1 Be it enacted by the People of the State of Maine as follows:

2 Sec. 1. 22 MRSA 1471-U, as repealed and replaced by PL 1989, c. 93, 1, is


3 repealed.

4 Sec. 2. 30-A MRSA 3007, sub-7 is enacted to read:


5 7. Restrictions on pesticide ordinances. A municipality may not adopt or enforce
6 any ordinance or rule regulating the sale or use of pesticides, including without limitation
7 ordinances relating to pesticide use limitations, registration, use notification, advertising
8 and marketing, distribution, applicator training and certification, storage, transportation,
9 disposal or product composition or the disclosure of confidential information related to
10 pesticides. An ordinance regulating the sale or use of pesticides adopted prior to the
11 effective date of this subsection is void. As used in this subsection, "pesticide" has the
12 same meaning as in Title 22, section 1471-C, subsection 19.

13 SUMMARY
14 This bill prohibits a municipality from adopting or continuing to enforce any
15 ordinance or rule regarding the sale or use of pesticides.
