Please refer to TERMINAL POINTS FOR MAIN PLANT EQUIPMENT


SUPPLIER (SEC) dated April 21, 2006 and signed on April 24, 2006 and
DIVISION OF WORK (DOW) BETWEEN MAIN PLANT SUPPLIER (SEC) &
JINDAL (JSW) FOR 2X300MW POWER ROJECT signed on March 24,
2006, and General Conditions of Contracts.
1.0

PROJECT SCHEDULE (Refer to GCC)

1.1

Commercial Operation Date (C.O.D) for the main plant equipment ( SG +


STG unit) shall be 27 months from the date of Notice To Proceed (NTP)
for the first unit 30 months for second unit.

2.0

LIQUIDATED DAMAGES (Refer to GCC)

2.1

In the event of delay in supply of critical equipment/material following


liquidated damages shall become payable by SEC to JSWEVL for each
Unit :
(a) For the delay period :
0.05 per each day of delay on the
delayed item price for the first seven weeks and for beyond seven
weeks 0.05% per day on the SG or STG package unitwise price

2.2

Ceiling on Liquidated Damages for delay in completion of supply shall,


however, be 10% of Contract price

3.0

PLANNING AND MONITORING

3.1

PLANNING
SEC shall prepare a Master Network Schedule in the form of PERT
network.. The network shall be prepared on a Work Breakdown Structure.
The master network shall identify milestones of key events of each
system/package in the areas of engineering, procurement, manufacture
and despatch.,. The master network shall represent the Level I plan and
form the basis for development of detailed second and third tier execution
plans.
The master network shall be submitted along with the bid and shall be
mutually discussed and finalised before the award of Contract. The
master network shall identify a complete list of inputs to be furnished by
the JSWEVL which may be required for proper interfacing and tie up.
Scheduled dates for providing such inputs shall also be indicated and the
same be mutually discussed and finalised.

SEC shall not change the Master network without the prior approval of
the JSWEVL in accordance with the Conditions of Contract. In the event
that the JSWEVL approves a revision to the Master Network in
accordance with the Conditions of Contract, the SEC shall submit a
revised Master Network within two weeks thereafter. This programme
shall fully comply with the requirements of the specification and where
necessary, reflect changes to the sequence or progress of the Works as
indicated by the JSWEVL, or as proposed by the SEC and accepted by
the JSWEVL. Such an agreed revised programme shall become the
Overall SEC Programme for the outstanding works.
3.2

SEC, within 28 days after the date of the issue of the Issue of NTP shall
submit to the Engineer the detailed programme which shall be
consistent with the Project Schedule given above.

3.3

ALTERATION OF THE PROGRAMME


No material alteration to the Programme shall be made without the
approval of the JSWEVL / Engineer. However, SEC may make alterations
to the Programme without the approval of the JSWEVL / Engineer being
required where such alterations are consistent with the key milestone
dates set out in the Project Schedule .

3.4

SEC shall submit the coding procedure being adopted for


computerisation along with the logic and the Work Breakdown Schedule
with their respective weightages used for generating the life cycle curves
and shall submit the Work Intensity Chart based on weightages
conforming to their overall schedule.

4.0

REVISION OF PROGRAMME
If the progress of the Scope of Supply or any other part of the Works
does not conform to the Programme, the JSWEVL / Engineer may
instruct the SEC to revise the programme.
If for any reason which does not entitle the SEC to an extension of time
the rate of progress of the Scope of Supply or part thereof is at any time
in the reasonable opinion of JSWEVL or the Engineer too slow to secure
completion of the works within the Time for Completion or any extended
date the JSWEVL may so notify SEC in writing and SEC shall thereupon
take such steps as are necessary and JSWEVL may approve an order to
accelerate (whether by re-programming the order or sequence of work or
by increasing the personnel or other resources of SEC or its sub-SECs
employed on the Scope of Supply) the progress of the Scope of Supply
or part thereof so as to achieve completion of each section by the Time
for Completion as may be extended. The SEC shall not be entitled to any

