kapamilya artist got overwhelmed with the warm reception he recieved from his fans. He was very grateful for the reception his fans showed and he plans to go back here in Tacloban soon, he said. Of course I want to go back here as long as am not anymore busy. 112 years hence: Independent court

he countrys third branch of government, co-equal with the executive and legislative branches, celebrated yesterday its 112th year of existence. With over a century of being a final legal arbiter, the Supreme Court of the Philippines has evolved through time in keeping with the challenges of human undertakings here and abroad. Not to say that the Courts decisions are swayed by inevitable forces, largely political and economic, the countrys rich jurisprudence is a summation of the transformation of the countrys supposedly most independent arm of this democratic

state. From procedural to substantive laws, the changes in the way the Court has rendered its resolution on questions of law and decisions on controversies affecting constitutionality of edicts, other issuances and other social activities, are reflective of the amendments these laws underwent. Although not drastic, these changes were influences of global trends and discovery of loopholes and lapses of previous laws that needs be ironed out. This explains the dictum that law is dynamic. A colorful life worth emulating


Engineer Saylito Mondares Purisima turns 54 today, and oh, what a glorious life- in fact a very inspiring one. Lito, as friends, peers and close acquaintances, fondly address him, is a walking example of how to rise from the quagmire of want and need experienced in his younger days and coming to a relatively being successful professional, businessperson and a family man that he is now. Needless for me to discuss details how he lived his life from the time he left Placer, Masbate after graduating high school, sought a job in machine shops, finance his study for Mechanical Engineering and eventually succeeded and becomes one. He pursued contracts and seek payments for contracts job done in Leyte, Cebu, Bohol, Palawan, Iloilo etc. that SMP Engineering Work his main establishment generates, can provide in order that employees get paid. Worthy of note is he took into his custody one deaf-mute from Masbate, a very poor man, brought him to Isabel and assigns him simple chores, like sweeping the yard, cutting grass and paid handsomely for his status and he appears happy. There are a lot more one can observe in the man. I foresee that 6 years from now, at 60 he may opt to simply retire and enjoy fruits of labor, but I doubt. In his being an active individual all his life and now,

These players are in the all-stars selection of the PBA teams. In preparation for the FIBA-Asia tournament, Smart-Gilas will play the European champion Lilthonarian national under 20 team twice. The advantage of the Smart-Gilas team in the FIBA-Asia tournament is the home court support of the Filipinos as we are the host country of this basketball tournament of Asian countries participated by powerhouse teams of China, Iran and South Korea.

The Philippines is now preparing for the 27th FIBA-Asia Championship scheduled on Aug. 1-11, 2013 at the MOA arena, Pasay City with the Philippines as the host country. The Philippines chose to be with Jordan, ChineseTaipei and Saudi Arabia in Group A after which it is to face the top 3 teams from Group B composed of Japan, Qatar, Lebanon and Hongkong. It avoided early confrontation with traditional powers in Asia like China, Iran and South

Korea. The Smart-Gilas team is now on a 2 week training camp in Lithuania and it chose to join Group A where the Filipinos have a chance to emerge as the top team. The top 4 teams from the combined 4 groups advance to the knock-out quarter finals. Joining Group A gives the Philippines the chance to come out 1 or 2 after the quarterfinals. Our country may have been granted independence during that historical rites more than a century ago but we seem to have lost its essence over the years. On another front, the independence that we have may have pushed us too far in the exercise and enjoyment of our freedom. We are a people that are prone to abusing the freedom and liberty that we have. Our democratic setup had been chaotic in many instances because of our tendency to play beyond the limits of our freedom. By and large, people with vested interests and hidden agenda are toying with our freedom to do the things as they will without regard to its consequences to our democratic institutions that ensures the protection of our freedom and . . . independence? They only have the laws to guide them in decisionmaking and control their way of thinking. Justices in appellate courts as well as judges in the lower courts are expected to act in the same way. They are bound to noth-

ing or to no one but their loyalty to their country and countrymen. They should pen their decisions with no mental reservation. This makes the judiciary independent from the dictate of strong external influences. The genuine independence of the entire judiciary will make the celebration of the Supreme Courts 112 years of existence worthy. The celebration should go beyond partying and social graces.

Jesus said to his disciples: Do not think that I have come to abolish the law and the prophets. I have come, not to abolish them, but to fulfill them. Of this much I assure you: until heaven and earth pass away, not the smallest letter of the law, not the smallest part of the letter, shall be done away with until it all comes true. That is why whoever breaks the least significant of these commands and teaches others to do so shall be called least in the kingdom of God. Whoever fulfills and teaches these commands shall be great in the kingdom of God.

Our generation is blessed with the independence that our forefathers fought for with their lives. What we now enjoy is the fruit of the blood and lives that were offered at the altar of our freedom and democracy. After centuries of slavery under abusive colonial masters, our brave countrymen fought long battles that won us back our lost freedom. Armed with inferior weapons, our heroes fought with courage against the artillery of our foreign oppressors. They could have opted the convenient road to selfpreservation and lived longer under the rule of their foreign masters. But our forebears decided to fight a justified war that will win freedom for the future generations to enjoy. Ours was that future generation that now reaps the benefits of their hard won battles. As we mark this 115th commemoration of that momentous victory for our freedom and independence, it is but apt to look back at the heroic act our heroes took. Their unselfish concern for our generation led to the attainment of our indepen-

