EVIDENCE OF CONTRACT
Banking relationship is a contract between the Bank
& the Customer. (Indian Contract Act, 1872).
Customer should be legally capable of entering into
a valid contract .
Application from customer to the Bank must be in
the proper form.
Above holds good for both Deposit & Borrower
accounts.
Banker needs to be conversant with legal provisions
of various Acts.
Banker should take care more caution in respect of
lending.

Where terms of sanction stipulates creation of EQM by Deposit of Title
Deeds, Oral Assent has to be recorded with due compliance of the extant
guidelines and in such cases CHA 4 or CHA 6 will not be used.

ADVANCE TO SELF HELP GROUPS

CHECK POINTS FOR SHG
1. In the Inter-se Agreement to be executed by the members of the
SHGs, our bank is also a party. Besides, further covenants as to
trust obligations of the authorized representatives are also added.
The Inter-se agreement contains covenants both, for Demand
Loan and Term Loan up to the respective sanctioned limit.
2. The Inter-se agreement will have to be stamped as an agreement
cum power of attorney with applicable stamp duty.
3. The articles of agreement to be entered into with authorized
representatives has been duly modified to suit bank’s needs.
4. The articles of agreement will have to be stamped as a simple
agreement with applicable stamp duty.
5. It should be ensured that the Inter-se agreement and articles of
agreement are duly stamped and executed by all the members of
SHG and by the authorized representatives, respectively.
6. Appropriate acknowledgement of date and security should be
obtained periodically with due regularity.
7. With the adoption of model set of security documents as above,
joint Demand Promissory Note and Continuing Security Letter
need not be obtained.

(g) Search and Title Investigation Report from an approved advocate
certifying that the title to the loaned house/flat is clear, marketable and
free from any encumbrances. The report should also list out any special
document to be taken for creation of the mortgage. The Report should
be addressed to the Branch of the Bank where loan is to be granted.
HOME LOAN DOCUMENTS
(h) Extract of record of rights and Plan specification of the property
as approved by the local authority (copy of approved plan).
(These are not necessary when the building has been completed
and occupation certificate has been issued by local authority).
(i) Insurance policy for the cost of house/flat above plinth level
covering fire risks and other hazards duly endorsed in bank's
favour. (If the society has insured the entire building a copy of the
policy may be obtained and kept).
(j) A letter of authority issued by the borrower authorising the Bank
to pay premium on both Life Insurance Policy and Fire Insurance
Policy to the debit of borrower's loan/savings bank account.
(k) In the case of salaried persons, a letter addressed to the
employer, authorising them to deduct from his/her salary the
instalments and interest payable to the Bank and remit the same
to the Bank.
HOME LOAN DOCUMENTS
(l) Wherever salary deduction is not available , Standing
Instruction to debit the account / ECS (Debit) Mandate to be
obtained; ECS Mandate duly verified and registered.
(m) 2-3 CTS 2010 standard compliant cheques as PDCs (Post
Dated Cheques) Along with an undertaking to keep sufficient
balance in his/her account to honour the cheque/Standing
Instruction / ECS whenever the same is presented for payment.;
(n) A letter cum NOC from the builder/promoter/ vendor, in their
letter pad, as per banks standard format. The letter —cum- NOC
shall necessarily contain the Account Number of the Builder /
Promoter .
(o) Documents necessary to perfect collateral security, if any.
(p) Equitable mortgage of the property by deposit of title deeds
and recording of oral assent.
(q) Sanction letter duly acknowledged by borrower /guarantor.

STAR EDUCATION LOAN
Based on New Model Education Loan Scheme for higher studies in
India and Abroad (2015) formulated by IBA, New Application
Form (New L-487) and Educational Loan Agreement (L-488) to be
stamped as an Agreement cum Power of Attorney are introduced
and revised list documents to be obtained as under:
I. New L-487 Common Application Form as per IBA Model (Not to be
Stamped-Annexure-IV);
II. L- 434 D. P. Note

IV. L-488- Education Loan Agreement - to be stamped as an Agreement
cum Power of Attorney (Annexure-V)

currency of the loan without NOC from the Bank. This letter
should be obtained in duplicate and original forwarded to the
concerned Treasury Office/Employer for registration/noting,
Acknowledge copy to be kept on record. [ Annexure II]
5. Mandate letter to debit the S/B or other deposit accounts into
which pension is credited, for recovery of the loan instalment
/ amount
PENSIONER LOAN
6. A NOC from legal heirs entitled for family pension for
recovery of loan instalment/amount from their
account in which family pension amount is credited, if
necessary.

STAR MITRA LOAN SCHEME
All documentation of star personal loan scheme
will apply. Additional following document to be
obtained.
i. Doctors Certificate to be obtained from the borrower
regarding the extent of handicap and the need for the
equipment.
ii. Quotation/Invoice in respect of the equipment to be
purchased.
iii. Stamped receipt to be submitted after purchase of the
equipment.
iv. Staff members also permitted (other than those who
are under suspension) from those branches where the
salary account of the employee is maintained. Loan to
be repaid before retirement/ recovered from terminal
dues in case of cessation from service.

The POA to be executed in the presence of officials of Indian
Embassy/Consulate abroad (Branch to send a scanned copy of
the POA to the Indian Embassy/Consultate whee it is executed to
enable them to deny its genuineness, if any.
After receipt of POA in India the same to be submitted to
Registrar of Assurance for adjudication as well as registration in
consultation with a panel advocate of the Bank.
All the documents signed by the POA holder on behalf of the
principal should have a rubber stamp affixed below each
signature with following notation :

POA should contain the photograph of the POA holder as well as
the signature of the POA holder, both attested by the executants
in case of POA is executed in India during the executants visit to
India.

In case of POA is executed abroad, the POA must contain the
photograph of th POA holder duly attested by the executants.
The POA holder to sign the POA in the presence of the officials
of the Branch. POA holder signature duly attested by his

Mention to be made in the bank’s standard security
documents/ attendance register/oral assent to show that the
same is executed by the attorney on behalf of the principal (as
per item No ix)
The documents to be executed by the POA holder for and on
behalf of the NRI. After execution of documents a letter
written by the NRI confirming execution of documents by POA
including creation of security by way of mortgage to be
obtained, as per specimen given in BC No.108/3.

The creation of security/execution of documents could be
undertaken by the applicant borrower if he is present in the country.
Creation of Security/execution of documents could also be
undertaken by POA holder of the applicant.
Where documents are signed by POA holder following measures to be

Application must be signed by the borrower himself;
Request letter from the borrower to the Branch to allow
execution of documents and creation of security by POA holder
POA to be restricted to closer relatives viz. spouse, father,
mother, brother, sister, son and daughters of NRI concerned. In
extreme cases POA other than close relatives may be permitted
by the SA.
POA should be executed as per approved specimen of the Bank
(given in Annexure II of BC No. 108/3 dated 01.04.2014).