additional payment or extension of time or reduction in LD for taking such


steps.
5.0

REPORTING AND CO-ORDINATION

5.1

During the performance of the Work, SEC shall submit daily/weekly/monthly


updates comparing the Work completed against the target/milestone
schedule or if SECs performance is not in compliance therewith, more
frequently as requested by JSWEVL / Engineer. If SECs performance of the
work is not in compliance with the Milestone Schedule, without restricting
any other rights or remedies of JSWEVL hereunder, SEC shall (i) submit its
plan for schedule recovery and (ii) specify in writing the steps to be taken to
achieve ongoing compliance with such revised schedule. SEC submit the
overall life cycle curve for progress curve. SEC shall adopt a milestone
approach and shall identify several milestones to be achieved so that they
could be measured physically. Computation of progress of the SEC use
weighted value concept and submit detailed computerised linked bar chart.
SEC shall submit work, breakdown structure in detail along with the
weightage and the milestone to be achieved every week preferably in a
graphical / tabular format.

5.2

SEC shall comply with the target/Milestone Schedule and to attend and
participate in progress, site co-ordination or special purpose meetings.
Progress, site and co-ordination meeting will be held at SECs
engineering office or the Site on a weekly basis, unless otherwise
requested by JSWEVL. SEC shall have in attendance at any such
meeting the Project Manager and other management workers authorised
to commit additional manpower to the Work and shall for any progress
meeting bring a forecast showing the last periods progress versus the
last periods
scheduled work plan and the work plan for the next
three weekly time periods. Unless otherwise stated in writing by JSWEVL
the forecast shall describe the Work by task, by site location, by area or
building and by bay for a one month period. The commencement and
completion of each task to be performed shall be clearly designated. If
requested by JSWEVL, representatives of Vendors of major materials
shall be at each such meeting. JSWEVL may on reasonable notice to
SEC call a special purpose meeting whether at SECs engineering office
or the site to review any portion of the Work, the performance of which is
of substantial concern to JSWEVL.

5.3

The SEC shall use the latest version of a project management software
preferably Primavera Project Planner to generate and submit the
schedules.

5.4

SCHEDULES

5.4.1

Project milestone schedule


The Project Milestone Schedule shall be a PERT Network Schedule
containing the Project milestones for activities pertaining to conceptual
design, detailed design, procurement packages, supervision of erection,
supervision of commissioning, and performance test.
The Project Milestone Schedule indicating current status shall be
submitted with the SECs monthly request for payment / progress reports.

5.4.2

Project summary schedule


The Project Summary Schedule shall be a Bar Chart Schedule containing
activities pertaining to conceptual design, detailed design, procurement
packages, construction packages including erection, testing,
commissioning and take-over at a summary level.

5.4.3

Overall contract schedule


The Overall Contract Schedule shall be a computerised, critical path
method (CPM) schedule, containing sufficient detail to effectively control
the Project.
The schedule shall be in Precedence Diagram Method
(PDM) format.
The Overall Contract Schedule shall be a composite of all other specific
schedules. The Overall Contract Schedule shall be used for Project
Activity Coordinating, Project Monitoring, Project Reporting and Progress
Payments.
The Overall Contract Schedule shall have distinct areas for engineering
and design, procurement and manufacture, installation and construction
of facilities by area, erection of equipment, construction of process
systems (mechanical, instrumentation and control, and electrical), and
activities for testing, checkout, start-up, performance testing, start-up
training, operation and maintenance. Construction activities shall be
organised by discipline.
The Overall Contract Schedule shall show expected and required start
and completion dates for each activity listed and it shall also include

The planning , scheduling and monitoring including resource scheduling


and monitoring shall be carried out using Primavera Project Planner
latest version project management or Microsoft Project software and SEC
shall submit the detailed network schedule in electronic floppy diskettes/
by e-mail every month to enable JSWEVL / JSWEVLs Representative to
review the same.
JSWEVL will review and comment on the Overall Contract Schedule and,
upon agreement with SEC on any necessary changes, SEC shall furnish
JSWEVL prints of the accepted schedule.