dence from our oppressors. We were able to establish our own government and fly our flag independently. Our colonizers placed us under an authoritarian regime that considered us no more than slaves under the Spanish crown. After the Spanish rule, we still have to be ruled by American and Japanese invaders before we obtained liberation by a victory in a war whose credit was grabbed by the Americans, obliterating as it did, the win of our Filipino soldiers. We could take the sacrifice of our forefathers as their decisive move to free us from the burden of oppression and slavery. They risked their lives fighting a battle against well armed foreign invaders, so that we could enjoy a life of freedom and liberty. Segundo allegedly had three (3) children, the defendants herein, who were Spanish citizens and were all the time residing in Spain. 8. As shown in the decision of the Supreme Court dated February 29, 1988 in a case docketed as G.R. No. 60443 emanating from the cadastral proceedings involving the subject land and other records from the cadastral proceedings, more than fifty years ago, in 1932, the Director of Lands filed with the Court of First Instance of Leyte a petition for the settlement and adjudication of titles over certain lands in the Ormoc Cadastre. One of the lands included in the proceeding was Lot No. 689 located in the town (now city) or Ormoc, containing an area of 338 square meters, more or less. For several years, no one laid claim to this Lot No. 689 despite notice having been given in accordance with law. In 1932, the cadastral court ordered all claimants to file their claims for the subject lot on February 4, 1933. Despite several extensions granted by the Court motu propio, nobody filed a claim on the said lot. So, an order of general default was issued and the dismissal of the cadastral proceeding as regards said lot was ultimately entered. 9. On July 22, 1940, defendants who stated that they were the legitimate children and only heirs of the deceased spouses, Segundo Garcia Fernandez and Eulogia Alvarez, filed a petition with the Court of Appeals to lift the order of default based on Section 513 of the old Code of Civil Proce-

dure which was however dismissed on technical grounds by decision rendered on September 27, 1940. 10. In 1940, after receiving the adverse resolution of the Court of Appeals, defendants abandoned the land believing that they could no longer claim any right over the land since their petition was dismissed. 11. Defendants were never citizens of the Philippines; they were never in actual, open, continuous, exclusive and adverse possession of the land in the concept as owner. Defendants were all the time living in Spain as they were residents and citizens of Spain. In fact, defendants are not in possession of the title of the land. In addition, during the cadastral proceedings and the proceedings before the Court of Appeals and Supreme Court, defendants never appeared in person. In fact, in his letter-reply to Atty. Teoduro T. Carvajal, the Spanish consul to the Philippines stated that as per letter of the Mayor of Langreo, Asturias, Spain, there is no record in the Municipality of Langreo, Asturias, Spain that defendants were residing thereat from 1981 up to 1988. A copy of the letter is hereto attached as Annex B. 12. Lot No. 689 is a private property. However, having been abandoned by the original owner, the land is one without an owner; and as such, it pertains to the state as part of the patrimonial property under the principle that lands without an owner belong to the state. While the same cannot be acquired by occupation under Article 714 of the New Civil Code, it can be acquired by the law on acquisition prescription as provided in Article 1113 of the New Civil Code. Said Article 1113 provides thus: All things which are within the commerce of man are susceptible of prescription, unless otherwise provided. Property of the state or of any of its subdivisions not patrimonial in character shall not be object of prescription. 13. Plaintiffs have been in open, continuous, adverse and peaceful possession in concept of an owner of the subject parcel of land (Lot 689 located in Burgos St., Ormoc City) for more than fifty (50) years. 14. Plaintiffs have paid the taxes due thereon. 15. Plaintiffs have not been sued over the subject lot as they never received judicial summons involving the subject lot. 16. As such, plaintiffs have acquired ownership over the land by virtue of the law on acquisitive prescription as provided in Art. 1137 of the New Civil Code which provides thus: Art. 1137. Ownership and other real rights over immovables also prescribe through uninterrupted adverse possession thereof for thirty years, without need of title for of good faith (1959a) 17. Original Certificate of Title No. 0-592 for Lot 689 is null and void inasmuch as defendants were never citizens of the Philippines; they were never in actual, open, continuous, exclusive and adverse possession of the land in the concept as owner. More books needed at People Center Library


TACLOBAN CITY Renor Dauag, regional representative of the Presidential Commission for Good Governance (PCGG-8), said his office is open for donation of books at the People Center Library (PCL) in response to some college students plea for PCL to acquire more latest books needed for research purposes. Many came to the office already, saying they are willing to donate some books. But, nobody of them came back to donate. To whoever wants to donate books, they are always welcomed, said Dauag. To date, the PCL has not acquired new set of books for this year as there is no enough budget allotted for its acquisition of books. What we are after today is only the maintenance of the PCL, the People Center and the Sto. Nio Shrine. In the case of the PCL, we cannot acquire new set of books because there is no budget given by the government, Dauag added. The total fund of the PCGG-8 goes to the payment of electric bills, the salary of its employees and others, leaving nothing for the acquisition of new books, he said. Although PCL has lots of books ranging from different subjects like History, Tourism, Politics and the like, students who come to the said library for research purposes are still not satisfied. We are looking for specific textbooks at the People Center Library, but we really cannot find any. The books that are there are the general references books. I hope they can also provide such books, a college student said. In light of this, Dauag said that the books in PCL are the only books that they can provide as of now. He added that not even a centavo from the government is given for the acquisition of these books and the ownership of the PCL is still hotly debated in the higher ups. The library is open to all and that is one thing that the students should be thankful of because most libraries are exclusive. They are only going to pay P10 for a library card, Dauag explained. He said that anyone who is willing to donate books should come first to the office of the PCGG-8 for official transaction. (RAM IDELBERT