MONITORING

The schedule be updated and submitted to the JSWEVL at least once


each month. The updates shall show actual progress and any proposed
changes in the schedule of the remaining work.
Diagrams of activities and relationships forming the CPM, organised by
specification and system, shall be submitted with the output reports and
float path descriptions. Construction activities shall be included in
sufficient detail to define the work supported by engineering design
deliverables, such as drawings, lists and specifications, and by
equipment and material deliveries to the site.
Engineering design shall be shown in sufficient detail to clearly define all
area and system design activities and the inter-relationship between
design disciplines. Procurement of equipment and materials shall be
shown in sufficient detail to identify each equipment / system / package,
preparation of specification and issue, tender preparation / receipt, bid
review & negotiation award, information submittals (by discipline and
type), and delivery to the site, including shipping durations.
Detailed network schedule shall show the sequence, timing and duration
of the work and the planned commencement and completion dates of all
separable portions of the work including each milestone in form, content
and level of details satisfactory to JSWEVL/Engineer. It shall also show
SECs manpower forecast, procurement, delivery and installation plans
for major materials and other schedule information reasonably as
required by JSWEVL/Engineer.
Appropriate time shall be allocated for the approval of the documents by
JSWEVL / Engineer and the same shall be indicated in the network
schedule.
The schedule for JSWEVLs input shall be mutually agreed upon after the
award of Contract.
Other project activities necessary to control the work under this Contract
shall be included as mutually agreed to by the SEC and the JSWEVL.
5.5

PROCUREMENT SCHEDULE
The Procurement Schedule shall cover all equipment and materials to be
furnished by SEC, and critical items to be furnished by his sub-SECs,
manufacturers and suppliers as proposed by the SEC and accepted by
the JSWEVL. This schedule shall indicate times for bid invitation,
economic evaluation, ordering of materials, approval of manufacturers
drawings including JSWEVLs review, fabrication, shipping, delivery,
testing, and other significant Project milestones.

Procurement Schedule shall be in agreement with and supporting the


Overall Contract Schedule.
The Procurement Schedule shall be updated atleast once each month
and submitted with the Project Report to show the status of orders
placed, Engineering Submittals, and delivery.
Copies or listings of
material orders or sub-contracts issued with their issue dates shall be
included.
5.6

DETAILED START-UP SCHEDULE


The Detailed Start-up Schedule shall include a schedule of all required
tests, and shall be based on a Start-up Requirements Network which
shall be prepared by the SECs start-up organisation when the design is
sufficiently complete to commence start-up planning. The Detailed Startup Schedule shall show all sub-system package
construction completion activities, consistent with the Overall Contract
Schedule, followed by pre-operational start-up, testing, initial operation,
reliability operation, unit characteristic tests and performance guarantee
tests. Definite Hold points shall be included to allow for inspections and
certification.

5.7

ENGINEERING SUBMITTAL SCHEDULE


The Engineering Submittal Schedule shall be prepared in accordance
with the requirements of Section C 13 : Data to be furnished after
award of Contract.

5.8

MISCELLANEOUS SCHEDULES
The SEC shall prepare and submit to the JSWEVL miscellaneous
schedules covering plant operation, plant maintenance and training upto
substantial completion. Each schedule shall be in sufficient detail to
effectively control and monitor the associated activities. Each schedule
will be at the appropriate level of detail.

5.9

Apart from the overall Contract Schedule, SEC shall provide detailed
network schedules for manufacturing and site activities separately from
major sub-SECs for information and monitoring by JSWEVL / JSWEVLs
Representative.

5.10

The following requirements apply to all schedules prepared by the SEC.


The schedules shall be prepared and administered based on schedule
plans and procedures submitted as part of the Project Procedures.

(a)

JSWEVL will review and comment on each schedule, and upon


agreement with SEC of any necessary changes, will accept the
schedule.

(b)

SEC shall not change the planned portions of schedules without


prior notification to JSWEVL along with justification and reasons
thereof.

(c)

The schedule should be periodically updated to reflect the


activities completed and any rescheduling of balance activities.
In case any particular activity is likely to be delayed or already
delayed the SEC shall furnish to the JSWEVL the proposed
recovery schedule and indicating the additional resources being
employed for such recovery.

(d)

Each schedule show the activities in a colour graphic format


suitable for displaying scheduled and actual progress.
Schedules be submitted on reproducible media and in electronic
format with four printed copies (two for JSWEVL and two for
JSWEVLs Representative).

(e)

Each schedule shall be coordinated with the other Project


schedules to assure the timely availability of information for
procurement, design and construction purposes to avoid any
delay in Work progress.

(f)

The accepted schedules shall be updated to show progress


atleast once each month and submitted to the JSWEVL to show
the status of the Work.

Corrective action for the slippages in the schedule also shall be


highlighted in the progress report .
